Pesticide Management and Disposal; Standards for Pesticide
Containers and Containment; Change to Labeling Compliance Date

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: EPA is amending the pesticide container and containment
regulations to provide a 4-month extension of the 40 CFR 156.159
labeling compliance date from August
16, 2010 to December 16, 2010. This change is being made because there
is insufficient time for pesticide registrants, EPA and states to
complete the label amendments. This change will avoid the temporary
removal of a significant number of pesticides from the market while a
1-year extension proposed elsewhere in today's Federal Register
proceeds through the rulemaking process, and while pesticide
registrants, EPA and states work to update the pesticide labels to
comply with the label requirements in the container and containment
regulations.

DATES: This final rule is effective August 16, 2010.

Withdrawal of the Emission-Comparable Fuel Exclusion Under RCRA

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: This final action withdraws the conditional exclusion from
regulations promulgated on December 19, 2008 under subtitle C of the
Resource Conservation and Recovery Act (RCRA) for so-called Emission
Comparable Fuel (ECF). These are fuels produced from hazardous
secondary materials which, when burned in industrial boilers under
specified conditions, generate emissions that are comparable to
emissions from burning fuel oil in those boilers. EPA is withdrawing
this conditional exclusion because the Agency has concluded that ECF is
more appropriately classified as a discarded material and regulated as
a hazardous waste. The exclusions for comparable fuel and synthesis gas
fuel are not addressed or otherwise affected by this final rule.

Mandatory Reporting of Greenhouse Gases

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: EPA is proposing to amend specific provisions in the 2009
Final Mandatory Greenhouse Gas Reporting rule (2009 Final MRR) to
correct certain technical and editorial errors that have been
identified since promulgation and to clarify or propose minor updates
to certain provisions that have been the subject of questions from
reporting entities. These proposed changes include additional
information to better or more fully understand compliance obligations,
corrections to data reporting elements so they more closely conform to
the information used to perform emission calculations and other
corrections and amendments. EPA has received six petitions for
reconsideration on the 2009 Final MRR. EPA is still considering these
petitions, and the issues raised in the petitions are not discusssed or
addressed in today's action.

Conservation Practices for the Natural Resources Conservation Service

AGENCY: Natural Resources Conservation Service (NRCS).

ACTION: Notice of availability of proposed changes in the NRCS National
Handbook of Conservation Practices for public review and comment.

SUMMARY: Notice is hereby given of the intention of NRCS to issue a
series of revised conservation practice standards in the National
Handbook of Conservation Practices. These standards include: Animal
Mortality Facility (Code 316), Critical Area Planting (Code 342),
Composting Facility (Code 317), Grazing Land Mechanical Treatment (Code
548), Hedgerow Planting (422), Irrigation Canal or Lateral (Code 320),
Irrigation Land Leveling (Code 464), Irrigation System, Surface, and
Subsurface (Code 443), Riparian
Herbaceous Cover (Code 390), Rock Barrier (Code 555), Roofs and Covers
(Code 367), Runoff Management System (Code 570), Shallow Water
Development and Management (Code 646), Streambank and Shoreline
Protection (Code 580), Upland Wildlife Habitat Management (Code 645),
and Wetland Wildlife Habitat Management (Code 644). NRCS State
Conservationists who choose to adopt these practices for use within
their State will incorporate them into section IV of their respective
electronic Field Office Technical Guide. These practices may be used in
conservation systems that treat highly erodible land (HEL) or on land
determined to be a wetland. Section 343 of the Federal Agriculture
Improvement and Reform Act of 1996 requires NRCS to make available for
public review and comment all proposed revisions to conservation
practice standards used to carry out HEL and wetland provisions of the
law.

DATES: Effective Date: This is effective June 15, 2010.
    Comment Date: Submit comments on or before July 15, 2010. Final
versions of these new or revised conservation practice standards will
be adopted after the close of the 30-day period and after consideration
of all comments.

Draft EPA's Reanalysis of Key Issues Related to Dioxin Toxicity
and Response to NAS Comments (EPA/600/R-10/038A)

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice of Listening Session.

SUMMARY: EPA is announcing a listening session to be held on July 9,
2010, during the public comment period for the external review draft
document entitled ``EPA's Reanalysis of Key Issues Related to Dioxin
Toxicity and Response to NAS Comments'' (EPA/600/R-10/038A). The EPA's
draft document and peer review charge are available via the Internet on
the National Center for Environmental Assessment's (NCEA) home page
under the Recent Additions and Publications menus at http://
www.epa.gov/ncea
. This draft document responds to the key
recommendations and comments included in the National Academy of
Sciences (NAS) 2006 report. In addition, it includes new analyses on
potential human effects that may result from exposure to 2,3,7,8-
tetrachlorodibenzo-p-dioxin (TCDD).
    The release of the draft document for public comment was announced
in a May 21, 2010, Federal Register Notice (75 FR 28610). EPA also
announced that it intends to forward all public comments submitted
before July 7, 2010, in response to the May 21, 2010, Notice, to the
EPA Science Advisory Board (SAB) peer review panel for its
consideration and provided instructions for submitting comments.
    The draft document is also being provided to the SAB, a body
established under the Federal Advisory Committee Act, for independent
external peer review. The SAB is convening an expert panel composed of
scientists knowledgeable about technical issues related to dioxins and
risk assessment. The SAB is holding a public teleconference on June 24,
2010, and a public panel meeting on July 13-15, 2010. The SAB peer
review meetings were announced by the SAB staff office in a separate
May 24, 2010, Federal Register Notice (75 FR 28805). Members of the
public who wish to ensure that their technical comments are provided to
the SAB expert panel before each meeting should also e-mail their
comments separately to Thomas Armitage, the SAB Designated Federal
Officer at armitage.thomas@epa.gov, following the procedures in the May
24, 2010, Federal Register Notice announcing the SAB public meetings.
The public comment period and SAB external peer review are independent
processes that provide separate opportunities for all interested
parties to comment on the draft report.
    The purpose of the listening session is to allow all interested
parties to present scientific and technical comments on draft IRIS
health assessments to EPA and other interested parties during the
public comment period and before the external peer review meeting. EPA
welcomes the scientific and technical comments that will be provided to
the Agency by the listening session participants. All comments
submitted according to the detailed instructions provided in the May
21, 2010, Federal Register Notice under SUPPLEMENTARY INFORMATION will
be considered by the Agency as it revises the draft assessment in
response to the independent external peer review and public comments.
All presentations will become part of the official public record.

DATES: The listening session on the draft IRIS health assessment for
dioxin will be held on July 9, 2010, beginning at 9 a.m. and ending at
4 p.m., Eastern Daylight Time. If you would like to make a presentation
at the listening session, you should register by July 2, 2010, indicate
that you wish to make oral comments at the session, and indicate the
length of your presentation. When you register, please indicate if you
will need audio-visual equipment (e.g., laptop computer and slide
projector). In general, each presentation should be no more than 30
minutes. If, however, there are more requests for presentations than
the allotted time allows, then the time limit for each presentation
will be adjusted. A copy of the agenda for the listening session will
be available at the meeting. If no speakers have registered by July 2,
2010, the listening session will be cancelled and EPA will notify those
registered of the cancellation.
    The public comment period for review of this draft assessment was
announced previously in the Federal Register (75 FR 28610) on May 21,
1010. As stated in that Federal Register Notice, the public comment
period began on May 21, 2010, and ends August 19, 2010. Any technical
comments submitted during the public comment period should be in
writing and must be received by EPA by August 19, 2010, according to
the procedures outlined in the May 21, 2010, Federal Register Notice.
Only those public comments submitted by July 7, 2010, or e-mailed
separately to Thomas Armitage, the SAB Designated Federal Officer at
armitage.thomas@epa.gov, following the procedures in the May 24, 2010,
Federal Register Notice announcing the SAB public meetings, will be
provided to the independent peer-review panel prior to the peer-review
meeting. However, all comments received during the public comment
period will be provided to the SAB peer review committee and will also
inform the Agency's revision of the draft assessment.

Trifloxystrobin; Pesticide Tolerances

SUMMARY: This regulation increases existing tolerances for residues of
trifloxystrobin in or on corn, field, forage; corn, sweet, forage; and
corn, sweet, stover. Bayer CropScience requested these tolerances under
the Federal Food, Drug, and Cosmetic Act (FFDCA). Additionally, EPA is
removing several tolerances which have expired.

DATES: This regulation is effective June 11, 2010. Objections and
requests for hearings must be received on or before August 10, 2010,
and must be filed in accordance with the instructions provided in 40
CFR part 178 (see also Unit I.C. of the SUPPLEMENTARY INFORMATION).

Amendments to the Protocol Gas Verification Program and Minimum
Competency Requirements for Air Emission Testing

AGENCY: Environmental Protection Agency (EPA).

ACTION: Proposed Rule; Reconsideration.

SUMMARY: Recent EPA gas audit results indicate that some gas cylinders
used to calibrate continuous emission monitoring systems on stationary
sources do not meet EPA's performance specification. Reviews of stack
test reports in recent years indicate that some stack testers do not
properly follow EPA test methods or do not correctly calculate test
method results. Therefore, EPA is proposing to amend its Protocol Gas
Verification Program (PGVP) and the minimum competency requirements for
air emission testing (formerly air emission testing body requirements)
to improve the accuracy of emissions data. EPA is also proposing to
amend other sections of the Acid Rain Program continuous emission
monitoring system regulations by adding and clarifying certain
recordkeeping and reporting requirements, removing the provisions
pertaining to mercury monitoring and reporting, removing certain
requirements associated with a class-approved alternative monitoring
system, disallowing the use of a particular quality assurance option in
EPA Reference Method 7E, adding an incorporation by reference that was
inadvertently left out of the January 24, 2008 final rule, and
clarifying the language and applicability of certain provisions.

SUMMARY: This notice announces that HUD is conducting a second
competition for assistance under its FY2009 Brownfields Economic
Development Initiative (BEDI) NOFA, and that it has posted the BEDI
NOFA on its Web site and on Grants.gov. This second round of
competition makes approximately $8.1 million in assistance available
under the Department of Housing and Urban Development Appropriations
Act, 2009 (Pub. L. 111-8, approved March 11, 2009). All BEDI grants
must be used in conjunction with a new Section 108-guaranteed loan
commitment. Applicants for BEDI assistance must address the
requirements established by HUD's Fiscal Year 2009 Notice of Funding
Availability (NOFA) Policy Requirements and General Section to the NOFA
published on December 29, 2008 (73 FR 79548), as amended on April 16,
2009 (74 FR 17685).

Finding of Failure To Submit Section 110 State Implementation
Plans for Interstate Transport for the 2006 National Ambient Air
Quality Standards for Fine Particulate Matter

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: EPA is making a finding that certain states have failed to
submit State Implementation Plans (SIPs) to satisfy the attainment and
maintenance interstate transport requirements of the Clean Air Act
(CAA) with respect to the 2006 24-hour National Ambient Air Quality
Standards (NAAQS) for fine particulate matter (24-hour
PM2.5). Pursuant to the CAA, states are required to submit
SIPs that satisfy the requirements of the CAA related to interstate
transport of pollution. This document addresses two elements of that
requirement. A state must address its significant contribution to
nonattainment and its interference with maintenance of a NAAQS in any
neighboring state. The CAA requires that states submit SIPs to meet the
applicable requirements of the CAA within 3 years after the
promulgation of a new or revised NAAQS, or within such shorter period
as EPA may provide. On September 21, 2006, EPA promulgated a final rule
establishing new standards for the 24-hour PM2.5 NAAQS. At
present, 29 states or territories have not yet submitted complete SIPs
to satisfy the section 110(a) nonattainment and maintenance transport
requirements. Through this action, EPA is making a finding of failure
to submit these SIPs which creates a 2-year deadline for the
promulgation of a Federal Implementation Plan (FIP) by EPA unless,
prior to that deadline, a state makes a submission to meet these two
requirements of the CAA and EPA approves such submission.

DATES: The effective date of this rule is July 9, 2010.

SUMMARY: On April 29, 2010, the EPA Administrator signed proposed
emission standards for the following source categories: Industrial,
Commercial, and Institutional Boilers and Process Heaters located at
major sources; Industrial, Commercial, and Institutional Boilers
located at area sources; and Commercial and Industrial Solid Waste
Incineration Units. On the same date, the Administrator also signed a
proposal entitled ``Identification of Non-Hazardous Secondary Materials
That Are Solid Waste.'' EPA has received a request to schedule
additional public hearings for these four related rulemakings. Given
the significant public interest in these rules and to further public
participation opportunities, EPA is granting the request and has
scheduled three public hearings. These hearings will occur in
Arlington, Virginia, on June 15, 2010; Houston, Texas, on June 22,
2010; and Los Angeles, California, on June 22, 2010. More information
on the locations is shown in SUPPLEMENTARY INFORMATION.
    In addition, EPA is extending the deadline for written comments on
the proposed rules (75 FR 32006 (major source boilers), 75 FR 31896
(area source boilers), 75 FR 31938 (CISWI), and 75 FR 31844 (waste
definition)) to August 3, 2010. This extension will provide additional
time for public participation.

    Public Hearings. These hearings will occur in Arlington, Virginia,
on June 15, 2010; Houston, Texas, on June 22, 2010; and Los Angeles,

Pipeline Safety: Workshop on Public Awareness Programs

SUMMARY: PHMSA is co-sponsoring a one day public awareness workshop
with the National Association of Pipeline Safety Representatives
(NAPSR). The workshop will be an opportunity, following the initial
four-year implementation cycle, to review the implementation process,
identify what implementation strategies have worked well, discuss
challenges faced by the pipeline industry, discuss Federal and state
regulatory oversight, learn about public interest and need for
information about pipelines in their communities, and identify critical
elements of a successful operator public awareness program. Pipeline
trade associations, the Pipeline Safety Trust, the National
Transportation Safety Board, and pipeline operators will share lessons
learned from implementing their public awareness programs based on
Federal regulations. PHMSA and state partners will discuss the scope of
and timeline for conducting effectiveness evaluations. PHMSA and our
state partners will use the results from this event, in addition to
existing inspection activities, to further develop our programs for
evaluating pipeline operator public awareness programs. The workshop
will be webcast live, in real time and presentations will be made
available following the workshop.

DATES: The workshop will be held on June 30, 2010. Name badge pick up
and on-site registration will be available starting at 7 a.m., with the
workshop taking place from 8 a.m. until approximately 5 p.m. central
