Light-Duty Vehicle Greenhouse Gas Emission Standards and

ACTION: Final rule.

SUMMARY: EPA and NHTSA are issuing this joint Final Rule to establish a
National Program consisting of new standards for light-duty vehicles
that will reduce greenhouse gas emissions and improve fuel economy.
This joint Final Rule is consistent with the National Fuel Efficiency
Policy announced by President Obama on May 19, 2009, responding to the
country's critical need to address global climate change and to reduce
oil consumption. EPA is finalizing greenhouse gas emissions standards
under the Clean Air Act, and NHTSA is finalizing Corporate Average Fuel
Economy standards under the Energy Policy and Conservation Act, as
amended. These standards apply to passenger cars, light-duty trucks,
and medium-duty passenger vehicles, covering model years 2012 through
2016, and represent a harmonized and consistent National Program. Under
the National Program, automobile manufacturers will be able to build a
single light-duty national fleet that satisfies all requirements under
both programs while ensuring that consumers still have a full range of
vehicle choices. NHTSA's final rule also constitutes the agency's
Record of Decision for purposes of its National Environmental Policy
Act (NEPA) analysis.

DATES: This final rule is effective on July 6, 2010, sixty days after
date of publication in the Federal Register. The incorporation by
reference of certain publications listed in this regulation is approved
by the Director of the Federal Register as of July 6, 2010.

SUMMARY: The U.S. Environmental Protection Agency (EPA) is announcing
the availability of literature searches for four IRIS assessments and
requesting scientific information on health effects that may result
from exposure to these chemical substances. EPA's IRIS is a human
health assessment program that evaluates quantitative and qualitative
risk information on effects that may result from exposure to specific
chemical substances found in the environment.

technology, and management issues. NACEPT is a committee of individuals
who represent diverse interests from academia, industry, non-
governmental organizations, and local, state, and tribal governments.
The purpose of this meeting is to discuss the Council's FY 20l0-FY 2012

Revisions to Energy Efficiency Enforcement Regulations

SUMMARY: The U.S. Department of Energy (DOE or the ``Department'')
intends to expand and revise its existing energy efficiency enforcement
regulations for certain consumer products and commercial and industrial
equipment covered under the Energy Policy and Conservation Act of 1975,
as amended (EPCA or the ``Act''). These regulations provide for
manufacturer submission of compliance statements and certification
reports to DOE, maintenance of compliance records by manufacturers, and
the availability of enforcement actions for improper certification or
upon a determination of noncompliance. To facilitate this process and
to allow interested parties to provide suggestions, comments, and
information, DOE is publishing this request for information. This
request identifies several areas on which DOE is particularly
interested in receiving information; however, any input and suggestions
considered relevant to the topic are welcome.

Tree Assistance Program

AGENCY: Farm Service Agency and Commodity Credit Corporation, USDA.

SUMMARY: This rule implements specific requirements for the Tree
Assistance Program (TAP) authorized by the Food, Conservation, and
Energy Act of 2008 (the 2008 Farm Bill). TAP provides disaster
assistance to eligible orchardists and nursery tree growers to replant
or rehabilitate trees, bushes, and vines that were lost due to natural
disaster. Orchardists and nursery tree growers who commercially raise
trees, bushes, and vines for which there were mortality losses in
excess of 15 percent, after adjustment for normal mortality, are
eligible for TAP payments. Eligible losses must have occurred between
January 1, 2008, and September 30, 2011. This rule specifies how the
TAP payments are calculated and when producers may apply for benefits.
This rule also removes regulations for prior tree disaster assistance
programs.

AGENCY: Minerals Management Service (MMS), Interior.

ACTION: Notice of indefinite postponement of comment period on and
cancellation of public meetings to scope for an Environmental Impact
Statement (EIS) for Proposed Mid-Atlantic Oil and Gas Lease Sale 220.

SUMMARY: This Notice serves to cancel scoping meetings and to postpone
the comment period on scoping for Sale 220 until further notice. Three
public scoping meetings that had been scheduled on May 12, 25, and 27,
in the Federal Register (Vol. 75, No. 82, page 22623) to solicit
information to assist MMS in preparing an EIS to evaluate potential
environmental effects of proposed Lease Sale 220 are hereby cancelled.
Also, the public scoping meeting scheduled for May 12, 2010, in
Norfolk, Virginia, to solicit public input on both Sale 220 and the
Geological & Geophysical Programmatic EIS on the Mid- and South
Atlantic OCS (G&G PEIS) is hereby cancelled. This Notice does not
affect the public scoping period for the G&G PEIS. The scoping period
for that PEIS ends on May 17, 2010 (see 75 FR 16830).
    Pursuant to the regulations implementing the procedural provisions
of the National Environmental Policy Act of 1969, as amended (42 U.S.C.
4321 et seq) (NEPA), MMS had reopened the scoping comment period on the
EIS for proposed Lease Sale 220 for a period of 45 days from the date
of the Federal Register notice on April 29, 2010. The closing date for
scoping under that notice was to be June 14, 2010. The scoping period
for Lease Sale 220 is now postponed until or unless we provide further
notification.

DATES: On April 29, 2010, MMS published a notice in the Federal
Register (Vol. 75, No. 82, page 22623) announcing the continuation of
scoping for a 45-day period and that three public meetings were
scheduled on:
    May 12 at Hilton Norfolk Airport in Norfolk, Virginia;
    May 25 at Princess Royale Oceanfront Hotel and Conference
Center, Ocean City, Maryland; and
    May 27 at Elizabeth City State University Fine Arts
Complex in Elizabeth City, North Carolina.
    These meetings are cancelled.
    Comments: Comments that are provided in the period between
publication of the notification reopening scoping on April 29, 2010,
and this notification of postponed scoping will be held together with
comments received during the initial scoping period of November 13,
2008 through January 13, 2009. No further comments are being solicited
for scoping of the Lease Sale 220 EIS pending decision by the Secretary
of the Interior.

to provide a comprehensive, integrated, and scientifically credible
global environmental assessment to support decision-making processes at
appropriate levels. Individuals may seek to nominate others (or

through the U.S. government. For those who wish to submit their
nominations through the U.S. government, your nomination must be
submitted to UNEP at the Web site above, and the nomination must also
be received at the U.S. Department of State, Office of Environmental
Policy, which is coordinating the U.S. Government nomination process,
no later than May 12, 2010. The remainder of this announcement provides
background information and describes how to submit recommendations.
    The Global Environment Outlook is the primary assessment process of
the UN Environment Programme (UNEP), which helps keep the global
environment under review. It is a tool that informs decision-making,
focusing on assessment priorities and analyzing policy challenges and
opportunities to provide policy response options. It is
also a communications tool that brings together diverse stakeholder
groups, builds capacity and aims to raise awareness on the status and
trends of the environment.
    Experts are expected to have a thorough understanding in one or
more of the following areas: Environmental science; environment and
development priorities, challenges and policy; and environmental
management or governance. UNEP will select nominees by matching
expertise to specific roles, paying due regard to disciplinary, gender
and geographical balance. Details of the GEO-5 nominating process may

which they are nominated, should they be selected to do so by GEO.
Nomination by the U.S. Government to GEO-5 does not imply a commitment
by the U.S. Government to provide financial support for participation.
    UNEP may provide travel and subsistence costs for non-Federal
participants if requested by the participant, subject to the
availability of resources. Additional guidance on compensation of

Lead; Amendment to the Opt-Out and Recordkeeping Provisions in

SUMMARY: EPA is finalizing several revisions to the Lead Renovation,
Repair, and Painting Program (RRP) rule that published in the Federal
Register on April 22, 2008. The RRP rule established accreditation,
training, certification, and recordkeeping requirements as well as work
practice standards on persons performing renovations for compensation
in most pre-1978 housing and child-occupied facilities. In this
document, EPA is eliminating the ``opt-out'' provision that currently
exempts a renovation firm from the training and work practice
requirements of the rule where the firm obtains a certification from
the owner of a residence he or she occupies that no child under age 6
or pregnant women resides in the home and the home is not a child-
occupied facility. EPA is also requiring renovation firms to provide a
copy of the records demonstrating compliance with the training and work
practice requirements of the RRP rule to the owner and, if different,
the occupant of the building being renovated or the operator of the
child-occupied facility. In addition, the rule makes minor changes to
the certification, accreditation and state authorization requirements.

SUMMARY: EPA is proposing several revisions to the 2008 Lead

facilities. EPA is particularly concerned about dust-lead hazards
generated by renovations because of the well-documented toxicity of
lead, especially to younger children. This proposal includes additional
requirements designed to ensure that lead-based paint hazards generated
by renovation work are adequately cleaned after renovation work is
finished and before the work areas are re-occupied. Specifically, EPA
is proposing to require dust wipe testing after many renovations
covered by the RRP rule. For a subset of jobs involving demolition or
removal of plaster through destructive means or the disturbance of
paint using machines designed to remove paint through high-speed
operation, such as power sanders or abrasive blasters, this proposal
would also require the renovation firm to demonstrate, through dust
wipe testing, that dust-lead levels remaining in the work area are
below regulatory levels.

on the exteriors of public and commercial buildings and to determine
whether lead-based paint hazards are created by interior renovation,
repair, and painting projects in public and commercial buildings. For

SUMMARY: The U.S. Department of Energy (DOE) is initiating the
rulemaking and data collection process to consider amended energy
conservation standards for commercial refrigeration equipment (CRE).
DOE will hold a public meeting to discuss and receive comments on its
planned analytical approach and issues it will address in this
rulemaking proceeding. DOE welcomes written comments and relevant data
from the public on any subject within the scope of this rulemaking. To
inform interested parties and to facilitate this process, DOE has
prepared a framework document that details the analytical approach and
identifies several issues on which DOE is particularly interested in
receiving comment.

and we do not expect funds to become available in the future.

SUMMARY: NMFS issues this emergency rule to close a portion of the Gulf
of Mexico (Gulf) exclusive economic zone (EEZ) to all fishing, in
response to the Deepwater Horizon oil spill. The closure was applicable
May 2, 2010, and will remain in effect for 10 days, unless conditions
allow NMFS to terminate it sooner. NMFS will continue to monitor and
evaluate the oil spill and its impacts on Gulf fisheries and will take
immediate and appropriate action to extend or reduce this closed area.
This closure is implemented for public safety.

DATES: This rule is effective May 3, 2010 through 12:01 a.m., local
time, May 12, 2010. The closure was applicable on May 2, 2010. Comments

non-transportation renewable energy that results in a reduction in
greenhouse gases. The Agency will authorize up to $40 million in
funding for this program for fiscal year (FY) 2010.

SUMMARY: The United States Environmental Protection Agency is
announcing the 2010 Annual Meeting of the Ozone Transport Commission
(OTC). This OTC meeting will explore options available for reducing
ground-level ozone precursors in a multi-pollutant context. The
Commission will be evaluating potential measures and considering
actions in areas such as performance standards for electric generating
units (EGUs) on high electric demand days, oil and gas boilers serving
EGUs, small natural gas boilers, stationary generators, energy
security/energy efficiency, architectural industrial and maintenance
coatings, consumer products, industrial commercial and institutional
(ICI) boilers, vapor recovery at gas stations, large above ground
storage tanks, seaports, aftermarket catalysts, lightering, and non-
road idling.

SUMMARY: We, the U.S. Fish and Wildlife Service, announce the reopening
of the public comment period on the proposed designation of critical
habitat for the polar bear (Ursus maritimus) under the Endangered
Species Act of 1973, as amended (Act). We also announce the
availability of a draft economic analysis (DEA), corrections to our
proposed boundaries for sea-ice critical habitat, our intention to hold
two public hearings to provide the public with an opportunity to submit
testimony on the proposed designation of critical habitat for the polar
bear and on the DEA, and an amended required determinations section of
the proposal. We are reopening the comment period to allow all
interested parties an opportunity to provide additional comment on the
proposed rule, the associated DEA, corrections to our proposed
boundaries for sea-ice critical habitat, and the amended required
determinations section. If you submitted comments previously, you do
not need to resubmit them because we have already incorporated them
into the public record and will fully consider them in preparation of
the final rule.

    Public Hearings: We will hold two public hearings, one on June 15,
2010, from 7-10 p.m. in Anchorage, Alaska, and another on June 17,

DTE ENERGY; Enrico Fermi Atomic Power Plant Unit 1; Exemption
From Certain Low-Level Waste Shipment Tracking Requirements In 10 CFR
Part 20 Appendix G

1.0 Background

    DTE Energy (DTE) is the licensee and holder of Facility Operating
License No. DPR-9 issued for Enrico Fermi Atomic Power Plant, Unit 1
(Fermi-1), located in Monroe County, Michigan. Fermi-1 is a permanently
shutdown nuclear reactor facility. DTE is in the process of
decommissioning Fermi-1 and radioactive waste shipments from the site
are ongoing and expected to increase over the next year. During the
decommissioning process, large volumes of slightly contaminated
concrete rubble and debris are generated that require shipment for
disposal in offsite low-level radioactive waste disposal sites.
Experience at other decommissioning nuclear power facilities has shown
that, due primarily to the volume of radioactive waste; licensees have
encountered an increase in the number of routine shipments that take
longer than 20 days from transfer to the shipper to receipt
acknowledgment from the disposal site. Each shipment with receipt
notifications greater than 20 days requires a special investigation and
report to the U.S. Nuclear Regulatory Commission (NRC or the
Commission) which the licensee believes to be burdensome and
unnecessary to meet the intent of the regulation. . . .
4.0 Conclusion

    Accordingly, the Commission has determined that, pursuant to 10 CFR
20.2301, the exemption requested by DTE in its November 13, 2009,
letter is authorized by law and will not result in undue hazards to
life or property. Therefore, the Commission hereby grants DTE an
exemption to extend the 20-day investigation and reporting requirements
for shipments of low-level radioactive waste, as required by 10 CFR
part 20, appendix G, section III.E, to 35 days.
    Pursuant to 10 CFR 51.31, the Commission has determined that the
granting of this exemption will not have a significant effect on the
quality of the human environment as documented in Federal Register (FR)
notice 75 FR 20867, April 21, 2010.
    This exemption is effective upon issuance.
