Isoxaben; Pesticide Tolerances

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: This regulation establishes tolerances for residues of
isoxaben in or on almond, hulls; grape; nut, tree, group 14; and
pistachio. Dow AgroSciences requested these tolerances under the
Federal Food, Drug, and Cosmetic Act (FFDCA).

DATES: This regulation is effective November 12, 2010. Objections and
requests for hearings must be received on or before January 11, 2011,
and must be filed in accordance with the instructions provided in 40
CFR part 178 (see also Unit I.C. of the SUPPLEMENTARY INFORMATION).

SUMMARY: The NRC and the DOE announce their intent to conduct a public
meeting to discuss agency interactions and activities in accordance
with each agency's responsibilities under Section 3116 of the National
Defense Authorization Act (NDAA) for Fiscal Year 2005. The meeting
date, time, and location are listed below:

Background

    On October 9, 2004, the Ronald W. Reagan National Defense
Authorization Act for Fiscal Year 2005 (NDAA) was passed by Congress and was signed by the President on October 28, 2004. Section 3116 of the NDAA allows
the DOE to determine that certain incidental waste, stemming from
reprocessing of spent nuclear fuel, is not high-level waste (HLW).
Should these incidental wastes, or Waste Incidental to Reprocessing
(WIR), meet the criteria defined by the NDAA, they will be disposed via
near-surface disposal. The NDAA is applicable only in the states of
South Carolina and Idaho and does not apply to waste transported out of
these States. The NDAA requires that: (1) DOE consult with NRC on its
waste determinations in South Carolina and Idaho, and (2) NRC, in
coordination with the State, monitor disposal actions taken by DOE for
the purpose of assessing compliance with NRC regulations in 10 CFR part
61, subpart C. If the NRC considers any disposal actions taken by the
DOE pursuant to subparagraphs (A) or (B) of Section 3116(a)(3) of the
NDAA to be not in compliance with those performance objectives, the NRC
shall, as soon as practicable after discovery of the noncompliant
conditions, inform the DOE, the covered State, and Congress. On
November 16, 2006 and July 20, 2007, the NRC and DOE held public
meetings to discuss the efficiency and effectiveness of the
consultation process. This meeting is part of a series of continuing
public lessons learned meetings that the NRC and DOE hold jointly.
Since the November 2006 NRC/DOE joint public meeting, many NDAA,
Section 3116 consultation and monitoring activities have taken place at
the Savannah River Site. NRC is currently fulfilling its monitoring
role for disposal actions at the Saltstone Facility at the Savannah
River Site and consultation activities are underway as the DOE has
recently submitted the F-Tank Farm Performance Assessment and Draft
Waste Determination for NRC review. The agencies will provide the
public with an update on NDAA Section 3116 activities, provide
interested stakeholders a chance to make comments and ask questions,
and inform the public of future activities.

will be made available on the NRC's Agencywide Documents Access and

SUMMARY: OSHA invites interested parties to participate in an open,
informal public meeting to discuss proposals in preparation for the
20th session of the United Nations Subcommittee of Experts on the
Globally Harmonized System of Classification and Labelling of Chemicals
(UNSCEGHS). The UNSCEGHS meeting will be held December 7-9, 2010, in
Geneva, Switzerland. OSHA, along with the U.S. Interagency GHS
Coordinating Group, plans to consider the comments and information
gathered at this public meeting when developing the U.S Government
positions for the UNSCEGHS meeting.

Inspection Service has prepared an environmental assessment relative to
the control of Arundo donax (giant reed, Carrizo cane). The
environmental assessment considers the effects of, and alternatives to,
the release of Arundo scale into the continental United States for use
as a biological control agent to reduce the severity of Arundo donax
infestations. We are making the environmental assessment available to
the public for review and comment.

Draft Toxicological Review of Hexavalent Chromium: In Support of
Summary Information on the Integrated Risk Information System (IRIS)

2010.

SUMMARY: EPA published a 60-day public comment period on September 30,
2010 (75 FR 60454) for the external review draft human health
assessment titled, ``Toxicological Review of Hexavalent Chromium: In
Support of Summary Information on the Integrated Risk Information
System (IRIS)'' EPA/635/R-10/004C. We are extending the public comment
period 30 days at the request of the American Chemistry Council (ACC).
The draft assessment was prepared by the National Center for
Environmental Assessment (NCEA) within the EPA Office of Research and
Development (ORD). EPA released this draft assessment solely for the
purpose of pre-dissemination peer review under applicable information
quality guidelines. This draft assessment has not been formally
disseminated by EPA. It does not represent and should not be construed
to represent any Agency policy or determination. After public review
and comment, an EPA contractor will convene an expert panel for
independent external peer review of this draft assessment. The public
comment period and external peer review meeting are separate processes
that provide opportunities for all interested parties to comment on the
assessment. The external peer review meeting will be scheduled at a
later date and announced in the Federal Register. Public comments
submitted during the public comment period will be provided to the
external peer reviewers before the panel meeting and considered by EPA
in the disposition of public comments. Public comments received after
the public comment period closes will not be submitted to the external
peer reviewers and will only be considered by EPA if time permits.

DATES: The public comment period will be extended from November 29,
2010 to December 29, 2010. Comments should be in writing and must be
received by EPA by December 29, 2010.

Draft Toxicological Review of Urea: In Support of Summary
Information on the Integrated Risk Information System (IRIS)

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice of peer review meeting.

SUMMARY: EPA is announcing that Versar, Inc., an EPA contractor for
external scientific peer review, will convene an independent panel of
experts and organize and conduct an external peer review meeting to
review the draft human health assessment titled, ``Toxicological Review
of Urea: In Support of Summary Information on the Integrated Risk
Information System (IRIS)'' (EPA/635/R-10/005). The draft assessment
was prepared by the National Center for Environmental Assessment (NCEA)
within the EPA Office of Research and Development.
    On September 28 EPA released this draft assessment [75 FR 59716]
solely for the purpose of pre-dissemination peer review under
applicable information quality guidelines. This draft assessment has
not been formally disseminated by EPA. It does not represent and should
not be construed to represent any Agency policy or determination.
    Versar, Inc. invites the public to register to attend this workshop
as observers. In addition, Versar, Inc. invites the public to give
brief oral comments and/or provide written comments at the workshop
regarding the draft assessment under review. Time is limited, and
reservations will be accepted on a first-come, first-served basis. In
preparing a final report, EPA will consider Versar, Inc.'s report of
the comments and recommendations from the external peer review workshop
and any written public comments that EPA receives in accordance with
this notice.

DATES: The peer review panel workshop on the draft assessment for Urea
will be held via teleconference on December 13, 2010, beginning at 1
p.m. and ending at 5 p.m. Eastern Standard Time.

Update of Noxious Weed Regulations

AGENCY: Animal and Plant Health Inspection Service, USDA.

ACTION: Final rule.

SUMMARY: We are amending the regulations governing the importation and
interstate movement of noxious
weeds by adding definitions of terms used in the regulations, adding
details regarding the process of applying for the permits used to
import or move noxious weeds, adding a requirement for the treatment of
niger seed, and adding provisions for petitioning to add a taxon to or
remove a taxon from the noxious weed lists. These changes will update
the regulations to reflect current statutory authority and program
operations and improve the effectiveness of the regulations. We are
also adding seven taxa to the list of terrestrial noxious weeds and to
the list of seeds with no tolerances applicable to their introduction.
This action will prevent the introduction or dissemination of these
noxious weeds into or within the United States.

1. Authority

    This Notice of Intent (NOI) is published pursuant to the
regulations (40 CFR 1501.7) implementing the provisions of the National
Environmental Policy Act (NEPA) of 1969 as amended (42 U.S.C. 4321 et
seq. (1988)).

2. Purpose of the Notice of Intent

    The BOEMRE is announcing its intent to prepare a supplemental
environmental impact statement (SEIS) for Western Planning Area (WPA)
Lease Sale 218 and Central Planning Area (CPA) Lease Sale 222 in the
2007-2012 5-Year OCS Program. The proposed sales are in the Gulf of
Mexico's WPA off the States of Texas and Louisiana and in the CPA off
the States of Texas, Louisiana, Mississippi, and Alabama. The SEIS will
update the environmental and socioeconomic analyses in the Gulf of
Mexico OCS Oil and Gas Lease Sales: 2007-2012; WPA Sales 204, 207, 210,
215, and 218; CPA Sales 205, 206, 208, 213, 216, and 222, Final
Environmental Impact Statement (OCS EIS/EA MMS 2007-018) (Multisale
EIS), the NOI for which was published in the Federal Register on March
7, 2006 (Vol. 71, No. 44, Page 11444). The SEIS will also update the
environmental and socioeconomic analyses in the GOM OCS Oil and Gas
Lease Sales: 2009-2012; CPA Sales 208, 213, 216, and 222; WPA Sales
210, 215, and 218; Final SEIS (OCS EIS/EA MMS 2008-041), the NOI for
which was published in the Federal Register on September 10, 2007 (Vol.
72, No. 174, Page 51654). The SEIS for 2009-2012 was prepared after the
Gulf of Mexico Energy and Security Act (Pub. L. 109-432, December 20,
2006), which required BOEMRE to offer approximately 5.8 million acres
in the CPA (``181 South Area'') for oil and gas leasing, ``as soon as
practicable after the date of enactment of this Act.'' Lease Sales 218
and 222 are proposed to be held in late 2011 or early 2012, before the
end of the 2007-2012 5-Year OCS Program.
    A SEIS is deemed appropriate to supplement the NEPA documents cited
above for these lease sales in order to consider new circumstances and
information arising, among other things, from the Deepwater Horizon
blowout and spill. The SEIS analysis will focus on updating the
baseline conditions and potential environmental effects of oil and
natural gas leasing, exploration, development, and production in the
WPA and CPA.
    Scoping Process: Federal, State, and local government agencies, and
other interested parties may assist BOEMRE in determining the
significant issues and alternatives to be analyzed in the SEIS. Early
planning and consultation is important for ensuring that all interests
and concerns are communicated to the Department of the Interior for
future decisions in the leasing process pursuant to the Outer
Continental Shelf Lands Act and regulations at 30 CFR 256. At a
minimum, alternatives that will be considered for the sales are no
action (i.e., cancel the sale) or to exclude certain areas from the
sales. Input is requested on additional measures (e.g., technology or
water depth limitations) that would maximize avoidance and minimize
impacts to environmental and socioeconomic resources. Formal
consultation with other Federal agencies, the affected states, and the
public will be carried out during the NEPA process and will be
completed before a final decision is made on Lease Sales 218 and 222.

ACTION: Notice of availability; request for comments.

SUMMARY: The U.S. Department of Energy Office of Energy Efficiency and
Renewable Energy (EERE) announces the availability of a set of Standard
Work Specifications (SWSs), Job Task Analyses (JTAs) and essential
Knowledge, Skills and Abilities (KSAs) applicable to energy efficiency
retrofits of single family homes which together constitute the
Workforce Guidelines for Home Energy Upgrades (``Workforce
Guidelines''). These Workforce Guidelines are intended for voluntary
adoption by the Weatherization Assistance Program, EPA Home Performance
with Energy Star program partners, State, municipal and utility
ratepayer-funded energy efficiency retrofit programs, and private
sector home performance contractors, as well as any other organization,
company, or individual involved in energy efficiency retrofits of
residential homes. Through this notice, DOE also requests public
comments on the Workforce Guidelines.

DATES: Comments on the Workforce Guidelines for Home Energy Upgrades
must be received by 5 p.m. Eastern Time on Friday, January 7, 2011.

SUMMARY: EPA is taking direct final action on several revisions to
EPA's mobile source emission programs standards and test procedures.
EPA believes that each of these is minor and non-controversial in
nature. Most of the changes arise from the results of the collaborative
test program and related technical work we conducted for the highway
heavy-duty diesel in-use testing program. Most noteworthy here is the
adoption of a particulate matter measurement allowance for use with
portable emission measurement systems. Related to this are two
provisions to align the in-use program timing requirements with
completion of the program as required in current regulations and the
incorporation of revisions to a few technical requirements in the
testing regulations based on information learned in this and one other
test program. Finally, the DFR modifies a few transitional
flexibilities for locomotive, recreational marine, and Tier 4 nonroad
engines and incorporates a handful of minor corrections.

DATES: This is effective on January 7, 2011 without further notice,
unless EPA receives adverse comment by December 8, 2010 on any
amendment, paragraph, or section of this rule. If EPA receives adverse
comment on this rule or any discrete amendment, paragraph, or section
of this rule, we will publish a timely withdrawal of the Direct Final
Rule, or the amendment, paragraph, or section of the direct final rule
that received adverse comment, in the Federal Register informing the
public that the rule, or that amendment, paragraph, or section of the
rule, will not take effect.
