SUMMARY: EPA issued a notice in the Federal Register of November 19,
2008, concerning a petition for rulemaking and collateral relief filed
by the International Center for Technology Assessment (ICTA) and
others. In general, the petition requests that the Agency classify
nanoscale silver as a pesticide, require formal pesticide registration
of all products containing nanoscale silver, analyze the potential
human health and environmental risks of nanoscale silver, take
regulatory actions under the Federal Insecticide, Fungicide, and
Rodenticide Act (FIFRA) against existing products that contain
nanoscale silver, and take other regulatory actions under FIFRA as
appropriate for nanoscale silver products. This document extends the
comment period for 60 days from January 20, 2009 to March 20, 2009.

SUMMARY: Section 1201 of the Safe, Accountable, Flexible, Efficient
Transportation Equity Act: A Legacy for Users (SAFETEA-LU) requires the
Secretary of Transportation (Secretary) to establish a Real-Time System
Management Information Program that provides, in all States, the
capability to monitor, in real-time, the traffic and travel conditions
of the major highways of the United States and to share that data with
State and local governments and with the traveling public. This
proposed rule would establish minimum parameters and requirements for
States to make available and share traffic and travel conditions
information via real-time information programs.

SUMMARY: NMFS proposes to implement identification and certification
procedures to address illegal, unreported, and unregulated (IUU)
fishing activities and bycatch of protected living marine resources
(PLMRs) pursuant to the High Seas Driftnet Fishing Moratorium
Protection Act (Moratorium Protection Act). The objective of these
procedures is to promote the sustainability of transboundary and shared
fishery stocks and to enhance the conservation and recovery of PLMRs.
The proposed rule is intended to implement existing U.S. statutory
authorities to address noncompliance with international fisheries
management and conservation agreements and encourage the use of bycatch
reduction methods in international fisheries that are comparable to
methods used by U.S. fishermen. NMFS is seeking public comment on these
procedures and on the sources and types of information to be considered
in these procedures.

SUMMARY: On May 17, 2006, NRCS published an interim final rule for the
Healthy Forests Reserve Program (HFRP) and received 11 comment letters.
NRCS proposes to amend this rule to incorporate changes associated with
enactment of the Food, Conservation, and Energy Act of 2008 (the 2008
Act). The 2008 Act authorizes $9,750,000 for each of the fiscal years
2009 through 2012 to carry out the program. As a result of the 2008
Act, NRCS will allow land enrollment through permanent easements, or
easements for a maximum duration allowed under state law and continue
to allow enrollment through 10-year cost-share agreements; and allow
enrollment of land owned by tribes or members of tribes in 30-year
contracts or 10-year cost-share agreements, or any combination of both.
Forty percent of program expenditures in any fiscal year will be used
for restoration cost-share agreement enrollment and 60 percent of
program expenditures in any fiscal year will be for easement
enrollment.
    In addition to changes associated with the 2008 Act, NRCS is
addressing comments received on the interim final rule and proposing
additional changes that improve program implementation based on the
experience gained from the HRFP implementation under the interim final
rule.

SUMMARY: The Nuclear Regulatory Commission (NRC) is correcting a final
rule that appeared in the Federal Register on June 9, 2008 (73 FR
32453). The final rule amended NRC's regulations related to licensee
reporting requirements for source material and special nuclear material
to the Nuclear Materials Management and Safeguards System. This
document is necessary to correct an erroneous amendatory instruction.

to January 1, 2009.

SUMMARY: This final rule revises the Hazardous Materials Regulations to
maintain alignment with international standards by incorporating
various amendments, including changes to proper shipping names, hazard
classes, packing groups, special provisions, packaging authorizations,
air transport quantity limitations, and vessel stowage requirements.
These revisions are necessary to harmonize the Hazardous Materials
Regulations with recent changes to the International Maritime Dangerous
Goods Code, the International Civil Aviation Organization's Technical
Instructions for the Safe Transport of Dangerous Goods by Air,
Transport Canada's Transportation of Dangerous Goods Regulations, and
the United Nations Recommendations on the Transport of Dangerous Goods.
    These revisions also include amendments and clarifications
addressing the safe transportation of batteries and battery-powered
devices. Consistent with recent changes to the International Civil
Aviation Organization's Technical Instructions, PHMSA is clarifying the
prohibition against transporting electrical devices, including
batteries and battery-powered devices that are likely to create sparks
or generate a dangerous amount of heat. PHMSA is also modifying and
enhancing requirements for the packaging and handling of batteries and
battery-powered devices, particularly in air commerce, to emphasize the
safety precautions that are necessary to prevent incidents during
transportation. PHMSA developed these revisions in conjunction with the
Federal Aviation Administration to enhance the safe transportation of
batteries and battery-powered devices.

DATES: Effective date: February 13, 2009.
    Voluntary Compliance Date: PHMSA is authorizing voluntary
compliance beginning January 1, 2009.
    Delayed Compliance Date: Except as specified in Sec. Sec.  171.14,
171.25, 172.102, 172.448, and 178.703 as amended herein, compliance
with the amendments adopted in this final rule is required beginning
January 1, 2010.
    Incorporation by Reference Date: The incorporation by reference of
the publications adopted in Sec.  171.7 of this final rule has been
approved by the Director of the Federal Register as of February 13,
2009.

SUMMARY: Section 2510 of the Food, Conservation, and Energy Act of 2008
(2008 Act) established the Agricultural Water Enhancement Program
(AWEP) by amending section 1240I of the Food Security Act of 1985. The
Secretary of Agriculture delegated the authority for AWEP to the Chief
of the Natural Resources Conservation Service (NRCS), who is a vice
president of the Commodity Credit Corporation (CCC). NRCS is an agency
of the U.S. Department of Agriculture (USDA). Up to $58.4 million in
AWEP financial assistance is expected to be available in fiscal year
2009 for NRCS to enter into contracts with producers. The purpose of
this notice is to inform agricultural producers of the availability of
AWEP funds and to solicit proposals from potential partners who seek to
enter into partnership agreements with the Chief to promote the
conservation of ground and surface water and the improvement of water
quality.

DATES: Proposals must be postmarked by March 2, 2009.

Energy Conservation Standards for Residential Water Heaters,
Direct Heating Equipment, and Pool Heaters: Public Meeting and
Availability of the Preliminary Technical Support Document

AGENCY: Office of Energy Efficiency and Renewable Energy, Department of
Energy.

ACTION: Notice of public meeting and availability of preliminary
technical support document.

SUMMARY: The Department of Energy (DOE) will hold an informal public
meeting to discuss and receive comments on the product classes that DOE
plans to analyze for purposes of amending energy conservation standards
for certain residential heating products; the analytical framework,
models, and tools that DOE is using to evaluate standards for these
products; the results of preliminary analyses performed by DOE for
these products; and potential energy conservation standard levels
derived from these analyses that DOE could consider for these products.
DOE also encourages written comments on these subjects. To inform
stakeholders and facilitate this process, DOE has prepared an agenda, a
preliminary Technical Support Document (preliminary-TSD), and briefing
materials, all of which are available at: http://www.eere.energy.gov/
buildings/appliance_standards/residential/heating
products.html.

DATES: DOE will hold a public meeting on Monday, February 9, 2009, from
9 a.m. to 5 p.m. in Washington, DC. Any person requesting to speak at

Availability of Draft Guidelines for Use of Pesticide-Treated
Wood Products

AGENCY: National Marine Fisheries Service (NMFS), National Oceanic and
Atmospheric Administration (NOAA), Commerce.

ACTION: Notice of availability; request for comments.

SUMMARY: NMFS is providing this notice in order to allow other agencies
and the public an opportunity to review and provide comments on a draft
guideline document regarding the use of pesticide-treated wood products
in aquatic environments. The intent of the guidelines is to aid NMFS
personnel conducting Endangered Species Act (ESA) and Magnuson-Stevens
Fishery Conservation and Management Act (Magnuson-Stevens Act)
Essential Fish Habitat (EFH) consultations in making consistent
determinations regarding projects proposing to use pesticide-treated
wood products in habitats utilized by NOAA trust resources. The
guidelines attempt to convey a summary of information that should be
considered when examining the effects determinations made by the action
agency, and to direct personnel to documents containing more detailed
information when needed. NMFS is requesting comment on the draft
guideline document before it is finalized. All comments received before
the due date will be considered before finalizing the guideline
document. All comments received will become part of the public record
and will be available for review upon request.

SUMMARY: Section 2703 of Title II of the Food, Conservation, and Energy
Act of 2008 (the 2008 Act) (Pub. L. 110-246) reauthorizes the
subsection on Regional Equity established under section 1241(d) of the
Food Security Act of 1985 (16 U.S.C. 3841(d)), as amended (Regional
Equity provision). The purpose of this provision is to give priority to
certain states for certain conservation program funding. States
eligible to receive funding through the Regional Equity provision are
those that have not received, for a given fiscal year, an aggregate
allocation of at least $15,000,000 from programs specified in the
Regional Equity provision. In addition, States must have approved
applications for financial and technical assistance under the specified
programs in order to be eligible to receive funding. The Regional
Equity programs are all of the conservation programs authorized by
subtitle D, Title XII of the Food Security Act of 1985, 16 U.S.C. 3801
et seq., except for the Conservation Reserve Program, the Wetland
Reserve Program, and the Conservation Security Program, which are
excluded from the conservation programs affected by the Regional Equity
provision. This interim final rule sets forth how the Natural Resources
Conservation Service (NRCS), an agency of the U.S. Department of
Agriculture (USDA), will implement the Regional Equity provision.

Hazardous Materials: Improving the Safety of Railroad Tank Car
Transportation of Hazardous Materials

AGENCY: Pipeline and Hazardous Materials Safety Administration (PHMSA),
Department of Transportation (DOT).

ACTION: Final rule.

SUMMARY: The Pipeline and Hazardous Materials Safety Administration
(PHMSA), in coordination with the Federal Railroad Administration
(FRA), is amending the Hazardous Materials Regulations to prescribe
enhanced safety measures for rail transportation of poison inhalation
hazard (PIH) materials, including interim design standards for railroad
tank cars. Pending validation and implementation of the crashworthiness
performance standard proposed in the NPRM issued under this docket on
April 1, 2008, the rule mandates commodity-specific improvements in
safety features and design standards for newly manufactured DOT
specification tank cars. The rule also adopts a 50 mph speed
restriction for loaded rail tank cars transporting PIH materials; an
improved top fittings performance standard; an allowance to increase
the gross weight of tank cars that meet the enhanced standards; and
adoption of the industry standard for normalized steel in certain tank
cars. The interim standards established in this rule will enhance the
accident survivability of PIH tank cars when compared to existing
regulations while providing tank car owners continued flexibility in
car selection. Adoption of this interim standard will ensure the
ongoing availability of tank cars while PHMSA and FRA complete research
and testing on advanced tank car design to validate and implement a
more stringent performance standard.

DATES: Effective Date: March 16, 2009. The incorporation by reference
of the publication listed in the rule is approved by the Director of
the Federal Register as of March 16, 2009.

the publications adopted in Sec.  171.7 of this final rule has been

SUMMARY: The U.S. Environmental Protection Agency (EPA) is announcing
the availability of the final White Paper on Integrated Modeling for
Integrated Environmental Decision Making (EPA 100/R-08/010, November
2008.
    In pursuing its mission to protect human health and to safeguard
the natural environment, the U.S. Environmental Protection Agency often
relies on environmental models. The EPA defines a model as a
``simplification of reality that is constructed to gain insights into
select attributes of a particular physical, biological, economic, or
social system.'' While traditionally environmental modeling has focused
on considering a single pollutant in a single environmental medium,
this approach is no longer viewed as sufficient for effective
environmental management decision support. It is increasingly
recognized that a holistic approach to modeling the environment and the
mechanisms governing the fate and transport of pollutants through the
different environmental media as well as the multiple exposure pathways
and the consequent responses of humans and ecosystems, is required to
adequately assess and address environmental problems. Integrated
modeling is thus of importance to helping EPA consider the environment
as a ``single, interrelated system''. Integrated modeling encompasses a
broad range of approaches and configurations of models, data and
assessment methods to describe and analyze complex environmental
problems, often in a multimedia and multidisciplinary manner.
    This staff white paper recommends a commitment to a new direction
in environmental modeling and decision making, one that adopts a
systems thinking approach. This approach EPA will be able to
significantly improve its ability to conduct scientific analyses in
support of integrated decision making. The result will be implementing
more efficient, effective and equitable policies and programs to
advance environmental protection as well as economic prosperity. This
white paper: (1) Outlines the need for and value of integrated modeling
for EPA science and decision-making; (2) analyzes the state of the art
and practice of integrated modeling and include examples of how this
approach has been successfully applied and the lessons learned; (3)
identifies the challenges to more fully implementing this approach in
the future; and (4) presents a plan to create an enabling environment
to facilitate a concerted, systematic, and stable approach to the
development and application of integrated modeling for integrated
decision making.

SUMMARY: Under the Federal Advisory Committee Act, Public Law 92-463,
EPA gives notice of a meeting of the Farm, Ranch, and Rural Communities
Committee (FRRCC). The purpose of the FRRCC is to provide advice to the
Administrator of EPA on environmental issues and programs that impact,
or are of concern to, farms, ranches, and rural communities. The FRRCC
is a part of EPA's efforts to expand cooperative working relationships
with the agriculture industry and others who are interested in
agricultural issues and to achieve greater progress in environmental
protection.
    The purpose of the meeting is to further advance: (1) Discussion of
the impacts of Agency agriculture-related programs, policies, and
regulations regarding climate change and renewable energy; (2)
identification and development of a comprehensive environmental
strategy for livestock operations; and (3) development of a
constructive approach or framework to address areas of common interest
