ACTION: Notice of public comment Period.

-----------------------------------------------------------------------

SUMMARY: The Environmental Protection Agency (EPA) is soliciting public
comment and recommendations on enforcement and compliance national
priorities to be addressed for fiscal years 2011-2013. EPA selects

from states, EPA staff, tribes, and on-line public comments.
Enforcement national priorities are not limited to those priority
candidates on the above Web site and the public is invited to propose
additional areas for consideration. Comments will be considered as part
of the process EPA uses to identify and select enforcement and
compliance national priorities. Final priority selection will be
incorporated into the EPA Office of Enforcement and Compliance

An Assessment of Decision-Making Processes: The Feasibility of
Incorporating Climate Change Information Into Land Protection Planning

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice of Public Comment Period.

-----------------------------------------------------------------------

SUMMARY: EPA is announcing a 30-day public comment period for the draft
document titled, ``An Assessment of Decision-Making Processes: The
Feasibility of Incorporating Climate Change Information into Land
Protection Planning'' (EPA/600/R-09/142a). The document was prepared by
the National Center for Environmental Assessment within EPA's Office of
Research and Development. This draft document is a review of decision-
making processes of selected land protection programs. The goal of this
document is to assess the feasibility of incorporating climate change
impacts information into the evaluation of these programs. The
assessment revealed that there are several strategies that might be
useful for incorporating climate change information into decision
making. As part of a portfolio of adaptation strategies, land
protection may become more important for jurisdictions, particularly to
ameliorate climate change impacts on watersheds and wildlife.
The public comment period and the external peer review, which will
occur after the public comment period, are separate processes that
provide opportunities for all interested parties to comment on the
document. EPA intends to forward the public comments that are submitted
in accordance with this notice to the external peer reviewer panel
prior to the meeting for their consideration. When finalizing the draft
document, EPA intends to consider any public comments that EPA receives
in accordance with this notice.
EPA is releasing this draft document solely for the purpose of pre-
dissemination peer review under applicable information quality
guidelines. This document has not been formally disseminated by EPA. It
does not represent and should not be construed to represent any Agency
policy or determination.

DATES: The 30-day public comment period begins December 31, 2009, and
ends February 1, 2010. Technical comments should be in writing and must be received by EPA by February 1, 2010.

ADDRESSES: The draft ``An Assessment of Decision-Making Processes: The

public. Historically, EPA has met this mandate by publishing weekly
notices of availability of EPA comments, which includes a brief summary
of EPA's comment letters, in the Federal Register. Since February 2008,
EPA has been including its comment letters on EISs on its Web site at:
http://www.epa.gov/compliance/nepa/eisdata.html. Including the entire
EIS comment letters on the Web site satisfies the Section 309(a)
requirement to make EPA's comments on EISs available to the public.
Accordingly, after March 31, 2010, EPA will discontinue the publication
of this notice of availability of EPA comments in the Federal Register.

Hazardous Waste Management System; Exclusion for Identifying and
Listing Hazardous Waste

AGENCY: Environmental Protection Agency (EPA).

ACTION: Direct final rule.

-----------------------------------------------------------------------

SUMMARY: The EPA (also, ``the Agency'' or ``we'' in this preamble) is
taking direct final action to grant a petition submitted by
Professional Plating, Inc. (PPI), in Brillion, Wisconsin to exclude (or
``delist'') up to 140 cubic yards of sludge per year generated by its
wastewater treatment plant from the list of hazardous wastes.
The Agency has decided to grant the petition based on an evaluation
of waste-specific information provided by PPI. This decision
conditionally excludes the petitioned waste from the requirements of
hazardous waste regulations under the Resource Conservation and
Recovery Act (RCRA).
We conclude that PPI's petitioned waste is nonhazardous with
respect to the original listing criteria and that there are no other
factors which would cause the waste to be hazardous when disposed of in
a Subtitle D landfill which is permitted, licensed, or registered by a
State to manage industrial solid waste.

DATES: This rule is effective on March 1, 2010 without further notice,
unless EPA receives adverse comment by January 29, 2010. If EPA
receives adverse comment, we will publish a timely withdrawal in the
Federal Register informing the public that the rule will not take
effect.
