Mandatory Reporting of Greenhouse Gases

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: This action amends the Final Mandatory Reporting of Greenhouse
Gases Rule to require reporters subject to the rule to provide: The
name, address, and percentage ownership of their U.S. parent
company(s); their primary North American Industry Classification System
code(s) as well as all additional applicable North American Industry
Classification System code(s); and an indication of whether or not any
of their reported emissions are from a cogeneration unit. This final
action also corrects an editorial error in revisions made to the
General Provisions published earlier this year.

DATES: The final rule is effective on November 22, 2010.

AGENCY: Federal Motor Carrier Safety Administration (FMCSA), DOT.

SUMMARY: Under 49 CFR 385.407 FMCSA may not issue a hazardous materials
safety permit (HMSP) to a motor carrier having a crash rate, or driver,
vehicle, or hazardous materials (HM) out-of-service (OOS) rate in the
top 30 percent of the national average. This document revises the date
used to calculate the threshold crash and OOS rates, from calendar year
cycles to fiscal year cycles, from October 1 of a given year to
September 30 of the following year. This will provide motor carriers
and the industry a 3-month preview of the crash and OOS rates FMCSA
uses to determine HMSP eligibility, before the motor carrier HMSP
registration cycle begins on January 1.

2010.

Vision and Framework for Public Review, and Notice of Informational
Webinar Meetings

ACTION: Notice of availability of a draft NOAA Climate Service
strategic vision and framework for public review, and notice of
informational webinar meetings.

SUMMARY: On February 8, 2010, the Department of Commerce and the
National Oceanic and Atmospheric Administration (NOAA) announced their
intent to establish a new NOAA Climate Service (NCS). The new service
will directly support NOAA's vision of ``an informed society that uses
a comprehensive understanding of the role of the oceans, coasts, and
atmosphere in the global ecosystem to make the best social and economic
decisions.'' It will also contribute to NOAA's mission ``to understand
and anticipate changes in Earth's environment, and conserve and manage
coastal and marine resources to meet our Nation's economic, social and
environmental needs.'' The reorganization of existing agency assets is
intended to help NOAA better work with our partners to respond to the
growing demands for climate information from the public, business,
industry, local, state and Federal agencies, and decision makers.
    As part of the process to establish a new NCS, NOAA recently
completed a strategic vision and framework document that describes how
NOAA proposes to respond to society's growing need for climate
services. The document describes the vision and outlines how the NCS
can achieve new strategic goals related to the delivery and development
of reliable, timely, and authoritative climate science and service to
enable a climate-resilient society to grow and prosper.
    NOAA will accept comments on the strategic vision from September 21
to midnight on October 18, 2010. A copy of the draft document and
instructions on how to submit comments can be found at http://
www.noaa.gov/climate
.
    NOAA is also hosting a series of informational webinars for
individuals and organizations to learn more about the proposed NCS
vision and timeline and to provide an opportunity for to answer
questions, and obtain feedback. Each webinar is targeted to a specific
sector, and will begin with a presentation from Dr. Chet Koblinsky,
Director, NOAA Climate Program Office and Transitional Deputy Director,
NOAA Climate service, and will be followed by a question and answer
session.

Planning and Standards (OAQPS) of EPA is making available a draft
report, Policy Assessment for the Review of the Secondary National
Ambient Air Quality Standards for Oxides of Nitrogen and Oxides of
Sulfur: Second External Review Draft. The EPA is releasing this
preliminary draft document to seek early consultation with the Clean
Air Scientific Advisory Committee (CASAC) and to solicit public comment
on the overall structure, framing of key issues and conclusions
regarding options for key elements of the standards.

Conservation Act to provide for measuring standby mode and off mode
energy consumption, and to update the active mode test procedure. DOE
is also proposing to eliminate an obsolete clothes washer test
procedure currently codified in the Code of Federal Regulations, and is
announcing a public meeting to discuss and receive comments on the
issues presented in this NOPR.

Significant New Use Rules on Certain Chemical Substances

AGENCY: Environmental Protection Agency (EPA).

ACTION: Direct final rule.

SUMMARY: EPA is promulgating significant new use rules (SNURs) under
section 5(a)(2) of the Toxic Substances Control Act (TSCA) for 25
chemical substances which were the subject of premanufacture notices
(PMNs). One of these chemical substances is subject to a TSCA section
5(e) consent order issued by EPA. This action requires persons who
intend to manufacture, import, or process any of these 25 chemical
substances for an activity that is designated as a significant new use
by this rule to notify EPA at least 90 days before commencing that
activity. The required notification will provide EPA with the
opportunity to evaluate the intended use and, if necessary, to prohibit
or limit that activity before it occurs.

DATES: This rule is effective on November 19, 2010. For purposes of
judicial review, this rule shall be promulgated at 1 p.m. (e.s.t.) on
October 4, 2010.
    Written adverse or critical comments, or notice of intent to submit
adverse or critical comments, on one or more of these SNURs must be
received on or before October 20, 2010 (see Unit VI. of the
SUPPLEMENTARY INFORMATION).

SUMMARY: The EPA is announcing a public hearing to be held for the
proposed ``Rule to Implement the 1997 8-Hour Ozone National Ambient Air
Quality Standard: New Source Review Anti-Backsliding Provisions for
Former 1-Hour Ozone Standard'' which published in the Federal Register
on August 24, 2010. The hearing will be held on Tuesday, October 12,
2010, in Washington, DC.

DATES: The public hearing will be held on October 12, 2010.

ADDRESSES: The October 12, 2010, hearing will be held at the EPA Ariel
Rios North building, Room 1332, 1200 Pennsylvania Avenue, Washington,
DC 20460. The public hearing will convene at 9 a.m. (eastern daylight

Multi-Walled Carbon Nanotubes and Single-Walled Carbon Nanotubes;

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: EPA is issuing significant new use rules (SNURs) under section
5(a)(2) of the Toxic Substances Control Act (TSCA) for two chemical
substances which were the subject of Premanufacture Notices (PMNs). The
two chemical substances are identified generically as multi-walled
carbon nanotubes (MWCNT) (PMN P-08-177) and single-walled carbon
nanotubes (SWCNT) (PMN P-08-328). This action requires persons who
intend to manufacture, import, or process either of these two chemical
substances for a use that is designated as a significant new use by
this final rule to notify EPA at least 90 days before commencing that
activity. EPA believes that this action is necessary because these
chemical substances may be hazardous to human health and the
environment. The required notification would provide EPA with the
opportunity to evaluate the intended use and, if necessary, to prohibit
or limit that activity before it occurs.

SUMMARY: The Department of Energy (DOE) is seeking comments from
interested parties on policy and logistical challenges that confront
smart grid implementation, as well as recommendations on how to best
overcome those challenges. DOE is undertaking this Request for
Information (RFI) on behalf of the Administration and in consultation
with key stakeholders from state regulatory bodies. The RFI will assist
these parties as they seek to assure smart grid deployments benefit consumers, the
economy and the environment. In particular, comments on the RFI will
help inform the Administration's analysis of policy challenges and
possible solutions being developed by the Smart Grid Subcommittee of
the National Science and Technology Council's Committee on Technology.
The Subcommittee seeks to base its analysis on an up-to-date
understanding of the context in which smart grid technologies, business
models and policies operate. This is the third in a series of RFIs
issued by DOE regarding smart grid implementation. Prior RFIs sought
comment on data access, data usage and privacy issues, and on
communications requirements for the smart grid. In this RFI, DOE seeks
specific input on: the best way to define the term ``smart grid'' for
policymaking purposes; the consumer-level benefits from, and challenges
to, smart grid deployment; the benefits and challenges associated with
smart grid implementation on the ``utility side'' of the meter; the
ways in which policy makers at all levels of government can share
experience and resources; and the broader, economy-wide benefits and
challenges associated with the smart grid. In so doing, this RFI avoids
duplicating questions that were raised in prior RFIs.

SUMMARY: PHMSA published the Control Room Management/Human Factors
final rule in the Federal Register on December 3, 2009, which became
effective on February 1, 2010. The final rule established an 18-month
program development deadline of August 1, 2011, and a subsequent 18-
month program implementation deadline of February 1, 2013. This
proposed rule proposes to expedite the program implementation deadline
to August 1, 2011, for most of the requirements, except for certain
provisions regarding adequate information and alarm management, which
would have a program implementation deadline of August 1, 2012.
