AGENCY: Environmental Protection Agency (EPA).
ACTION: Notice.
-----------------------------------------------------------------------
SUMMARY: Section 5 of the Toxic Substances Control Act (TSCA) requires
any person who intends to manufacture (defined by statute to include
import) a new chemical (i.e., a chemical not on the TSCA Inventory) to
notify EPA and comply with the statutory provisions pertaining to the
manufacture of new chemicals. Under sections 5(d)(2) and 5(d)(3) of
TSCA, EPA is required to publish a notice of receipt of a
premanufacture notice (PMN) or an application for a test marketing
exemption (TME), and to publish periodic status reports on the
chemicals under review and the receipt of notices of commencement to
manufacture those chemicals. This status report, which covers the
period from November 3, 2008 through November 14, 2008, consists of the
PMNs pending or expired, and the notices of commencement to manufacture
a new chemical that the Agency has received under TSCA section 5 during
this time period.

Climate Change Science Program Unified Synthesis Product.
-----------------------------------------------------------------------
SUMMARY: The National Oceanic and Atmospheric Administration publish
this notice to announce plans to add a second public comment period for
the U.S. Climate Change Science Program Unified Synthesis Product
(USP). The peer review and first public comment period that ended on
August 14, 2008 produced a large number of suggestions for improvements
in the scientific completeness and readability of the USP. These
comments have resulted in substantial revisions to the document, and a
second draft is now being prepared for release in January 2009 for a
45-day public comment period. Another Federal Register Notice will be
published announcing the start of the public comment period and will
provide detailed instructions for accessing the revised document and
submitting comments.
SUPPLEMENTARY INFORMATION: The CCSP was established by the President in
2002 to coordinate and integrate scientific research on global change
and climate change sponsored by 13 participating departments and
agencies of the U.S. Government. The CCSP is charged with preparing
information resources that promote climate-related discussions and
decisions, including scientific synthesis and assessment analyses that
support evaluation of important policy issues.

Excess Spoil, Coal Mine Waste, and Buffers for Perennial and
Intermittent Streams
AGENCY: Office of Surface Mining Reclamation and Enforcement, Interior.
ACTION: Final rule.
-----------------------------------------------------------------------
SUMMARY: We, the Office of Surface Mining Reclamation and Enforcement
(OSM), are amending our regulations concerning stream buffer zones,
stream-channel diversions, siltation structures, impoundments, excess
spoil, and coal mine waste. Among other things, this rule requires that
surface coal mining operations be designed to minimize the creation of
excess spoil and the adverse environmental impacts of fills constructed
to dispose of excess spoil and coal mine waste. We have revised the
stream buffer zone rule to more closely reflect the underlying
provisions of the Surface Mining Control and Reclamation Act of 1977
(SMCRA), to adopt related permit application requirements, to require
that disturbance of perennial and intermittent streams and their buffer
zones generally be avoided unless it is not reasonably possible to do
so, to identify exceptions to the requirement to maintain an
undisturbed buffer zone for perennial and intermittent streams, and to
clarify the relationship between SMCRA and the Clean Water Act.
DATES: This rule is effective January 12, 2009. The incorporation by
reference of the publication listed in the rule is approved by the
Director of the Federal Register as of January 12, 2009.
