SUMMARY: EPA will hold a public meeting to give members of the public
an opportunity to comment on a proposed rule under section 4(a)(1)(B)
of the Toxic Substances Control Act (TSCA) to require manufacturers,
importers, and processors of certain high production volume (HPV)
chemical substances to conduct testing to obtain screening level data
for health and environmental effects and chemical fate. Opportunity to
present oral comment was provided in the proposed rule, and in response
to that opportunity, two requests to present oral comments were
received.

DATES: The meeting will be held on Tuesday, March 31, 2009, from 8 a.m.
to noon.
    Requests to participate in the meeting must be received on or
before March 31, 2009.

SUMMARY: Section 325 of the Energy Independence and Security Act of
2007 provides the Commission with authority to promulgate energy
labeling rules for consumer electronics, including televisions. The
Commission is seeking comment on whether it should require labels for
televisions and other consumer electronic products.

partners.

Birds of Conservation Concern 2008, especially to provide

SUMMARY: In this final rule, NESDIS establishes a new schedule of fees
for the sale of its data, information, and related products and
services to users. NESDIS is revising the fee schedule to ensure that
the fees accurately reflect the costs of providing access to the
environmental data, information, and related products and services.
NESDIS is authorized under 15 U.S.C. 1534 to assess fees, up to fair
market value, for access to environmental data, information, and
products derived from, collected, and/or archived by NOAA. Other than
depreciation, costs to upgrade computer hardware and software systems
will not be included in the fees charged to users.

Indiana Michigan Power Company; Receipt of Request for Action
Under 10 CFR 2.206

    Notice is hereby given that by petition dated December 16, 2008,
Mr. David Lochbaum (petitioner) has requested that the U.S. Nuclear
Regulatory Commission (NRC) take action with regard to the licensee for
the Donald C. Cook Nuclear Power Plant, Unit 1. The petitioner requests
that the NRC issue a demand for information requiring the licensee to
docket information regarding the following four issues at least 30 days
before restarting the reactor from the current outage:
    (1) The vibration levels experienced in the control room, turbine
building, and other structures during the September 20, 2008, event;
    (2) The vibration levels assumed in these locations during the
safe-shutdown earthquake (SSE);
    (3) In locations where the vibration levels during the September
20, 2008, event exceeded the vibration levels assumed for an SSE, the
extent to which piping and pipe supports were replaced or repaired
because of potential stress damage and the bases for not replacing
other structures, systems, and components exposed to greater than SSE
loading; and
    (4) In locations where the vibration levels during the September
20, 2008, event did not exceed the vibration levels assumed for an SSE,
the extent of the measures taken to protect against spurious equipment
operation and the bases for concluding that the as-left configuration
will not pose a public health hazard in event of an SSE.
    As the basis for this request, the petitioner states that the event
caused significant vibration levels that caused spurious operation of
standby equipment and may have contributed to a breach that seriously
impaired the fire protection system. The petitioner further states that
the information being sought in the petition is needed to apply the
proper lessons from the event to the future operation of the Donald C.
Cook Nuclear Plant, Unit 1. The petitioner states that without this
information, the NRC cannot be assured of, and the public is therefore
not adequately protected from, significant adverse safety implications
of an SSE causing spurious actuation of equipment.
    The NRC is treating the request pursuant to Title 10, Section
2.206, ``Requests for Action under This Subpart,'' of the Code of
Federal Regulations (10 CFR 2.206). The request has been referred to
the Director of the Office of Nuclear Reactor Regulation. As provided
by 10 CFR 2.206, the NRC will take appropriate action on this petition
within a reasonable time. A copy of the petition is available for

SUMMARY: Pursuant to the Federal Advisory Committee Act, EPA gives
notice of a public meeting of the Pesticide Program Dialogue Committee
(PPDC) on April 22-23, 2009. A draft agenda is under development that
will include reports from and discussions about current issues from the
following PPDC work groups: Work Group on 21st Century Toxicology/New
Integrated Testing Strategies; Work Group on Web-Distributed Labeling;
and Work Group on Comparative Safety Statements for Pesticide Product
Labeling. The agenda will also include a discussion about current water
quality issues (including an update on spray drift); a discussion about
an overall strategy regarding incident data, including pyrethroid
incidents and pet incidents; and updates on the Endocrine Disruptors
Screening Program, Pollinator Protection, and the Endangered Species
Act consultation process. Several PPDC work group meetings have also
been scheduled in March and April 2009, and are open to the public.

). On behalf of the Estuary Habitat
Restoration Council (Council), the Corps is soliciting proposals for
estuary habitat restoration projects. This document describes project
criteria and evaluation criteria the Council will use to determine
which projects to recommend. Recommended projects must provide
ecosystem benefits, have scientific merit, be technically feasible, and
be cost-effective. Proposals selected for Estuary Habitat Restoration
Program funding may be implemented in accordance with a cost-share
agreement with the Corps, a cooperative agreement with the Corps, or a
cooperative agreement with one of the other agencies represented on the
Council, subject to availability of funds.

SUMMARY: The U.S. Department of Energy (DOE) today publishes a final
rule to promote Federal procurement of energy-efficient products. The
final rule establishes guidelines for Federal agencies regarding the
implementation of amendments to the National Energy Conservation Policy
Act (NECPA) that require Federal agencies to procure ENERGY STAR
qualified and Federal Energy Management Program (FEMP) designated
products in procurements involving energy consuming products and
systems. Today's final rule includes changes in response to comments
received on the notice of proposed rulemaking published June 19, 2007.
Most notably, today's final rule does not establish a reporting
requirement, as initially proposed, for federal agencies under
procurement requirement of NECPA.

SUMMARY: The U.S. Nuclear Regulatory Commission (NRC) is amending its
regulations governing the disposal of high-level radioactive wastes in
a proposed geologic repository at Yucca Mountain, Nevada. The final
rule implements the U.S. Environmental Protection Agency's (EPA's)
revised standards for doses that could occur after 10,000 years, but
within the period of geologic stability. The final rule also specifies
a range of values for the deep percolation rate to be used to represent
climate change after 10,000 years, as called for by EPA, and specifies
that calculations of radiation doses for workers use the same weighting
factors that EPA is using for calculating individual doses to members
of the public.

DATES: Effective Date: This final rule is effective on April 13, 2009.

SUMMARY: Environmental Protection Agency (EPA) is granting a petition
submitted by Bayer Material Science in Baytown, Texas to exclude (or
delist) the toluene diisocyanate (TDI) residues generated from its
facility located in Baytown, Texas from the lists of hazardous wastes.
This final rule responds to the petition submitted by Bayer Material
Science to delist K027 TDI residues generated from the facility's
distillation units.
    After careful analysis and use of the Delisting Risk Assessment
Software (DRAS), EPA has concluded the petitioned waste is not
hazardous waste. This exclusion applies to 9,780 cubic yards per year
of the K027 residues. Accordingly, this final rule excludes the
petitioned waste from the requirements of hazardous waste regulations
under the Resource Conservation and Recovery Act (RCRA) when it is
disposed in a Subtitle D Landfill.

SUMMARY: The U.S. Environmental Protection Agency (EPA) is announcing
the availability of a document titled, ``First External Review Draft
Integrated Science Assessment for Carbon Monoxide'' (EPA/600/R-09/019).
This draft document was prepared by the National Center for
Environmental Assessment (NCEA) within EPA's Office of Research and
Development as part of the review of the national ambient air quality
standards (NAAQS) for carbon monoxide.
    EPA is releasing this draft document to seek review by the Clean
Air Scientific Advisory Committee (CASAC) and the public. The draft
document does not represent and should not be construed to represent
any final EPA policy, viewpoint, or determination. EPA will consider

SUMMARY: The U.S. Environmental Protection Agency (EPA or Agency),
National Center for Environmental Innovation (NCEI) is giving notice of
the availability of its solicitation for proposals from institutions
that are interested in organizing two symposia over four years to
promote sharing and transfer of innovative environmental protection
approaches among States, EPA, and other primarily governmental
representatives. The solicitation is available at the Agency's State

SUMMARY: Section 136 of the Energy Independence and Security Act of
2007, as amended, provides for grants and loans to eligible automobile
manufacturers and component suppliers for projects that reequip,
expand, and establish manufacturing facilities in the United States to
produce light-duty vehicles and components for such vehicles, which
provide meaningful improvements in fuel economy performance beyond
certain specified levels. Section 136 also provides that grants and
loans may cover engineering integration costs associated with such
projects. The program established by section 136 is referred to as the
Advanced Technology Vehicles Manufacturing Incentive Program.
    This notice announces that DOE has determined to change the
previously announced process for submission of applications for a loan
under section 136. Henceforth, DOE will consider and evaluate
substantially complete applications as and when they are submitted and
may make decisions on such applications and close loans with respect to
such applications at any time.

Wildlife Habitat Incentive Program Correction

SUMMARY: The Natural Resources Conservation Service published in the
Federal Register of January 16, 2009, an interim final rule with
request for comment amending the program regulations for the Wildlife
Habitat Incentive Program (WHIP) to incorporate programmatic changes
authorized by the Food, Conservation, and Energy Act of 2008 (2008
Act). The language in the interim final rule regarding the application
of the payment limitation to joint operations was incorrect and is
inconsistent with payment attributions specified in the regulation
which governs payment limitations and eligibility determinations for
CCC-funded programs. This document corrects that language. NRCS is also
using the opportunity presented by this rulemaking to extend the
comment period by an additional 30 days and ask for public input on key
programmatic implementation questions.

DATES: This correction is effective on March 12, 2009. The comment
period for the WHIP Interim Final Rule published on January 16, 2009,
is hereby extended and comments must be received on or before April 17,
2009. Additionally, NRCS has extended the public comment period for the
Environmental Analysis (EA) and Finding of No Significant Impact
(FONSI) until April 17, 2009. A copy of the EA and FONSI may be
obtained, and comments submitted, as provided for in the January 16,
2009, WHIP interim final rule.
