SUMMARY: This regulation establishes tolerances for residues of
chlorantraniliprole in or on almonds; nut, tree, crop group 14, and
pistachios. E.I. Du Pont de Nemours and Company requested these
tolerances under the Federal Food, Drug, and Cosmetic Act (FFDCA). This
regulation also establishes time-limited rotational crop tolerances for
residues of chlorantraniliprole in or on cowpeas, forage and hay; field
peas, vines and hay; forage, fodder and straw of cereal grains, crop
group 16; grass forage, fodder and hay, crop group 17; leaves of root
and tuber vegetables, crop group 2, leeks, nongrass animal feeds
(forage, fodder, straw and hay), crop group 18; okra; onions, green;
onions, Welsh; peanuts, hay; shallots; soybeans, forage and hay;
strawberries and sugarcane, sugar. The time-limited tolerances expire
on April 25, 2010.

DATES: This regulation is effective June 26, 2009. Objections and
requests for hearings must be received on or before August 25, 2009,
and must be filed in accordance with the instructions provided in 40
CFR part 178 (see also Unit I.C. of the SUPPLEMENTARY INFORMATION).

tolerances for the herbicides metolachlor and S-metolachlor and correct
the tolerance guava (from guave) on bifenazate and buprofezin and 2,4-D
on cranberry. The regulatory actions proposed in this document are in
follow-up to the Agency's reregistration program under the Federal
Insecticide, Fungicide, and Rodenticide Act (FIFRA), and tolerance
reassessment program under the Federal Food, Drug, and Cosmetic Act
(FFDCA), section 408(q).

SUMMARY: This notice announces the Department of Energy's (DOE's)
decision, pursuant to 10 CFR 1021.343(c), that it is in the interest of
public welfare to grant a variance from certain requirements of its
National Environmental Policy Act (NEPA) Implementing Procedures (10
CFR part 1021) in regard to the review of applications under the
Electric Drive Vehicle Battery and Component Manufacturing Initiative
funded by the American Recovery and Reinvestment Act of 2009 (Recovery
Act). The variance is limited to certain requirements identified in 10
CFR 1021.216, Procurement, Financial Assistance, and Joint Ventures.
The variance in no way affects the requirement to prepare an
environmental assessment or environmental impact statement for any
application selected for funding. The merit review of applications in
response to this funding opportunity will include consideration of the
potentially significant environmental impacts of the projects proposed
for funding that are within the competitive range. By providing this
variance, DOE can reduce the time needed to select applications for
possible future funding consistent with the sense of urgency
underpinning the Recovery Act.

Change (UNFCCC), provide updates on recent developments, and solicit
individual input from participants. The purpose of the industry
roundtable is to allow private sector stakeholders, particularly
industry and trade associations, to advise U.S. officials on the impact
a new UNFCCC agreement could have on their respective operations and on
associated commercial opportunities. The DOC anticipates additional
outreach events will be held throughout the United States.

Reorganization and Name Change for the Office of Solid Waste

SUMMARY: On January 18, 2009, the Office of Solid Waste (OSW) was
reorganized and changed its name to the Office of Resource Conservation
and Recovery (ORCR). The name change reflects the breadth of the
responsibilities/authorities that Congress provided to EPA under the
Resource Conservation and Recovery Act (RCRA), the primary authorizing
statute. ORCR has three divisions, which consolidate the operations of
the six divisions under the OSW structure. This reorganization will
create a more efficient structure, consistent with current program
priorities and resource levels, and will enable EPA to better serve the
needs of the public and its key stakeholders over the next 5-10 years.
EPA has increased focus on resource conservation and materials
management; it is expected that focus on this important aspect of the
RCRA program will continue, while maintaining a strong waste management
regulatory and implementation program. EPA is taking final action to
amend the Code of Federal Regulations (CFR) to reflect the
reorganization and name change of the Office of Solid Waste.

SUMMARY: EPA is revising the area source category list by changing the
name of the ``Secondary Aluminum Production'' category to ``Aluminum
Foundries'' and the ``Nonferrous Foundries, not elsewhere classified
(nec)'' category to ``Other Nonferrous Foundries.'' At the same time,
EPA is issuing final national emission standards for the Aluminum
Foundries, Copper Foundries, and Other Nonferrous Foundries area source
categories. These final emission standards for new and existing sources
reflect EPA's determination regarding the generally available control
technologies or management practices (GACT) for each of the three area
source categories.

DATES: The final rule is effective on June 25, 2009. The incorporation

as of June 25, 2009.

rulemaking, the CSB seeks to obtain comments on how best to proceed
with implementing this requirement. The CSB will use this information
in the development of a proposed and then a final rule.

standards

SUMMARY: By a Notice in the Federal Register (73 FR 76736, December 16,
2008), the Tennessee Valley Authority (TVA) initially requested
comments on certain standards that TVA is considering adopting for
itself and the distributors of TVA power pertaining to certain energy
efficiency and Smart Grid standards. The standards being considered are
Integrated Resource Planning, Rate Design Modifications to Promote
Energy Efficiency Investments, Consideration of Smart Grid Investments,
and Smart Grid Information listed in section 111(d) of the Public
Utility Regulatory Policies Act of 1978 (Pub. L. 95-617) as amended by
the Energy Independence and Security Act of 2007 (Pub. L. 110-140). TVA
staff has developed a report that reviews each standard and makes a
preliminary recommendation with respect to each standard. TVA has
posted the report on the TVA Web site (http://www.tva.com/purpa). The
standards will be considered on the basis of their effect on
conservation of energy, efficient use of facilities and resources,
equity among electric consumers, and the objectives of the Tennessee
Valley Authority Act. As part of the process of considering the
standards, comments are requested from the public on the TVA staff
report. TVA is also extending the comment period on the standards
themselves, which are set out below.

Protection of Stratospheric Ozone: Allocation of Essential Use
Allowances for Calendar Year 2009

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: With this action, EPA is allocating essential use allowances
for import and production of Class I ozone-depleting substances for
calendar year 2009. Essential use allowances enable a person to obtain
controlled Class I ozone depleting substances as part of an exemption
to the regulatory ban on the production and import of these chemicals,
which became effective January 1, 1996. EPA allocates essential use
allowances for production and import of a specific quantity of Class I
substances solely for the designated essential purpose. The allocation
in this action is 63.0 metric tons of chlorofluorocarbons for use in
metered dose inhalers for 2009.

Regulation of Fuels and Fuel Additives: Modifications to
Renewable Fuel Standard Program Requirements

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: EPA is finalizing amendments to the Renewable Fuel Standard
program requirements. Following publication of the May 1, 2007, final
rule promulgating the Renewable Fuel Standard regulations, EPA
discovered a number of technical errors and areas within the
regulations that could benefit from clarification or modification. In
parallel proposed and direct final rules published on October 8, 2008,
EPA proposed to amend the regulations to make the appropriate
corrections, clarifications and modifications. However, EPA received
adverse comment on several provisions in the parallel proposed and
direct final rules and, on November 26, 2008, withdrew those provisions
from the direct final rule that drew adverse comment. In today's
action, EPA is addressing the comments received on the portions of the
direct final rule that were withdrawn and is finalizing those withdrawn
provisions with minor clarifying changes.

Significant New Use Rules on Certain Chemical Substances

AGENCY: Environmental Protection Agency (EPA).

ACTION: Direct final rule.

SUMMARY: EPA is promulgating significant new use rules (SNURs) under
section 5(a)(2) of the Toxic Substances Control Act (TSCA) for 23
chemical substances which were the subject of premanufacture notices
(PMNs). Four of these chemical substances are subject to TSCA section
5(e) consent orders issued by EPA. This action requires persons who
intend to manufacture, import, or process any of these 23 chemical
substances for an activity that is designated as a significant new use
by this rule to notify EPA at least 90 days before commencing that
activity. The required notification will provide EPA with the
opportunity to evaluate the intended use and, if necessary, to prohibit
or limit that activity before it occurs.

DATES: The effective date of this rule is August 24, 2009 without
further notice, unless EPA receives written adverse or critical
comments, or notice of intent to submit adverse or critical comments
before July 24, 2009. This rule shall be promulgated for purposes of

    If EPA receives written adverse or critical comments, or notice of
intent to submit adverse or critical comments, on one or more of these
SNURs before July 24, 2009, EPA will withdraw the relevant sections of

critical comments were received, providing a 30-day period for public

regulated National Pollutant Discharge Elimination System (NPDES)
facilities in reporting DMRs beginning June 22, 2009. Additional
States, Tribes, and Territories may adopt Network Discharge Monitoring
Report (NetDMR) and enable their regulated NPDES facilities to begin
utilizing the electronic reporting tool. NetDMR provides an
Internet-based reporting tool for NPDES facilities to electronically
sign and submit DMRs. NetDMR allows participants to discontinue mailing
in hard copy forms under 40 CFR 122.41 and 403.12.

uranium in near-surface radioactive waste disposal facilities. The
public workshops are intended to solicit the views of representatives
of interests that may be affected by the rulemaking. Members of the
public are invited to provide written comments on the issues presented
in this notice and to attend the workshops to provide feedback on the
potential rulemaking. The public workshops will be held in Rockville,
Maryland on September 2-3, 2009 and in Salt Lake City, Utah on
September 23-24, 2009.

Notice of Lodging of Consent Decree Under the Toxic Substances
Control Act

    Notice is hereby given that on June 16, 2009 a proposed Consent
Decree in United States v. Wallside, Inc., Civil Action No. 2:09-12317-
AC-DAS, was lodged with the United States District Court for the
Eastern District of Michigan. The consent decree settles claims against
a window manufacturing and replacement corporation located outside of
Detroit, Michigan. The claims were brought on behalf of the
Environmental Protection Agency (``U.S. EPA'') under the Toxic
Substances Control Act, 15 U.S.C. 2601 et seq., and on behalf of the
State of Michigan Department of Community Health (``Michigan DCH'')
under the Michigan Lead Abatement Act, 1998 Mich. Pub. Acts 219 1 et
seq., Mich. Comp. Laws Ann. 333.5451 et seq. The Plaintiffs allege in
the complaint that the Settling Defendant failed to make one or more of
the disclosures or to complete one or more of the disclosure activities
required by Title IV, 406(b) of the Toxic Substances Control Act.
    Under the Consent Decree, the Settling Defendant will pay a civil
penalty of $100,000 and will certify that it is now in compliance and
will continue to comply with residential lead based paint hazard
notification requirements. The Settling Defendant will also perform two
Supplemental Environmental Projects (``SEPs''). For one SEP the
Settling Defendant will provide $350,000 worth of windows to the State
of Michigan for installation in housing built before 1978. For the
other SEP, the Settling Defendant will voluntarily employ lead safe
work practices in advance of being subject to Federal regulations which
will become effective in April of 2010 imposing similar lead safe work
practices requirements on all renovators of pre-1978 properties.
    The Department of Justice will receive for a period of thirty (30)
days from the date of this publication comments relating to the
