AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: This regulation establishes tolerances for residues of
flumioxazin in or on the commodity fish, freshwater. Valent U.S.A.
Corporation requested these tolerances under the Federal Food, Drug,
and Cosmetic Act (FFDCA).

DATES: This regulation is effective November 10, 2010. Objections and
requests for hearings must be received on or before January 10, 2011,
and must be filed in accordance with the instructions provided in 40
CFR part 178 (see also Unit I.C. of the SUPPLEMENTARY INFORMATION).

Draft Toxicological Review of Hexavalent Chromium: In Support of

SUMMARY: EPA published a 60-day public comment period on September 30,
2010 (75 FR 60454) for the external review draft human health
assessment titled, ``Toxicological Review of Hexavalent Chromium: In
Support of Summary Information on the Integrated Risk Information
System (IRIS)'' EPA/635/R-10/004C. We are extending the public comment
period 30 days at the request of the American Chemistry Council (ACC).
The draft assessment was prepared by the National Center for
Environmental Assessment (NCEA) within the EPA Office of Research and
Development (ORD). EPA released this draft assessment solely for the
purpose of pre-dissemination peer review under applicable information
quality guidelines. This draft assessment has not been formally
disseminated by EPA. It does not represent and should not be construed
to represent any Agency policy or determination. After public review
and comment, an EPA contractor will convene an expert panel for
independent external peer review of this draft assessment. The public
comment period and external peer review meeting are separate processes
that provide opportunities for all interested parties to comment on the
assessment. The external peer review meeting will be scheduled at a
later date and announced in the Federal Register. Public comments
submitted during the public comment period will be provided to the
external peer reviewers before the panel meeting and considered by EPA
in the disposition of public comments. Public comments received after
the public comment period closes will not be submitted to the external
peer reviewers and will only be considered by EPA if time permits.

DATES: The public comment period will be extended from November 29,
2010 to December 29, 2010. Comments should be in writing and must be
received by EPA by December 29, 2010.

Draft Toxicological Review of Urea: In Support of Summary

SUMMARY: EPA is announcing that Versar, Inc., an EPA contractor for
external scientific peer review, will convene an independent panel of
experts and organize and conduct an external peer review meeting to
review the draft human health assessment titled, ``Toxicological Review
of Urea: In Support of Summary Information on the Integrated Risk
Information System (IRIS)'' (EPA/635/R-10/005). The draft assessment
was prepared by the National Center for Environmental Assessment (NCEA)
within the EPA Office of Research and Development.
    On September 28 EPA released this draft assessment [75 FR 59716]
solely for the purpose of pre-dissemination peer review under
applicable information quality guidelines. This draft assessment has
not been formally disseminated by EPA. It does not represent and should
not be construed to represent any Agency policy or determination.
    Versar, Inc. invites the public to register to attend this workshop
as observers. In addition, Versar, Inc. invites the public to give
brief oral comments and/or provide written comments at the workshop
regarding the draft assessment under review. Time is limited, and
reservations will be accepted on a first-come, first-served basis. In
preparing a final report, EPA will consider Versar, Inc.'s report of
the comments and recommendations from the external peer review workshop
and any written public comments that EPA receives in accordance with
this notice.

Update of Noxious Weed Regulations

AGENCY: Animal and Plant Health Inspection Service, USDA.

ACTION: Final rule.

SUMMARY: We are amending the regulations governing the importation and
interstate movement of noxious
weeds by adding definitions of terms used in the regulations, adding
details regarding the process of applying for the permits used to
import or move noxious weeds, adding a requirement for the treatment of
niger seed, and adding provisions for petitioning to add a taxon to or
remove a taxon from the noxious weed lists. These changes will update
the regulations to reflect current statutory authority and program
operations and improve the effectiveness of the regulations. We are
also adding seven taxa to the list of terrestrial noxious weeds and to
the list of seeds with no tolerances applicable to their introduction.
This action will prevent the introduction or dissemination of these
noxious weeds into or within the United States.

1. Authority

    This Notice of Intent (NOI) is published pursuant to the
regulations (40 CFR 1501.7) implementing the provisions of the National
Environmental Policy Act (NEPA) of 1969 as amended (42 U.S.C. 4321 et
seq. (1988)).

2. Purpose of the Notice of Intent

    The BOEMRE is announcing its intent to prepare a supplemental
environmental impact statement (SEIS) for Western Planning Area (WPA)
Lease Sale 218 and Central Planning Area (CPA) Lease Sale 222 in the
2007-2012 5-Year OCS Program. The proposed sales are in the Gulf of
Mexico's WPA off the States of Texas and Louisiana and in the CPA off
the States of Texas, Louisiana, Mississippi, and Alabama. The SEIS will
update the environmental and socioeconomic analyses in the Gulf of
Mexico OCS Oil and Gas Lease Sales: 2007-2012; WPA Sales 204, 207, 210,
215, and 218; CPA Sales 205, 206, 208, 213, 216, and 222, Final
Environmental Impact Statement (OCS EIS/EA MMS 2007-018) (Multisale
EIS), the NOI for which was published in the Federal Register on March
7, 2006 (Vol. 71, No. 44, Page 11444). The SEIS will also update the
environmental and socioeconomic analyses in the GOM OCS Oil and Gas
Lease Sales: 2009-2012; CPA Sales 208, 213, 216, and 222; WPA Sales
210, 215, and 218; Final SEIS (OCS EIS/EA MMS 2008-041), the NOI for
which was published in the Federal Register on September 10, 2007 (Vol.
72, No. 174, Page 51654). The SEIS for 2009-2012 was prepared after the
Gulf of Mexico Energy and Security Act (Pub. L. 109-432, December 20,
2006), which required BOEMRE to offer approximately 5.8 million acres
in the CPA (``181 South Area'') for oil and gas leasing, ``as soon as
practicable after the date of enactment of this Act.'' Lease Sales 218
and 222 are proposed to be held in late 2011 or early 2012, before the
end of the 2007-2012 5-Year OCS Program.
    A SEIS is deemed appropriate to supplement the NEPA documents cited
above for these lease sales in order to consider new circumstances and
information arising, among other things, from the Deepwater Horizon
blowout and spill. The SEIS analysis will focus on updating the
baseline conditions and potential environmental effects of oil and
natural gas leasing, exploration, development, and production in the
WPA and CPA.
    Scoping Process: Federal, State, and local government agencies, and
other interested parties may assist BOEMRE in determining the
significant issues and alternatives to be analyzed in the SEIS. Early
planning and consultation is important for ensuring that all interests
and concerns are communicated to the Department of the Interior for
future decisions in the leasing process pursuant to the Outer
Continental Shelf Lands Act and regulations at 30 CFR 256. At a
minimum, alternatives that will be considered for the sales are no
action (i.e., cancel the sale) or to exclude certain areas from the
sales. Input is requested on additional measures (e.g., technology or
water depth limitations) that would maximize avoidance and minimize
impacts to environmental and socioeconomic resources. Formal
consultation with other Federal agencies, the affected states, and the
public will be carried out during the NEPA process and will be
completed before a final decision is made on Lease Sales 218 and 222.

Knowledge, Skills and Abilities (KSAs) applicable to energy efficiency
retrofits of single family homes which together constitute the
Workforce Guidelines for Home Energy Upgrades (``Workforce
Guidelines''). These Workforce Guidelines are intended for voluntary
adoption by the Weatherization Assistance Program, EPA Home Performance
with Energy Star program partners, State, municipal and utility
ratepayer-funded energy efficiency retrofit programs, and private
sector home performance contractors, as well as any other organization,
company, or individual involved in energy efficiency retrofits of
residential homes. Through this notice, DOE also requests public
comments on the Workforce Guidelines.

SUMMARY: EPA is taking direct final action on several revisions to
EPA's mobile source emission programs standards and test procedures.
EPA believes that each of these is minor and non-controversial in
nature. Most of the changes arise from the results of the collaborative
test program and related technical work we conducted for the highway
heavy-duty diesel in-use testing program. Most noteworthy here is the
adoption of a particulate matter measurement allowance for use with
portable emission measurement systems. Related to this are two
provisions to align the in-use program timing requirements with
completion of the program as required in current regulations and the
incorporation of revisions to a few technical requirements in the
testing regulations based on information learned in this and one other
test program. Finally, the DFR modifies a few transitional
flexibilities for locomotive, recreational marine, and Tier 4 nonroad
engines and incorporates a handful of minor corrections.

unless EPA receives adverse comment by December 8, 2010 on any

SUMMARY: EPA issued a final rule in the Federal Register of August 18,
2010, concerning the establishment, reassessment, modification and
revoking of tolerances for residues of flubendiamide, in or on multiple
food and livestock commodities. This document is being issued to
correct typographical errors in the referenced rule, specifically, to
revise incorrect tolerance values for the established tolerances for
corn, field, grain; corn, field, stover; corn, sweet, stover; and
cotton gin byproducts.

Direct Final Rule Staying Numeric Limitation for the Construction
and Development Point Source Category

AGENCY: Environmental Protection Agency (EPA).

ACTION: Direct final rule.

SUMMARY: EPA is taking direct final action to stay the numeric effluent
limitation of 280 NTU and associated monitoring requirements for the
Construction and Development Point Source Category. This action is
necessary so that EPA can reconsider the record basis for calculating
the numeric effluent limitation. EPA expects to move expeditiously with
its reconsideration, and will remove the stay when such reconsideration
is completed.

DATES: This rule is effective on January 4, 2011 without further
notice, unless EPA receives adverse comment by December 6, 2010 for 40
CFR 450.22(a) and (b), which are stayed indefinitely. If EPA receives
adverse comment, we will publish a timely withdrawal in the Federal
Register informing the public that the rule will not take effect.

proposing to amend the significant new use rule (SNUR) for 2-Propen-1-
one, 1-(4-morpholinyl)- (CAS No. 5117-12-4) to allow certain uses
without requiring a significant new use notice (SNUN). EPA
is proposing this amendment based on review of new toxicity test data
and receipt of a SNUN for this chemical substance. The proposed amended
SNUR would continue to require a SNUN for new uses that may involve
significant changes in human exposure.

SUMMARY: EPA proposes to revise its regulations governing procedures
for the satisfaction of data requirements under the Federal
Insecticide, Fungicide, and Rodenticide Act (FIFRA). These provisions
include, among other things, procedures for the protection of exclusive
use and data compensation rights of data submitters. The proposed
revisions would update the regulations, which have not been revised
since issuance in 1984, to accommodate statutory and procedural changes
that have occurred since that time. The revisions would also make minor
changes to clarify the regulations. The revisions would simplify the
procedures and reduce burdens for certain data submitters.

Notice of Availability of a Draft Environmental Impact Statement
(DEIS) for New Medium- and Heavy-Duty Fuel Efficiency Improvement
Program

AGENCY: National Highway Traffic Safety Administration (NHTSA),
Department of Transportation (DOT).

ACTION: Notice of availability of a Draft Environmental Impact
Statement (DEIS).

SUMMARY: NHTSA has prepared a DEIS to disclose and analyze the
potential environmental impacts of the agency's newly proposed fuel
consumption standards for commercial medium- and heavy-duty on-highway
vehicles and work trucks (``HD vehicles''), which NHTSA recently
proposed pursuant to the Energy Independence and Security Act of 2007.
NHTSA invites Federal, State, and local agencies, Indian tribes, and
the public to submit written comments on the DEIS using the
instructions set forth in this notice. To facilitate review of the
DEIS, NHTSA has posted the DEIS on its Web site (http://www.nhtsa.gov/
fuel-economy
) and placed it in the agency's docket, identified by the
docket number at the beginning of this notice. NHTSA will consider all
public comments received on the DEIS in preparing final NEPA documents
to support final fuel consumption standards, which NHTSA plans to issue
next year.

DATES: To ensure that NHTSA has the opportunity to consider comments on
the DEIS, NHTSA must receive written comments by January 3, 2011. NHTSA
will try to consider comments received after that date to the extent
the NEPA and rulemaking schedules allow, but NHTSA cannot ensure that
it will be able to do so.
