Mandatory Reporting of Greenhouse Gases

AGENCY: Environmental Protection Agency (EPA).

ACTION: Proposed rule.

SUMMARY: EPA is proposing a regulation to require reporting of
greenhouse gas emissions from all sectors of the economy. The rule
would apply to fossil fuel suppliers and industrial gas suppliers, as
well as to direct greenhouse gas emitters. The proposed rule does not
require control of greenhouse gases, rather it requires only that
sources above certain threshold levels monitor and report emissions.

DATES: Comments must be received on or before June 9, 2009. There will
be two public hearings. One hearing was held on April 6 and 7, 2009, in
the Washington, DC, area (One Potomac Yard, 2777 S. Crystal Drive,
Arlington, VA 22202). One hearing will be on April 16, 2009 in
Sacramento, CA (Sacramento Convention Center, 1400 J Street,
Sacramento, CA 95814). The April 16, 2009 hearing will begin at 9 a.m.
local time.

American Recovery and Reinvestment Act of 2009 (Recovery Act)
Supplemental Funding for Brownfields Revolving Loan Fund (RLF) Grantees

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice.

SUMMARY: EPA's Office of Brownfields and Land Revitalization (OBLR)
plans to make available approximately $40 million in Recovery Act
funding to supplement Revolving Loan Fund capitalization grants
previously awarded competitively under section 104(k)(3) of the
Comprehensive Environmental Response, Compensation and Liability Act
(CERCLA), 42 U.S.C. 9604(k)(3). Brownfields Cleanup Revolving Loan Fund
(BCRLF) pilots awarded under section 104(d)(1) of CERCLA that have not
transitioned to section 104(k)(3) grants are not eligible to apply for
these funds. EPA will award these funds under the criteria described
below only to RLF grantees who have demonstrated an ability to deliver
programmatic results by making at least one loan or subgrant and have
effectively utilized existing available loan funds (high performing RLF
grantees).
    The Agency is now accepting requests for Recovery Act supplemental
funding from high performing RLF grantees. Requests for funding must be
submitted to the EPA Regional Contact (listed below) by May 1, 2009.
Specific information on submitting a request for Recovery Act RLF
supplemental funding can be obtained by contacting the EPA Regional
Contact.

SUMMARY: Pursuant to Section 102(2)(C) of the National Environmental
Policy Act of 1969 (42 U.S.C. 4332(C)), the National Park Service (NPS)
announces the availability of the Record of Decision (ROD) for the
Final General Management Plan (GMP)/Wilderness Study (WS)/Environmental
Impact Statement (EIS), Sleeping Bear Dunes
National Lakeshore (Lakeshore), Michigan. On January 6, 2009, the
Midwest Regional Director approved the ROD for the project. As soon as
practicable, the NPS will begin to implement the preferred alternative
contained in the final EIS.
    The preferred alternative will provide for the preservation of
natural resources, while offering opportunities for visitor enjoyment
of natural, cultural, and recreational resources in a scenic outdoor
setting. This alternative includes approximately 32,100 acres (45
percent of the Lakeshore) proposed for wilderness. No developed county
roads are included in proposed wilderness areas. Visitor services and
facilities remain much as they are now, with improvements at key
locations on the mainland and on South Manitou Island. Acquisition of
lands within the Benzie Corridor will continue.
    The ROD includes a statement of the decision made, synopses of
other alternatives considered, the basis for the decision, a
description of the environmentally preferable alternative, a finding on
impairment of park resources and values, a listing of measures to
minimize environmental harm, and an overview of public involvement in
the decision-making process.

or are of concern to, farms, ranches, and rural communities. The FRRCC

National and Governmental Advisory Committees to the U.S.
Representative to the Commission for Environmental Cooperation

SUMMARY: Under the Federal Advisory Committee Act, Public Law 92-463,
EPA gives notice of a meeting of the National Advisory Committee (NAC)
and Governmental Advisory Committee (GAC) to the U.S. Representative to
the North American Commission for Environmental Cooperation (CEC). The
National and Governmental Advisory Committees advise the EPA
Administrator in her capacity as the U.S. Representative to the CEC
Council. The Committees are authorized under Articles 17 and 18 of the
North American Agreement on Environmental Cooperation (NAAEC), North
American Free Trade Agreement Implementation Act, Public Law 103-182,
and as directed by Executive Order 12915, entitled ``Federal
Implementation of the North American Agreement on
Environmental Cooperation.'' The NAC is composed of 12 members
representing academia, environmental non-governmental organizations,
and private industry. The GAC consists of 12 members representing
state, local, and Tribal governments. The Committees are responsible
for providing advice to the U.S. Representative on a wide range of
strategic, scientific, technological, regulatory, and economic issues
related to implementation and further elaboration of the NAAEC.
    The purpose of the meeting is to review elements of the CEC's draft
2010-2015 Strategic Plan and assist in the development of U.S.
priorities for the CEC Council Session in June 2009. The meeting will
also include a public comment session. A copy of the agenda will be

Bacillus subtilis MBI 600; Exemption from the Requirement of a
Tolerance

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: This regulation establishes an exemption from the requirement
of a tolerance for residues of the biofungicide, Bacillus subtilis MBI
600, in or on all food commodities, including residues resulting from
post-harvest uses, when applied/used in accordance with good
agricultural practices. Becker Underwood, Inc. submitted a petition to
EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting
an amendment to expand the existing exemption from the requirement of a
tolerance. This regulation eliminates the need to establish a maximum
permissible level for residues of Bacillus subtilis MBI 600 in or on
all food commodities.

DATES: This regulation is effective April 8, 2009. Objections and
requests for hearings must be received on or before June 8, 2009, and
must be filed in accordance with the instructions provided in 40 CFR
part 178 (see also Unit I.C. of the SUPPLEMENTARY INFORMATION).

SUMMARY: The Department of Energy (DOE) is announcing that it is
amending energy conservation standards pertaining to the cooking
efficiency of residential gas kitchen ranges and ovens, because it has
determined that such standards would be technologically feasible and
economically justified and would result in significant conservation of
energy, the three primary statutory criteria for adoption of standards
under the Energy Policy and Conservation Act (EPCA). DOE is not
adopting energy conservation standards pertaining to the cooking
efficiency of residential electric kitchen ranges and ovens and
microwave ovens, because it has determined that such standards would
not be technologically feasible and economically justified. At this
point, DOE has decided to defer its decision regarding adoption of
amended energy conservation standards for the energy efficiency of
commercial clothes washers and standby mode and off mode power
consumption by microwave ovens, pending further rulemaking. Finally,
DOE is not adopting amended standards for dishwashers and dehumidifiers
in this rulemaking, because recent amendments to EPCA have already set
standards for those products.

DATES: The effective date of this rule is June 8, 2009. Compliance with
the standards set by today's final rule is required on April 9, 2012.

17, 2009, the date of enactment of ARRA. This action permits the use of
non-domestic iron, steel, and manufactured goods in such projects
funded by ARRA that may otherwise be prohibited under section 1605(a).

ACTION: Standard operating procedures for State Technical Committees.

SUMMARY: Section 1261(b)(1) of the Food Security Act of 1985, as
amended by the Food, Conservation, and Energy Act of 2008 (2008 Act)
requires the Secretary of Agriculture to develop standard operating
procedures to standardize the operations of State Technical Committees.
NRCS published an interim final rule for State Technical Committees, 7
CFR part 610, in the Federal Register on November 25, 2008, that states
NRCS will incorporate standard operating procedures for State Technical
Committees into its directives system and provide public notice of
those procedures. NRCS seeks public comment on this document that
includes the current NRCS standard operating procedures as set forth in
the NRCS directives system.

Indiana Michigan Power Company; Donald C. Cook Nuclear Plant,
Units 1 and 2; Exemption

1.0 Background

    The Indiana Michigan Power Company (the licensee) is the holder of
Facility Operating License Nos. DPR-58 and DPR-74, which authorizes
operation of the Donald C. Cook Nuclear Plant, Units 1 and 2. The
licenses provide, among other things, that the facility is subject to
all rules, regulations, and orders of the U.S. Nuclear Regulatory
Commission (NRC, the Commission) now or hereafter in effect.
    The facility consists of two pressurized-water reactors located in
Berrien County in Michigan.

2.0 Request/Action

    Title 10 of the Code of Federal Regulations, Part 50, Section
36a(a)(2) (10 CFR 50.36a(a)(2)) requires each licensee to submit a
report to the Commission annually that specifies the quantity of each
of the principal radionuclides released to unrestricted areas in liquid
and in gaseous effluents during the previous 12 months, including any
other information as may be required by the Commission to estimate
maximum potential annual radiation doses to the public resulting from
effluent releases. The report must be submitted as specified in Section
50.4, and the time between report submittals must be no longer than 12
months.
    The licensee has proposed an amendment to Technical Specification
5.6.3 to change the submittal date for the report from ``within 90 days
of January 1 of each year'' to ``prior to May 1 of each year.''
Therefore, the licensee has requested a one-time exemption from the 12-
month reporting criteria specified in 10 CFR 50.36a(a)(2) for its
submittal of the 2008 Radioactive Effluent Release Report.
    In summary, the exemption does not affect the information required
to be submitted or the time period the report covers, only the date the
report is submitted.

Migratory Bird Permits; Revision of Expiration Dates for Double-
Crested Cormorant Depredation Orders

AGENCY: Fish and Wildlife Service, Interior.

ACTION: Final rule; availability of final environmental assessment.

SUMMARY: We, the U.S. Fish and Wildlife Service, extend the expiration
dates for two existing depredation orders for double-crested cormorants
(Phalacrocorax auritus) for 5 years so that we can continue to
authorize take of double-crested cormorants without a permit under the
terms and conditions of the depredation orders. This action will
continue to allow take of depredating double-crested cormorants to
protect aquaculture, fish hatcheries, fish resources, other birds,
vegetation, and habitats.

DATES: This rule will be effective on April 30, 2009.
