AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice.

-----------------------------------------------------------------------

SUMMARY: The Environmental Protection Agency's Total Coliform Rule/
Distribution System Advisory Committee established an Agreement in
Principle (AIP), which provides the Agency with recommendations for
revising the 1989 Total Coliform Rule (TCR). One of the recommendations

opportunities for stakeholders to provide feedback on the development
of the proposed revised Total Coliform Rule (RTCR).
Topics to be discussed in the meeting include a review of EPA's
commitments to stakeholder outreach and involvement pertaining to the
proposed RTCR and linkages to other rules; plan and schedule for
guidance documents development; progress in converting the AIP
recommendations to the rule language; discussion on proposed changes to
the Public Notification and Consumer Confidence Report language; and
discussion on AIP recommendations regarding review of the TCR
analytical methods for Total Coliform/E. coli. EPA will also provide
status on the Distribution System Research and Information Collection
Partnership. Teleconferencing will be available for individuals unable
to attend the meeting in person.

[EPA-HQ-OPP-2008-0794; FRL-8399-5]

Formaldehyde, Polymer with 2-Methyloxirane and 4-Nonylphenol;
Tolerance Exemption

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

-----------------------------------------------------------------------

SUMMARY: This regulation establishes an exemption from the requirement
of a tolerance for residues of formaldehyde, polymer with 2-
methyloxirane and 4-nonylphenol (CAS Reg. No. 37523-33-4); when used as
an inert ingredient in a pesticide chemical formulation. Akzo Nobel
Surface Chemistry, LLC, submitted a petition to EPA under the Federal
Food, Drug, and Cosmetic Act (FFDCA), requesting an exemption from the
requirement of a tolerance. This regulation eliminates the need to
establish a maximum permissible level for residues of formaldehyde,
polymer with 2-methyloxirane and 4-nonylphenol on food or feed
commodities.

DATES: This regulation is effective March 18, 2009. Objections and
requests for hearings must be received on or before May 18, 2009, and
must be filed in accordance with the instructions provided in 40 CFR
part 178 (see also Unit I.C. of the SUPPLEMENTARY INFORMATION).

ADDRESSES: EPA has established a docket for this action under docket
identification (ID) number EPA-HQ-OPP-2008-0794. All documents in the
docket are listed in the docket index available at http://

Prevention of Significant Deterioration (PSD) and Nonattainment
New Source Review (NSR): Aggregation

AGENCY: Environmental Protection Agency.

ACTION: Proposed Rule.

-----------------------------------------------------------------------

SUMMARY: EPA is proposing to delay the effective date for the
Environmental Protection Agency (``EPA'') rule addressing
``aggregation'' under the Prevention of Significant Deterioration
(``PSD'') and the nonattainment New Source Review (``nonattainment
NSR'') programs (collectively, ``NSR'') published in the Federal
Register on January 15, 2009. This rule (the ``NSR Aggregation
Amendments'') described when a source must combine (``aggregate'')
nominally-separate physical changes and changes in the method of
operation for the purpose of determining whether they are a single
change resulting in a significant emissions increase.
On January 30, 2009, the Natural Resources Defense Council
(``NRDC'') submitted a petition for reconsideration (the ``NRDC
Petition'') of the NSR Aggregation Amendments. In response to the NRDC
Petition, EPA announced on February 13, 2009, that it would convene a
reconsideration proceeding for the NSR Aggregation Amendments and would
delay the effective date of the rule from February 17, 2009 until May
18, 2009. In this action, EPA is proposing an additional delay of the
effective date of the NSR Aggregation Amendments and soliciting comment
on the duration of this additional delay in order to allow for
sufficient time to conduct the reconsideration proceeding.

DATES: Comments. Comments must be received on or before April 17, 2009.
Public Hearing. If anyone contacts EPA requesting a public hearing
by March 30, 2009, we will hold a public hearing on April 2, 2009. If a

NUCLEAR REGULATORY COMMISSION

[NRC-2009-0117]

Notice of Issuance of Regulatory Guide

AGENCY: Nuclear Regulatory Commission.

ACTION: Notice of Issuance and Availability of Regulatory Guide 1.200,
Revision 2.

-----------------------------------------------------------------------

FOR FURTHER INFORMATION CONTACT: Mary Drouin, Office of Nuclear
Regulatory Research, U.S. Nuclear Regulatory Commission, Washington, DC
20555-0001, telephone (301) 251-7574 or e-mail to Mary.Drouin@nrc.gov.

SUPPLEMENTARY INFORMATION:

I. Introduction

The U.S. Nuclear Regulatory Commission (NRC) is issuing a revision
to an existing guide in the agency's ``Regulatory Guide'' series. This
series was developed to describe and make available to the public
information such as methods that are acceptable to the NRC staff for
implementing specific parts of the agency's regulations, techniques
that the staff uses in evaluating specific problems or postulated
accidents, and data that the staff needs in its review of applications
for permits and licenses.
Revision 2 of Regulatory Guide 1.200, ``An Approach for Determining
the Technical Adequacy of Probabilistic Risk Assessment Results for
Risk-Informed Activities,'' was issued with a temporary identification
as Draft Regulatory Guide, DG-1200. In 1995, the NRC issued a Policy
Statement on the use of probabilistic risk analysis (PRA), encouraging
its use in all regulatory matters. That Policy Statement states that ``
* * * the use of PRA technology should be increased to the extent
supported by the state-of-the-art in PRA methods and data and in a
manner that complements the NRC's deterministic approach.'' Since that
time, many uses have been implemented or undertaken, including
modification of the NRC's reactor safety inspection program and
initiation of work to modify reactor safety regulations. Consequently,
confidence in the information derived from a PRA is an important issue,
in that the accuracy of the technical content must be sufficient to
justify the specific results and insights that are used to support the
decision under consideration.
This regulatory guide describes one acceptable approach for
determining whether the technical adequacy of the PRA, in total or the
parts that are used to support an application, is sufficient to provide
confidence in the results, such that the PRA can be used in regulatory
decision-making for light-water reactors. This guidance is intended to
be consistent with the NRC's PRA Policy Statement. It is also intended
to reflect and endorse guidance provided by standards-setting and
nuclear industry organizations.

ANNOUNCEMENT 8

Subject: MIENERGY/Nuclear - ND. NRC. Indiana Michigan Power Company; Receipt of Request for Action Under 10 CFR 2.206

[Federal Register: March 16, 2009 (Volume 74, Number 49)]
[Notices]

NUCLEAR REGULATORY COMMISSION

[Docket No. 50-315; License No. DPR-58; NRC-2009-0111]

Indiana Michigan Power Company; Receipt of Request for Action
Under 10 CFR 2.206

Notice is hereby given that by petition dated December 16, 2008,
Mr. David Lochbaum (petitioner) has requested that the U.S. Nuclear
Regulatory Commission (NRC) take action with regard to the licensee for
the Donald C. Cook Nuclear Power Plant, Unit 1. The petitioner requests
that the NRC issue a demand for information requiring the licensee to
docket information regarding the following four issues at least 30 days
before restarting the reactor from the current outage:
    (1) The vibration levels experienced in the control room, turbine
building, and other structures during the September 20, 2008, event;
    (2) The vibration levels assumed in these locations during the
safe-shutdown earthquake (SSE);
    (3) In locations where the vibration levels during the September
20, 2008, event exceeded the vibration levels assumed for an SSE, the
extent to which piping and pipe supports were replaced or repaired
because of potential stress damage and the bases for not replacing
other structures, systems, and components exposed to greater than SSE
loading; and
    (4) In locations where the vibration levels during the September
20, 2008, event did not exceed the vibration levels assumed for an SSE,
the extent of the measures taken to protect against spurious equipment
operation and the bases for concluding that the as-left configuration
will not pose a public health hazard in event of an SSE.
As the basis for this request, the petitioner states that the event
caused significant vibration levels that caused spurious operation of
standby equipment and may have contributed to a breach that seriously
impaired the fire protection system. The petitioner further states that
the information being sought in the petition is needed to apply the
proper lessons from the event to the future operation of the Donald C.
Cook Nuclear Plant, Unit 1. The petitioner states that without this
information, the NRC cannot be assured of, and the public is therefore
not adequately protected from, significant adverse safety implications
of an SSE causing spurious actuation of equipment.
The NRC is treating the request pursuant to Title 10, Section
2.206, ``Requests for Action under This Subpart,'' of the Code of
Federal Regulations (10 CFR 2.206). The request has been referred to
the Director of the Office of Nuclear Reactor Regulation. As provided
by 10 CFR 2.206, the NRC will take appropriate action on this petition
within a reasonable time. A copy of the petition is available for
inspection at the Commission's Public Document Room (PDR), located at
One White Flint North, Public File Area O1 F21, 11555 Rockville Pike
(first floor), Rockville, MD. Publicly available records will be accessible from the Agencywide Documents Access and Management System (ADAMS) Public Electronic Reading Room on the Internet at the NRC Web site, http://www.nrc.gov/
reading-rm/adams.html
. Persons who do not have access to ADAMS or who
encounter problems in accessing the documents located in ADAMS should
contact the NRC PDR reference staff by telephone at 1-800-397-4209 or
301-415-4737, or by e-mail to PDR.Resource@nrc.gov.
