Procedures for Implementing the National Environmental Policy Act
and Assessing the Environmental Effects Abroad of EPA Actions

AGENCY: Environmental Protection Agency (EPA).

ACTION: Direct final rule.

SUMMARY: EPA is issuing a direct final rule to make corrections to its
rule entitled ``Procedures for Implementing the National Environmental
Policy Act and Assessing the Effects Abroad of EPA Actions,'' which was
published September 19, 2007. Since the final rule became effective on
October 19, 2007, EPA has received inquiries about some minor
inconsistencies and ambiguities in the final rule. This action involves
four minor, technical corrections to the rule to address those issues.
The first correction expands the definition of ``applicants'' to
include those who request EPA approvals. The second change clarifies
that a categorical exclusion includes vacant land. The third change
corrects the text to indicate that the number of extraordinary
circumstances is ten. The last change expands Subpart C to apply to EPA
approvals as well as permits and assistance grants.

DATES: This rule is effective on April 6, 2009 without further notice,
unless EPA receives adverse comment by March 6, 2009. If EPA receives
adverse comment, we will publish a timely withdrawal in the Federal
Register informing the public that the rule will not take effect.

SUMMARY: EPA is proposing to correct its rule entitled ``Procedures for
Implementing the National Environmental Policy Act and Assessing the
Effects Abroad of EPA Actions,'' which was published September 19,
2007. Since the final rule became effective on October 19, 2007, EPA

SUMMARY: This notice announces EPA's receipt of an application 524-EUP-
1 from Monsanto Company requesting to amend and extend an experimental
use permit (EUP) for the plant-incorporated protectant (PIP) Bacillus
thuringiensis Cry1Ac protein and the genetic material necessary for its
production (vector PV-GMIR9) in MON 87701 soybean. The Agency has
determined that the permit may be of regional and national
significance. Therefore, in accordance with 40 CFR 172.11(a), the
Agency is soliciting comments on this application.

                Revocation of Certain Executive Orders Concerning
                Regulatory Planning and Review

                By the authority vested in me as President by the
                Constitution and the laws of the United States of
                America, it is hereby ordered that:

                Section 1. Executive Order 13258 of February 26, 2002,
                and Executive Order 13422 of January 18, 2007,
                concerning regulatory planning and review, which
                amended Executive Order 12866 of September 30, 1993,
                are revoked.

                Sec. 2. The Director of the Office of Management and
                Budget and the heads of executive departments and
                agencies shall promptly rescind any orders, rules,
                regulations, guidelines, or policies implementing or
                enforcing Executive Order 13258 or Executive Order
                13422, to the extent consistent with law.

                Sec. 3. This order is not intended to, and does not,
                create any right or benefit, substantive or procedural,
                enforceable at law or in equity by any party against
                the United States, its departments, agencies, or
                entities, its officers, employees, or agents, or any

AGENCY: Environmental Protection Agency.

ACTION: Final rule: Delay of effective date and request for comment.

SUMMARY: The Environmental Protection Agency (EPA) is delaying by sixty
days the effective date of the final rule that amends the Spill
Prevention, Control, and Countermeasure (SPCC) regulations published in
the Federal Register on December 5, 2008. Thus, the amendments will
become effective on April 4, 2009. EPA additionally is requesting
public comment on the extension of the effective date and its duration,
and on the regulatory amendments contained in the final rule.

DATES: This document is effective February 3, 2009. The effective date
of FR Doc. E8-28159, published in the Federal Register on December 5,
2008 (73 FR 74236), is delayed to April 4, 2009.

                Regulatory Review

                Memorandum for the Heads of Executive Departments and
                Agencies

                For well over two decades, the Office of Information
                and Regulatory Affairs (OIRA) at the Office of
                Management and Budget (OMB) has reviewed Federal
                regulations. The purposes of such review have been to
                ensure consistency with Presidential priorities, to
                coordinate regulatory policy, and to offer a
                dispassionate and analytical ``second opinion'' on
                agency actions. I strongly believe that regulations are
                critical to protecting public health, safety, our
                shared resources, and our economic opportunities and
                security. While recognizing the expertise and authority
                of executive branch departments and agencies, I also
                believe that, if properly conducted, centralized review
                is both legitimate and appropriate as a means of
                promoting regulatory goals.

                The fundamental principles and structures governing
                contemporary regulatory review were set out in
                Executive Order 12866 of September 30, 1993. A great
                deal has been learned since that time. Far more is now
                known about regulation--not only about when it is
                justified, but also about what works and what does not.
                Far more is also known about the uses of a variety of
                regulatory tools such as warnings, disclosure
                requirements, public education, and economic
                incentives. Years of experience have also provided
                lessons about how to improve the process of regulatory
                review. In this time of fundamental transformation,
                that process--and the principles governing regulation
                in general--should be revisited.

                I therefore direct the Director of OMB, in consultation
                with representatives of regulatory agencies, as
                appropriate, to produce within 100 days a set of
                recommendations for a new Executive Order on Federal
                regulatory review. Among other things, the
                recommendations should offer suggestions for the
                relationship between OIRA and the agencies; provide
                guidance on disclosure and transparency; encourage
                public participation in agency regulatory processes;
                offer suggestions on the role of cost-benefit analysis;
                address the role of distributional considerations,
                fairness, and concern for the interests of future
                generations; identify methods of ensuring that
                regulatory review does not produce undue delay; clarify
                the role of the behavioral sciences in formulating
                regulatory policy; and identify the best tools for
                achieving public goals through the regulatory process.

                This memorandum is not intended to, and does not,
                create any right or benefit, substantive or procedural,
                enforceable at law or in equity by any party against
                the United States, its departments, agencies, or
                entities, its officers, employees, or agents, or any
                other person.

                The Director of OMB is hereby authorized and directed
                to publish this memorandum in the Federal Register.

Formaldehyde Emissions from Pressed Wood Products; Extension of
Comment Period and Notice of Sixth Public Meeting

AGENCY: Environmental Protection Agency (EPA).

ACTION: Advance notice of proposed rulemaking; extension of comment
period.

SUMMARY:  EPA issued an advanced notice of proposed rulemaking (ANPR)
in the Federal Register of December 3, 2008, describing EPA's initial
steps to investigate and request comment, information, and data
relating to formaldehyde emissions from pressed wood products. The ANPR
also announced five public meetings that EPA scheduled in order to
obtain additional stakeholder input. EPA is announcing today one
additional public meeting to enable more complete public participation.
Additionally, this document extends the comment period for 45 days,
from February 2, 2009, to March 19, 2009. This extension is necessary
to provide the public with an opportunity to provide additional and
more thorough comments to the docket.

DATES: Comments, identified by docket identification (ID) number EPA-
HQ-OPPT-2008-0627, must be received on or before March 19, 2009.
    The meeting will be held on March 4, 2009, from 1 p.m. until the
last speaker has spoken or to 5 p.m.

submission of comments.

Teleconference Meeting

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice.

SUMMARY: The U.S. Environmental Protection Agency's (EPA or Agency)
Office of the Science Advisor (OSA) announces a public meeting of the
Human Studies Review Board (HSRB) to advise the Agency on EPA's
scientific and ethical review of human subjects research. The HSRB will
hold a Public teleconference to discuss two completed field studies by
Carroll-Loye Biological Research of mosquito repellent efficacy, and
spatial insect repellent technology.

DATES: The teleconference will be held on February 17, 2009, from 11:30
to approximately 4 p.m. (Eastern Time).
    Location: The meeting will take place via telephone only.
    Meeting Access: For information on access or services for
individuals with disabilities, please contact Lu-Ann Kleibacker prior
to the meeting using the information under FOR FURTHER INFORMATION
CONTACT, so that appropriate arrangements can be made.
    Procedures for Providing Public Input: Interested members of the

ACTION: Final rule; notice of delay of effective date and comment
period.

SUMMARY: In accordance with the memorandum of January 20, 2009, from
the Assistant to the President and Chief of Staff, entitled
``Regulatory Review,'' published in the Federal Register on January 26,
2009, the Department is delaying the effective date and opening for
public comment, the rule published on December 29, 2008. This rule
regulates the sustainable free use, commercial harvest, and sale of
special forest products and forest botanical products from National
Forest System lands. The December rule was originally set to take
effect January 28, 2009.

DATES: Effective January 28, 2009, the effective date of the rule
amending 36 CFR parts 223 and 261 published at 73 FR 79367, December
29, 2008, is delayed until March 30, 2009. Comments must be received by
March 2, 2009.
