Control of Emissions From New Marine Compression-Ignition Engines
at or Above 30 Liters per Cylinder

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

-----------------------------------------------------------------------

SUMMARY: EPA is finalizing emission standards for new marine diesel
engines with per-cylinder displacement at or above 30 liters (called
Category 3 marine diesel engines) installed on U.S. vessels. These
emission standards are equivalent to those adopted in the amendments to
Annex VI to the International Convention for the Prevention of
Pollution from Ships (MARPOL Annex VI). The emission standards apply in
two stages--near-term standards for newly built engines will apply
beginning in 2011; long-term standards requiring an 80 percent
reduction in NOX emissions will begin in 2016. We are also
finalizing a change to our diesel fuel program that will allow for the
production and sale of 1,000 ppm sulfur fuel for use in Category 3
marine vessels. In addition, the new fuel requirements will generally
forbid the production and sale of other fuels above 1,000 ppm sulfur
for use in most U.S. waters, unless alternative devices, procedures, or
compliance methods are used to achieve equivalent emissions reductions.
We are adopting further provisions under the Act to Prevent Pollution
from Ships, especially to apply the emission standards to engines
covered by MARPOL Annex VI that are not covered by the Clean Air Act,
and to require that these additional engines use the specified fuels
(or equivalents).
    The final regulations also include technical amendments to our
motor vehicle and nonroad engine regulations; many of these changes
involve minor adjustments or corrections to our recently finalized rule
for new nonroad spark-ignition engines, or adjustment to other
regulatory provisions to align with this recent final rule.

DATES: This final rule is effective on June 29, 2010. The incorporation
by reference of certain publications listed in this regulation is
approved by the Director of the Federal Register as of June 29, 2010.

published at 75 FR 12451 on March 16, 2010.

Registration review is EPA's periodic review of pesticide registrations
to ensure that each pesticide continues to satisfy the statutory
standard for registration, that is, that the pesticide can perform its
intended function without unreasonable adverse effects on human health
or the environment. Through this program, EPA is ensuring that each
pesticide's registration is based on current scientific and other
knowledge, including its effects on human health and the environment.

SUMMARY: In response to requests from several organizations, the
Department of State (DOS) is extending the public comment period for
the Keystone XL Pipeline Project Draft Environmental Impact Statement
(DEIS). The Department of State had originally set the end of the
comment period at May 31, 2010. The Department has decided, in response
to the requests noted above, to extend the comment period until
Wednesday, June 16, 2010. The original notice of availability of the
DEIS was published by EPA in the Federal Register on April 16, 2010 [75
FR 19969]. A second notice that listed the public comment meetings and
additional information on the DEIS was published in the Federal
Register on April 20, 2010 [75 FR 20653].

Draft 2010 Report to Congress on the Benefits and Costs of
Federal Regulations

SUMMARY: The Office of Management and Budget (OMB) requests comments on
its Draft 2010 Report to Congress on the Benefits and Costs of Federal
Regulations, available at: http://www.whitehouse.gov/omb/inforeg_

. The Draft Report is divided into four
chapters. Chapter I examines the benefits and costs of major Federal
regulations issued in fiscal year 2009 and summarizes the benefits and
costs of major regulations issued between October 1999 and September
2009. It also discusses regulatory impacts on State, local, and Tribal
governments, small business, wages, and economic growth. Chapter II
offers recommendations for regulatory reform. Chapter III provides an
update on implementation of the Information Quality Act. Chapter IV
summarizes agency compliance with the Unfunded Mandates Reform Act.
    In this draft Report, OMB offers the following recommendations:
    1. OMB identifies several measures designed to meet analytical
challenges, principally involving increased transparency.
    2. OMB offers a brief discussion of disclosure as a regulatory
tool.
    3. OMB recommends consideration of certain low-cost approaches to
the problem of childhood obesity.
    4. OMB draws on principles of open government to invite public
suggestions about improvements in existing regulations, with particular
reference to economic growth.
    These recommendations build on those of the 2009 Report, in which
OMB emphasized the importance of open government and in particular of
obtaining access to ``dispersed knowledge'' about how to improve
regulation. To promote such engagement, OMB requests suggestions about
regulatory changes that might serve to promote economic growth, with
particular reference to increasing employment, innovation, and
competitiveness. OMB is especially interested in identifying both new
initiatives and current regulations that might be modified, expanded,
or repealed in order to promote those goals. Consistent with Executive
Order 12866, OMB welcomes suggestions for regulatory reforms that have
significant net benefits, that might increase net exports, and that
might promote growth, innovation, and competitiveness for small
business, perhaps through increasing flexibility. OMB requests that
nominations be submitted electronically to OMB within 60 days from the
date of notice publication in the Federal Register through http://

.

Phosphate Ester, Tallowamine, Ethoxylated; Exemption from the
Requirement of a Tolerance

AGENCY: Environmental Protection Agency (EPA).

SUMMARY:  This regulation establishes an exemption from the requirement
of a tolerance for residues of phosphate ester, tallowamine,
ethoxylated (CAS Reg. No. 68308-48-5), herein referred to in this
document as PETAE when used as an inert ingredient at a maximum of 20%
by weight in pesticide formulations applied in or on growing crops.
Huntsman Corporation submitted a petition to EPA under the Federal
Food, Drug, and Cosmetic Act (FFDCA), requesting establishment of an
exemption from the requirement of a tolerance. This regulation
eliminates the need to establish a maximum permissible level for
residues of PETAE.

DATES: This regulation is effective April 28, 2010. Objections and

SUMMARY: EPA is issuing this Advance Notice of Proposed Rulemaking
(ANPR) to describe information currently available and information
being collected that will be used by the Administrator to issue a
subsequent proposal regarding whether, in the Administrator's judgment,
aircraft lead emissions from aircraft using leaded aviation gasoline
(avgas) cause or contribute to air pollution which may reasonably be
anticipated to endanger public health or welfare. In this ANPR we
describe and request comment on the data available for evaluating lead
emissions, ambient concentrations and potential exposure to lead from
the continued use of leaded avgas in piston-engine powered aircraft. We
also describe and request comment on additional information being
collected that will inform any future action.
    This ANPR is being issued to further respond to a petition
submitted by Friends of the Earth (FOE) in 2006. Emissions of lead from
piston-engine aircraft using leaded avgas comprise approximately half
of the national inventory of lead emitted to air. There are almost
20,000 airport facilities in the U.S. at which leaded avgas may be
used. EPA has long-standing concerns regarding exposure to lead,
particularly during childhood. The most recent review and revision of
the National Ambient Air Quality Standard (NAAQS) for lead, promulgated
in 2008, found that serious health effects occur at much lower levels
of lead in blood than previously identified and did not identify a safe
level of lead exposure.

Mine Ore Processing and Production Area Source Category and Addition to
Source Category List for Standards

AGENCY: Environmental Protection Agency (EPA).

ACTION: Proposed rule.

SUMMARY: EPA is proposing to add the gold mine ore processing and
production area source category to the list of source categories
subject to regulation under the hazardous air pollutant section of the
Clean Air Act (CAA) due to their mercury emissions. EPA is also
proposing national mercury emission standards for this category based
on the emissions level of the best performing facilities which are well
controlled for mercury. EPA is soliciting comments on all aspects of
this proposed rule.

DATES: Comments must be received on or before May 28, 2010 unless a
public hearing is requested by May 10, 2010. If a hearing is requested
on this proposed rule, written comments must be received by June 14,
2010. Under the Paperwork Reduction Act, comments on the information
collection provisions must be received by the Office of Management and
Budget (OMB) on or before May 28, 2010.

Draft Test Guidelines; Reopening of Comment Period

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice; reopening of comment period.

SUMMARY: EPA issued a notice in the Federal Register of January 27,
2010, concerning four draft test guidelines for product performance of
public health uses of antimicrobial agents. EPA received a request from
the public to extend the comment period. After further consideration,
EPA decided to reopen the comment period to allow additional time for
public comments. This document reopens the comment period for 60 days.

SUMMARY: This document contains a technical correction to the final
rule regarding the test procedures for general service fluorescent
lamps, incandescent reflector lamps, and general service incandescent
lamps, which was published in the Federal Register on July 6, 2009. In
that final rule, the U.S. Department of Energy (DOE) adopted amendments
to its test procedure regulations for the above-specified lamps.
However, due to a drafting error, part of the original wording was
inadvertently removed from the DOE test procedure regulations in the
Code of Federal Regulations (CFR). This final rule addresses this issue
and restores the correct and complete language to the regulations.

DATES: Effective on April 28, 2010.
