Stakeholder Meeting Regarding Re-Evaluation of Currently Approved
Total Coliform Analytical Methods

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: The Environmental Protection Agency (EPA or Agency) is hosting
three public Web conferences during which the Agency will have a
technical dialogue with stakeholders regarding re-evaluation of
currently approved Total Coliform Rule (TCR) analytical methods. At
these meetings, stakeholders will be given an opportunity to discuss
potential elements of a method re-evaluation study, such as developing
a reference coliform/non-coliform library for use in evaluation of
method performance, setting method performance acceptance criteria,
and/or revising the Alternate Test Protocol (ATP). These meetings are
follow-up to the public stakeholder meeting held on May 11-12, 2010.
The proposed Revised Total Coliform Rule (RTCR) was published in the
Federal Register on July 14, 2010.

DATES: The first public Web conference will be held on Wednesday,
September 8, 2010, (10 a.m. to 3 p.m., Eastern Time (ET). To register

Public Teleconference and Public Comment

ACTION: Notification of public teleconference and public comment.

SUMMARY: Pursuant to the Federal Advisory Committee Act (FACA), Public
Law 92-463, the U.S. Environmental Protection Agency (EPA) hereby
provides notice that the National Environmental Justice Advisory
Council (NEJAC) will host a public teleconference meeting on Thursday,
August 26, 2010, starting at 1 p.m. Eastern Time. The primary topic of
discussion will be EPA's charge to the NEJAC on incorporating
environmental justice concerns into permits under Federal environmental
laws, and EPA's draft Plan EJ 2014. This NEJAC National Public
Teleconference meeting is open to the public. There will be a public
comment period beginning at 3:30 p.m. until 4 p.m. Eastern Time.
Members of the public are encouraged to provide comments relevant to
the topics of the meeting.
    For additional information about registering to attend the meeting
or to provide public comment, please see SUPPLEMENTARY INFORMATION. Due
to a limited number of telephone lines, attendance will be on a first-
come, first-serve basis. There is no fee to attend, but pre-
registration is required. Registration for the teleconference meeting

Draft Guidance, ``Federal Greenhouse Gas Accounting and
Reporting''

AGENCY: Council on Environmental Quality.

ACTION: Notice: Extension of comment period.

SUMMARY: This notice extends the comment period on draft guidance
published in the Federal Register on July 16, 2010. The original date
that the comment period would end was August 16, 2010. That date will
now be extended until September 1, 2010
    On October 5, 2009, President Obama signed Executive Order (E.O.)
13514--Federal Leadership in Environmental, Energy, and Economic
Performance (74 FR 52117) in order to establish an integrated strategy
toward sustainability in the Federal Government and to make reduction
of greenhouse gas (GHG) emissions a priority for Federal agencies.
Among other provisions, E.O. 13514 requires agencies to measure,
report, and reduce their GHG emissions.
    Section 9(a) of E.O. 13514 directed the Department of Energy's
(DOE's) Federal Energy Management Program (FEMP), in coordination with
the Environmental Protection Agency (EPA), Department of Defense (DoD),
General Services Administration (GSA), Department of the Interior
(DOI), Department of Commerce (DOC), and other agencies as appropriate,
to develop recommended Federal GHG reporting and accounting procedures.
On April 5, 2010, DOE-FEMP submitted the final recommendations on
Federal GHG reporting and accounting procedures to the Chair, Council
on Environmental Quality (CEQ).
    Section 5(a) of E.O. 13514 directed that the Chair of CEQ issue
guidance for Federal GHG accounting and reporting. Based on the final
recommendations, CEQ has prepared a draft guidance document. CEQ is
committed to open government principles and leading by example to
ensure that the Federal Government is transparent in its processes for
accounting and reporting of Federal GHG emissions.
    The Federal Government seeks to continually improve both the
quality of data and methods necessary for calculating GHG emissions.
Over time, additional requirements, methodologies and procedures will
be included in revisions to this document and supporting documents to
improve the Federal Government's overall ability to accurately account
for and report GHG emissions. In particular, while a detailed approach
to accepted and peer-reviewed life cycle methodologies is beyond the
scope of the current version of this guidance document, the Federal
Government is interested in including such approaches in future
versions, and may request comment on inclusion of life cycle
methodologies in future versions of this Guidance document.
    CEQ provides this draft guidance for public review and comment to
ensure accessibility of Federal accounting and reporting requirements
and to enhance the quality of public involvement in governmental
decisions relating to the environment.

Cooperative Agreements and Superfund State Contracts for
Superfund Response Actions

SUMMARY: This rule amends the regulation by allowing interim progress
reports to be due in 60 days, instead of the current 30-day
requirement, following the close of the quarterly and semi-annual
reporting periods. In addition, this amendment allows the recipient of
a Superfund State Contract (SSC) to request that EPA apply any
overpayment of cost share to another site. The revisions affect States,
Indian Tribes, intertribal consortia, and political subdivisions. The
revisions will improve the administration and effectiveness of
Superfund Cooperative Agreements and Superfund State Contracts.

EPA's Denial of the Petitions To Reconsider the Endangerment and

SUMMARY: The Environmental Protection Agency (EPA) is denying the
petitions to reconsider the Endangerment and Cause or Contribute
Findings for Greenhouse Gases under Section 202(a) of the Clean Air
Act. The Findings were signed by the Administrator on December 7, 2009.
EPA has carefully reviewed all of the petitions and revisited both the
scientific record and the Administrator's decision process underlying
the Findings in light of these petitions. EPA's analysis of the
petitions reveals that the petitioners have provided inadequate and
generally unscientific arguments and evidence that the underlying
science supporting the Findings is flawed, misinterpreted or
inappropriately applied by EPA. The petitioners' arguments fail to meet
the criteria for reconsideration under the Clean Air Act. The science
supporting the Administrator's finding that elevated concentrations of
greenhouse gases in the atmosphere may reasonably be anticipated to
endanger the public health and welfare of current and future U.S.
generations is robust, voluminous, and compelling, and has been
strongly affirmed by the recent science assessment of the U.S. National
Academy of Sciences.

Transportation Conformity Rule Restructuring Amendments

AGENCY: Environmental Protection Agency (EPA).

ACTION: Proposed rule.

SUMMARY: In this action, EPA is proposing to restructure several
sections of the transportation conformity rule so that they would apply
to any new or revised National Ambient Air Quality Standards (NAAQS)
that are established in the future for transportation-related criteria
pollutants. This proposal should reduce the need to amend the rule in
the future for the sole purpose of referencing specific new or revised
NAAQS. EPA is also proposing in this action that a near-term year would
have to be analyzed when using the budget test when an area's
attainment date has passed, or when an area's attainment date has not
yet been established. The budget test demonstrates that the total on-
road emissions projected for a metropolitan transportation plan or TIP
are within the emissions limits (``budgets'') established by the state
air quality implementation plan (``SIP'').
    This action also includes several administrative proposals and
clarifications to improve implementation of the rule.
    The Clean Air Act (CAA) requires federally supported transportation
plans, transportation improvement programs, and projects to be
consistent with (``conform to'') the purpose of the state air quality
implementation plan. The U.S. Department of Transportation (DOT) is
EPA's Federal partner in implementing the transportation conformity
regulation. EPA has consulted with DOT, and they concur with this
proposed rule.

TSCA Inventory Update Reporting Modifications

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: The Toxic Substances Control Act (TSCA) Inventory Update
Reporting (IUR) rule enables EPA to collect and then make public
critical information on the manufacturing, processing, and use of
commercial chemicals, including current information on volumes of
chemical production, manufacturing facility data, and how the chemicals
are used. This information helps the Agency determine whether chemicals
may be dangerous to people or the environment. EPA proposes to amend
the TSCA IUR rule, thereby providing improved information for EPA to
better identify and, where appropriate, take steps to manage risks
associated with chemical substances and mixtures (referred to hereafter
as chemical substances). Additionally, improved information would be
available for the public. The IUR rule, promulgated under TSCA section
8(a), requires manufacturers (including importers) of certain chemical
substances on the TSCA Chemical Substance Inventory (TSCA Inventory) to
report information about the manufacturing (including import),
processing, and use of those chemical substances. EPA is proposing to
require electronic reporting of IUR information and to modify IUR
reporting requirements, including certain circumstances that trigger
reporting, the specific data to be reported, the reporting standard for
processing and use information, and Confidential Business Information
(CBI) reporting procedures. These modifications would provide

SUMMARY: EPA is announcing a 45-day public comment period for the draft
document ``Nanomaterial Case Study: Nanoscale Silver in Disinfectant
Spray'' (EPA/600/R-10/081). The document is being issued by the
National Center for Environmental Assessment within EPA's Office of
Research and Development. The draft is intended to serve as part of a
process to help identify and prioritize scientific and technical
information that could be used in conducting comprehensive
environmental assessments of selected nanomaterials. It does not
attempt to draw conclusions regarding potential environmental risks of
nanoscale silver; rather, it aims to identify what is known and unknown
about nanoscale silver to support future assessment efforts.
    When finalizing the draft document, EPA intends to consider any
public comments that EPA receives in accordance with this notice.
    EPA is releasing this draft document solely for the purpose of pre-
dissemination review under applicable information quality guidelines.
This document has not been formally disseminated by EPA. It does not
represent and should not be construed to represent any Agency policy or
determination.

    The Agricultural Air Quality Task Force (AAQTF) will meet to
continue discussions on air quality issues relating to agriculture.
Additionally, the Livestock and Poultry Subcommittee of the AAQTF will
conduct a pre-meeting Livestock and Poultry Air Emissions
Standardization (LPAES) Workshop discussing livestock and poultry air
emissions monitoring data/research obtained from the National Animal
Air Emissions Monitoring Study (NAAEMS), and other published research/
data.

DATES: The LPAES workshop will convene at 2 p.m. on Monday September
27, 2010 and at 8 a.m. on Tuesday September 28, 2010 and will conclude
at 6 p.m. September 27, 2010 and 5 p.m. September 28, 2010.
    The AAQTF meeting will convene at 8 a.m. on Wednesday and Thursday
(September 29-30, 2010), and conclude at 5 p.m. each day. A public
comment period for the AAQTF meeting will be held on September 30,
2010. Individuals making oral presentations should register in person
at the AAQTF meeting site and must bring with them fifty copies of any
materials they would like distributed.

reporting rule to clarify certain provisions, to correct technical and
editorial errors, and to address certain questions and issues that have
arisen since promulgation. These proposed changes include providing

greater flexibility or simplified calculation methods for certain
sources in a facility, amending data reporting requirements to provide
additional clarity on when different types of GHG emissions need to be
calculated and reported, clarifying terms and definitions in certain
equations, and technical corrections.

Product Cancellation Order for Certain Pesticide Registrations

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice.

SUMMARY: This notice announces EPA's order for the cancellations,
voluntarily requested by the registrants and accepted by the Agency, of
the products listed in Table 1 of Unit II., pursuant to section 6(f)(1)
of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as
amended. This cancellation order follows a January 26, 2010 Federal
Register Notice of Receipt of Requests from the registrants listed in
Table 2 of Unit II. to voluntarily cancel these product registrations.
In the January 26, 2010 notice, EPA indicated that it
would issue an order implementing the cancellations, unless the Agency
received substantive comments within the 180-day comment period that
would merit its further review of these requests, or unless the
registrants withdrew their requests. The Agency did not receive any
comments on the notice. Further, the Agency received notice from a
registrant to withdraw one cancellation request. Accordingly, EPA
hereby issues in this notice a cancellation order granting the
requested cancellations. Any distribution, sale, or use of the products
subject to this cancellation order is permitted only in accordance with
the terms of this order, including any existing stocks provisions.

DATES: The cancellations are effective August 11, 2010.

Pesticides; Revised Fee Schedule for Registration Applications

SUMMARY: EPA is publishing a revised list of pesticide registration
service fees applicable to specified pesticide applications and
tolerance actions. In accordance with the Pesticide Registration
Improvement Renewal Act, the registration service fees for covered
pesticide registration applications received on or after October 1,
2010, will increase by 5 percent, rounded up to the nearest dollar amount,
from the fees published for fiscal years 2009 and 2010. The new fees
become effective on October 1, 2010.

Revision of Freedom of Information Act Regulations

AGENCY: Council on Environmental Quality.

SUMMARY: This document amends the Council on Environmental Quality's
(CEQ) regulations governing the disclosure of information pursuant to
the requests made under the Freedom of Information Act (FOIA). These
revisions also reflect the principles established by President Obama's
Presidential Memoranda on ``Transparency and Open Government'' and
``Freedom of Information Act'' issued on January 21, 2009 and Attorney
General Holder's Memorandum on ``The Freedom of Information Act
(FOIA)'' issued on March 19, 2009. Additionally, the regulations have
been updated to reflect CEQ's policy and practices and reaffirm its
commitment to providing the fullest possible disclosure of records to
the public. The regulations provide for an online FOIA Requester
Service Center and Reading Room; electronic FOIA requests; access to
records published or released under FOIA in electronic format, provided
the record is readily reproducible in that form or format; designation
of a Chief FOIA Officer and FOIA Public Liaison; referral of requests
to appropriate Federal agencies or consultation with another agency, if
appropriate; review of requests in order of receipt; multi-tacking of
FOIA requests based on the amount of time and work involved in
processing requests; revision of CEQ's initial determination period
from 10 days to 20 days, beginning on the date CEQ receives a written
request; assignment of individualized tracking numbers for certain
requests; tolling of the time limit for CEQ to act on a request;
expedited processing of FOIA requests upon showing a showing of
compelling need; CEQ consultations with a requester to determine if a
FOIA request may be modified to allow for a more timely response, or to
arrange an alternative time frame for a response; informing the
requester of the volume of requested material withheld and the extent
of deletions in records released in response to a FOIA request;
increase in time for appeal from 45 to 60 days from the date of denial
of a request; extension of the time limit to respond to a request in
``unusual circumstances,'' and aggregation of clearly related requests
by a single requester or group of requesters. Further, CEQ's fee
structure is revised to include a method for computing fees based upon
the classification of the requester and the base pay of the employee
making the search, an increase of copying costs from $0.10 to $0.15 per
page, and a provision for waiving fees. Additional administrative
changes include reorganizing, renumbering, and renaming of the FOIA
subsections and updating addresses and telephone numbers.

regulatory provisions and making several editorial corrections. These
amendments do not require pipeline operators to take on any significant
new pipeline safety initiatives.

DATES: The effective date of this final rule is October 1, 2010.
