Confidentiality Claims

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: The Environmental Protection Agency (EPA) receives from time
to time Freedom of Information Act (FOIA) requests for documentation
received or issued by EPA or data contained in EPA database systems
pertaining to the export and import of Resource Conservation and
Recovery Act (RCRA) hazardous waste from/to the United States, the
export of cathode ray tubes (CRTs) from the United States, and the
export and import of RCRA universal waste from/to the United States.
These documents and data may identify or reference multiple parties,
and describe transactions involving the movement of specified materials
in which the parties propose to participate or have participated. The
purpose of this notice is to inform ``affected businesses'' about the
documents or data sought by these types of FOIA requests in order to
provide the businesses with the opportunity to assert claims that any
of the information sought that pertains to them is entitled to
treatment as confidential business information (CBI), and to send
comments to EPA supporting their claims for such treatment. Certain
businesses, however, do not meet the definition of ``affected
business,'' and are not covered by today's notice. They consist of any
business that actually submitted to EPA any document at issue pursuant
to applicable RCRA regulatory requirements and did not assert a CBI
claim as to information that pertains to that business in connection
with the document at the time of its submission; they have waived their
right to do so at a later time. Nevertheless, other businesses
identified or referenced in the documents that were submitted to EPA by
the submitting business may have a right to assert a CBI claim
concerning information that pertains to them and may do so in response
to this notice.

DATES: Comments must be received on or before March 1, 2010. The period
for submission of comments may be extended if, before the comments are
due, you make a request for an extension of the comment period and it
is approved by the EPA legal office. Except in extraordinary
circumstances, the EPA legal office will not approve such an extension
without the consent of any person whose request for release of the
information under the FOIA is pending.

the availability of a final document titled, ``Integrated Science
Assessment for Carbon Monoxide'' (EPA/600/R-09/019F). This document was
prepared by the National Center for Environmental Assessment (NCEA)
within EPA's Office of Research and Development as part of the review
of the national ambient air quality standards (NAAQS) for carbon
monoxide.

Beauveria Bassiana Strain GHA; Notice of Receipt of a Request for
an Amendment to Delete a Use in a Pesticide Registration

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice.

SUMMARY: In accordance with section 6(f)(1) of the Federal Insecticide,
Fungicide, and Rodenticide Act (FIFRA), as amended, EPA is issuing a
notice of receipt of a request for an amendment by a registrant to
delete a use in a pesticide registration. Section 6(f)(1) of FIFRA
provides that a registrant of a pesticide product may at any time
request that any of its pesticide registrations be amended to delete
one or more uses. FIFRA further provides that, before acting on the
request, EPA must publish a notice of receipt of any request in the
Federal Register.

DATES: The deletion is effective,July 28, 2010 unless the Agency
receives a written withdrawal request on or before July 28, 2010. The
Agency will consider a withdrawal request postmarked no later than July
28, 2010.
    Users of this product who desire continued use on the crop being
deleted should contact the applicable registrant on or before July 28,
2010.

Storage of Elemental Mercury Environmental Impact Statement and Notice
of Public Hearings

SUMMARY: The Department of Energy (DOE) announces the availability of
the Draft Long-Term Management and Storage of Elemental Mercury
Environmental Impact Statement (DOE/EIS-0423D, ``Draft Mercury Storage
EIS'' or ``Draft EIS'') for public review and comment during a public
comment period that extends through March 30, 2010. This Draft EIS has
been prepared in accordance with the implementing regulations under the
National Environmental Policy Act (NEPA) and evaluates the potential
health and environmental effects of storing a projected total of up to
10,000 metric tons (11,000 tons) of elemental mercury. Seven
alternative sites across the U.S. are evaluated. DOE invites the public
to comment through the several avenues listed under ADDRESSES and
SUPPLEMENTARY INFORMATION. The U.S. Environmental Protection Agency
(EPA) and the Mesa County (Colorado) Board of Commissioners are
cooperating agencies on this Draft EIS.

DATES: The public is invited to submit oral and/or written comments on
this Draft EIS during the public comment period, which extends through
March 30, 2010. DOE will consider all comments received or postmarked
by that date in preparing the Final EIS, expected in fall 2010, and
will consider late comments to the extent practicable. DOE will hold
public hearings on the dates and at the times and locations listed
under SUPPLEMENTARY INFORMATION below.

SUMMARY: EPA Regions 1, 2, 3, 5, 6, 7, 8, 9, and 10 today are modifying
the 2008 National Pollutant Discharge Elimination System (NPDES)
general permits for stormwater discharges associated with construction
activity in order to extend by one year the expiration date of the
permit. Hereinafter, these NPDES general permits will be referred to as
``permit'' or ``2008 construction general permit'' or ``2008 CGP.'' The
2008 CGP was originally issued for a period of two (2) years. Today,
EPA is modifying the CGP in order to extend the 2 year term of the 2008
CGP by one year so that it expires on June 30, 2011, instead of June
30, 2010, resulting in a permit that will be in effect for a total
period of three (3) years. By Federal law, no NPDES permit may be
issued for a period that exceeds five (5) years.

DATES: EPA is modifying its 2008 Construction General Permit by
extending the permit by one year. This permit modification is effective
on January 20, 2010. The 2008 Construction General Permit will now
expire on midnight June 30, 2011, instead of June 30, 2010.

reporting requirements for energy conservation standards and energy
use, and to address other matters, including compliance certification,
prohibited actions, and enforcement procedures for specific consumer
products and commercial and industrial equipment. Due to drafting
errors, language added to the rule in one amendment was deleted from
the rule by another amendment, and certain erroneous internal cross
references were made. This correction addresses these errors.

SUMMARY: Notice is hereby given of the intention of NRCS to issue a
series of revised conservation practice standards in the National
Handbook of Conservation Practices. These standards include: Air
Filtration and Scrubbing (Code 371), Animal Trails and Walkways (Code
575), Combustion System Improvement (Code 372), Conservation Crop
Rotation (Code 328), Diversion (Code 362), Dust Control on Unpaved
Roads and Surfaces (Code 373), Forage Harvest Management (Code 511),
Herbaceous Weed Control (Code 315), Range Planting (Code 550), and
Riparian Herbaceous Cover (Code 390). NRCS State Conservationists who
choose to adopt these practices for use within their States will
incorporate them into Section IV of their respective electronic Field
Office Technical Guides. These practices may be used in conservation
systems that treat highly erodible land (HEL) or on land determined to
be a wetland. Section 343 of the Federal Agriculture Improvement and
Reform Act of 1996 requires NRCS to make available for public review
and comment all proposed revisions to conservation practice standards
used to carry out HEL and wetland provisions of the law.

DATES: Effective Date: This is effective January 28, 2010.
    Comment date: Submit comments on or before March 1, 2010. Final
versions of these new or revised conservation practice standards will
be adopted after the close of the 30-day period, and after
consideration of all comments.

adequate protection of the public health and safety, and the common
defense and security of the United States.

Premanufacture Notification Exemption for Polymers; Amendment of
Polymer Exemption Rule to Exclude Certain Perfluorinated Polymers

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: EPA is amending the polymer exemption rule, which provides an
exemption from the premanufacture notification (PMN) requirements of
the Toxic Substances Control Act (TSCA), to exclude from eligibility
polymers containing as an integral part of their composition, except as
impurities, certain perfluoroalkyl moieties consisting of a CF3- or
longer chain length. This exclusion includes polymers that contain any
one or more of the following: Perfluoroalkyl sulfonates (PFAS),
perfluoroalkyl carboxylates (PFAC), fluorotelomers, or perfluoroalkyl
moieties that are covalently bound to either a carbon or sulfur atom
where the carbon or sulfur atom is an integral part of the polymer
molecule (affected polymers). In general, any person who intends to
manufacture (which is defined by TSCA to include import into the
customs territory of the United States) any of these polymers not
already on the TSCA Inventory (Inventory) must complete the TSCA PMN
review process prior to commencing the manufacture or import of such
polymers. Alternatively, manufacturers or importers may submit a
request for a different exemption, such as the Low Volume Exemption
(LVE) or Low Release and Exposure Exemption (LoREX), for affected
polymers that they reasonably believe may qualify for such exemptions.
Those persons who are currently manufacturing or importing affected
polymers, or who have previously manufactured or imported them but are
not doing so now, in full compliance with the 1995 polymer exemption
rule, may continue manufacturing or importing them until January 27,
2012. After that date, manufacture of these polymers will no longer be
authorized under the polymer exemption rule, and continued manufacture
or import must be authorized under a different TSCA section 5(h)(4)
exemption or under a different TSCA section 5 authority, such as TSCA
section 5(a)(1) or section 5(e). This change is necessary because,
based on current information, EPA can no longer conclude that these
polymers ``will not present an unreasonable risk to human health or the
environment'' under the terms of the polymer exemption rule, which is
the determination necessary to support an exemption under TSCA section
5(h)(4).

SUMMARY: This regulation establishes an exemption from the requirement
of a tolerance for residues of 2-propenoic acid, 2-ethylhexyl ester,
polymer with ethenylbenzene and 2-methylpropyl 2-methyl-2-propenoate;
when used as an inert ingredient in a pesticide chemical formulation.
BASF Corporation submitted a petition to EPA under the Federal Food,
Drug, and Cosmetic Act (FFDCA), requesting an exemption from the
requirement of a tolerance. This regulation eliminates the need to
establish a maximum permissible level for residues of 2-propenoic acid,
2-ethylhexyl ester, polymer with ethenylbenzene and 2-methylpropyl 2-
methyl-2-propenoate on food or feed commodities.

SUMMARY: This regulation establishes an exemption from the requirement
of a tolerance for residues of oxirane, 2-methyl-,polymer with oxirane,
dimethyl ether (CAS Reg. No. 61419-46-3); minimum number average
molecular weight (in AMW) 2,800; when used as an inert ingredient in a
pesticide chemical formulation under 40 CFR 180.960. BASF Corporation,
100 Campus Dr., Florham Park, NJ 07932 submitted a petition to EPA
under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting an
exemption from the requirement of a tolerance. This regulation
eliminates the need to establish a maximum permissible level for
residues of oxirane, 2-methyl-, polymer with oxirane, dimethyl ether
(CAS Reg. No. 61419-46-3) on food or feed commodities.

DATES: This regulation is effective January 27, 2010. Objections and
requests for hearings must be received on or before March 29, 2010, and
must be filed in accordance with the instructions provided in 40 CFR
part 178 (see also Unit I.C. of the SUPPLEMENTARY INFORMATION).

Canada) in their respective jurisdictions. Under agreement with the
SLSMC, the SLSDC is amending the joint regulations by updating the
Seaway Regulations and Rules in various categories. The proposed
changes will update the following sections of the Regulation and Rules:
Condition of Vessels; Seaway Navigation; Radio Communications; and
General. These proposed amendments are necessary to take account of
updated procedures and will enhance the safety of transits through the
Seaway. Several of the proposed amendments are merely editorial or for
clarification of existing requirements.
