Update of Continuous Instrumental Test Methods; Correction

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule; correction.

SUMMARY: EPA published a final rule in the Federal Register on May 22,
2008, that made technical corrections to five test methods. Inadvertent
printing errors were made in the publication. Text insertions were
misplaced, duplicate insertions were made, and the definition for
system bias was inadvertently revised. The purpose of this action is to
correct these errors.

Energy (DOE) for the Waste Isolation Pilot Plant (WIPP), the U.S.
Environmental Protection Agency (EPA or ``we'') determined that between
2006 and 2008, DOE operated the WIPP facility in compliance with
applicable Federal statutes, regulations, and permit requirements
designated in Section 9(a)(1) of the WIPP Land Withdrawal Act, as
amended. The Secretary of Energy was notified of the determination via
a letter from EPA Administrator Lisa P. Jackson dated May 22, 2009.

Energy Conservation Program: Energy Conservation Standards for
Refrigerated Bottled or Canned Beverage Vending Machines

SUMMARY: The Energy Policy and Conservation Act prescribes energy
conservation standards for certain commercial and industrial equipment
and requires the U.S. Department of Energy (DOE) to administer an
energy conservation program for this equipment. In this notice, DOE is
proposing new energy conservation standards for refrigerated bottled or
canned beverage vending machines. DOE is also announcing a public
meeting on its proposed standards.

DATES: DOE will hold a public meeting on Wednesday, June 17, 2009 from
9 a.m. to 4 p.m. in Washington, DC. DOE must receive requests to speak
at the public meeting no later than 4 p.m. Wednesday, June 3, 2009. DOE

AGENCY: Food and Drug Administration, HHS.

ACTION: Final rule.

SUMMARY: The Food and Drug Administration (FDA) is amending its bottled
water regulations to require that bottled water manufacturers test
source water for total coliform, as is required for finished bottled
water products, and to require, if any coliform organisms are detected
in source water, that bottled water manufacturers determine whether any
of the coliform organisms are Escherichia coli (E. coli), an indicator
of fecal contamination. FDA also is amending its bottled water
regulations to require, if any coliform organisms are detected in
finished bottled water products, that bottled water manufacturers
determine whether any of the coliform organisms are E. coli. FDA also
is amending the adulteration provision of the bottled water standard to
reflect the possibility of adulteration caused by the presence of
filth. Bottled water containing E. coli will be considered adulterated,
and source water containing E. coli will not be considered to be of a
safe, sanitary quality and will be prohibited from use in the
production of bottled water. FDA is also amending its bottled water
regulations to require that, before a bottler can use source water from
a source that has tested positive for E. coli, the bottler must take
appropriate measures to rectify or eliminate the cause of E. coli
contamination of that source, and that the bottler must keep records of
such actions. Existing regulatory provisions require bottled water
manufacturers to keep records of new testing required by this rule.
This final rule will ensure that FDA's standards for the minimum
quality of bottled water, as affected by fecal contamination, will be
no less protective of the public health than those set by the
Environmental Protection Agency (EPA) for public drinking water.

DATES: This rule is effective December 1, 2009. The incorporation by
reference of certain publications listed in the rule is approved by the
Director of the Federal Register as of December 1, 2009.

SUMMARY: Rural Development is delaying the effective date of the
interim rule for Rural Development Guaranteed Loans, which was
published on December 17, 2008, to October 1, 2009. The interim rule
establishes a unified guaranteed loan platform for the enhanced
delivery of four existing Rural Development guaranteed loan programs:
Community Facilities; Water and Waste Disposal; Business and Industry;
and Rural Energy for America Program, formerly known as Renewable
Energy Systems and Energy Efficiency Improvement Program.

SUMMARY: The Rural Business-Cooperative Service (RBS), an Agency within
the USDA Rural Development mission area, announces the availability of
two individual grants: one single $500,000 grant from the passenger
transportation funds appropriated for the Rural Business Enterprise
Grant (RBEG) program and another single $250,000 grant for Federally
Recognized Native American Tribes' (FRNAT) from funds appropriated for
the RBEG program. RBS will administer these
awards under the RBEG program and 7 U.S.C. 1932(c)(2) for fiscal year
(FY) 2009. Each grant is to be competitively awarded to a qualified
national non-profit organization. One grant is for the provision of
technical assistance to rural transportation projects. The other grant
is for the provision of technical assistance to rural transportation
projects operated by FRNAT's only.

DATES: The deadline for receipt of preapplications in the USDA Rural
Development State Office is July 13, 2009. Applications received at a
USDA Rural Development State Office after that date will not be
considered for FY 2009 funding. For further information contact the

AGENCY: Natural Resources Conservation Service and Commodity Credit

ACTION: Interim final rule; amendment; extension of comment period.

SUMMARY: The Commodity Credit Corporation (CCC) published in the
Federal Register of January 15, 2009, an interim final rule with
request for comment amending the program regulations for the
Environmental Quality Incentives Program (EQIP) to incorporate
programmatic changes authorized by the Food, Conservation, and Energy
Act of 2008 (2008 Act). On March 12, 2009, CCC corrected language in
the interim final rule regarding the erroneous application of the
payment limitation provisions to joint operations, and extended the
comment period to April 17, 2009. This document amends the interim
final rule by expanding the ability of CCC to include an expansion of
the exception regarding conservation practices on public land. CCC is
also using the opportunity presented by this rulemaking to extend the
comment period. However, the extended comment period is limited to the
provisions in this amendment.

SUMMARY: In this notice, EPA is announcing the revised Drinking Water
State Revolving Fund (DWSRF) allotments that will be provided to the

American Indian Tribes, and Alaska Native Villages if the President's budget request
for Fiscal Year 2010 is enacted. These allotments reflect the results
from EPA's most recent Drinking Water Infrastructure Needs Survey and
Assessment, which was released on March 26, 2009. The revised State
allotment percentages will be the basis for distributing the DWSRF
program appropriations to the States for the four years from Fiscal
Years 2010 through 2013.

AGENCY: Natural Resources Conservation Service (NRCS), Department of

SUMMARY: NRCS will hold public meetings to gather stakeholder input on
important natural resource concerns and program approaches to address
these natural resource concerns in the next decade.
    On June 22, 2008, Congress reauthorized the RCA, 16 U.S.C. 2001-
2009, through amendments in the Food, Conservation, and Energy Act of
2008 (Pub. L. 110-246). In the reauthorization, Congress extended RCA
through 2018 and called for the first report to be delivered to
Congress by January 2011. RCA provides USDA with broad strategic
assessment and planning authority and calls for the development of a
national program to guide USDA activities for the conservation,
protection, and enhancement of soil, water, and related natural
resources. Through RCA, USDA appraises the status and trends of soil,
water, and related resources on non-Federal land, assesses their
capability to meet present and future demands, evaluates current and
needed programs, policies, and authorities, and develops a national
soil and water conservation program to give direction for USDA soil and
water conservation activities.
    Public participation is a central element of the RCA process. USDA
will hold listening sessions to provide the public with an opportunity
to comment on conservation priorities, program approaches, future
conservation needs, and opportunities to improve the appraisal process.

Etoxazole; Pesticide Tolerances

SUMMARY: This regulation establishes tolerances for residues of
etoxazole in or on stone fruit; plum; prune; spearmint tops and oil;
peppermint tops and oil; tomato; and cucumber. This regulation also
deletes the existing cherry tolerance, as it will be superseded by
inclusion in the stone fruit crop group. The Interregional Research
Project Number 4 (IR-4) requested these tolerances under the Federal
Food, Drug, and Cosmetic Act (FFDCA).

DATES: This regulation is effective May 27, 2009. Objections and
requests for hearings must be received on or before July 27, 2009, and
must be filed in accordance with the instructions provided in 40 CFR

Definition of Solid Waste Public Meeting

SUMMARY: The Environmental Protection Agency (EPA) is announcing a
public meeting regarding the Agency's recent regulation on the
definition of solid waste under Subtitle C of the Resource Conservation
and Recovery Act (RCRA). Specifically, EPA is currently reviewing a
petition filed with the Administrator under RCRA section 7004(a)
requesting that the Agency reconsider and repeal the recently
promulgated revisions to the definition of solid waste for hazardous
secondary materials being reclaimed, and is soliciting comments and
information to assist the agency in evaluating the petition. EPA does
not plan to repeal the rule, but is interested in receiving comments on
possible revisions to the rule. Persons may register to speak at the
public meeting or may submit written comments to the address below.

DATES: The public meeting will be held on June 30, 2009, from 9 a.m. to
4:30 p.m. The closing date for advance registration is June 23, 2009.

Standards of Performance for Coal Preparation and Processing
Plants

AGENCY: Environmental Protection Agency (EPA).

ACTION: Supplemental proposal.

SUMMARY: EPA is proposing a supplemental action to the proposed
amendments to the new source performance standards for coal preparation
and processing plants published on April 28, 2008. The 2008 proposal,
among other things, proposed to revise the particulate matter and
opacity standards for thermal dryers, pneumatic coal cleaning
equipment, and coal handling equipment located at coal preparation and
processing plants. This supplemental action proposes to revise the
particulate matter emissions and opacity limits included in the
original proposal for thermal dryers, pneumatic coal-cleaning
equipment, and coal handling equipment. It also proposes to expand the
applicability of the thermal dryer standards so that the proposed
standards for thermal dryers would apply to both direct contact and
indirect contact thermal dryers drying all coal ranks and pneumatic
coal-cleaning equipment cleaning all coal ranks. In addition, it
proposes to establish a sulfur dioxide emission limit and a combined
nitrogen oxide and carbon monoxide emissions limit for thermal dryers.
We are also proposing to amend the definition of coal for purposes of

SUMMARY: This regulation establishes tolerances for residues of
acibenzolar-S-methyl in or on onion, bulb, subgroup 3-07A; and
vegetable, cucurbit, group 9. It also removes the section 18 time-
limited tolerance on onion, bulb which is superseded by the new
tolerance on onion, bulb, subgroup 3-07A. Interregional Research
Project Number 4 (IR-4) and Syngenta Crop Protection requested these
tolerances under the Federal Food, Drug, and Cosmetic Act (FFDCA).

DATES: This regulation is effective May 26, 2009. Objections and

Regulation of Fuels and Fuel Additives: Changes to Renewable Fuel
Standard Program

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: Under the Clean Air Act, as amended by Sections 201, 202, and
210 of the Energy Independence and Security Act of 2007, the
Environmental Protection Agency is required to promulgate regulations
implementing changes to the Renewable Fuel Standard program. The
revised statutory requirements specify the volumes of cellulosic
biofuel, biomass-based diesel, advanced biofuel, and total renewable
fuel that must be used in transportation fuel each year, with the
volumes increasing over time. The revised statutory requirements also
include new definitions and criteria for both renewable fuels and the
feedstocks used to produce them, including new greenhouse gas emission
thresholds for renewable fuels. For the first time in a regulatory
program, an assessment of greenhouse gas emission performance is being
utilized to establish those fuels that qualify for the four different
renewable fuel standards. As mandated by the revised statutory
requirements, the greenhouse gas emission assessments must evaluate the
full lifecycle emission impacts of fuel production including both
direct and indirect emissions, including significant emissions from
land use changes. The proposed program is expected to reduce U.S.
dependence on foreign sources of petroleum by increasing domestic
sources of energy. Based on our lifecycle analysis, we believe that the
expanded use of renewable fuels would provide significant reductions in
greenhouse gas emissions such as carbon dioxide that affect climate
change. We recognize the significance of using lifecycle greenhouse gas
emission assessments that include indirect impacts such as emission
impacts of indirect land use changes. Therefore, in this preamble we
have been transparent in breaking out the various sources of greenhouse
gas emissions included in the analysis and are seeking comments on our
methodology as well as various options for determining the lifecycle
greenhouse gas emissions (GHG) for each fuel. In addition to seeking
comments on the information in this document and its supporting
materials, the Agency is conducting peer reviews of critical aspects of
the lifecycle methodology. The increased use of renewable fuels would
also impact criteria pollutant emissions, with some pollutants such as
volatile organic compounds (VOC) and nitrogen oxides (NOX)
expected to increase and other pollutants such as carbon monoxide (CO)
and benzene expected to decrease. The production of feedstocks used to
produce renewable fuels is also expected to impact water quality.
    This action proposes regulations designed to ensure that refiners,
blenders, and importers of gasoline and diesel would use enough
renewable fuel each year so that the four volume requirements of the
Energy Independence and Security Act would be met with renewable fuels
that also meet the required lifecycle greenhouse gas emissions
performance standards. Our proposed rule describes the standards that
would apply to these parties and the renewable fuels that would qualify
for compliance. The proposed regulations make a number of changes to
the current Renewable Fuel Standard program while retaining many
elements of the compliance and trading system already in place.

to help ensure a full understanding of our lifecycle analysis, the
major issues identified and the options discussed. We expect that this
workshop will help ensure that we receive submission of the most
thoughtful and useful comments to this proposal and that the best
methodology and assumptions are used for calculating GHG emissions
impacts of fuels for the final rule. While this workshop will be held
during the comment period, it is not intended to replace either the
formal public hearing or the need to submit comments to the docket.

Smart Grid Policy; Notice of Extension of Time

AGENCY: Federal Energy Regulatory Commission.

ACTION: Notice of extension of time.

SUMMARY: On March 19, 2009, the Federal Energy Regulatory Commission
(Commission) issued a Proposed Policy Statement and Action Plan that,
among other things, proposed an interim rate policy to encourage the
development of smart grid systems. On May 19, 2009, the Commission
issued a Notice Requesting Supplemental Comments regarding rate
recovery for certain smart grid investments. The Commission is
extending the date for filing these supplemental comments.

Notice of Solicitation of Applications (NOSA) for Inviting
Applications for Renewable Energy Systems and Energy Efficiency
Improvements Grants and Guaranteed Loans and Renewable Energy
Feasibility Studies Grants Under the Rural Energy for America Program

AGENCY: Rural Business-Cooperative Service, USDA.

ACTION: Notice.

SUMMARY: This notice announces that Rural Business-Cooperative Service
is accepting applications for fiscal year (FY) 2009 to purchase
renewable energy systems and make energy efficiency improvements and to
conduct feasibility studies for renewable energy systems for
agriculture producers and rural small businesses in eligible rural
areas. Funding will be available in the form of grants and loan
guarantees. In addition to grants and loan guarantees, applicants may
apply for combination loan guarantee and grant funding (combination
package). Lastly, the Agency intends to publish a proposed rule that
will amend the Rural Energy for America portion of the Rural
Development Grants regulation, published October 15, 2008 [73 FR
61198], at 7 CFR part 5002, for feasibility study projects in calendar
year 2009.

DATES: Complete applications under this Notice must be received by the
appropriate USDA Rural Development State Office no later than 4:30
local time July 31, 2009. Neither complete nor incomplete applications
received after this date and time will be considered, regardless of the
postmark on the application.
    The comment period for information collection under the Paperwork
Reduction Act of 1995 continues through July 27, 2009. Comments on the
paper work burden must be received by this date to be assured of
consideration.

and Finding of No Significant Impact for Environmental Assessment.

SUMMARY: We, the U.S. Fish and Wildlife Service (Service), announce the
availability of the Final Comprehensive Conservation Plan (CCP) and
Finding of No Significant Impact (FONSI) for the Environmental
Assessment (EA) for Seney National Wildlife Refuge (NWR). Goals and
objectives in the CCP describe how the agency intends to manage the
refuge over the next 15 years.
