Castor Oil, Ethoxylated, Dioleate; Tolerance Exemption

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: This regulation establishes an exemption from the requirement
of a tolerance for residues of castor oil, ethoxylated, dioleate; when
used as an inert ingredient in a pesticide chemical formulation under
40 CFR 180.960. Exponent, on behalf of Plant Impact plc, submitted a
petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA),
requesting an exemption from the requirement of a tolerance. This
regulation eliminates the need to establish a maximum permissible level
for residues of castor oil, ethoxylated, dioleate on food or feed
commodities.

DATES: This regulation is effective July 30, 2010. Objections and
requests for hearings must be received on or before September 28, 2010,
and must be filed in accordance with the instructions provided in 40
CFR part 178 (see also Unit I.C. of the SUPPLEMENTARY INFORMATION).

ACTION: Listening sessions.

SUMMARY: The Environmental Protection Agency (EPA) is announcing its
plans to initiate national rulemaking to make a limited set of targeted
changes to EPA's water quality standards regulation. EPA expects to
publish such proposed rule changes in the Federal Register in Summer
2011. EPA's intent is to improve the regulation's effectiveness in
helping to restore and maintain the chemical, physical, and biological
integrity of the Nation's waters. The purpose of this notice is to
announce EPA's intent to hold two informal public ``listening
sessions'' in August 2010. The sessions will allow EPA to inform the
public about the rulemaking, and will offer an opportunity for the
public to express views on the general direction of the rulemaking,
including the six specific elements of the rulemaking.

DATES: The two public listening sessions will be held as audio
teleconferences on August 24 and 26, 2010, from 1 to 2:30 p.m. EDT.

SUMMARY: The Environmental Protection Agency (EPA) receives from time
to time Freedom of Information Act (FOIA) requests for documentation
received or issued by EPA or data contained in EPA database systems
pertaining to the export and import of Resource Conservation and
Recovery Act (RCRA) hazardous waste from/to the United States, the
export of cathode ray tubes (CRTs) and Spent Lead Acid Batteries
(SLABs) from the United States, and the export and import of RCRA
universal waste from/to the United States. These documents and data may
identify or reference multiple parties, and describe transactions
involving the movement of specified materials in which the parties
propose to participate or have participated. The purpose of this notice
is to inform ``affected businesses'' about the documents or data sought
by these types of FOIA requests in order to provide the businesses with
the opportunity to assert claims that any of the information sought
that pertains to them is entitled to treatment as confidential business
information (CBI), and to send comments to EPA supporting their claims
for such treatment. Certain businesses, however, do not meet the
definition of ``affected business,'' and are not covered by today's
notice. They consist of any business that actually submitted to EPA any
document at issue pursuant to applicable RCRA regulatory requirements
and did not assert a CBI claim as to information that pertains to that
business in connection with the document at the time of its submission;
they have waived their right to do so at a later time. Nevertheless,
other businesses identified or referenced in the documents that were
submitted to EPA by the submitting business may have a right to assert
a CBI claim concerning information that pertains to them and may do so
in response to this notice.

DATES: Comments must be received on or before August 30, 2010. The
period for submission of comments may be extended if, before the
comments are due, you make a request for an extension of the comment

SUMMARY: The Federal Energy Regulatory Commission clarifies its
regulations requiring major non-interstate pipelines to post daily
scheduled volume information and other data for certain points, as well
as its regulations requiring interstate pipelines to post information
regarding the provision of no-notice service. These modifications
include establishing the compliance deadline for major non-interstate
pipelines after the effective date of this rule and clarifying the
requirement for interstate pipelines to update posted no-notice service
volumes.

SUMMARY: The Federal Transit Administration (FTA), as the federal lead
agency, and the City of Detroit (the City) intend to prepare an
Environmental Impact Statement (EIS) for the proposed Woodward Avenue
Light Rail Transit (LRT) project in Detroit, Michigan. The proposed
project, described more completely within, is an LRT line that would
begin in downtown Detroit near the Detroit River and extend northwest
along Woodward Avenue (M-1), terminating near Eight-Mile Road (M-102)
in Detroit, Wayne County, Michigan. The purpose of this notice is to
alert interested parties regarding the intent to prepare the EIS, to
provide information on the nature of the proposed project and possible
alternatives, and to invite public participation in the EIS process.

DATES: Written comments on the scope of the EIS, including the
project's purpose and need, the alternatives to be considered, the
impacts to be evaluated, and the methodologies to be used in the
evaluations should be sent to the Headquarters office of FTA on or

Second Draft Document Related to the Review of the National
Ambient Air Quality Standards for Particulate Matter

SUMMARY: The EPA is announcing an extension of the public comment
period for one chapter of the draft assessment document titled, Policy
Assessment for the Review of the Particulate Matter National Ambient
Air Quality Standards--Second External Review Draft. The EPA is
extending the comment period for chapter 4--Review of the Secondary
Standards for Visibility-Related Effects. This chapter is based on the
Particulate Matter Urban-Focused Visibility Assessment (UFVA) which was
finalized later than originally anticipated. As a result, the Agency is
extending the comment period by two weeks to provide stakeholders and
the public with adequate time to conduct appropriate analysis and
prepare meaningful comments on chapter 4 of the second draft Policy
Assessment. The original comment period was to end on August 16, 2010.
The extended comment period for chapter 4 will now close on August 30,
2010.

SUMMARY: In accordance with the Agricultural Bioterrorism Protection
Act of 2002, we are soliciting public comment regarding the list of
select agents and toxins that have the potential to pose a severe
threat to animal or plant health, or to animal or plant products. The
Act requires the biennial review and republication of the list of
select agents and toxins and the revision of the list as necessary.
Accordingly, we are soliciting public comment on the current list of
select agents and toxins in our regulations and suggestions regarding
any addition or reduction of the animal or plant pathogens currently on
the list of select agents. In addition, we are soliciting public
comment on the potential reorganization of the list of select agents
and toxins based on the relative potential of each select agent or
toxin to be misused to adversely affect human, plant or animal health.
Such tiering of the list could allow for the application of different
security measures for those select agents or toxins which pose a higher
risk to animal or plant health if they were to be stolen or otherwise
misused.

SUMMARY: In accordance with current Agency practice to describe more
clearly the measurement and scope or coverage of the tolerances, EPA is
proposing minor revisions to tolerance expressions for a number of
pesticide active ingredients, including the insecticides
chlorethoxyfos, clofentezine, cyromazine, etofenprox, fenbutatin-oxide,
fosthiazate, propetamphos, and tebufenozide; the fungicides aluminum
tris(O-ethylphosphonate) and fenarimol; the herbicides butylate,
clethodim, clomazone, fenoxaprop-ethyl, flumetsulam, flumiclorac
pentyl, fluridone, fomesafen, glufosinate ammonium, lactofen,
propyzamide, quinclorac, and pyridate; and the fungicide/bactericide
oxytetracycline. Also, EPA is proposing to revoke the tolerances for
aluminum tris(O-ethylphosphonate) on pineapple fodder and forage
because they are not considered to be significant livestock feed items,
and revise specific tolerance nomenclatures for aluminum tris(O-
ethylphosphonate), clethodim, flumetsulam, and fluridone. In addition,
EPA will be removing several expired tolerances for aluminum tris(O-
ethylphosphonate), etofenprox, propyzamide, and tebufenozide.

SUMMARY: EPA is announcing the availability of a January 19, 2010
petition from Dow AgroSciences LLC (``DAS''), Makhteshim Agan of North

requesting EPA promulgate a rule for creating and amending Endangered
Species Protection Bulletins (``County Bulletins'') intended to provide
additional label directions as part of the Agency's Endangered Species
Protection Program (ESPP). DAS, MANA, and Cheminova state that
appropriate, clear, and equitable procedures for creating and amending
County Bulletins must be established. They further claim that the
current process used to develop and implement County Bulletins is ad
hoc, and that EPA has no established procedures for input by the
agricultural or forestry communities, or to assure the pesticide
registrant's ability to review, comment upon and/or challenge proposed
language in County Bulletins that would be referenced on its label.

SUMMARY: In accordance with section 6(f)(1) of the Federal Insecticide,
Fungicide, and Rodenticide Act (FIFRA), as amended, EPA is issuing a
notice of receipt of requests by the registrants to voluntarily cancel
their rotenone registrations. The requests would not terminate the last
rotenone products registered for use in the United States. EPA intends
to grant these requests at the close of the comment period for this
announcement unless the Agency receives substantive comments within the
comment period that would merit its further review of the requests, or
unless the registrants withdraw their requests. If these requests are
granted, any sale, distribution, or use of products listed in this
notice will be permitted after the registration has been cancelled only
if such sale, distribution, or use is consistent with the terms as
described in the final order.

SUMMARY: The Agricultural Air Quality Task Force (AAQTF) will meet to
continue discussions on air quality issues relating to agriculture.
Additionally, the Livestock and Poultry Subcommittee of the AAQTF will
conduct a pre-meeting Livestock and Poultry Air Emissions
Standardization (LPAES) Workshop to discuss livestock and poultry air
emissions monitoring data/research obtained from the National Animal
Air Emissions Monitoring Study (NAAEMS).

DATES: The LPAES workshop will convene at 2 p.m. on Monday, September
27, 2010, and conclude at 6 p.m., and convene at 8 a.m. on Tuesday,
September 28, 2010, and conclude at 5 p.m.
    The AAQTF meeting will convene at 8 a.m. on Wednesday, September 29
and Thursday, September 30, and conclude at 5 p.m. each day. A public
comment period for the AAQTF meeting will be held on September 30,
2010. Individuals making oral presentations should register in person
at the AAQTF meeting site and must bring with them 50 copies of any
materials they would like distributed.

Confidentiality Determinations for Data Required under the Mandatory
Greenhouse Gas Reporting Rule and Proposed Amendment to Special Rules
Governing Certain Information Obtained under the Clean Air Act''. In
this action, EPA is proposing confidentiality determinations for the
data elements proposed to be added or revised in the ``Proposed
Rulemaking: Revision of Certain Provisions of the Mandatory Reporting
of Greenhouse Gases Rule,'' also signed today. This action addresses
only the confidentiality of the new and revised data elements proposed
in the concurrent notice.

Methyl Parathion; Rescision of Previously Issued Order and
Issuance of Revised Cancellation Order for Certain Pesticide

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice.

SUMMARY: This notice announces EPA's rescision of a previously issued
cancellation order and provides a revised cancellation order,
voluntarily requested by the registrants and accepted by the Agency, of
products containing methyl parathion, pursuant to section 6(f)(1) of
the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as
amended. This revised cancellation order rescinds a July 16, 2010
Federal Register Notice which incorrectly stated the effective date of
the cancellations of the product registrations listed in Table 1 of
Unit II. This order correctly identifies the effective dates of
cancellation for the affected product registrations. In addition, this
order clarifies the existing stocks provisions. These are the last products containing this pesticide registered for use in the United States. In the April 28,
2010 Federal Register Notice of Receipt of Requests from the
registrants listed in Table 2 of Unit II. to voluntarily cancel all
these product registrations, EPA indicated that it would issue an order
implementing the cancellations, unless the Agency received substantive
comments within the 30 day comment period that would merit its further
review of these requests, or unless the registrants withdrew their
requests. The Agency received two comments on the notice but none
merited the denial or the further review of the requests. Further, the
registrants did not withdraw their requests. Accordingly, EPA hereby
issues in this notice a cancellation order granting the requested
cancellations. Any distribution, sale, or use of the products subject
to this cancellation order is permitted only in accordance with the
terms of this order, including any existing stocks provisions.

DATES: The cancellations are effective December 31, 2012.

SUMMARY: The Department of Energy (``Department'' or ``DOE'') is
seeking comment and information from the public to assist in its
development of regulations pertaining to section 934 of the Energy
Independence and Security Act of 2007 (``Act''). Section 934 addresses
how the United States will meet its obligations under the Convention on
Supplementary Compensation for Nuclear Damage (``Convention'' or
``CSC'') and, in particular, its obligation to contribute to an
international supplementary fund in the event of certain nuclear
incidents. Section 934 authorizes the Secretary of Energy
(``Secretary'') to issue regulations establishing a retrospective risk
pooling program by which nuclear suppliers will reimburse the United
States government for its contribution to the international
supplementary fund. The Department's regulations to implement the
retrospective risk pooling program are the subject of this notice.

Inflation Adjustment of the Ordinary Maximum and Aggravated
Maximum Civil Monetary Penalties for a Violation of the Hazardous
Material Transportation Laws and Regulations

AGENCY: Federal Railroad Administration (FRA), Department of

SUMMARY: FRA is adjusting the ordinary maximum penalty and the
aggravated maximum penalty that it will apply when assessing a civil
monetary penalty for a violation of the Federal hazardous material
transportation laws or a regulation, special permit, or approval issued
under those laws. The aggravated maximum penalty is available only for
a violation that results in death, serious illness, or severe injury to
any person or substantial destruction of property. In particular, FRA
is increasing the ordinary maximum civil monetary penalty per violation
from $50,000 to $55,000 and the aggravated maximum civil penalty from
$100,000 to $110,000. The minimum civil monetary penalty for a
violation related to training remains at $450. The minimum civil
monetary penalty per violation for other hazardous material violations
remains at $250. These adjustments are required by the Federal Civil
Penalties Inflation Adjustment Act of 1990 as amended by the Debt
Collection Improvement Act of 1996.

SUMMARY: Section 101(a) of the Consumer Product Safety Improvement Act
(``CPSIA'') provides that, as of August 11, 2011, children's products
may not contain more than 100 parts per million (``ppm'') of lead,
unless the Consumer Product Safety Commission (``CPSC'' or
``Commission''), determines that it is not technologically feasible,
after notice and a hearing and after analyzing the public health
protections associated with substantially reducing lead in children's
products. The reduction can be for a product or product category. This
notice requests comment and information on the technological
feasibility of meeting the 100 ppm lead content limit for children's
products.
