comment period for 60 days, from June 18, 2010, to August 17, 2010.

Sodium 1,4-Dialkyl Sulfosuccinates; Exemption from the
Requirement of a Tolerance

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY:  This regulation establishes an exemption from the requirement
of a tolerance for residues of sodium 1,4-dialkyl sulfosuccinates
including sodium 1,4-dihexyl sulfosuccinate (CAS Reg. No. 3006-15-3);
sodium 1,4-diisobutyl sulfosuccinate (CAS Reg. No. 127-39-9); and
sodium 1,4-dipentyl sulfosuccinate (CAS Reg. No. 922-80-5) when used as
an inert ingredient in pesticide formulations for pre-harvest and post-
harvest uses, as well as, for application to animals under 40 CFR
180.910 and 40 CFR 180.930, respectively. The Joint Inerts Task Force
(JITF), Cluster Support Team 13 submitted a petition to EPA under the
Federal Food, Drug, and Cosmetic Act (FFDCA), requesting establishment
of an exemption from the requirement of a tolerance. This regulation
eliminates the need to establish a maximum permissible level for
residues of the sodium 1,4-dialkyl sulfosuccinates.

DATES: This regulation is effective June 16, 2010. Objections and
requests for hearings must be received on or before August 16, 2010,
and must be filed in accordance with the instructions provided in 40
CFR part 178 (see also Unit I.C. of the SUPPLEMENTARY INFORMATION).

Protection of Stratospheric Ozone: Notice 25 for Significant New
Alternatives Policy Program

AGENCY: Environmental Protection Agency (EPA).

ACTION: Determination of Acceptability.

SUMMARY: This Determination of Acceptability expands the list of
acceptable substitutes for ozone-depleting substances under the U.S.
Environmental Protection Agency's Significant New Alternatives Policy
program. The substitutes are for use in the following sectors:
Refrigeration and air-conditioning, foam blowing, aerosols, and
sterilants. The majority of the acceptability decisions find
substitutes acceptable as alternatives to the class II ozone depleting
substances hydrochlorofluorocarbon (HCFC)-22, HCFC-142b and blends
containing one or both of these substances. EPA is also finding one of
the alternatives, HFO-1234ze, acceptable as a substitute for CFC-113 in the heat transfer end use and as a substitute for CFC-11 in the aerosol propellant end use.
The listing of additional refrigerant alternatives as acceptable will
provide users in the refrigeration and air-conditioning sector with
more options for replacing HCFC-22 and HCFC-142b, which, pursuant to
EPA's phaseout regulations, may generally be used only as a refrigerant
to service equipment manufactured before January 1, 2010.

Bacillus thuringiensis eCry3.1Ab Protein in Corn; Temporary
Exemption from the Requirement of a Tolerance

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: This regulation establishes a temporary exemption from the
requirement of a tolerance for residues of Bacillus thuringiensis
eCry3.1Ab protein in corn in or on the food and feed commodities of
corn; corn, field; corn, sweet; and corn, pop, when used as a plant-
incorporated protectant in accordance with the terms of Experimental
Use Permit 67979-EUP-8. Syngenta Seeds, Incorporated submitted a
petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA),
requesting a temporary exemption from the requirement of a tolerance.
This regulation eliminates the need to establish a maximum permissible
level for residues of Bacillus thuringiensis eCry3.1Ab protein in corn
under the FFDCA. The temporary tolerance exemption expires on June 1,
2012.

DATES: This regulation is effective June 16, 2010. Objections and
requests for hearings must be received on or before August 16, 2010, and must be

SUMMARY: EPA issued an advance notice of proposed rulemaking (ANPRM) in
the Federal Register of April 7, 2010, concerning the reassessment of
the use authorizations for PCBs. This document extends the comment
period for 45 days, from July 6, 2010, to August 20, 2010. This
extension is necessary to provide the public with an opportunity to
provide additional and more thorough comments. Also, EPA is holding two
additional public meetings to enable additional public comment on the
ANPRM during the comment period extension.

DATES: Comments, identified by docket identification (ID) number EPA-
HQ-OPPT-2009-0757, must be received on or before August 20, 2010.
     Meetings will be held on July 22, 2010, from 9 a.m. until the last
speaker has spoken or until 1 p.m., in San Francisco, CA and on July

AGENCY: Minerals Management Service, Interior.

ACTION: Notice of Availability (NOA) of the Record of Decision (ROD)
and Notice to the Public of the Secretary of the Interior's Response to
Comments From the Advisory Council on Historic Preservation (ACHP).

SUMMARY: In accordance with the regulations implementing the National
Environmental Policy Act of 1969 (NEPA), the MMS is announcing the
availability of the ROD for the Cape Wind Energy Project (the Project).
The ROD for the Project records the decisions that the MMS reached to
select the Preferred Alternative at Horseshoe Shoal in Nantucket Sound
described in its Final Environmental Impact Statement (January 2009).
After careful consideration of all the concerns expressed during the
lengthy review and consultation process and thorough analyses of the
many factors involved, the Secretary approved the ROD finding that the
public benefits weigh in favor of approving the Cape Wind Project at
the Horseshoe Shoal location. The MMS will offer a commercial lease to
Cape Wind Associates, LLC (CWA) in response to CWA's application. The
CWA's rights to construct and operate the Project pursuant to the lease
are subject to construction and operation approvals from the MMS. The
Secretary of the Interior (the Secretary) and the Director of the MMS
co-signed the ROD for the Project on April 28, 2010.
    In accordance with the regulations implementing Section 106 of the
National Historic Preservation Act of 1966 (NHPA), the public is also
notified that on April 28, 2010, the Secretary responded to the April
2, 2010, comments of the ACHP concerning the Project. The ACHP provided
comments to the Secretary following his termination of the Section 106
consultation on March 1, 2010. The Secretary's response explains his
decision and indicates how the ACHP's comments were taken into account
in his consideration of the effects of the project on historical and
cultural resources. The Secretary provides a detailed response for each
of the ACHP's comments and recommendations.

    Authority: The NOA of the ROD is published pursuant to the
regulations at 40 CFR 1506.6, implementing the provisions of NEPA
(42 U.S.C. 4321 et seq.). The Notice to the Public of the Secretary
of the Interior's Response to the ACHP is published pursuant to the
regulations at 36 CFR 800.7(c)(4)(iii), implementing the provisions
of NHPA (16 U.S.C. 470 et seq.).

SUMMARY: EPA is amending the pesticide container and containment
regulations to provide a 4-month extension of the 40 CFR 156.159
labeling compliance date from August
16, 2010 to December 16, 2010. This change is being made because there
is insufficient time for pesticide registrants, EPA and states to
complete the label amendments. This change will avoid the temporary
removal of a significant number of pesticides from the market while a
1-year extension proposed elsewhere in today's Federal Register
proceeds through the rulemaking process, and while pesticide
registrants, EPA and states work to update the pesticide labels to
comply with the label requirements in the container and containment
regulations.

Withdrawal of the Emission-Comparable Fuel Exclusion Under RCRA

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: This final action withdraws the conditional exclusion from
regulations promulgated on December 19, 2008 under subtitle C of the
Resource Conservation and Recovery Act (RCRA) for so-called Emission
Comparable Fuel (ECF). These are fuels produced from hazardous
secondary materials which, when burned in industrial boilers under
specified conditions, generate emissions that are comparable to
emissions from burning fuel oil in those boilers. EPA is withdrawing
this conditional exclusion because the Agency has concluded that ECF is
more appropriately classified as a discarded material and regulated as
a hazardous waste. The exclusions for comparable fuel and synthesis gas
fuel are not addressed or otherwise affected by this final rule.

Mandatory Reporting of Greenhouse Gases

SUMMARY: EPA is proposing to amend specific provisions in the 2009
Final Mandatory Greenhouse Gas Reporting rule (2009 Final MRR) to
correct certain technical and editorial errors that have been
identified since promulgation and to clarify or propose minor updates
to certain provisions that have been the subject of questions from
reporting entities. These proposed changes include additional
information to better or more fully understand compliance obligations,
corrections to data reporting elements so they more closely conform to
the information used to perform emission calculations and other
corrections and amendments. EPA has received six petitions for
reconsideration on the 2009 Final MRR. EPA is still considering these
petitions, and the issues raised in the petitions are not discusssed or
addressed in today's action.

series of revised conservation practice standards in the National
Handbook of Conservation Practices. These standards include: Animal

Composting Facility (Code 317), Grazing Land Mechanical Treatment (Code
548), Hedgerow Planting (422), Irrigation Canal or Lateral (Code 320),
Irrigation Land Leveling (Code 464), Irrigation System, Surface, and
Subsurface (Code 443), Riparian
Herbaceous Cover (Code 390), Rock Barrier (Code 555), Roofs and Covers
(Code 367), Runoff Management System (Code 570), Shallow Water
Development and Management (Code 646), Streambank and Shoreline
Protection (Code 580), Upland Wildlife Habitat Management (Code 645),
and Wetland Wildlife Habitat Management (Code 644). NRCS State
Conservationists who choose to adopt these practices for use within
their State will incorporate them into section IV of their respective
electronic Field Office Technical Guide. These practices may be used in
conservation systems that treat highly erodible land (HEL) or on land
determined to be a wetland. Section 343 of the Federal Agriculture
Improvement and Reform Act of 1996 requires NRCS to make available for
public review and comment all proposed revisions to conservation
practice standards used to carry out HEL and wetland provisions of the
law.

DATES: Effective Date: This is effective June 15, 2010.
    Comment Date: Submit comments on or before July 15, 2010. Final
versions of these new or revised conservation practice standards will
be adopted after the close of the 30-day period and after consideration
of all comments.

Draft EPA's Reanalysis of Key Issues Related to Dioxin Toxicity
and Response to NAS Comments (EPA/600/R-10/038A)

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice of Listening Session.

SUMMARY: EPA is announcing a listening session to be held on July 9,
2010, during the public comment period for the external review draft
document entitled ``EPA's Reanalysis of Key Issues Related to Dioxin
Toxicity and Response to NAS Comments'' (EPA/600/R-10/038A). The EPA's
draft document and peer review charge are available via the Internet on
the National Center for Environmental Assessment's (NCEA) home page
under the Recent Additions and Publications menus at http://
www.epa.gov/ncea
. This draft document responds to the key
recommendations and comments included in the National Academy of
Sciences (NAS) 2006 report. In addition, it includes new analyses on
potential human effects that may result from exposure to 2,3,7,8-
tetrachlorodibenzo-p-dioxin (TCDD).
    The release of the draft document for public comment was announced
in a May 21, 2010, Federal Register Notice (75 FR 28610). EPA also
announced that it intends to forward all public comments submitted
before July 7, 2010, in response to the May 21, 2010, Notice, to the
EPA Science Advisory Board (SAB) peer review panel for its
consideration and provided instructions for submitting comments.
    The draft document is also being provided to the SAB, a body
established under the Federal Advisory Committee Act, for independent
external peer review. The SAB is convening an expert panel composed of
scientists knowledgeable about technical issues related to dioxins and
risk assessment. The SAB is holding a public teleconference on June 24,
2010, and a public panel meeting on July 13-15, 2010. The SAB peer
review meetings were announced by the SAB staff office in a separate
May 24, 2010, Federal Register Notice (75 FR 28805). Members of the
public who wish to ensure that their technical comments are provided to
the SAB expert panel before each meeting should also e-mail their
comments separately to Thomas Armitage, the SAB Designated Federal
Officer at armitage.thomas@epa.gov, following the procedures in the May
24, 2010, Federal Register Notice announcing the SAB public meetings.
The public comment period and SAB external peer review are independent
processes that provide separate opportunities for all interested
parties to comment on the draft report.
    The purpose of the listening session is to allow all interested
parties to present scientific and technical comments on draft IRIS
health assessments to EPA and other interested parties during the
public comment period and before the external peer review meeting. EPA
welcomes the scientific and technical comments that will be provided to
the Agency by the listening session participants. All comments
submitted according to the detailed instructions provided in the May
21, 2010, Federal Register Notice under SUPPLEMENTARY INFORMATION will
be considered by the Agency as it revises the draft assessment in
response to the independent external peer review and public comments.
All presentations will become part of the official public record.

DATES: The listening session on the draft IRIS health assessment for
dioxin will be held on July 9, 2010, beginning at 9 a.m. and ending at
4 p.m., Eastern Daylight Time. If you would like to make a presentation
at the listening session, you should register by July 2, 2010, indicate
that you wish to make oral comments at the session, and indicate the
length of your presentation. When you register, please indicate if you
will need audio-visual equipment (e.g., laptop computer and slide
projector). In general, each presentation should be no more than 30
minutes. If, however, there are more requests for presentations than
the allotted time allows, then the time limit for each presentation
will be adjusted. A copy of the agenda for the listening session will
be available at the meeting. If no speakers have registered by July 2,
2010, the listening session will be cancelled and EPA will notify those
registered of the cancellation.
    The public comment period for review of this draft assessment was
announced previously in the Federal Register (75 FR 28610) on May 21,
1010. As stated in that Federal Register Notice, the public comment
period began on May 21, 2010, and ends August 19, 2010. Any technical
comments submitted during the public comment period should be in
writing and must be received by EPA by August 19, 2010, according to
the procedures outlined in the May 21, 2010, Federal Register Notice.
Only those public comments submitted by July 7, 2010, or e-mailed
separately to Thomas Armitage, the SAB Designated Federal Officer at
armitage.thomas@epa.gov, following the procedures in the May 24, 2010,
Federal Register Notice announcing the SAB public meetings, will be
provided to the independent peer-review panel prior to the peer-review
meeting. However, all comments received during the public comment
period will be provided to the SAB peer review committee and will also
inform the Agency's revision of the draft assessment.

make oral comments at the session and provide the length of your

retain your photo identification and will provide you with a visitor's
badge. At the guard's desk, attendees should give the name Christine
Ross and the telephone number 703-347-8592 to the guard on duty. The
guard will contact Ms. Ross who will meet you in the reception area to
escort you to the meeting room. When you leave the building, please
return your visitor's badge to the guard and you will receive your
photo identification.

SUMMARY: The DOE Geothermal Technologies Program, Office of Science-
Geosciences Program and Office of Fossil Energy-Carbon Sequestration
Program will be holding a joint workshop on Common Research Themes for
Carbon Storage and Geothermal Energy, June 15-16, 2010. Experts from
industry, academia, national labs, and State and Federal geological
surveys will discuss geosciences research needs for subsurface
reservoir characterization, development, and management. The resulting
report will provide the collaborating offices with information key to
coordinating high priority research in common areas. Further
