ACTION: Notification of Public Teleconference and Public Comment.

SUMMARY: Pursuant to the Federal Advisory Committee Act (FACA), Public
Law 92-463, the U.S. Environmental Protection Agency (EPA) hereby
provides notice that the National Environmental Justice Advisory
Council (NEJAC) will host a public teleconference call on, Wednesday
April 28, 2010, starting at 2 p.m. Eastern Time. The primary topics of
discussion will be updates on EPA's response to the NEJAC's Goods
Movement Report; and reports from the NEJAC liaisons to the Tribal
Operations Commission and the Children's Health Protection Advisory
Committee School Siting Task Group. This NEJAC National Public
Teleconference meeting is open to the public. There will be a public
comment period from 3:30 p.m. to 4 p.m. Eastern Time. Members of the
public are encouraged to provide comments relevant to the topics of
this call.
    For additional information about registering to attend the call or
to provide public comment during the call, please see SUPPLEMENTARY
INFORMATION. Due to a limited number of telephone lines, attendance
will be on a first-come basis. There is no fee to attend, but pre-

SUMMARY: The Department of Homeland Security (DHS), National Protection
and Programs Directorate (NPPD), Office of Infrastructure Protection
(IP), Infrastructure Security Compliance Division (ISCD) will be
submitting the following information collection request (ICR) to the
Office of Management and Budget (OMB) for review and clearance in
accordance with the Paperwork Reduction Act of 1995 (PRA). The
information collection is a new information collection. A 60-day public
notice for comments was previously published in the Federal Register on
June 10, 2009, at 74 FR 27555. Comments were received and responses are
in this notice. The purpose of this notice is to solicit additional
comments during a 30-day public comment period prior to the submission
of this collection to OMB. The submission describes the nature of the
information collection, the categories of respondents, the estimated
burden, and cost.

Mandatory Reporting of Greenhouse Gases

AGENCY: Environmental Protection Agency (EPA).

ACTION: Proposed rule amendment.

SUMMARY: EPA is proposing to amend the Mandatory Greenhouse Gas (GHG)
Reporting Rule, to require reporters subject to the rule to provide:
The name, address, and ownership status of their U.S. parent company;
their primary and all other applicable North American Industry
Classification System (NAICS) code(s); and an indication of whether or
not any of their reported emissions are from a cogeneration unit. The
Mandatory GHG Reporting Rule requires greenhouse gas emitting
facilities and suppliers of fuels and industrial gases from all sectors
of the economy to report their greenhouse gas emissions and to provide
certain additional supporting data in annual reports submitted to EPA.

DATES: Comments. Comments must be received on or before June 11, 2010.
    Public Hearing. EPA does not plan to conduct a public hearing

Mandatory Reporting of Greenhouse Gases: Additional Sources of
Fluorinated GHGs

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: EPA is revising and supplementing its initial proposed actions
to require reporting of fluorinated greenhouse gas (fluorinated GHG)
emissions from certain source categories. Specifically, EPA is revising
and supplementing its initial proposal to require reporting of
fluorinated GHG emissions from electronics manufacturing, production of
fluorinated gases, and use of electrical transmission and distribution
equipment. EPA is also proposing to require such reporting from
manufacture or refurbishment of electrical equipment and import and
export of pre-charged equipment and closed cell foams. This proposed
rule would not require control of greenhouse gases; rather it would
require only that sources above certain threshold levels monitor and
report emissions.

Mandatory Reporting of Greenhouse Gases: Injection and Geologic
Sequestration of Carbon Dioxide

AGENCY: Environmental Protection Agency (EPA).

ACTION: Proposed rule.

SUMMARY: EPA is proposing a rule to require reporting on carbon dioxide
(CO2) injection and geologic sequestration (GS). The
proposed rulemaking does not require control of greenhouse gases
(GHGs), rather it requires only monitoring and reporting of
CO2 injection and geologic sequestration. EPA first proposed
that suppliers of CO2 be subject to mandatory GHG reporting
requirements in April 2009 and finalized the rule for suppliers of
CO2 on October 30, 2009.

Mandatory Reporting of Greenhouse Gases: Petroleum and Natural
Gas Systems

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: EPA is proposing a supplemental rule to require reporting of
greenhouse gas (GHG) emissions from petroleum and natural gas systems.
Specifically, the proposed supplemental rulemaking would require
emissions reporting from the following industry segments: Onshore
petroleum and natural gas production, offshore petroleum and natural
gas production, natural gas processing, natural gas transmission
compressor stations, underground natural gas storage, liquefied natural
gas (LNG) storage, LNG import and export terminals, and distribution.
The proposed supplemental rulemaking does not require control of GHGs,
rather it requires only that sources above certain threshold levels
monitor and report emissions.

SUMMARY: EPA is announcing a 60-day public comment period for two
related draft documents: (1) ``The Effects of Mountaintop Mines and
Valley Fills on Aquatic Ecosystems of the Central Appalachian
Coalfields'' (EPA/600/R-09/138A) and (2) ``A Field-based Aquatic Life
Benchmark for Conductivity in Central Appalachian Streams'' (EPA/600/R-
10/023A). These reports were developed by the National Center for
Environmental Assessment (NCEA) within EPA's Office of Research and
Development as part of a set of actions taken by EPA to further clarify
and strengthen environmental permitting requirements for Appalachian
mountaintop removal and other surface coal mining projects, in
coordination with Federal and State regulatory agencies (http://
www.epa.gov/owow/wetlands/guidance/mining.html
).
    Both documents will be reviewed by an independent review panel
convened by EPA's Science Advisory Board (SAB). The SAB's peer review
meeting, which the public will be able to attend as observers, will be
scheduled at a later date, and announced in the Federal Register. The
public comment period and the SAB meeting are separate processes that
provide opportunities for all interested parties to comment on the
document. EPA intends to forward the public comments that are
submitted, in accordance with this notice, to the SAB review panel
prior to the meeting for their consideration. When finalizing the draft
documents, EPA intends to consider any significant public comments that
it receives in accordance with this notice.
    EPA is releasing these draft documents for the purpose of pre-
dissemination peer review under applicable information quality
guidelines. The documents have not been formally disseminated by EPA.
They do not represent and should not be construed to represent a final
Agency policy or determination; however, the documents reflect EPA's
best interpretation of the available science. The draft documents are
available via the Internet on NCEA's home page under the Recent

SUMMARY: EPA is announcing that Eastern Research Group, Inc. (ERG), an
EPA contractor for external scientific peer review, will convene an
independent panel of experts and organize and conduct an external peer
review meeting to review two draft documents entitled, ``Using
Probabilistic Methods to Enhance the Role of Risk Analysis in Decision-
Making, with Case Study Examples'' and a ``Managers' Summary'' of the
same document. The draft documents were prepared by the Agency's Risk
Assessment Forum. The peer review meeting is scheduled to take place on
May 6, 2010. On August 18, 2009, EPA announced a 15-day public comment
period for the draft documents (74 FR 41695), and on September 17, 2009
extended the comment period to 60 days (74 FR 47794), thus closing the
public comment period on October 16, 2009.
    The public comment period and the external peer review are separate
processes that provide opportunities for all interested parties to
comment on the document. In addition to the opportunity provided for
public comments through the EPA docket by the closing date of October
16, 2009, the public can provide comments for the external peer
reviewers' consideration through the public meeting scheduled for May
6, 2010.
    EPA is releasing this draft document solely for the purpose of pre-
dissemination peer review under applicable information quality
guidelines. This document has not been formally disseminated by EPA. It
does not represent and should not be construed to represent any Agency
policy or determination.
    The public will be given an opportunity to observe and provide oral

Total Coliform Rule Revisions--Notice of Stakeholder Meeting

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: The Environmental Protection Agency (EPA) is developing
proposed revisions to the 1989 Total Coliform Rule (TCR). The Total
Coliform Rule/Distribution System Advisory Committee established an
Agreement in Principle, which provides the Agency with recommendations
for revising the TCR. One of the recommendations of the Committee is
that EPA conduct stakeholder outreach as the Agency develops the
proposed revisions. Today, EPA is giving notice of a public meeting in
which the Agency will provide updates on the proposed Revised Total
Coliform Rule (RTCR) and the Distribution Systems Research and
Information Collection Partnership; opportunities for stakeholders to
provide feedback on assessment and corrective action guidance related
to the proposed rule; and opportunities for stakeholders to provide
feedback on options for the process of reviewing the methods approved
to analyze drinking water samples to determine the presence of total
coliforms and E. coli. Other topics to be discussed in the meeting
include a review of EPA's commitments to stakeholder outreach and
involvement pertaining to the proposed RTCR and the plan and tentative
schedule for revising other guidance documents.

an interim final rule that established America's Marine Highway
Program, under which the Secretary will designate marine highway

integrate the marine highway into the transportation planning process;
and research improvements in efficiencies and environmental
sustainability. This action is required by Public Law 110-140, the
Energy Independence and Security Act of 2007. The interim final rule
solicited comments, which are discussed in the ``Section by Section
Review'' below and incorporated in this final rule. In addition, the
interim final rule sought recommendations for designation of Marine
Highway Corridors. This rule adopts the interim final rule, addresses
Marine Highway Corridors (and continues to solicit recommendations for
Marine Highway Corridor recommendations), and establishes eligibility
requirements, criteria and information necessary to apply for
designation as a Marine Highway Project by the Secretary of
Transportation. Solicitations from applicants desiring Marine Highway
Project designation will be initiated through notification in the
Federal Register at a future date. This rule also sets forth the manner
in which the Department of Transportation will identify and recommend
solutions to impediments to expanded use of marine highways and lays
the groundwork for coordinating with States, private transportation
providers, and local and Tribal governments, and conducting research
related to marine highway development. The program should improve
system capacity and efficiency, air quality, highway safety, and
national security.

SUMMARY: The Natural Resources Conservation Service (NRCS), on behalf
of the Commodity Credit Corporation (CCC), announces that a minimum of
$25 million in financial assistance will be made available in fiscal
year (FY) 2010 for the Wetlands Reserve Enhancement Program (WREP)
throughout the United States to eligible landowners.
    Under WREP, NRCS enters into agreements with eligible partners to
help enhance conservation outcomes on wetlands and adjacent lands. WREP
targets and leverages resources to carry out high priority wetland
protection, restoration, and enhancement activities and improve
wildlife habitat through agreements with States (including a political
subdivision or agency of a State), nongovernmental organizations, and
Indian tribes. This notice is to
solicit proposals from potential partners who seek to enter into
agreements with NRCS under this authority and to inform landowners of
the potential availability of program funds through approved projects.

DATES: Effective Date: The notice of request is effective April 9,
2010.
    Eligible partners may submit proposals to the NRCS State office by
mail or via courier.
    By mail: Proposals must be postmarked by May 24, 2010.
    By courier or hand delivery: Proposals must be delivered
by May 24, 2010.

ADDRESSES: Written proposals for projects geographically located within
a State should be sent to the appropriate NRCS State Conservationist,
whose names and addresses are identified as an attachment to this
notice. Written proposals for multi-State projects are to be sent to
the NRCS State Conservationist of the State in which the majority of

courier will be accepted between 9 a.m. and 4 p.m., local time, Monday
through Friday, except Federal holidays.

in children's toys and child care articles, pursuant to section 108 of
the Consumer Product Safety Improvement Act of 2008 (CPSIA) (Pub. L.
110-314).

SUMMARY: The purpose of this announcement is to notify interested
members of the public of the opportunity to submit comments to the
draft fifth National Communication on U.S. climate change actions for
the United Nations Framework Convention on Climate Change (UNFCCC). In
June 1992, the United States signed, and later ratified, the UNFCCC.
Pursuant to the national communication reporting requirements under
Articles 4.2 and 12 of the Convention and to guidelines later adopted
by the UNFCCC Conference of the Parties (COP), the United States
submitted the first U.S. Climate Action Report (CAR) to the UNFCCC
Secretariat in 1994, and subsequent reports in 1997, 2002, and 2006.
The U.S. Government has prepared an initial draft of the fifth National
Communication for public review. This report reflects the U.S.
Government commitment to the UNFCCC to transparently communicate U.S.
actions and policies addressing climate change. See SUPPLEMENTARY
INFORMATION for instructions on accessing the electronic version of the
report, file format requirements for submitting comments, and other
information about electronic filing.

SUMMARY: The Department of Veterans (VA) is amending its regulation
concerning evaluation of studies relating to the health effects of
exposure to herbicides containing dioxin and radiation to remove the
obsolete references to herbicides containing dioxin. This final rule
reflects changes made by the Agent Orange Act of 1991 in the procedures
for VA's evaluation of the health effects of exposure to herbicides
containing dioxin. This document makes non-substantive changes for the
purpose of removing obsolete regulatory provisions.

Regulation Supplement (DFARS) to address requirements for minimizing
the use of hexavalent chromium in defense weapon systems, subsystems,
components, and other items. The proposed rule prohibits the delivery
of items containing hexavalent chromium under DoD contracts unless an
exception applies.
