Standards of Performance for New Stationary Sources and Emissions
Guidelines for Existing Sources: Hospital/Medical/Infectious Waste
Incinerators

AGENCY: Environmental Protection Agency (EPA).

ACTION: Proposed rule; amendments.

-----------------------------------------------------------------------

SUMMARY: On October 6, 2009, EPA promulgated its response to the remand
of the new source performance standards and emissions guidelines for
hospital/medical/infectious waste incinerators by the U.S. Court of
Appeals for the District of Columbia Circuit and satisfied the Clean
Air Act Section 129(a)(5) requirement to conduct a review of the
standards every five years. This action proposes to amend the new
source performance standards in order to correct inadvertent drafting
errors in the emissions limits for nitrogen oxides and sulfur dioxide
promulgated for large hospital/medical/infectious waste incinerators,
which did not correspond to our description of our standard-setting
process. This action will also correct erroneous cross-references in
the reporting and recordkeeping requirements.

DATES: Comments. Comments must be received on or before June 28, 2010.
Because of the need to revise the new source performance standards
(NSPS) emissions limits and reporting and recordkeeping requirements in
a timely manner, EPA will not grant requests for extensions beyond this
date.
Public Hearing. If anyone contacts EPA by May 24, 2010 requesting
to speak at a public hearing, EPA will hold a public hearing on June 1,

individual to package or ship a hazardous material in a manner that
varies from the regulations so long as an equivalent level of safety is
maintained. The revisions in this final rule are intended to provide

paperwork burdens and facilitating commerce while maintaining an
appropriate level of safety.

Hazardous Materials; Packages Intended for Transport by Aircraft

AGENCY: Pipeline and Hazardous Materials Safety Administration (PHMSA),
DOT.

ACTION: Notice of proposed rulemaking (NPRM).

-----------------------------------------------------------------------

SUMMARY: PHMSA proposes to amend requirements in the Hazardous
Materials Regulations to enhance the integrity of inner packagings or
receptacles of combination packagings containing liquid hazardous
material by ensuring they remain intact when subjected to the reduced
pressure and other forces encountered in air transportation. In order
to substantially decrease the likelihood of a hazardous materials
release, the proposed amendments: prescribe specific test protocols and
standards for determining whether an inner packaging or receptacle is
capable of meeting the pressure differential requirements specified in
the regulations and, consistent with the 2011-2012 edition of the
International Civil Aviation Organization Technical Instructions for
the Safe Transport of Dangerous Goods by Aircraft (ICAO Technical
Instructions), require the closures on all inner packagings containing
liquids within a combination packaging to be secured by a secondary
means or, under certain circumstances, permit the use of a liner.

Regulation of Fuels and Fuel Additives: Alternative Affirmative
Defense Requirements for Ultra-Low Sulfur Diesel and Gasoline Benzene
Technical Amendment

AGENCY: Environmental Protection Agency (EPA).

ACTION: Direct final rule.

-----------------------------------------------------------------------

SUMMARY: EPA is issuing a direct final rule to amend the diesel sulfur
regulations to allow refiners, importers, distributors, and retailers
of highway diesel fuel the option to use an alternative affirmative
defense if the Agency finds highway diesel fuel samples above the
specified sulfur standard at retail facilities. This alternative
defense consists of a comprehensive program of quality assurance
sampling and testing that would cover all participating companies that
produce and/or distribute highway diesel fuel if certain other
conditions are met. The sampling and testing program would be carried
out by an independent surveyor. The program would be conducted pursuant
to a survey plan approved by EPA that is designed to achieve the same
objectives as the current regulatory quality assurance requirement.
This rule also amends the gasoline benzene regulations to allow
disqualified small refiners the same opportunity to generate gasoline
benzene credits as that afforded to non-small refiners.

DATES: This rule is effective on July 12, 2010 without further notice,
unless EPA receives adverse comment by June 10, 2010. If EPA receives
adverse comment, we will publish a timely withdrawal in the Federal
Register informing the public that this rule, or the relevant
provisions of this rule, will not take effect. The incorporation by
reference of a certain publication listed in the regulations is
approved by the Director of the Federal Register as of July 12, 2010.
Hearings: If EPA receives a request from a person wishing to speak
at a public hearing by May 26, 2010, a public hearing will be held at a

Product Cancellation Order for Certain Pesticide Registrations

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice.

-----------------------------------------------------------------------

SUMMARY: This notice announces EPA's order for the cancellations,
voluntarily requested by the registrants and accepted by the Agency, of
the products listed in Table 1, pursuant to section 6(f)(1) of the
Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as
amended. This cancellation order follows a February 3, 2010 Federal
Register Notice of Receipt of Requests from the registrants listed in
Table 2 to voluntarily cancel these product registrations. In the
February 3, 2010 Notice, EPA indicated that it would issue an order
implementing the cancellations unless the Agency received substantive
comments within the 30-day comment period that would merit its further
review of these requests or unless the registrants withdrew their
requests. The Agency received comments on the notice but none merited
its further review of the requests. The registrants did not withdraw
their requests. Accordingly, EPA hereby issues in this notice a
cancellation order granting the requested cancellations. Any
distribution, sale, or use of the products subject to this cancellation
order is permitted only in accordance with the terms of this order,
including any existing stocks provisions.

DATES: The cancellations are effective May 11, 2010.

 DEPARTMENT OF ENERGY

Implementing the National Broadband Plan by Empowering Consumers
and the Smart Grid: Data Access, Third Party Use, and Privacy

AGENCY: Department of Energy.

ACTION: Request for Information.

-----------------------------------------------------------------------

SUMMARY: The Department of Energy (DOE) is seeking comments and
information from interested parties to assist DOE in understanding
current and potential practices and policies for the states and other
entities \1\ to empower consumers (and perhaps others) through access
to detailed energy information in electronic form--including real-time
information from smart meters, historical consumption data, and pricing
and billing information. This request for information (RFI) asks
interested parties, including industry, consumer groups and State
governments, to report on State efforts to enact Smart Grid privacy and
data collection policies. This RFI also seeks input regarding
individual utility practices and policies regarding data access and
collection; third party access to detailed energy information; and the
role of the consumer in balancing the benefits of access and privacy.
Finally, this RFI seeks comment on what policies and practices should
guide policymakers in determining who can access consumers' energy
information and under what conditions.
---------------------------------------------------------------------------

Protection of Stratospheric Ozone: Allocation of Essential Use
Allowances for Calendar Year 2010

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

-----------------------------------------------------------------------

SUMMARY: With this action, EPA is allocating essential use allowances
for import and production of Class I ozone-depleting substances (ODSs)

ban on the production and import of these chemicals, which became
effective as of January 1, 1996. EPA allocates essential use allowances
for production or import of a specific quantity of Class I substances
solely for the designated essential purpose. The allocation in this
action is 30.0 metric tons (MT) of chlorofluorocarbons (CFCs) for use
in metered dose inhalers (MDIs) for 2010.

DATES: This final rule is effective May 10, 2010.

ADDRESSES: EPA has established a docket for this action under Docket ID
No. EPA-HQ-OAR-2009-0566. All documents in the docket are listed on the
