Guidance on the Development, Evaluation, and Application of
Environmental Models

SUMMARY: The U.S. Environmental Protection Agency (EPA) is announcing
the availability of the final ``Guidance Document on the Development,
Evaluation, and Application of Regulatory Environmental Models,'' EPA/
100/K-09/003 (hereinafter ``Models Guidance''). EPA's Council for
Regulatory Environmental Modeling (CREM) developed the Models Guidance
and its companion product, the ``Models Knowledge Base'' (hereinafter
``Models KBase,'' http://cfpub.epa.gov/crem/knowledge_base/
knowbase.cfm
), to improve the practices associated with the development, evaluation, and application of models for environmental decision making. Furthermore,
by providing access to its tools and methods, EPA increases
transparency and can improve the public's understanding of how science
is used to make environmental decisions.
    While the Models Guidance does not impose legally binding
requirements on EPA or the public, it provides recommendations on the
principles of good modeling practice, stressing the importance of model
quality, documentation, and transparency with the aim of helping to
determine when and how a model can be used to inform a decision.

The meeting will include discussion of current topics and presentations
about activities being conducted by EPA's Office of Transportation and

SUMMARY: The Environmental Protection Agency (EPA) Underground
Injection Control Program will be hosting a meeting to discuss
innovative ideas for Aquifer Storage and Recovery (ASR) operations that
would prevent endangerment of underground sources of drinking water.
While ASR may be a valuable tool to support public drinking water
supplies, EPA or States with primary enforcement responsibility
regulate underground injection activities to protect underground
sources of drinking water pursuant to the Safe Drinking Water Act. EPA
is assembling an interdisciplinary group of experts to generate ideas
regarding the use of ASR technology in a manner that will prevent
endangerment of drinking water resources. EPA requests those interested

DATES: The ASR Expert Meeting will be held on May 5-6, 2009. The
meeting will be two (2) half days (May 5, 1 p.m.-5 p.m., May 6, 8 a.m.-

Chronic Wasting Disease Herd Certification Program and Interstate

AGENCY: Animal and Plant Health Inspection Service, USDA.

SUMMARY: We are proposing further amendments that would establish a
herd certification program to eliminate chronic wasting disease from
farmed or captive cervids in the United States. Under the 2006 Chronic
Wasting Disease (CWD) rule, participating deer, elk, and moose herds
would have to follow CWD Herd Certification Program requirements for
animal identification, testing, herd management, and movement of
animals into and from herds. This document proposes additional changes
to the program regarding recognition of State bans on the entry of
farmed or captive cervids for reasons unrelated to CWD, the number of
years an animal must be monitored for CWD before it may move
interstate, interstate movement of cervids that originated from herds
in proximity to a CWD outbreak, herd inventory procedures, and several
other matters. These actions are intended to help eliminate CWD from
the farmed or captive cervid herds in the United States.

SUMMARY: This notice announces the availability of a Final
Environmental Impact Statement (FEIS) and Section 4(f) Evaluation for
the Blue Water Bridge Plaza Study (BWB). This action is pursuant to the
National Environmental Policy Act (NEPA) of 1969, 42 U.S.C. 4321 et
seq., as amended and the Council on Environmental Quality Regulations
(40 CFR Parts 1500-1508). The FEIS discusses the recommended
alternative to improve the United States inspection Facility at the
Blue Water Bridge Plaza and the I-94/I-69 corridor in St. Clair County,
Michigan; describes the environmental impacts of the proposed project
and proposed mitigation; and addresses comments received on the Draft
Environmental Impact Statement and Section 4(f) Evaluation issued in
August 2007.

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice.

SUMMARY: In accordance with section 6(f)(1) of the Federal Insecticide,
Fungicide, and Rodenticide Act (FIFRA), as amended, EPA is issuing a
notice of receipt of requests by the registrants to voluntarily amend
their registrations to terminate uses of certain products containing
the pesticide pentachloronitrobenzene, or PCNB. The requests would
terminate PCNB use on golf course roughs (i.e., use on golf courses
will be limited to tees, greens, and fairways); residential sites
including lawns, yards, and ornamental plants and gardens around homes
and apartments; grounds around day care facilities; school yards; parks
(except industrial parks); playgrounds; and athletic fields (except
professional and college fields). The requests would not terminate the
last PCNB products registered for use in the United States. EPA intends
to grant these requests at the close of the comment period for this
announcement unless the Agency receives substantive comments within the
comment period that would merit its further review of the requests, or
unless the registrants withdraw their requests within this period. Upon
acceptance of these requests, any sale, distribution, or use of
products listed in this notice will be permitted only if such sale,
distribution, or use is consistent with the terms as described in the
final order.

SUMMARY: The Department is delaying the effective date of this rule for
an additional 60 days. The Department previously delayed the effective
date and sought comment for 30 days ending on March 2, 2009 (74 FR
5107). More time is needed for the Forest Service to properly respond
to the comments and to consider any potential changes to the rule. The
rule regulates the sustainable free use, commercial harvest, and sale
of special forest products and forest botanical products from National
Forest System lands.

SUMMARY: The future of this country's economy, security, and
environment are linked to one key challenge: energy. To reduce fuel
consumption, NHTSA has been issuing Corporate Average Fuel Economy
(CAFE) standards since the late 1970's under the Energy Policy and
Conservation Act (EPCA). However, the principal effects of these
standards are broader than their statutory purpose. Reducing fuel
consumption conserves petroleum, a non-renewable energy source, saves
consumers money, and promotes energy independence and security by
reducing dependence on foreign oil. It also directly reduces the motor
vehicle tailpipe emissions of carbon dioxide (CO2), which is
the principal greenhouse gas emitted by motor vehicles.
    The Energy Independence and Security Act (EISA) amended EPCA by
mandating that the model year (MY) 2011-2020 CAFE standards be set
sufficiently high to ensure that the industry-wide average of all new
passenger cars and light trucks, combined, is not less than 35 miles
per gallon by MY 2020. This is a minimum requirement, as NHTSA must set
standards at the maximum feasible level in each model year. NHTSA will
determine, based on all of the relevant circumstances, whether that
additional requirement calls for establishing standards that reach the
35 mpg goal earlier than MY 2020.
    NHTSA published a proposal in May 2008 to begin implementing EISA
by establishing CAFE standards for MYs 2011-2015. A draft final rule
for those model years was completed, but not issued.
    In the context of his calls for the development of new national
policies to prompt sustained domestic and international actions to
address the closely intertwined issues of energy independence, energy
security and climate change, the President issued a memorandum on
January 26, 2009, requesting NHTSA to divide its rulemaking into two
parts. First, he requested the agency to issue a final rule adopting
CAFE standards for MY 2011 only. Given the substantial time and
analytical effort involved in developing CAFE standards and the limited
amount of time before the statutory deadline of March 30, 2009 for
establishing the MY 2011 standards, the agency has necessarily based
this one year final rule almost wholly on the information available to
it and the analysis performed by it in support of the draft final rule
completed last fall.
    Second, the President requested NHTSA to establish standards for MY
2012 and later after considering the appropriate legal factors, the
comments filed in response to the May 2008 proposal, the relevant
technological and scientific considerations, and, to the extent
feasible, a forthcoming report by the National Academy of Sciences,
mandated under section 107 of EISA, assessing existing and potential
automotive technologies and costs that can practicably be used to
improve fuel economy. The deferral of action on standards for the later
model years provides the agency with an opportunity to review its
approach to CAFE standard setting, including its methodologies,
economic and technological inputs and decisionmaking criteria, so as to
ensure that it will produce standards that contribute, to the maximum
extent possible within the limits of EPCA/EISA, to meeting the energy
and environmental challenges and goals outlined by the President.
    NHTSA estimates that the MY 2011 standards will raise the industry-
wide combined average to 27.3 mpg, save 887 million gallons of fuel
over the lifetime of the MY 2011 cars and light trucks, and reduce
CO2 emissions by 8.3 million metric tons during that period.

Energy Conservation Program: Test Procedures for Battery Chargers

SUMMARY: The Department of Energy (DOE) is amending its test procedures
for battery chargers (BCs) and external power supplies (EPSs) to
include provisions for measuring standby mode and off mode energy
consumption, as directed by the Energy Independence and Security Act of
2007 (EISA 2007). Furthermore, DOE is adding to its single-voltage
external power supply test procedure specifications for testing switch-
selectable external power supplies. Finally, DOE is extending the
current certification reporting requirements to the Class A external
power supplies for which Congress established energy efficiency
standards in EISA 2007.

Power Reactor Security Requirements

AGENCY: Nuclear Regulatory Commission.

SUMMARY: The Nuclear Regulatory Commission (NRC) is amending its
security regulations and adding new security requirements pertaining to
nuclear power reactors. This rulemaking establishes and updates
generically applicable security requirements similar to those
previously imposed by Commission orders issued after the terrorist
attacks of September 11, 2001. Additionally, this rulemaking adds
several new requirements not derived directly from the security order
requirements but developed as a result of insights gained from
implementation of the security orders, review of site security plans,
implementation of the enhanced baseline inspection program, and NRC
evaluation of force-on-force exercises. This rulemaking also updates
the NRC's security regulatory framework for the licensing of new
nuclear power plants. Finally, it resolves three petitions for
rulemaking (PRM) that were considered during the development of the
final rule.

DATES: Effective Date: This final rule is effective on May 26, 2009.
Compliance Date: Compliance with this final rule is required by March
31, 2010, for licensees currently licensed to operate under 10 CFR Part
50.

Hazardous Chemical Reporting; Tier II Inventory Information

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: EPA issued a final rule in the Federal Register on November 3,
2008, amending the Emergency Planning and Emergency Release
Notification and Hazardous Chemical Reporting regulations, as well as
re-writing the regulations in a plain language format. This document is
being issued to correct a technical error to the regulatory text in
Hazardous Chemical Reporting, specifically in the Tier II inventory
information section.

DATES: This final rule is effective March 26, 2009.

Rulemaking To Reaffirm the Promulgation of Revisions of the Acid

AGENCY: Environmental Protection Agency (EPA).

ACTION: Withdrawal of direct final rule.

SUMMARY: Because EPA received an adverse comment, EPA is withdrawing
the direct final rule for ``Rulemaking to Reaffirm the Promulgation of
Revisions of the Acid Rain Program Rules,'' which was published in the
Federal Register on December 15, 2008.

DATES: Effective March 26, 2009, EPA withdraws the direct final rule
published at 73 FR 75954 on December 15, 2008.

SUPPLEMENTARY INFORMATION: Because EPA received an adverse comment, EPA is withdrawing the direct final rule for ``Rulemaking to Reaffirm the
Promulgation of Revisions of the Acid Rain Program Rules,'' which was
published on December 15, 2008 (73 FR 75954).
    EPA stated in that direct final rule that if EPA received adverse
comment by January 29, 2009, the direct final rule would not take
effect and EPA would publish a timely withdrawal of the direct final
rule in the Federal Register. EPA subsequently received an adverse
comment on the direct final rule.
    Because EPA received an adverse comment, EPA is withdrawing the
direct final rule for ``Rulemaking to Reaffirm the Promulgation of
Revisions of the Acid Rain Program Rules.'' As stated in the parallel
proposed rule (73 FR 75983) published on the same day as the direct
final rule, EPA will not institute a second comment period in this
proceeding concerning the Acid Rain Program rule revisions addressed in
the direct final and parallel proposed rules. EPA will address the
adverse comment on the direct final rule in a subsequent final rule
based on the parallel proposed rule.
    The revisions of the Acid Rain Program rules whose promulgation EPA
proposed to reaffirm in the parallel proposed rule were described in
detail, along with EPA's reasons for such reaffirmation, in the interim
final rule (73 FR 75959) that was published on the same day as the
direct final and that reaffirmed--on an interim basis pending final
action in this proceeding--the promulgation of the Acid Rain Program
rule revisions. EPA notes that it is not withdrawing the interim final
rule.

SUMMARY: A meeting of the National Advisory Committee for Acute
Exposure Guideline Levels for Hazardous Substances (NAC/AEGL Committee)
will be held on April 14-16, 2009, in Alexandria, VA. At this meeting,
the NAC/AEGL Committee will address, as time permits, the various
aspects of the acute toxicity and the development of Acute Exposure
Guideline Levels (AEGLs) for the following chemicals: Acrylonitrile,
aldicarb, arsenic pentoxide, arsenic trichloride, calcium cyanide,
carbofuran, diacetylmorphine, fluoroacetate salts, methomyl, methyl
fluoroacetate, methyl iodide, methoxyethylmercuric acetate,
monofluoroacetic acid, oxamyl, paraquat, perchloryl fluoride,
perfluoroisobutylene, phencyclidine, phosgene, phosgene oxime,
potassium cyanide, sodium cyanide, sodium fluoroacetate, tellurium

1,1,1-trichloroethylene, and tungsten hexafluoride.
