Exposure Factors Handbook: 2009 Update

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice of Peer-Review Workshop.

-----------------------------------------------------------------------

SUMMARY: EPA is announcing that Eastern Research Group, Inc. (ERG), an
EPA contractor for external scientific peer review, will convene an
independent panel of experts and organize and conduct an external peer-
review workshop on March 3-4, 2010, to review the external review draft
document titled, ``Exposure Factors Handbook 2009 Update'' (EPA/600/R-
09/052A). EPA previously announced the 60-day public comment period
(ending December 7, 2009) for the draft document in the Federal
Register on October 7, 2009 (74 FR 51592). The draft document was
prepared by the National Center for Environmental Assessment (NCEA)
within EPA's Office of Research and Development. The Exposure Factors
Handbook provides information on various physiological and behavioral
factors commonly used in assessing exposure to environmental chemicals.
The handbook was first published in 1989 and was updated in 1997. This
updated version incorporates data available since 1997 up to June 2009.
It also reflects the revisions made to the Child-Specific Exposure
Factors Handbook, which was updated and published in 2008. Each chapter
in the revised Exposure Factors Handbook presents recommended values
for the exposure factors covered in the chapter as well as a discussion
of the underlying data used in developing the recommendations.
The public comment period and the external peer-review workshop are
separate processes that provide opportunities for all interested
parties to comment on the document. EPA intends to forward public
comments submitted in accordance with the October 7, 2009, Federal
Register notice (74 FR 51592) to ERG, for consideration by the external
peer-review panel prior to the workshop. EPA will consider public
comments and recommendations from the expert panel workshop as EPA
finalizes the draft document.
EPA is releasing this draft document solely for the purpose of pre-
dissemination peer review under applicable information quality
guidelines. This document has not been formally disseminated by EPA. It
does not represent and should not be construed to represent any Agency
policy or determination.
ERG invites the public to register to attend this workshop as
observers. In addition, ERG invites the public to give oral comments at
the workshop regarding the draft document under review. Members of the
public interested in making oral comments at the workshop should also
provide ERG with an electronic copy of their comments. Space is
limited, and reservations will be accepted on a first-come, first-
served basis. The draft document and EPA's peer-review charge are only
available via the Internet on NCEA's home page under the Recent
Additions menu at http://www.epa.gov/ncea. In preparing a final report,
EPA will consider ERG's report of the comments and recommendations from
the external peer-review workshop and any public comments that EPA
received.

DATES: The peer-review panel workshop will begin on Wednesday, March 3,
2010, at 8 a.m., and will end on Thursday, March 4, 2010, at
approximately 12 p.m. Eastern Standard Time.

ADDRESSES: The peer-review workshop will be held at the Sheraton
Crystal City Hotel, 1800 Jefferson Davis Highway, Arlington, VA 22202.
The EPA contractor, ERG, is organizing, convening, and conducting the
peer-review workshop. To attend the workshop, register by February 24,
2010, by calling ERG at 781-674-7374 or toll free at 800-803-2833 (ask
for the EFH peer-review coordinator, Laurie Waite). You may register
via the Internet at https://www2.ergweb.com/projects/conferences/
peerreview/register-efh.htm
, or by sending a facsimile to 781-674-2906
(please reference: ``EFH peer-review workshop'' and include your name,

you would like to make oral comments at the workshop. The draft
``Exposure Factors Handbook: 2009 Update'' is only available via the
Internet on the National Center for Environmental Assessment's home
page under the Recent Additions menu at http://www.epa.gov/ncea. No
printed copies are available because of the size of the document.

Hazardous Material; Miscellaneous Packaging Amendments

AGENCY: Pipeline and Hazardous Materials Safety Administration (PHMSA),
DOT.

ACTION: Final rule.

-----------------------------------------------------------------------

SUMMARY: In this final rule, PHMSA is amending packaging requirements
in the Hazardous Materials Regulations to enhance compliance
flexibility, improve clarity, and reduce regulatory burdens.
Specifically, we are revising several packaging related definitions;
adding provisions to allow more flexibility when preparing and
transmitting closure instructions, including conditions under which
closure instructions may be transmitted electronically; adding a
requirement for shippers to retain packaging closure instructions;
incorporating new language that will allow for a practicable means of
stenciling the ``UN'' symbol on packagings; and clarifying a
requirement to document the methodology used when determining whether a
change in packaging configuration requires retesting as a new design or
may be considered a variation of a previously tested design. This final
rule also incorporates requirements for construction, maintenance, and
use of Large Packagings.

DATES: Effective Date: October 1, 2010.
Voluntary Compliance Date: Compliance with the requirements adopted
herein is authorized as of March 4, 2010. However, persons voluntarily
complying with these regulations should be aware that appeals may be
received and as a result of PHMSA's evaluation of these appeals, the
amendments adopted in this final rule may be revised accordingly.

Significant New Use Rules on Certain Chemical Substances

AGENCY: Environmental Protection Agency (EPA).

ACTION: Direct final rule.

-----------------------------------------------------------------------

SUMMARY: EPA is promulgating significant new use rules (SNURs) under
section 5(a)(2) of the Toxic Substances Control Act (TSCA) for 15
chemical substances which were the subject of premanufacture notices
(PMNs). Three of these chemical substances are subject to TSCA section
5(e) consent orders issued by EPA. This action requires persons who
intend to manufacture, import, or process any of these 15 chemical substances for an activity that is designated as a significant new use by this rule to notify EPA
at least 90 days before commencing that activity. The required
notification will provide EPA with the opportunity to evaluate the
intended use and, if necessary, to prohibit or limit that activity
before it occurs.

DATES: The effective date of this rule is April 2, 2010 without further
notice, unless EPA receives written adverse or critical comments, or
notice of intent to submit adverse or critical comments before March 3,
2010. This rule shall be promulgated for purposes of judicial review at
1 p.m. (e.s.t.) on February 16, 2010.
If EPA receives written adverse or critical comments, or notice of
intent to submit adverse or critical comments, on one or more of these

ANNOUNCEMENT 3

Subject: AGRICULTURE - NM. USDA. Departmental Management; Public meeting on BioPreferred\SM\ Complex Products and Assemblies Designation and Industry Training on Selling Biobased Products to the Federal Government

[Federal Register: February 1, 2010 (Volume 75, Number 20)]
[Notices]

DEPARTMENT OF AGRICULTURE

Departmental Management; Public meeting on BioPreferred\SM\
Complex Products and Assemblies Designation and Industry Training on
Selling Biobased Products to the Federal Government

AGENCY: Departmental Management, Office of Procurement and Property
Management, USDA.

ACTION: Notice of public meeting and industry training.

-----------------------------------------------------------------------

SUMMARY: The U.S. Department of Agriculture (USDA) will hold a public
meeting on February 24, 2010, for interested stakeholders to discuss
the issue of complex assembly products that contain biobased materials
and components. Complex assembly products are made of distinct
materials and components where some or all of the components contain
biobased materials. One example of a complex assembly product is an
office chair where the seat cushion, fabric, seat base and plastic
molding are produced using biobased materials.
This issue pertains to (1) the designation USDA of biobased
products for a Federal procurement preference, as mandated by the Food,
Conservation, and Energy Act of 2008, and (2) the potential
implications for complex assembly products under the pending ``USDA
Certified Biobased Product'' labeling program. Given the growing
importance of biobased products to consumers, industry, and government,
there is a clear need to assess the viability of complex products, and
to do so using an agreed-upon and credible process.
Prior to the public meeting, USDA will conduct training for
biobased manufacturers on February 23, 2010 from 1 p.m. to 5 p.m. (PST)
to provide useful information on selling biobased products to the
Federal government. Topics will include:
    1. Using BioPreferred tools to position your business to sell or
increase sales to the Federal government;
    2. The General Services Administration (GSA) Schedules/Programs
(also referred to as the Multiple Award Schedules and Federal Supply
Schedules) and GSA Advantage; and
    3. Selling products via the Department of Defense's (DOD) EMALL to
the Defense Logistics Agency (DLA), the Department of Defense's largest
logistics combat support agency.

Speakers will include representatives from GSA, DLA, and a former
government procurement official.

Dates

    Industry training: February 23, 2010, 1 p.m. to 5 p.m. (PST)
    Public meeting: February 24, 2010, 8:30 a.m. to 1 p.m. (PST)
