SUMMARY:  This final rule makes minor revisions to the terminology of
certain commodity terms listed under 40 CFR part 180, subpart C. This
action establishes a uniform listing of commodity terms.

DATES:  This document is effective September 9, 2009. Objections and

and must be filed in accordance with the instructions provided in 40

Pendimethalin; Pesticide Tolerances

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: This regulation establishes a tolerance for combined residues
of the herbicide pendimethalin including its metabolites and degradates
in or on olive at 0.1 parts per million (ppm). The Interregional
Research Project Number 4 (IR-4) requested this tolerance under the
Federal Food, Drug, and Cosmetic Act (FFDCA).

DATES: This regulation is effective September 9, 2009. Objections and
requests for hearings must be received on or before November 9, 2009,
and must be filed in accordance with the instructions provided in 40

ACTION: Request for Nominations to the Local Government Advisory
Committee (LGAC).

SUMMARY: The U.S. Environmental Protection Agency (EPA) invites
nominations from a diverse range of qualified candidates to be
considered for appointment to its Local Government Advisory Committee
(LGAC). Vacancies are anticipated to be filled by January 2010. Sources
in addition to this Federal Register Notice may also be utilized in the
solicitation of nominees.
    Background: The LGAC is a federal advisory committee chartered
under the Federal Advisory Committee Act (FACA), Public Law 92-463. EPA
established the LGAC in 1993 to provide independent advice to the EPA
Administrator on a broad range of environmental issues affecting local
government. Members serve as local elected and appointed officials
representing: counties, cities, and other local governments; small
communities; tribal governments; and state governments. Members are
appointed by the EPA Administrator for two year terms with the
possibility of reappointment to a second term. The LGAC usually meets
2-3 times annually and the average workload for the members is
approximately 5 to 10 hours per month. EPA provides reimbursement for
travel and other incidental expenses associated with official
government business. EPA is seeking nominations from mayors, city
council members, county commissioners and executives, city managers,
small town officials, public works and environmental directors, tribal
governments, and state officials including legislators and
environmental directors. Nominees will be considered according to the
mandates of FACA, which requires committees to maintain diversity
across a broad range of constituencies, sectors, interests, and groups.
EPA strongly encourages nominations from women and minorities.
    The following criteria will be used to evaluate nominees:

--Experience serving as an elected official;
--Experience serving as an appointed official for a state, county, city
or tribe;
--Experience in working at the national level on local governments
issues;
--Demonstrated experience with environmental and sustainability issues;
--Executive management level experience with membership in broad-based
networks;
--Excellent interpersonal, oral and written communication, and
consensus-building skills.
--Ability to volunteer time to attend meetings 2-3 times a year,
participate in teleconference meetings, attend listening sessions with
the Administrator or other senior-level officials, develop policy
recommendations to the Administrator, and prepare reports and advice
letters. Nominations must include a resume and a short biography
describing the professional and educational qualifications of the
nominee, as well as the nominee's current business address, e-mail
address, and daytime telephone number. Interested candidates may self-
nominate.

SUMMARY: Section 5207 of the Safe, Accountable, Flexible, Efficient
Transportation Equity Act: A Legacy for Users (SAFETEA-LU) established
the Surface Transportation Environment and Planning Cooperative
Research Program (STEP). The FHWA anticipates that resources for STEP
or a similar program to carry out national research on issues related
to planning, environment, and realty are likely to be included in
future surface transportation legislation even though SAFETEA-LU
expires at the end of this fiscal year. Legislation preceding SAFETEA-
LU--the Intermodal Surface Transportation Efficiency Act of 1991
(ISTEA) and the Transportation Equity Act for the 21st Century (TEA-
21)--provided resources for FHWA to carry out surface transportation
research initiatives that included planning, environment, and realty
research. SAFETEA-LU continued FHWA's research program funding and
established STEP.
    The purpose of this notice is to announce the proposed FY 2010 STEP
implementation strategy in anticipation that the FHWA is likely to
receive resources for national research on issues related to
environment and planning as a part of future transportation legislation
and to request suggested lines of research for FY 2010 via the STEP Web
site at: http://www.fhwa.dot.gov/hep/step/index.htm. Stakeholder
feedback from the STEP Web site provides useful research ideas and
helps to prevent redundant areas of research, saving valuable research
funds.

Notice of Availability of Revised Fuel Cycle Oversight Process

AGENCY: Nuclear Regulatory Commission.

ACTION: Request for public comment on revision of the NRC's fuel cycle
oversight program.

SUMMARY:
    The Nuclear Regulatory Commission (NRC) is proposing significant
revisions to its processes for overseeing the safety and security of
fuel cycle facilities. The NRC plans to develop a revised oversight
process for fuel cycle facilities that is more risk-informed, and
performance-based, resulting in more objective, predictable, and
transparent results of licensee or certificate holder assessments.
(This notice will use ``licensees'' throughout, but in doing so the
intent is also to include ``certificate holders.'') Current oversight
consists mainly of inspections, enforcement and periodic assessments
based on inspection findings. NRC staff intends that any revised
oversight would not establish any new regulatory requirements. Rather,
revised oversight would improve inspection and assessment so that NRC
conclusions would be more closely based on risk and more understandable
to members of the public. Revised oversight could potentially add
objective measures of performance, called performance indicators, with
criteria for measuring acceptable performance. However, development of
performance indicators may not be part of the initial revision to the
oversight process. Inspections would focus in areas of highest risk
that are not well-measured by performance indicators and on validating
performance indicator information. Assessments would be based on more
objective criteria. Supplemental inspections (those above and beyond
the number and type of inspections normal for a well-performing plant)
of licensees whose performance shows indications of decline, would also
be based on objective criteria. These principles are currently applied
by the NRC in the oversight of power reactor safety and security and is
outlined in ``Reactor Oversight Process,'' NUREG-1649, (Agencywide
Documents Access and Management System [ADAMS] Accession No.
ML070890365).
    Since 1999, the NRC has undertaken several initiatives to examine
and improve the NRC's oversight process for fuel cycle facilities,
including those licensed or certified under Title 10 of the Code of
Federal Regulations (10 CFR) Part 40 (Domestic Licensing of Source
Material), Part 70 (Domestic Licensing of Special Nuclear Material),
and Part 76 (Certification of Gaseous Diffusion Plants). Although
previous efforts resulted in some revisions to inspection and
assessment procedures, current NRC oversight could be improved by more
fully incorporating into inspection and assessment the risk insights of
licensees' integrated safety analyses, where applicable (the
requirement to perform an integrated safety analysis apply only to 10
CFR Part 70 licensees). Integrated safety analyses establish safety
controls based on analyses of potential hazards at a facility.
    To meet the objective of developing an oversight process with an
improved degree of transparency, predictability, objectivity and
consistency, using risk-informed and performance-based tools, the staff
is undertaking a comprehensive effort to develop a Revised Fuel Cycle
Oversight Process (RFCOP). The staff's efforts will be consistent with
the recent guidance in this area, notably the guidance provided in the
Staff Requirements Memoranda dated April 3, 2008, and February 17, 2009
(Agencywide Documents Access and Management System [ADAMS] Accession
Nos. ML080940439 and ML090490032), and will be responsive to
recommendations in the Office of Inspector General report OIG 07-A-06
(ADAMS ML070100282).

DATES: The comment period expires November 2, 2009. Comments received
after this date will be considered if it is practical to do so, but the
Commission is able to ensure consideration only for comments received
on or before this date.

Methoxyfenozide; Pesticide Tolerances

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: This regulation establishes tolerances for residues of
methoxyfenozide in or on citrus oil and fruit, citrus, group 10 with
regional registrations; and corn, pop, grain; corn, pop, stover; pea,
dry seed; and pomegranate. The Interregional Research Project No. 4
(IR-4) requested these tolerances under the Federal Food, Drug, and
Cosmetic Act (FFDCA).

DATES: This regulation is effective September 2, 2009. Objections and
requests for hearings must be received on or before November 2, 2009,
and must be filed in accordance with the instructions provided in 40
CFR part 178 (see also Unit I.C. of the SUPPLEMENTARY INFORMATION).

SUMMARY: The Environmental Protection Agency (EPA) is announcing a 30-
day public comment period for the external peer review draft of
``Recommended Toxicity Equivalency Factors (TEFs) for Human Health Risk
Assessments of Dioxin and Dioxin-Like Compounds,'' a draft guidance
document. An EPA contractor for external peer review will convene a
panel of experts and will organize and conduct an independent expert
external peer review meeting to review the draft document. All comments
received by the closing date of October 2, 2009 will be shared with the
external peer review panel for their consideration. Comments received
after the close of the comment period may be considered by EPA when it
finalizes the document. This draft guidance document does not represent
and should not be construed to represent any EPA policy, viewpoint, or
determination. Members of the public may obtain the draft document from
http://www.regulations.gov; or http://www.epa.gov/raf/hhtefguidance; or
from Seema Schappelle via the contact information below. The public
comment period and external peer review are separate processes that
provide opportunities for all interested parties to comment on the
document.
    The external expert peer review will be conducted by letter and
open teleconference in the fall 2009 time frame. The panel may consider
public comments received in the official public docket for this
activity under docket ID number EPA-HQ-ORD-2009-0605. The draft
document is available at http://www.epa.gov/raf/hhtefguidance. In
preparing a final document, EPA intends to consider the public comments
submitted to EPA's docket during the public comment period and the

EPA. It does not represent and should not be construed to represent any

SUMMARY: The U.S. Department of Commerce (DOC) will host a one-day
conferences for participants in the agribusiness industry during which
senior U.S. government officials will inform private sector
stakeholders, particularly manufacturers of irrigation and agricultural
equipment and relevant alternative energy technology, food processors,
and specialized service providers, of Commerce Department programs,
services, and data that may be of assistance to them in reducing their
consumption of water and energy. By lowering U.S. companies' costs
associated with water and energy consumption, Commerce Department
programs can assist American firms to be more competitive in domestic
and international markets, as well as advance U.S. Government
objectives with respect to sustainability and climate change. A
secondary purpose is to inform attendees of preparations for the United
Nations Framework Convention on Climate Change (UNFCCC) negotiations
and for them to advise U.S. officials on the impact a new UNFCCC
agreement could have on their respective operations and on associated
commercial opportunities.
    The conference will be held in Fresno, California at the Holiday
Inn Downtown.
