Coat Protein of Plum Pox Virus; Exemption from the Requirement of
a Tolerance

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

-----------------------------------------------------------------------

SUMMARY: This regulation establishes an exemption from the requirement
of a tolerance for residues of the coat protein of plum pox virus in or
on stone fruit and almond when expressed in these food commodities by
the plant-incorporated protectant, coat protein gene of plum pox virus.
Interregional Research Project Number 4 of Rutgers University (on
behalf of the United States Department of Agriculture-Agricultural
Research Service-Appalachian Fruit Research Station) submitted a
petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA),
requesting an exemption from the requirement of a tolerance. This
regulation eliminates the need to establish a maximum permissible level
for residues of the coat protein of plum pox virus under the FFDCA.

DATES: This regulation is effective May 26, 2010. Objections and
requests for hearings must be received on or before July 26, 2010, and
must be filed in accordance with the instructions provided in 40 CFR
part 178 (see also Unit I.C. of the SUPPLEMENTARY INFORMATION).

Revocation of Significant New Use Rule on a Certain Chemical
Substance

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

-----------------------------------------------------------------------

SUMMARY: Pursuant to 40 CFR 721.185, EPA is revoking a significant new
use rule (SNUR) promulgated under section 5(a)(2) of the Toxic
Substances Control Act (TSCA) for the chemical substance identified
generically as polyalkyl phosphate, which was covered by premanufacture
notice (PMN) P-95-1772. Based on the concern criteria in Sec.
721.170(b), EPA issued a non-5(e) SNUR (i.e., a SNUR on a substance
that is not subject to a TSCA section 5(e) consent order) designating
certain activities as significant new uses. Subsequently, EPA received
and reviewed new information and test data for the chemical substance.
Based on the new information and test data, the Agency no longer finds
that the activities not described in PMN P-95-1772 constitute
significant new uses.

DATES: This final rule is effective July 26, 2010.

ADDRESSES: EPA has established a docket for this action under docket
identification (ID) number EPA-HQ-OPPT-2009-0668. All documents in the

Subject: AIR - PR. EPA. Clean Alternative Fuel Vehicle and Engine Conversions

Clean Alternative Fuel Vehicle and Engine Conversions

AGENCY: Environmental Protection Agency (EPA).

ACTION: Proposed rule.

-----------------------------------------------------------------------

SUMMARY: EPA is proposing to simplify and streamline the process by
which manufacturers of clean alternative fuel conversion systems may
demonstrate compliance with vehicle and engine emissions requirements.
Specifically, EPA is proposing to revise the regulatory criteria for
gaining an exemption from the Clean Air Act prohibition against
tampering for the conversion of vehicles and engines to operate on a
clean alternative fuel. Under existing EPA regulations, an exemption
from the tampering prohibition may only be granted to vehicles and
engines covered by a certificate of conformity. The proposed revisions
would create additional compliance options beyond certification that
would protect manufacturers of clean alternative fuel conversion
systems against a tampering violation, depending on the age of the
vehicle or engine to be converted. The new options would alleviate some
economic and procedural impediments to clean alternative fuel
conversions while maintaining environmental safeguards to ensure that
acceptable emission levels from converted vehicles are sustained.

DATES: Comments must be received on or before July 23, 2010. Under the
Paperwork Reduction Act, comments on the information collection
provisions are best assured of having full effect if the Office of
Management and Budget (OMB) receives a copy of your comments on or
before June 25, 2010.
Public Hearing: EPA has tentatively scheduled a public hearing
about this proposal for 9 a.m. June 23, 2010. EPA will hold the hearing
only if any party notifies EPA by June 18, 2010 of interest in
presenting oral testimony at the hearing. The hearing will start at 9
a.m. local time and continue until everyone has had a chance to speak.
EPA will cancel the hearing if no one expresses interest by June
18, 2010. EPA will notify the public of a cancellation by publication
in the Federal Register, via its alternative fuel conversion Web site,
http://www.epa.gov/otaq/consumer/fuels/altfuels/altfuels.htm and via

[Notices]
[Page 29540-29545]

ENVIRONMENTAL PROTECTION AGENCY

[EPA-HQ-OPP-2010-0397; FRL-8825-8]

Notice of Suspension of Certain Pesticide Registrations

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice.

-----------------------------------------------------------------------

SUMMARY: This notice, pursuant to section 6(f)(2) of the Federal
Insecticide, Fungicide and Rodenticide Act (FIFRA), announces certain
Notices of Intent to Suspend issued by EPA pursuant to section
3(c)(2)(B) of FIFRA. Each Notice of Intent to Suspend was issued
following the Agency's issuance of a Data Call-In notice (DCI), which
required the registrants of the affected pesticide products containing
a certain pesticide active ingredient to take appropriate steps to
secure certain data, and following the registrant's failure to submit
these data or to take other appropriate steps to secure the required
data. The subject data were determined to be required to maintain in
effect the existing registrations of the affected product(s). Failure
to comply with the data requirements of a DCI is a basis for suspension
of the affected registrations under section 3(c)(2)(B) of FIFRA.

DATES: The Notice of Intent to Suspend included in this Federal
Register notice will become a final and effective suspension order
automatically by operation of law 30 days after the date of the
registrant's receipt of the mailed Notice of Intent to Suspend or 30
days after the date of publication of this notice in the Federal
Register (if the mailed Notice of Intent to Suspend is returned to the
Administrator as undeliverable, if delivery is refused, or if the
Administrator otherwise is unable to accomplish delivery to the
registrant after making reasonable efforts to do so), unless during
that time a timely and adequate request for a hearing is made by a
person adversely affected by the Notice of Intent to Suspend or the
registrant has satisfied the Administrator that the registrant has
complied fully with the requirements that served as a basis for the
Notice of Intent to Suspend. Unit IV. explains what must be done to
avoid suspension under this notice (i.e., how to request a hearing or
how to comply fully with the requirements that served as a basis for
the Notice of Intent to Suspend).

AGENCY: Office of the Secretary, Interior.

ACTION: Notice of public meetings of the Invasive Species Advisory
Committee.

-----------------------------------------------------------------------

SUMMARY: Pursuant to the provisions of the Federal Advisory Committee
Act, notice is hereby given of meetings of the Invasive Species
Advisory Committee (ISAC). Comprised of 30 nonfederal invasive species
experts and stakeholders from across the nation, the purpose of the
Advisory Committee is to provide advice to the National Invasive
Species Council, as authorized by Executive Order 13112, on a broad
array of issues related to preventing the introduction of invasive
species and providing for their control and minimizing the economic,
ecological, and human health impacts that invasive species cause. The
Council is co-chaired by the Secretary of the Interior, the Secretary
of Agriculture, and the Secretary of Commerce. The duty of the Council
is to provide national leadership regarding invasive species issues.
Purpose of Meeting: The meeting will be held on June 22-24, 2010 in
San Francisco, California, and will focus primarily on aquatic
invaders. The Bay Area was chosen as the meeting location because it is
one of the most invaded marine/coastal environments in the world, with
over 50 invasive species that threaten the Bay's vibrant economy. ISAC
will provide recommendations to the Council concerning both the unique
challenges faced by the Bay Area, and broader challenges faced by NISC
agencies elsewhere in the nation. ISAC will also address the complex
relationship between climate change and invasive species, opportunities
for green jobs creation within invasive species efforts, ballast water
related issues, and the development of state invasive species councils.

DATES: Meeting of the Invasive Species Advisory Committee: Tuesday,
June 22, 2010 and Thursday, June 24, 2010; beginning at approximately 8
a.m., and ending at approximately 5 p.m. each day. Members will be
participating in an off-site field tour on Wednesday, June 23, 2010.

Subject: TOXICS - ND/90-Day Public Comment. Draft EPA's Reanalysis of Key Issues Related to Dioxin Toxicity and Response to NAS Comments

[Federal Register: May 21, 2010 (Volume 75, Number 98)]
[Notices]

ENVIRONMENTAL PROTECTION AGENCY

[FRL-9154-2; Docket ID No. EPA-HQ-ORD-2010-0395]

Draft EPA's Reanalysis of Key Issues Related to Dioxin Toxicity
and Response to NAS Comments

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice of Public Comment Period.

-----------------------------------------------------------------------

SUMMARY: EPA is announcing a 90-day public comment period for the
external review draft entitled, ``EPA's Reanalysis of Key Issues
Related to Dioxin Toxicity and Response to NAS Comments'' (EPA/600/R-
10/038A). This draft report responds to the key recommendations and
comments included in the National Academy of Sciences (NAS) 2006
report. In addition, it includes new analyses on potential human
effects that may result from exposure to 2,3,7,8-tetrachlorodibenzo-p-
dioxin (TCDD). These analyses have not been in previous versions of
draft reports related to EPA's dioxin reassessment activity. This draft
report is now considered to be under EPA's Integrated Risk Information
System (IRIS) program, and thus, the new IRIS process announced in May
2009 (http://www.epa.gov/iris/process/) is being followed. Per the May
2009 process, this draft report is beginning Step 4--independent
external peer review and public review and comment. This draft dioxin
report was prepared by the National Center for Environmental Assessment
(NCEA) within the EPA Office of Research and Development (ORD).
The draft document, ``EPA's Reanalysis of Key Issues Related to
Dioxin Toxicity and Response to NAS Comments,'' is also being provided
to EPA's Science Advisory Board (SAB), a body established under the
Federal Advisory Committee Act, for independent external peer review.
The SAB will convene an expert panel composed of scientists
knowledgeable about technical issues related to dioxins and risk
assessment. The SAB is expected to hold a public teleconference on or
about June 24, 2010, and a public panel meeting on July 13-15, 2010.
The SAB peer review meetings will be announced by the SAB staff office
in a separate Federal Register Notice. EPA intends to forward all
public comments submitted before July 7, 2010, in response to this
notice to the SAB peer review panel for their consideration. Members of
the public who wish to ensure that their technical comments are
provided to the SAB expert panel before each meeting should also e-mail
their comments separately to Thomas Armitage, the SAB Designated
Federal Officer at armitage.thomas@epa.gov, following the procedures in
the Federal Register Notice announcing the SAB public meetings. When
completing this draft dioxin report, EPA will consider any written
public comments that EPA receives in accordance with the detailed
instructions provided below under SUPPLEMENTARY INFORMATION. The public
comment period and SAB external peer review are independent processes
that provide separate opportunities for all interested parties to
comment on the draft report.
EPA is releasing this draft report solely for the purpose of pre-
dissemination peer review under applicable information quality
guidelines. This draft report has not been formally disseminated by
EPA. It does not represent and should not be construed to represent any
Agency policy or determination.

DATES: The public comment period begins May 21, 2010, and ends August
19, 2010. Comments should be in writing and must be received by EPA by
August 19, 2010.
Due to the timing of the SAB's peer review meeting, EPA can only
guarantee that those comments received by July 7, 2010, in response to
this Federal Register notice will be provided to the SAB panel prior to
the SAB meeting. Comments received after July 7, will still be provided
to the SAB panel and will also inform the Agency's revision of the
draft report.

ADDRESSES: The external review draft titled, ``EPA's Reanalysis of Key
Issues Related to Dioxin Toxicity and Response to NAS Comments'' (EPA/
600/R-10/038A) is available primarily via the Internet on the NCEA home
