Revisions to the General Conformity Regulations

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: The EPA is revising its regulations relating to the Clean Air
Act (CAA) requirement that Federal actions conform to the appropriate
State, tribal or Federal implementation plan (SIP, TIP, or FIP) for
attaining clean air (``General Conformity''). EPA and other Federal
agencies have gained experience with the implementation of the existing
regulations, which were promulgated in 1993 (and underwent minor
revisions in 2006), and have identified several issues with their
implementation. In addition, in 2004, EPA issued regulations to
implement the revised ozone national ambient air quality standards
(NAAQS) and in 2007 issued regulations to implement the new fine
particulate matter standard. State and other air quality agencies are
in the process of developing revised plans to attain the new standards
and the revisions to the General Conformity Regulations will be helpful
to the State, Tribe, and local agencies in developing, and Federal
agencies in commenting, on the proposed SIPs revisions. This rule
revision will also facilitate Federal agency compliance with conforming
its activities to the SIPs thereby preventing violations of the NAAQS.
This rule revision provides for a timely and effective process for
Federal agencies and States and Tribes to ensure Federal activities are
incorporated in these SIPs. Where that is not possible, it provides an
efficient and effective process for Federal agencies to ensure their
actions do not cause or contribute to a violation of the NAAQS or
interfere with the purpose of a SIP, TIP or FIP to attain or maintain
the NAAQS.

Energy Conservation Program: Energy Conservation Standards for
Small Electric Motors; Correction

ACTION: Final rule; technical correction.

SUMMARY: This document contains a technical correction to the final
rule regarding the energy conservation standards for small electric
motors, which was published on March 9, 2010. In that final rule, the
U.S. Department of Energy (DOE) adopted regulations to establish energy
conservation standards for small electric motors. Due to a drafting
error, an incorrect compliance date for this equipment was
inadvertently inserted into the regulation. This correction notice
addresses the error.

DATES: This technical correction is effective April 8, 2010.

Energy Conservation Program for Consumer Products: Test
Procedures for Residential Furnaces and Boilers

ACTION: Supplemental notice of proposed rulemaking and solicitation of

SUMMARY: In order to implement recent amendments to the Energy Policy
and Conservation Act (EPCA) by the Energy Independence and Security Act
of 2007 (EISA 2007), the U.S. Department of Energy (DOE) proposed
amendments to its test procedures for residential furnaces and boilers
to provide for measurement and incorporation of standby mode and off
mode energy consumption. A public meeting on the proposed rule was held
on August 18, 2009. This supplemental notice of proposed rulemaking
(SNOPR) proposes an integrated efficiency descriptor that incorporates
standby mode and off mode energy consumption into the statutorily
identified efficiency descriptor, Annual Fuel Utilization Efficiency
(AFUE).

DATES: DOE will accept comments, data, and information regarding the
notice of proposed rulemaking (NOPR) no later than April 20, 2010. For

SUMMARY: The U.S. Department of Energy (DOE) will hold a public meeting
to discuss and receive comments on: The equipment classes that DOE
plans to analyze for establishing energy conservation standards for
walk-in coolers and walk-in freezers; the analytical framework, models,
and tools that DOE is using to evaluate standards for this equipment;
the results of preliminary analyses performed by DOE for this
equipment; and the potential energy conservation standard levels
derived from these analyses that DOE could consider for this equipment.
In addition, DOE encourages written comments on these subjects. To
inform interested parties and facilitate this process, DOE has prepared
an agenda, a preliminary technical support document (preliminary TSD),
and briefing materials, which are available at: http://

SUMMARY: PHMSA is considering amendments to the Hazardous Materials
Regulations (HMR) as they apply to the transportation of combustible
liquids. Specifically, we are considering whether to harmonize the
domestic regulations applicable to the transportation of combustible
liquids with international transportation standards. In addition, we
are examining ways to revise, clarify, or relax certain regulatory
requirements to facilitate the transportation of these materials while
maintaining an adequate level of safety. The intent of this ANPRM is to
invite public comments on how to accomplish these goals, provide an
opportunity for comment on amendments PHMSA is considering, and present
a forum for the public to offer additional recommendations for the safe
transportation of combustible liquids.

Reconsideration of Interpretation of Regulations That Determine
Pollutants Covered by Clean Air Act Permitting Programs

AGENCY: Environmental Protection Agency.

ACTION: Final Action on Reconsideration of Interpretation.

SUMMARY: EPA has made a final decision to continue applying the
Agency's existing interpretation of a regulation that determines the
scope of pollutants subject to the Federal Prevention of Significant
Deterioration (PSD) program under the Clean Air Act (CAA or Act). In a
December 18, 2008 memorandum, EPA established an interpretation
clarifying the scope of the phrase ``subject to regulation'' found
within the definition of the term ``regulated NSR pollutant.'' After
considering comments on alternate interpretations of this term, EPA has
decided to continue to interpret it to include each pollutant subject
to either a provision in the CAA or regulation adopted by EPA under the
CAA that requires actual control of emissions of that pollutant. Thus,
this action explains that EPA will continue following the
interpretation in the December 18, 2008 memorandum with one exception.
EPA is refining its interpretation to establish that the PSD permitting
requirements will not apply to a newly regulated pollutant until a
regulatory requirement to control emissions of that pollutant ``takes
effect.'' In addition, this notice addresses several questions
regarding the applicability of the PSD and Title V permitting programs
to greenhouse gases (GHGs) upon the anticipated promulgation of EPA
regulations establishing limitations on emissions of GHGs from vehicles
under Title II of the CAA. Collectively, these conclusions result in an
EPA determination that PSD and Title V permitting requirements will not
apply to GHGs until at least January 2, 2011.

SUMMARY: EPA is withdrawing a significant new use rule (SNUR)

(TSCA) for the chemical substance identified as 1-Propene, 2,3,3,3-
tetrafluoro- (CAS No. 754-12-1), which was the subject of
premanufacture notice (PMN) P-07-601. EPA published the SNUR using
direct final rulemaking procedures. EPA received a notice of intent to
submit adverse comments on the rule. Therefore, the Agency is
withdrawing the SNUR, as required under the expedited SNUR rulemaking
process. Elsewhere in today's Federal Register, EPA is publishing
(under separate notice and comment rulemaking procedures) a proposed
SNUR for this substance.

SUMMARY:  EPA is proposing a significant new use rule (SNUR) under

Energy Conservation Program: Test Procedures for Battery Chargers

SUMMARY: The U.S. Department of Energy (DOE) proposes major revisions
to its test procedures for battery chargers and external power
supplies. In particular, DOE proposes to insert a new active mode
energy consumption test procedure for battery chargers, to assist in
the development of energy conservation standards as directed by the
Energy Independence and Security Act of 2007. DOE also proposes to
amend portions of its existing standby and off mode battery charger
test procedure to shorten the measurement time. DOE is also considering
amending its existing active mode single-voltage external power supply
test procedure to permit testing of certain types of external power
supplies that the existing test procedure may be unable to test.
Additionally, DOE proposes to insert a new procedure to address
multiple-voltage external power supplies, which are not covered under
the current single-voltage external power supply test procedure.
Finally, DOE is announcing a public meeting to receive comment on the
issues presented in this notice of proposed rulemaking.

Entergy Nuclear Operations, LLC; Palisades Nuclear Plant;
Exemption

1.0 Background

    Entergy Nuclear Operations, LLC (ENO) (the licensee) is the holder
of Facility Operating License No. DPR-20, which authorizes operation of
Palisades Nuclear Plant (PNP). The license provides, among other
things, that the facility is subject to all rules, regulations, and
orders of the U.S. Nuclear Regulatory Commission (NRC, the Commission)
now or hereafter in effect.
    The facility consists of one pressurized-water reactor located in
Van Buren County, Michigan.

2.0 Request/Action

    Title 10 of the Code of Federal Regulations (10 CFR) part 73,
``Physical protection of plants and materials,'' section 73.55,
``Requirements for physical protection of licensed activities in
nuclear power reactors against radiological sabotage,'' published March
27, 2009, effective May 26, 2009, with a full implementation date of
March 31, 2010, requires licensees to protect, with high assurance,
against radiological sabotage by designing and implementing
comprehensive site security programs. The amendments to
10 CFR 73.55 published on March 27, 2009, establish and update
generically applicable security requirements similar to those
previously imposed by Commission orders issued after the terrorist
attacks of September 11, 2001, and implemented by licensees. In
addition, the amendments to 10 CFR 73.55 include additional
requirements to further enhance site security based upon insights
gained from implementation of the post-September 11, 2001, security
orders. It is from three of these new requirements that ENO now seeks
an exemption from the March 31, 2010, implementation date. All other
physical security requirements established by this recent rulemaking
have already been or will be implemented by the licensee by March 31,
2010.
    By letter dated January 14, 2010, (inadvertently dated January 14,
2009), as supplemented by letter dated February 16, 2010, the licensee
requested an exemption in accordance with 10 CFR 73.5, ``Specific
exemptions.'' The licensee's January 14, 2010, and February 16, 2010,
letters, have certain portions which contain security-related
information and, accordingly, are not available to the public. The
licensee has requested an exemption from the March 31, 2010, compliance
date stating that it must complete a number of significant
modifications to the current site security configuration before all
requirements can be met. Specifically, the request is to extend the
compliance date for three requirements that would be in place by August
31, 2010, versus the March 31, 2010, deadline. Being granted this
exemption for the three requirements would allow the licensee to
complete the modifications designed to update aging equipment and
incorporate state-of-the-art technology to meet or exceed the noted
regulatory requirements. . .

SUMMARY: EPA is amending 40 CFR 180.560 to add a reference to the
active ingredient flucarbazone-sodium (wheat only) to the tolerance for
the inert ingredient cloquintocet-mexyl (acetic acid [(5-chloro-8-
quinolinyl) oxy]-, 1-methylhexyl ester; CAS Reg. No. 99607-70-2) and
its acid metabolite (5-chloro-8-quinolinoxyacetic acid) on wheat
forage, wheat grain, wheat hay, and wheat straw. Arysta LifeScience
North America, LLC requested this tolerance amendment under the Federal
Food, Drug, and Cosmetic Act (FFDCA).

DATES: This regulation is effective March 31, 2010. Objections and
requests for hearings must be received on or before June 1, 2010, and

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: In this final action, EPA is issuing a stay for 18 months of
the inclusion of fugitive emissions requirements in the federal
Prevention of Significant Deterioration (PSD) program published in the
Federal Register on December 19, 2008, in the final rule entitled,
``Prevention of Significant Deterioration (PSD) and Nonattainment New
Source Review (NSR): Reconsideration of Fugitive Emissions''
(``Fugitive Emissions Rule''). The Fugitive Emissions Rule under the
federal PSD program requires that fugitive emissions be included in
determining whether a physical or operational change results in a major
modification only for sources in industries that have been designated
through rulemaking under section 302(j) of the Clean Air Act (Act or
CAA). The existing stay is in effect for 3 months; that is, from
December 31, 2009 until March 31, 2010. This action puts in place an
additional stay for 18 months, which we believe will allow for
sufficient time for EPA to propose, take public comment on, and issue a
final action concerning the inclusion of fugitive emissions in the
federal PSD program.

DATES: The amendments to 40 CFR parts 51 and 52 in this rule are
effective from April 1, 2010 through October 3, 2011. Effective April

Registration review is EPA's periodic review of pesticide registrations
to ensure that each pesticide continues to satisfy the statutory
standard for registration, that is, the pesticide can perform its
intended function without unreasonable adverse effects on human health
or the environment. Registration review dockets contain information
that will assist the public in understanding the types of information
and issues that the Agency may consider during the course of
registration reviews. Through this program, EPA is ensuring that each
pesticide's registration is based on current scientific and other

SUMMARY: EPA has received a specific exemption request from the
Michigan Department of Agriculture to use the pesticide kasugamycin
(CAS No. 6980-18-3 to treat up to 10,000 acres of apples to control
fire blight. The applicant proposes the use of a new chemical which has
not been registered by EPA. EPA is soliciting public comment before
making the decision whether or not to grant the exemption.

Dicloran; Cancellation Order for Amendment to Terminate a Use of
DCNA Pesticide Registrations

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: This notice announces EPA's order for the label amendment,
which was voluntarily requested by the registrant and accepted by the
Agency, to terminate use on carrots for pesticide registrations listed
in Table 1 in Unit II. pursuant to section 6(f)(1) of the Federal
Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended. This
cancellation order follows a December 2, 2009 (74 FR 63151) Federal
Register Notice of Receipt of Request from the registrant listed in
Table 2 in Unit II. to voluntarily amend to terminate dicloran (DCMA)
use on carrots. In its December 2, 2009 Notice, EPA indicated that it
would issue an order implementing the cancellation and amendment to
terminate the use on carrot, unless the Agency received substantive
comments within the 30-day comment period that would merit its further
review of these requests, or unless the registrant withdrew their
request within this period. The 30-day comment period ended on January
4, 2010, at which time the Agency did not receive any comments on the
notice. Further, the registrant did not withdraw their request.
Accordingly, EPA hereby issues in this notice a cancellation order
granting the requested use termination. Any distribution, sale, or use
of the products subject to this cancellation order is permitted only in
accordance with the terms of this order, including any existing stocks
provisions.

DATES: The cancellations are effective as published in the Federal
Register on November 2, 2010.

Draft Toxicological Review of Dichloromethane: In Support of
Summary Information on the Integrated Risk Information System (IRIS)

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice of Public Comment Period and Listening Session.

SUMMARY: EPA is announcing a 60-day public comment period and a public
listening session for the external review draft human health assessment
titled, ``Toxicological Review of Dichloromethane: In Support of
Summary Information on the Integrated Risk Information System (IRIS)''
(EPA/635/R-10/003). The draft assessment was prepared by the National
Center for Environmental Assessment (NCEA) within EPA's Office of
Research and Development (ORD). The public comment period and external
peer review meeting, which will be scheduled at a later date and
announced in the Federal Register, are separate processes that provide
opportunities for all interested parties to comment on the assessment.
EPA intends to forward the public comments that are submitted in
accordance with this notice to the peer review panel prior to the
meeting for their consideration. When finalizing the draft assessment,
EPA intends to consider any public comments that EPA receives in
accordance with this notice.
    EPA is also announcing a listening session to be held on May 11,
2010, during the public comment period for this draft assessment. This
listening session is a step in EPA's revised IRIS process, announced on
May 21, 2009, for developing human health assessments for inclusion in
the IRIS database. The purpose of the listening session is to allow all
interested parties to present scientific and technical comments on
draft IRIS health assessments to EPA and other interested parties
during the public comment period and before the peer review meeting.
EPA welcomes the comments that will be provided to the Agency by the
listening session participants. The comments will be considered by the
Agency as it revises the draft assessment in response to the
independent SAB peer review and the public comments. All presentations
submitted to EPA according to the instructions below will become part
of the official public record.
    EPA is releasing this draft assessment solely for the purpose of
pre-dissemination peer review under applicable information quality
guidelines. This assessment has not been formally disseminated by EPA.
It does not represent and should not be construed to represent any
Agency policy or determination.

DATES: The public comment period begins March 31, 2010, and ends June
1, 2010. Comments should be in writing and must be received by EPA by
June 1, 2010.
    The listening session on the draft assessment for dichloromethane
will be held on May 11, 2010, beginning at 9 a.m. and ending at 4 p.m.,
Eastern Daylight Time. If you would like to attend the listening
session, you should register by May 4, 2010. If you would like to make
a presentation at the listening session, you should register by May 4,
2010, indicate that you wish to make oral comments at the session, and
indicate the length of your presentation. When you register, please
indicate if you will need audio-visual aid (e.g., laptop computer and
slide projector). In general, each presentation should be no more than
30 minutes. If, however, there are more requests for presentations than
the allotted time allows, then the time limit for each presentation
will be adjusted. A copy of the agenda for the listening session will
be available at the meeting. If no speakers have registered by May 4,
2010, the listening session will be cancelled, and EPA will notify
those registered of the cancellation.
    Listening session participants who want EPA to share their comments
with the external peer reviewers should also submit written comments
during the public comment period using the detailed and established
procedures described in the SUPPLEMENTARY INFORMATION section of this
notice. Comments submitted to the docket prior to the end of the public
comment period will be submitted to the external peer reviewers and
considered by EPA in the disposition of public comments. All comments
received will be submitted to the docket, but comments received after
the public comment period closes will not be submitted to the external
peer reviewers and will only be considered by EPA if time permits.

SUMMARY: The EPA Science Advisory Board (SAB) Staff Office announces
two public meetings of the SAB Trichloroethylene (TCE) Review Panel: a
teleconference and a face-to-face meeting to review EPA's Toxicological
Review of Trichloroethylene in Support of Summary Information on the
Integrated Risk Information System (IRIS), External Review Draft.

DATES: There will be a public teleconference on April 20, 2010 from
2:30 p.m. to 4:30 p.m. (Eastern Time). The public meeting will be held
on May 10, 2010 from 9 a.m. to 5 p.m. (Eastern Time), May 11, 2010 from
9 a.m. to 5 p.m. and May 12, 2010 from 9 a.m. to 3 p.m. (Eastern time).

AGENCY: Agency for Toxic Substances and Disease Registry (ATSDR),
Department of Health and Human Services (HHS).

ACTION: Request for comments on the proposed substances to be evaluated
for Set 24 toxicological profiles.

SUMMARY: This notice announces the list of proposed substances that
will be evaluated for Comprehensive Environmental Response,
Compensation, and Liability Act of 1980 (CERCLA) Set 24 toxicological
profile development. ATSDR's Division of Toxicology and Environmental
Medicine is soliciting public comments on the list of proposed
substances to be evaluated for toxicological profile development. ATSDR
also will consider the nomination of any additional, substances, not on
this list, that may have public health implications.

DATES: Nominations must be submitted within 30 days of the publication
of this notice.

SUPPLEMENTARY INFORMATION: The Superfund Amendments and Reauthorization
Act of 1986 (SARA) [42 U.S.C. 9601 et seq.] amended the CERCLA (or
Superfund) [42 U.S.C. 9601 et seq.] by establishing certain
requirements for ATSDR and the U.S. Environmental Protection Agency
(EPA) with regard to hazardous substances most commonly found at
facilities on the CERCLA NPL. Among these statutory requirements is a
mandate for the Administrator of ATSDR to prepare toxicological
profiles for each substance included on the Priority List of Hazardous
Substances. This identifies 275 hazardous substances that ATSDR and EPA
have determined pose the most significant potential threat to human
health (http://www.atsdr.cdc.gov/cercla/07list.html). The availability
of the revised list of the 275 priority substances was announced in the
Federal Register on March 6, 2008 (73 FR 12178). For prior versions of
the list of substances, see Federal Register notices dated April 17,
