Methoxyfenozide; Pesticide Tolerances

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: This regulation establishes tolerances for residues of
methoxyfenozide in or on citrus oil and fruit, citrus, group 10 with
regional registrations; and corn, pop, grain; corn, pop, stover; pea,
dry seed; and pomegranate. The Interregional Research Project No. 4
(IR-4) requested these tolerances under the Federal Food, Drug, and
Cosmetic Act (FFDCA).

DATES: This regulation is effective September 2, 2009. Objections and
requests for hearings must be received on or before November 2, 2009,
and must be filed in accordance with the instructions provided in 40
CFR part 178 (see also Unit I.C. of the SUPPLEMENTARY INFORMATION).

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice of document availability for public comment.

SUMMARY: The Environmental Protection Agency (EPA) is announcing a 30-
day public comment period for the external peer review draft of
``Recommended Toxicity Equivalency Factors (TEFs) for Human Health Risk
Assessments of Dioxin and Dioxin-Like Compounds,'' a draft guidance
document. An EPA contractor for external peer review will convene a
panel of experts and will organize and conduct an independent expert
external peer review meeting to review the draft document. All comments
received by the closing date of October 2, 2009 will be shared with the
external peer review panel for their consideration. Comments received
after the close of the comment period may be considered by EPA when it
finalizes the document. This draft guidance document does not represent
and should not be construed to represent any EPA policy, viewpoint, or
determination. Members of the public may obtain the draft document from
http://www.regulations.gov; or http://www.epa.gov/raf/hhtefguidance; or
from Seema Schappelle via the contact information below. The public
comment period and external peer review are separate processes that
provide opportunities for all interested parties to comment on the
document.
    The external expert peer review will be conducted by letter and
open teleconference in the fall 2009 time frame. The panel may consider
public comments received in the official public docket for this
activity under docket ID number EPA-HQ-ORD-2009-0605. The draft
document is available at http://www.epa.gov/raf/hhtefguidance. In
preparing a final document, EPA intends to consider the public comments
submitted to EPA's docket during the public comment period and the
comments and recommendations from the external peer reviewers.
    EPA is releasing this draft document solely for the purpose of pre-
dissemination peer review under applicable information quality
guidelines. This document has not been formally disseminated by the
EPA. It does not represent and should not be construed to represent any
Agency policy or determination.

SUMMARY: The U.S. Department of Commerce (DOC) will host a one-day
conferences for participants in the agribusiness industry during which
senior U.S. government officials will inform private sector
stakeholders, particularly manufacturers of irrigation and agricultural
equipment and relevant alternative energy technology, food processors,
and specialized service providers, of Commerce Department programs,
services, and data that may be of assistance to them in reducing their
consumption of water and energy. By lowering U.S. companies' costs
associated with water and energy consumption, Commerce Department
programs can assist American firms to be more competitive in domestic
and international markets, as well as advance U.S. Government
objectives with respect to sustainability and climate change. A
secondary purpose is to inform attendees of preparations for the United
Nations Framework Convention on Climate Change (UNFCCC) negotiations
and for them to advise U.S. officials on the impact a new UNFCCC
agreement could have on their respective operations and on associated
commercial opportunities.
    The conference will be held in Fresno, California at the Holiday
Inn Downtown.

SUMMARY: EPA is announcing the availability and seeking comment on a
July 23, 2009 petition from the American Bird Conservancy (ABC),
requesting that EPA revoke tolerances established under the Federal
Food, Drug and Cosmetic Act (FFDCA), section 408, for uses of 13
pesticides with no associated U.S. registrations. ABC claims that
maintaining these tolerances allows Central and South American
countries to continue using these pesticides on crops for which the
United States has already determined there are unacceptable risks for
U.S. protected migratory birds.

CHEMICAL SAFETY AND HAZARD INVESTIGATION BOARD

Sunshine Act Meeting--September 24, 2009--6:30 pm

    In connection with its investigation into the cause of a February
7, 2008, an explosion and fire at the Imperial Sugar refinery northwest
of Savannah, Georgia, the Chemical Safety and Hazard Investigation
Board announces that it will convene a public meeting on September 24,
2009, starting at 6:30 pm at the Hilton Savannah DeSoto--15 East
Liberty Street, Savannah, Georgia.
    At the meeting CSB staff will present to the Board the results of
their investigation into this incident. Key issues involved in the
investigation concern combustible dust hazard recognition, minimizing
combustible dust accumulation in the workplace, and equipment design
and maintenance. This will be followed by a public comment period prior
to a Board vote on the report.
    Incident: On February 7, 2008, at about 7:15 p.m., a series of
sugar dust explosions at the Imperial Sugar manufacturing facility in
Port Wentworth, Georgia, resulted in 14 worker fatalities and 36
injuries. Eight workers died at the scene and six eventually succumbed
to their injuries at the Augusta Burn Center. The explosions and
subsequent fires destroyed the sugar packing buildings, palletizer
room, and silos, and severely damaged the bulk train car loading area
and parts of the sugar refinery.
    Following the staff presentation and the conclusion of the public
comment period, the Board will consider whether to approve the final
report and recommendations. All staff presentations are preliminary and
are intended solely to allow the Board to consider in a public forum
the issues and factors involved in this case. No factual analyses,
conclusions or findings presented by staff should be considered final.
Only after the Board has considered the final staff presentation,
listened to the witnesses and the public comments and approved the
staff report will there be an approved final record of this incident.
    The meeting will be open to the public. Please notify CSB if a

Federal Requirements Under the Underground Injection Control
(UIC) Program for Carbon Dioxide (CO2) Geologic
Sequestration (GS) Wells; Notice of Data Availability and Request for
Comment

ACTION: Data availability; request for comment.

SUMMARY: Today's Notice supplements the proposed ``Federal Requirements
Under the Underground Injection Control (UIC) Program for Carbon
Dioxide (CO2) Geologic Sequestration (GS) Wells'' of July
25, 2008, presents new data and information, and requests public
comment on related issues that have evolved in response to comments on
the original proposal. This Notice contains preliminary field data from
the Department of Energy-sponsored Regional Carbon Sequestration
Partnership projects, the results of GS-related studies conducted by
the Lawrence Berkeley National Laboratory, and additional GS-related
research. Today's Notice also discusses comments and presents an
alternative the Agency is considering related to the proposed injection
depth requirements for Class VI wells.

DATES: Comments on the contents of this NODA must be received on or
before October 15, 2009. EPA does not plan to extend the comment period
for this Notice. EPA will hold a public hearing from 9 a.m. to 12 p.m.
and 1 p.m. to 4 p.m., CDT, September 17, 2009 in Chicago, IL.

Extension of Public Comment Period: Second External Review Draft
Integrated Science Assessment for Particulate Matter

AGENCY: Environmental Protection Agency (EPA).

ACTION: Extension of public comment period.

SUMMARY: The EPA is announcing an extension of the public comment
period for the draft document titled, ``Integrated Science Assessment
for Particulate Matter--Second External Review Draft'' (EPA/600/R-08/
139B and EPA/600/R-08/139BA). The document was prepared by the National
Center for Environmental Assessment (NCEA) within EPA's Office of
Research and Development as part of the review of the national ambient
air quality standards (NAAQS) for particulate matter.
    On July 31, 2009 (74 FR 38185), EPA released this draft document to
seek review by the Clean Air Scientific Advisory Committee (CASAC) and
the public (meeting date and location to be specified in a separate
Federal Register notice). The draft document does not represent and
should not be construed to represent any final EPA policy, viewpoint,
or determination. EPA will consider any public comments submitted in
response to this notice when revising the document.

DATES: The public comment period started on July 31, 2009 (74 FR
38185). This notice announces the extension of the deadline for public
comment from September 30, 2009, to October 12, 2009. Comments must be
received on or before October 12, 2009.

Energy Conservation Program: Energy Conservation Standards for
Refrigerated Bottled or Canned Beverage Vending Machines

AGENCY: Office of Energy Efficiency and Renewable Energy, Department of
Energy.

ACTION: Final rule.

SUMMARY: The U.S. Department of Energy (DOE) is adopting new energy
conservation standards for refrigerated bottled or canned beverage
vending machines. DOE has determined that energy conservation standards
for these types of equipment would result in significant conservation
of energy, and are technologically feasible and economically justified.

DATES: The effective date of this rule is October 30, 2009, except that
the standards in 10 CFR 431.296 are effective August 31, 2011. The
incorporation by reference of certain publications listed in this rule
was approved by the Director of the Federal Register on October 30,
2009.

SUMMARY: The NTP announces the availability of the draft background
document for formaldehyde by September 3, 2009, on the RoC Web site
(http://ntp.niehs.nih.gov/go/29679) or in printed text from the RoC
(see ADDRESSES below). The NTP invites the submission of public
comments on the draft background document for formaldehyde. The expert
panel will meet on November 2-4, 2009, at the Hilton Raleigh-Durham
Airport at Research Triangle Park, 4810 Page Creek Lane, Durham, NC
27703 to peer review the draft background document for formaldehyde
and, once completed, make a recommendation regarding the listing status
(i.e., known to be a human carcinogen, reasonably anticipated to be a
human carcinogen, or not to list) for formaldehyde in the 12th Edition
of the RoC (12th RoC). The RoC expert panel meeting is open to the
public with time scheduled for oral public comments. Attendance is
limited only by the available meeting room space. Following the expert
panel meeting and completion of the expert panel report, the NTP will
post the final background document and the expert panel report on the
RoC Web site.

DATES: The expert panel meeting for formaldehyde will be held on
November 2-4, 2009. The draft background document for formaldehyde will
be available for public comment by September 3, 2009. The deadline to
submit written comments is October 16, 2009, and the deadline for pre-
registration to attend the meeting and/or to provide oral comments at
the meeting is October 26, 2009.

SUMMARY: The NRC staff is soliciting public comment on its Proposed
Interim Staff Guidance (ISG) DC/COL-ISG-017 (Agencywide Documents
Access and Management System (ADAMS) Accession No. ML092230543). This
ISG supplements the guidance provided to the NRC staff in Sections 2.5
and 3.7 of NUREG-0800, ``Standard Review Plan (SRP) for the Review of
Safety Analysis Reports for Nuclear Power Plants,'' March 2007, and DC/
COL-ISG-01, ``Interim Staff Guidance on Seismic Issues Associated with
High Frequency Ground Motion in Design Certification and Combined
License Applications,'' issued May 19, 2008 (ADAMS Accession No.
ML081400293). The NRC staff issues DC/COL-ISGs to facilitate timely
implementation of current staff guidance and to facilitate activities
associated with review of applications for design certifications and
combined licenses by the Office of New Reactors. The NRC staff intends
to incorporate the final approved DC/COL-ISG-017 into the next revision
of SRP Sections 2.5 and 3.7 and Regulatory Guide 1.206, ``Combined
License Applications for Nuclear Power Plants (LWR Edition),'' June
2007.
