SUMMARY: The Department of Energy (DOE) is adopting new energy
conservation standards for commercial ice-cream freezers; self-
contained commercial refrigerators, commercial freezers, and commercial
refrigerator-freezers without doors; and remote condensing commercial
refrigerators, commercial freezers, and commercial refrigerator-
freezers. DOE has determined that energy conservation standards for
these types of equipment would result in significant conservation of
energy, and are technologically feasible and economically justified.

DATES: The effective date of this rule is March 10, 2009. The standards
established in today's final rule will be applicable starting January
1, 2012. Incorporation by reference of the material listed is approved
by the Director of the Federal Register on March 10, 2009.

SUMMARY: This action contains a minor correction to the final Civil
Monetary Penalty Inflation Adjustment Rule, which was published on
December 11, 2008 (73 FR 75340) and will be effective on January 12,
2009. As mandated by the Debt Collection Improvement Act (DCIA), the
rule adjusts for inflation the statutory civil penalties that may be
assessed for violations of EPA-administered statutes and their
implementing regulations. A corrected version of Table 1 of the
regulation appears at the end of this action.

Extract of Chenopodium ambrosioides near ambrosioides; Exemption
from the Requirement of a Tolerance

AGENCY:  Environmental Protection Agency (EPA).

ACTION:  Final rule.

SUMMARY:  This regulation establishes an exemption from the requirement
of a tolerance for residues of the Extract of Chenopodium ambrosioides
near ambrosioides on all food commodities when applied/used as a
biochemical insecticide/acaricide. AgraQuest, Inc. submitted a petition
to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA),
requesting an exemption from the requirement of a tolerance. This
regulation eliminates the need to establish a maximum permissible level
for residues of Extract of Chenopodium ambrosioides near ambrosioides
on all food commodities.

DATES:  This regulation is effective January 7, 2009. Objections and
requests for hearings must be received on or before March 9, 2009, and
must be filed in accordance with the instructions provided in 40 CFR
part 178 (see also Unit I.C. of the SUPPLEMENTARY INFORMATION).

Multiple Chemicals; Extension of Tolerances for Emergency

SUMMARY: This regulation extends time-limited tolerances for the
pesticides listed in Unit II. of the SUPPLEMENTARY INFORMATION. These
actions are in response to EPA's granting of emergency exemptions under
section 18 of the Federal Insecticide, Fungicide, and Rodenticide Act
(FIFRA) authorizing use of these pesticides. Section 408(l)(6) of the
Federal Food, Drug, and Cosmetic Act (FFDCA) requires EPA to establish
a time-limited tolerance or exemption from the requirement for a
tolerance for pesticide chemical residues in food that will result from
the use of a pesticide under an emergency exemption granted by EPA.

DATES: This regulation is effective January 7, 2009. Objections and
requests for hearings must be received on or before March 9, 2009, and
must be filed in accordance with the instructions provided in 40 CFR
part 178 (see also Unit I.C. of the SUPPLEMENTARY INFORMATION.

navigable water of the U.S., and to discharge dredged or fill material
into waters of the U.S. to facilitate the construction and operation of
a 300 megawatt (MW) baseload coal-fired electric generating unit,
referred to as NED 3, near Cassville in Grant County, WI. The Corps has
terminated its review of the WPL permit application due to WPL's
withdrawal of their permit application on November 21, 2008.

consider establishing energy conservation standards for walk-in coolers
and walk-in freezers. Accordingly, DOE will hold an informal public
meeting to discuss and receive comments on its planned analytical
approach and issues it will address in this rulemaking proceeding. DOE
welcomes written comments from the public on our stated approach for
this rulemaking. To inform stakeholders and to facilitate this process,
DOE has prepared a Framework Document which details the analytical
approach and identifies several issues on which DOE is particularly

Amending the Water and Waste Program Regulations

AGENCY: Rural Utilities Service, USDA.

ACTION: Direct final rule.

-----------------------------------------------------------------------

SUMMARY: The Rural Utilities Service (RUS), an agency delivering the
United States Department of Agriculture's (USDA) Rural Development
Utilities Programs, hereinafter referred to as Rural Development or the
Agency, is amending its regulations to administer the Water and Waste
Loan and Grant Programs. This action implements provisions of the 2008
Farm Bill for interest rates on direct loans and modifies the interest
rate structure currently being used for the direct loan program.
Interest rates on loans subject to 5 or 7 percent interest rate
limitations (poverty and intermediate rates, respectively) will adjust
with changes in the market rate. The poverty and intermediate interest
rates will be established at rates equal to a percentage of current
market yields for outstanding municipal obligations. The intended
effect of the amendment is to make part 1780 current with statutory
authority. No adverse comments are expected.

DATES: This rule will become effective February 20, 2009 without
further action unless the Agency receives written adverse comments or
written notices of intent to submit adverse comments on or before
February 5, 2009. If the Agency receives adverse comments or notices,
the Agency will publish a timely notice in the Federal Register
withdrawing the rule. Comments received will be considered under the
proposed rule published in this edition of the Federal Register in the
proposed rule section. A second public comment period will not be held.

equivalent no later than February 5, 2009.

this proposed rule, and the action will become effective at the time
specified in the direct final rule. If the Agency receives adverse
comments, a timely document will be published withdrawing the direct
final rule and all public comments received will be addressed in a
subsequent final rule based on this action.

SUMMARY: Section 5 of the Toxic Substances Control Act (TSCA) requires
any person who intends to manufacture (defined by statute to include
import) a new chemical (i.e., a chemical not on the TSCA Inventory) to
notify EPA and comply with the statutory provisions pertaining to the
manufacture of new chemicals. Under sections 5(d)(2) and 5(d)(3) of
TSCA, EPA is required to publish a notice of receipt of a
premanufacture notice (PMN) or an application for a test marketing
exemption (TME), and to publish periodic status reports on the
chemicals under review and the receipt of notices of commencement to
manufacture those chemicals. This status report, which covers the
period from November 17, 2008 through November 28, 2008, consists of
the PMNs pending or expired, and the notices of commencement to
manufacture a new chemical that the Agency has received under TSCA
section 5 during this time period.

SUMMARY: EPA is announcing the availability of a final report titled,
``Predicting Future Introductions of Nonindigenous Species to the Great
Lakes'' (EPA/600/R-08/066F). The report was prepared by the National
Center for Environmental Assessment (NCEA), within EPA's Office of
Research and Development (ORD). The Great Lakes of the United States
have been subjected to adverse ecological and economic impacts from
introduced species. Ballast water discharge from commercial shipping is
the major means by which these nonindigenous species have entered the
Great Lakes. This assessment demonstrates that successful invasions are
best predicted by knowing the propagule pressure (i.e., the number of
larvae/individuals entering a new area) and habitat matching (i.e., how
similar is the invaded area to the native range of the species). The
purpose of the report is to help resource managers focus monitoring
activities on particular nonindigenous species at ports that are most
at risk of invasion.
