Hazardous Waste Management System; Identification and Listing of

AGENCY: Environmental Protection Agency (EPA).

ACTION: Proposed rule.

SUMMARY: The Environmental Protection Agency (EPA or the Agency) is
proposing to amend its regulations under the Resource Conservation and
Recovery Act (RCRA) to remove saccharin and its salts from the lists of
hazardous constituents and commercial chemical products which are
hazardous wastes when discarded or intended to be discarded. EPA is
also proposing to amend the regulations under the Comprehensive
Environmental Response, Compensation, and Liability Act (CERCLA) to
remove saccharin and its salts from the list of hazardous substances.
This proposed rule is in response to a petition submitted to EPA by the
Calorie Control Council (CCC), to remove saccharin and its salts from
the above lists. EPA is proposing to grant CCC's petition based on a
review of the evaluations conducted by key public health agencies
concerning the carcinogenic and other potential toxicological effects
of saccharin and its salts, as well as EPA's own assessment of the
waste generation and management information for saccharin and its
salts, which demonstrate that saccharin and its salts do not meet the
criteria in the hazardous waste regulations for remaining on EPA's
lists of hazardous constituents, hazardous wastes, and hazardous
substances.

SUMMARY: Under the Federal Advisory Committee Act, Public Law 92-463,
EPA gives notice of a meeting of the NACEPT Subcommittee on Promoting
Environmental Stewardship.
    The purpose of the Subcommittee on Promoting Environmental
Stewardship (SPES) of the National Advisory Council for Environmental
Policy and Technology (NACEPT) is to advise the U.S. Environmental Protection
Agency on how to promote environmental stewardship practices that
encompass all environmental aspects of an organization in the regulated
community and other sectors, as appropriate, in order to enhance human
health and environmental protection. A copy of the meeting agenda will
be posted at http://epa.gov/ncei/dialogue.htm. This Web site also
includes the charge of the SPES, which provides further information
about the purpose of the Subcommittee.
    Meeting agenda will focus on the Subcommittee's potential
stewardship-related recommendations for the Agency.

DATES: The NACEPT Subcommittee on Promoting Environmental Stewardship
will hold an open meeting on May 5 (8 a.m.-5 p.m.) and May 6 (8 a.m.-4
p.m.) Eastern. Less than 15 calendar days notice is being given due to

Upper Peninsula Power Company; Notice of Availability of
Environmental Assessment

April 15, 2010.
    In accordance with the National Environmental Policy Act of 1969
and the Federal Energy Regulatory Commission's regulations, 18 CFR part
380, Commission staff have prepared an environmental assessment (EA)
regarding Upper Peninsula Power Company's plan to replace the spillway
at the Bond Falls Development of the Bond Falls Hydroelectric Project
(FERC No. 1864). The project is located on the Ontonagon River in
Ontonagon and Gogebic Counties, Michigan, and Vilas County, Wisconsin,
partially on lands within the Ottawa National Forest. The Bond Falls
Development is located on the Middle Branch of the Ontonagon River in
Ontonagon County, Michigan, and occupies 73.5 acres of land within the
Ottawa National Forest.
    The EA contains the Commission staff's analysis of the potential
environmental effects of the planned replacement of the Bond Falls
spillway and concludes that the spillway replacement, with appropriate
environmental protective measures, would not constitute a major federal
action that would significantly affect the quality of the human
environment.
    Copies of the EA are available for review in the Public Reference
Room 2-A of the Commission's offices at 888 First Street, NE.,
Washington, DC 20426. The EA may also be viewed on the Commission's

Dimethyldithiocarbamate Salts; Amendments to Terminate Uses

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice.

SUMMARY: This notice announces EPA's order for the cancellation and/or
amendments to terminate uses, voluntarily requested by the registrant
and accepted by the Agency, of products containing the pesticides
sodium dimethyldithiocarbamate and/or potassium
dimethyldithiocarbamate, pursuant to section 6(f)(1) of the Federal
Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended. This
cancellation order follows a September 16, 2009 Federal Register Notice
of Receipt of Requests from dimethyldithiocarbamate salts registrants
to voluntarily cancel and/or amend to terminate uses of some of their
dimethyldithiocarbamate salts product registrations. These are not the
last dimethyldithiocarbamate salts products registered for use in the
United States. In the September 16, 2009 notice, EPA indicated that it
would issue an order implementing the cancellations and amendments to
terminate uses, unless the Agency received substantive comments within
the 180-day comment period that would merit its further review of these
requests, or unless the registrant withdrew its requests within this
period. The Agency did not receive any comments on the notice. Further,
the registrant did not withdraw its requests. Accordingly, EPA hereby
issues in this notice a cancellation order granting the requested
product cancellation and amendments to terminate uses. Any
distribution, sale, or use of the sodium dimethyldithiocarbamate and
potassium dimethyldithiocarbamate products subject to this cancellation
order is permitted only in accordance with the terms of this order,
including any existing stocks provisions.

SUMMARY: This notice announces EPA's order for the cancellation of
products containing the pesticide pirimicarb, pursuant to section 3 of
the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as
amended. This cancellation order follows a February 21, 2004 expiration
of conditional registrations. Any distribution, sale, or use of the
products subject to this cancellation order is permitted only in
accordance with the terms of this order, including any existing stocks
provisions.

SUMMARY: The U.S. Environmental Protection Agency (EPA) is announcing
that a workshop entitled, ``Workshop to Discuss Policy-Relevant Science
to Inform EPA's Integrated Plan for Review of the National Ambient Air
Quality Standards for Lead,'' is being organized by EPA's Office of Air
and Radiation's Office of Air Quality Planning and Standards (OAQPS)
and EPA's Office of Research and Development's National Center for
Environmental Assessment (NCEA). The workshop will be held May 10-11,
2010, in Research Triangle Park, North Carolina. The workshop will be
open to attendance by interested public observers on a first-come,
first-served basis up to the limits of available space.

DATES: The workshop will be held on May 10 and 11, 2010. The pre-
registration deadline is May 3, 2010.

SUMMARY: The U.S. Department of Energy (DOE) is soliciting information
on how it can better assist the states to adopt, implement, enforce,
and assess compliance with the current model building energy codes or
their equivalent. DOE is interested in better understanding the
barriers and issues involved and the needs, resources, materials and
other technical assistance required to accomplish the goal of increased
adoption and compliance with the latest model building energy codes,
Standard 90.1-2007, Energy Standard for Buildings Except Low-Rise
Residential Buildings (or equivalent), for commercial buildings and the
2009 International Energy Conservation Code (or equivalent) for low-
rise residential buildings.
    DOE is publishing this request for information to allow interested
parties to provide suggestions, comments, and other information. This
notice identifies several areas in which DOE is particularly interested
in receiving information; however, any input and suggestions considered
relevant to the topic are welcome.

Review of the Secondary National Ambient Air Quality Standards
for Oxides of Nitrogen and Oxides of Sulfur

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice of extension of comment period.

SUMMARY: The EPA is announcing an extension of the public comment
period for a draft assessment document titled, Policy Assessment for
the Review of the Secondary National Ambient Air Quality Standards for
Oxides of Nitrogen and Oxides of Sulfur: First External Review Draft
(75 FR 11877; March 12, 2010). The comment period was originally
scheduled to end on April 29, 2010. The extended comment period will
close on May 13, 2010. The Agency is extending the comment period by
two weeks to provide the public with adequate time to conduct
appropriate analysis and prepare meaningful comments.
    Although EPA is extending the comment period for the first draft
policy assessment by two weeks, EPA is committed to issuing a proposal
addressing the nitrogen oxides (NOX) and sulfur oxides
(SOX) secondary National Ambient Air Quality Standards
(NAAQS) by July 12, 2011. The extension also will not alter EPA's
internal schedule for providing a second draft policy assessment for
review by the Clean Air Scientific Advisory Committee (CASAC) by the
end of July 2010.
    The public is encouraged to submit comments by the end of the
original comment period to ensure that EPA has adequate time to
evaluate and respond to those comments. However, all comments received
by May 13, 2010, will be considered in developing the second draft
policy assessment.

ACTION: Notice of Availability of the Draft Environmental Impact
Statement (EIS) for the Proposed TransCanada Keystone XL Pipeline
Project.

SUMMARY: The Department of State (DOS) has prepared a draft
Environmental Impact Statement (EIS) for the Proposed TransCanada
Keystone XL Pipeline Project. On September 19, 2008, TransCanada
Keystone Pipeline, LP (Keystone) filed an application for a
Presidential permit for the construction, operation, and maintenance of
pipeline facilities at the border of the U.S. and Canada for the
transport of crude oil across the U.S.-Canada international boundary.
The Secretary of State is designated and empowered to receive all
applications for Presidential permits, as referred to in Executive
Order 13337, as amended, for the construction, connection, operation,
or maintenance, at the borders of the United States, of facilities for
the exportation or importation of petroleum, petroleum products, coal,
or other fuels to or from a foreign country. Keystone has requested
authorization to construct and operate border crossing facilities at
the U.S.-Canadian border in Phillips County, near Morgan, Montana, in
connection with its proposed international pipeline project (the
Keystone XL Pipeline Project) that is designed to transport Canadian
crude oil production from the Western Canadian Sedimentary Basin (WCSB)
to destinations in the south central United States, including to an
existing oil terminal in Cushing, Oklahoma, and to existing delivery
points in the Port Arthur and East Houston areas of Texas.

SUMMARY: We are advising the public of our determination that a corn
line developed by Syngenta Biotechnology, Inc., designated as
transformation event MIR162, which has been genetically engineered for
insect resistance, is no longer considered a regulated article under
our regulations governing the introduction of certain genetically
engineered organisms. Our determination is based on our evaluation of
data submitted by Syngenta Biotechnology, Inc., in its petition for a
determination of nonregulated status, our analysis of other scientific
data, and our response to comments received from the public on the
petition for nonregulated status and its associated environmental
assessment and plant pest risk assessment. This notice also announces
the availability of our written determination of nonregulated status
and finding of no significant impact.

SUMMARY: The National Environmental Education Foundation was created by
Section 10 of Public Law 101-619, the National Environmental Education
Act of 1990. It is a private 501(c)(3) non-profit organization
established to promote and support education and training as necessary
tools to further environmental protection and sustainable,
environmentally sound development. It provides the common ground upon
which leaders from business and industry, all levels of government,
public interest groups, and others can work cooperatively to expand the
reach of environmental education and training programs beyond the
traditional classroom. The Foundation supports a grant program that
promotes innovative environmental education and training programs; it
also develops partnerships with government and other organizations to
administer projects that promote the development of an environmentally
literate public. The Administrator of the U.S. Environmental Protection
Agency, as required, by the terms of the Act, announces the following
appointment to the National Environmental Education Foundation Board of
Trustees. The appointee is Manuel Alberto Dim, a partner in the law
firm Lydecker Dim, LLP.

SUMMARY: The U.S. Environmental Protection Agency (EPA or Agency) is
announcing the third in-person meeting of the Climate Ready Water
Utilities (CRWU) Working Group of the National Drinking Water Advisory
Council (NDWAC). The purpose of this meeting is for the Working Group
to discuss key findings, the adaptive response framework on what it
means to be climate ready, enabling environment recommendations, and
climate-related tools to support utilities.

DATES: The third in-person CRWU Working Group meeting will take place
on May 5, 2010, from 8:30 a.m. to 5:30 p.m., Central Daylight Time
(CDT) and on May 6, 2010, from 8:30 a.m. to 3 p.m., CDT.

Oil and Gas and Sulphur Operations in the Outer Continental

AGENCY: Minerals Management Service (MMS), Interior.

ACTION: Final rule.

SUMMARY: The MMS is amending the regulations regarding oil and natural
gas production requirements. This is a complete rewrite of these
regulations, addressing issues such as production rates, burning oil,
and venting and flaring natural gas, to ensure appropriate development
of these natural resources. The final rule eliminates most restrictions
on production rates and clarifies limits on the amount of natural gas
that can be flared or vented. The final rule is written using plain
language, so it is easier to read and understand.

DATES: Effective Date: This rule is effective on May 19, 2010.

Categorical Exclusions From Environmental Review

AGENCY: Nuclear Regulatory Commission.

ACTION: Final rule.

SUMMARY: The U.S. Nuclear Regulatory Commission (NRC) is amending its
regulations that describe the categories of actions which do not
require an environmental review under the requirements of the National
Environmental Policy Act of 1969 (NEPA) as the NRC has determined that
such actions do not individually or cumulatively have a significant
effect on the human environment. The amended regulations eliminate the
need for the preparation of environmental assessments for NRC actions
that are minor, administrative, or procedural in nature. The amendments
do not change any requirements for licensees, but may provide for more
time for NRC action on more substantial issues and/or speed up the
process for review of the amendments.

DATES: This final rule is effective on April 19, 2010.
