FY2010 Supplemental Funding for Brownfields Revolving Loan Fund
(RLF) Grantees

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice of the Availability of Funds.

-----------------------------------------------------------------------

SUMMARY: EPA's Office of Brownfields and Land Revitalization (OBLR)
plans to make available approximately $8 million to supplementally fund
Revolving Loan Fund capitalization grants previously awarded
competitively under section 104(k)(3) of the Comprehensive
Environmental Response, Compensation and Liability Act (CERCLA), 42
U.S.C. 9604(k)(3). Brownfields Cleanup Revolving Loan Fund (BCRLF)
pilots awarded under section 104(d)(1) of CERCLA that have not
transitioned to section 104(k)(3) grants are not eligible to apply for
these funds. EPA will consider awarding supplemental funding only to
RLF grantees who have demonstrated an ability to deliver programmatic
results by making at least one loan or subgrant. The award of these
funds is based on the criteria described at CERCLA 104(k)(4)(A)(ii).
    The Agency is now accepting requests for supplemental funding from
RLF grantees. Requests for funding must be submitted to the appropriate
EPA Regional Brownfields Coordinator (listed below) by [insert date 30
days from date of publication]. Funding requests for hazardous
substances and/or petroleum funding will be accepted. Specific
information on submitting a request for RLF supplemental funding is
described below and additional information may be obtained by
contacting the EPA Regional Brownfields Coordinator.

DATES: This action is effective March 9, 2010.

Clean Air Act Advisory Committee (CAAAC) Request for Nominations
to the CAAAC

ACTION: Notice.

SUMMARY: The Environmental Protection Agency (EPA) established the
Clean Air Act Advisory Committee (CAAAC) on November 19, 1990, to
provide independent advice and counsel to EPA on policy issues
associated with implementation of the Clean Air Act of 1990. The
Committee advises on economic, environmental, technical scientific, and
enforcement policy issues.
    Request for Nominations: The U.S. Environmental Protection Agency
(EPA) invites nominations of qualified candidates to be considered for
appointments to the Clean Air Act Advisory Committee and its
subcommittees. Suggested deadline for receiving nominations is April 9,
2010. Appointments will be made by the Administrator of the
Environmental Protection Agency. Appointments for the full CAAAC
committee are expected to be announced in the summer of 2010. Nominee's
qualifications will be assessed under the mandates of the Federal
Advisory Committee Act, which requires Committees to maintain diversity
across a broad range of constituencies, sectors, and groups.
    Nominations for membership must include a resume describing the
professional and educational qualifications of the nominee as well as
community-based experience. Contact details should include full name
and title, business mailing address, telephone, fax, and e-mail
address. A supporting letter of endorsement is encouraged but not
required.

SUMMARY: The U.S. Department of Energy (DOE) is establishing metal
halide lamp ballast test procedures in today's final rule by which
manufacturers will demonstrate compliance with the metal halide lamp
fixture energy conservation standards mandated by the Energy Policy and
Conservation Act (EPCA), as amended. These test procedures are based
primarily on and incorporate by reference provisions of American
National Standards Institute (ANSI) Standard C82.6-2005, ``Ballasts for
High-Intensity Discharge Lamps--Methods of Measurement.'' As further
required by EPCA, DOE is establishing a test method for measuring
standby mode power consumption and explaining why off mode power
consumption does not apply to metal halide lamp ballasts. The test
procedures' standby mode provisions are based on the International
Electrotechnical Commission (IEC) Standard 62301, ``Household
electrical appliances--Measurement of standby power.'' This rule also
adopts a number of definitions for key terms.

DATES: These test procedures are effective on April 8, 2010. The
incorporation by reference of a certain publication listed in this rule
is approved by the Director of the Federal Register as of April 8,
2010.

Hazardous Materials: Risk-Based Adjustment of Transportation

AGENCY: Pipeline and Hazardous Materials Safety Administration (PHMSA).

SUMMARY: PHMSA, in consultation with the Transportation Security
Administration (TSA) of the Department of Homeland Security (DHS), is
modifying current security plan requirements applicable to the
commercial transportation of hazardous materials by air, rail, vessel,
and highway. Based on an evaluation of the security threats associated
with specific types and quantities of hazardous materials, the final
rule narrows the list of materials subject to security plan
requirements and reduces associated regulatory costs and paperwork
burden. The final rule also clarifies certain requirements related to
security planning, training, and documentation.

DATES: Effective date: This final rule is effective October 1, 2010.
    Voluntary compliance date: Voluntary compliance with all the
amendments in this final rule is authorized as of April 8, 2010.

SUMMARY: The Saint Lawrence Seaway Development Corporation (SLSDC) and
the St. Lawrence Seaway Management Corporation (SLSMC) of Canada, under
international agreement, jointly publish and presently administer the
St. Lawrence Seaway Regulations and Rules (Practices and Procedures in
Canada) in their respective jurisdictions. Under agreement with the
SLSMC, the SLSDC is amending the joint regulations by updating the
Seaway Regulations and Rules in various categories. The changes will
update the following sections of the Regulations and Rules: Condition
of Vessels; Radio Communications; and General. These amendments are
necessary to take account of updated procedures and will enhance the
safety of transits through the Seaway. Several of the proposed
amendments are merely editorial or for clarification of existing
requirements.

SUMMARY: This notice provides the public with notification that EPA has
prepared a draft Report to Congress: Study of Discharges Incidental to
Normal Operation of Commercial Fishing Vessels and Other Non-
Recreational Vessels Less than 79 feet. EPA conducted the study
required by Public Law 110-299 and is publishing this draft report to
seek public comment prior to finalizing the report. This draft report
presents the information required by Public Law 110-299 on the types of
wastewater discharged from commercial fishing vessels and non-
recreational vessels less than 79 feet in length. The draft report can
be accessed in its entirety at http://www.epa.gov/npdes/vessels. This
notice is being issued to obtain public comment on the draft report.

the Secondary National Ambient Air Quality Standards for NOx and SOx:
First External Review Draft (March 2010). The chartered CASAC will
subsequently hold a public teleconference to review and approve the
Panel's report.

DATES: The Panel meeting will be held Thursday, April 1, 2010 from 8:30

Beauveria bassiana HF23; Amendment of Exemption from the
Requirement of a Tolerance

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: This regulation amends an exemption from the requirement of a
tolerance for residues of the microbial insecticide. Beauveria bassiana
HF23 (40 CFR 180.1273) on all food commodities when used to treat
chicken and livestock facilities, from which manure will eventually be
composted and used as fertilizer on agricultural crops. JABB of the
Carolinas submitted a petition to EPA under the Federal Food, Drug, and
Cosmetic Act (FFDCA), requesting this amendment of the exemption from
the requirement of a tolerance. This regulation eliminates the need to
establish a maximum permissible level for residues of Beauveria
bassiana HF23.

DATES: This regulation is effective March 5, 2010. Objections and
requests for hearings must be received on or before May 4, 2010, and

applicant proposes the use of a new chemical which has not been
registered by the EPA.

SUMMARY: The Secretary of Agriculture intends to establish the
Collaborative Forest Landscape Restoration Advisory Committee
(Committee) pursuant to Title IV, Section 4003(e) of Omnibus Public
Land Management Act of 2009 (Pub. L. 111-11) passed into law on March
30, 2009. The Collaborative Forest Landscape Restoration Advisory
Committee is being established to evaluate, and provide recommendations
on each project proposal that has been submitted under Section
4003(c)(2) of this act. As required by the Federal Advisory Committee
Act, charters for Federal advisory committees must be renewed every 2
years. The Committee is soliciting nominations to fill no more than 15
vacancies with terms up to 2 years. The public is invited to submit
nominations for membership on the Collaborative Forest Landscape
Restoration Advisory Committee.

SUMMARY: The Comprehensive Environmental Response, Compensation, and
Liability Act of 1980 (``CERCLA'' or ``the Act''), as amended, requires
that the National Oil and Hazardous Substances Pollution Contingency
Plan (``NCP'') include a list of national priorities among the known
releases or threatened releases of hazardous substances, pollutants, or
contaminants throughout the United States. The National Priorities List
(``NPL'') constitutes this list. The NPL is intended primarily to guide
the Environmental Protection Agency (``EPA'' or ``the Agency'') in
determining which sites warrant further investigation. These further
investigations will allow EPA to assess the nature and extent of public
health and environmental risks associated with the site and to
determine what CERCLA-financed remedial action(s), if any, may be
appropriate. This rule adds nine sites to the NPL, all to the General
Superfund Section.

DATES: Effective Date: The effective date for this amendment to the NCP
is April 5, 2010.

ACTION: Notice of the extension of comment period.

SUMMARY: This notice extends the comment period on a notice published
in the Federal Register on December 9, 2009 (74 FR 65102). The original
date that the comment period would end was March 5, 2010. That date
will now be extended until April 5, 2010.
    Section 2031 of the Water Resources Development Act of 2007 (Pub.
L. 110-114) directs the Secretary of the Army to revise the ``Economic
and Environmental Principles and Guidelines for Water and Related Land
Resources Implementation Studies,'' (P&G) dated March 10, 1983,
consistent with a number of considerations enumerated in the statute.
The Administration has initiated the development of uniform planning
standards for the development of water resources that would apply to
water resources development programs and activities government-wide, to
agencies in addition to the traditional water resources development
agencies covered under the current Principles and Guidelines: the Army
Corps of Engineers, Bureau of Reclamation (Interior), Natural Resources
Conservation Service (USDA), and Tennessee Valley Authority. Therefore,
the Council on Environmental Quality (CEQ), in coordination with the
Office of Management and Budget, has implemented a two phase
interagency process revising the planning guidance. The first phase
focused on facilitating interagency revisions to the ``Principles and
Standards'' (Chapter I of the existing P&G) of Principles and
Guidelines for planning water resources projects. The second phase will
address revisions to the Procedures (Chapters II through IV of the 1983
P&G).
    Upon approval of the revised ``Principles and Standards'' and the
future revision of the Procedures, the entire revision will apply to
Federal water resources implementation studies including project
reevaluations and modifications except those commenced prior to the
issuance of the revised guidance. The purpose of this notice is
to provide an opportunity for interested individuals and organizations
to submit comments on the revised ``Principles and Standards''. Using
these comments and those from the National Academy of Sciences, CEQ
will lead an interagency effort to finalize the Principles and
Standards and draft the Procedures sections of the Principles and
Guidelines.

SUMMARY: The South Atlantic Fishery Management Council (Council) has
submitted CE-BA 1 which includes amendments to the following South
Atlantic fishery management plans (FMPs): the FMP for Coral, Coral
reefs, and Live/Hard Bottom Habitats of the South Atlantic Region
(Coral FMP); the FMP for the Dolphin and Wahoo Fishery off the Atlantic
States (Dolphin and Wahoo FMP); the FMP for Golden Crab of the South
Atlantic Region (Golden Crab FMP); the FMP for the Shrimp Fishery of
the South Atlantic Region (Shrimp FMP); and the FMP for the Snapper-
Grouper Fishery of the South Atlantic Region (Snapper-Grouper FMP), as
prepared and submitted by the South Atlantic Fishery Management Council
(Council); as well as the FMP for Coastal Migratory Pelagic (CMP)
Resources (CMP FMP); and the FMP for the Spiny Lobster Fishery of the
Gulf of Mexico and South Atlantic (Spiny Lobster FMP), as prepared and
submitted by the South Atlantic and Gulf of Mexico Fishery Management
Councils.
    Management actions proposed in CE-BA 1 include the establishment of
deepwater Coral Habitat Areas of Particular Concern (CHAPCs) to protect
what is currently thought to be the largest distribution (>23,000
square miles) of pristine deepwater coral ecosystems in the world.
Actions in the amendment would prohibit the use of bottom damaging
fishing gear and allow for the creation of allowable fishing zones
within the CHAPCs in the historical fishing grounds of the golden crab
and deepwater shrimp fisheries while extending protection for deepwater
coral ecosystems. CE-BA 1 would also amend the Coral, Shrimp, Coastal
Migratory Pelagics, Golden Crab, Spiny Lobster, Dolphin-Wahoo, and
Snapper-Grouper FMPs to provide spatial information on previously
designated essential fish habitat (EFH).
