Carbon Black; Exemption from the Requirement of a Tolerance

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: This regulation establishes an exemption from the requirement
of a tolerance for residues of carbon black (CAS Reg. No. 1333-86-4)
under 40 CFR 180.920 when used as an inert ingredient (colorant) in
pesticide formulations applied to seeds used to grow agricultural and
horticultural crops. Becker Underwood, Inc. submitted a petition to EPA
under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting an
exemption from the requirement of a tolerance. This regulation
eliminates the need to establish a maximum permissible level for
residues of carbon black.

DATES: This regulation is effective August 12, 2009. Objections and
requests for hearings must be received on or before October 13, 2009,
and must be filed in accordance with the instructions provided in 40
CFR part 178 (see also Unit I.C. of the SUPPLEMENTARY INFORMATION).

Sodium Lauryl Sulfate; Exemption From the Requirement of a
Tolerance

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: This regulation establishes an exemption from the requirement
of a tolerance for residues of sodium lauryl sulfate (CAS Reg. No. 151-
21-3) when used as a component of food contact sanitizing solutions
applied to all food contact surfaces in public eating places, dairy-
processing equipment, and food-processing equipment and utensils at a
maximum level in the end-use concentration of 350 parts per million
(ppm). ETI H2O submitted a petition to EPA under the Federal Food,
Drug, and Cosmetic Act (FFDCA), requesting an exemption from the
requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of sodium lauryl sulfate.

SUMMARY: This regulation establishes a time-limited tolerance for
residues of 1-naphthaleneacetic acid ethyl ester in or on avocados.
This action is in response to EPA's granting of an emergency exemption
under section 18 of the Federal Insecticide, Fungicide, and Rodenticide
Act (FIFRA) authorizing use of the pesticide on avocado trees. This
regulation establishes a maximum permissible level for residues of 1-
naphthaleneacetic acid ethyl ester in this food commodity. The time-
limited tolerance expires and is revoked on December 31, 2012.

Nominations to the FIFRA Scientific Advisory Panel; Request for
Comments

SUMMARY: This notice provides the names, addresses, professional
affiliations, and selected biographical data of persons nominated to
serve on the Scientific Advisory Panel (SAP) established under section
25(d) of the Federal Insecticide, Fungicide, and Rodenticide Act
(FIFRA). The FIFRA SAP was created on November 28, 1975, and made a
statutory panel by amendment to FIFRA, dated October 25, 1988. The
Agency is, at this time, selecting two new members to serve on the
FIFRA SAP as a result of a membership term that will expire this year
and the sudden and unexpected loss of a FIFRA SAP member. Public
comment on the nominations is invited, as these comments will be used
to assist the Agency in selecting the new chartered FIFRA SAP members.

Bromonitrostyrene; Product Cancellation Order

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice.

SUMMARY: This notice announces EPA's order for the cancellation of
products containing the pesticide bromonitrostyrene, pursuant to
section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide
Act (FIFRA), as amended. This cancellation order follows an August 27,
2008 Federal Register Notice of Receipt of Requests from the
bromonitrostyrene registrants to voluntarily cancel all their
bromonitrostyrene product registrations. These are the last
bromonitrostyrene products registered for sale or distribution in the
United States. In the August 27, 2008 Notice, EPA indicated that it
would issue an order accepting the requests for voluntary cancellation
and implementing the cancellations, unless the Agency received
substantive comments within the 30-day comment period that would merit

Notice of Meeting

    Board meeting: September 23, 2009-National Harbor, MD; the U.S.
Nuclear Waste Technical Review Board will meet to discuss the
implications of fuel-cycle technologies for nuclear waste management
and disposal.
    Pursuant to its authority under section 5051 of Public Law 100-203,
Nuclear Waste Policy Amendments Act of 1987, the U.S. Nuclear Waste
Technical Review Board will meet at National Harbor, Maryland, on
Wednesday, September 23, 2009, to discuss the implications of
alternative technological strategies for the management and disposal of
spent nuclear fuel and high-level radioactive waste. The Board will
receive an update on the Fuel Cycle Study being conducted at the
Massachusetts Institute of Technology, and a panel of industry
representatives will discuss their proposals to the U.S. Department of
Energy (DOE) for recycling, reprocessing, and burning spent nuclear
fuel in fast reactors. The Board also has invited a representative of
the Nuclear Energy Agency to present an overview of efforts in other
countries to manage and dispose of nuclear waste.
    Information presented at the meeting will be used by the Board as
part of its ongoing effort to inform Congress, the Secretary of Energy,
and a blue-ribbon commission of technical issues and questions that
should be addressed related to waste-management alternatives. The
Nuclear Waste Policy Amendments Act of 1987 requires the Board to
conduct an independent review of the technical and scientific validity
of DOE activities related to nuclear waste management, including
transporting, packaging, and disposing of spent nuclear fuel and high-
level radioactive waste.
    The Board meeting will be held at the Gaylord Hotel; 201 Waterfront
Street; National Harbor, MD 20745; (tel.) 301-965-2000, (fax) 301-965-
2039.
    A detailed meeting agenda will be available on the Board's Web
site, http: //www.nwtrb.gov, approximately one week before the meeting.
The agenda also may be obtained by telephone
request at that time. The meeting will be open to the public, and
opportunities for public comment will be provided.
    The meeting will begin at 8 a.m. on Wednesday morning. Time has
been set aside at the end of the day for public comments. Those wanting
to speak are encouraged to sign the ``Public Comment Register'' at the
check-in table. A time limit may have to be set on individual remarks,
but written comments of any length may be submitted for the record.
    Transcripts of the meeting will be available on the Board's Web
site, by e-mail, on computer disk, and on library-loan in paper format
from Davonya Barnes of the Board's staff no later than October 19,
2009.

SUMMARY: EPA is taking final action to revise a portion of its Phase 2
implementation rule for the 8-hour ozone National Ambient Air Quality
Standard (NAAQS or standard) for which the Agency had sought a
voluntary remand from the U.S. Circuit Court of Appeals for the
District of Columbia Circuit. The Court granted EPA's request by
remanding and vacating that portion of the rule. Specifically, this
rule addresses an interpretation that allowed certain credits toward
reasonable further progress (RFP) for the 8-hour standard from
emissions reductions outside the nonattainment area.

DATES: This rule is effective on October 13, 2009.

the Committee Management Secretariat, General Services Administration,
notice is hereby given that the Fusion Energy Sciences Advisory
Committee has been renewed for a two-year period.
    The Committee will provide advice to the Office of Science (DOE),
on long-range plans, priorities, and strategies for advancing plasma
science, fusion science and fusion technology--the knowledge base
needed for an economically and environmentally attractive fusion energy
source. The Secretary of Energy has determined that the renewal of the
Fusion Energy Sciences Advisory Committee is essential to the conduct
of the Department's business and in the public interest in connection
with the performance of duties imposed upon the Department of Energy by
law. The Committee will continue to operate in accordance with the
provisions of the Federal Advisory Committee Act, the Department of
Energy Organization Act (Pub. L. 95-91), the General Services
Administration Final Rule on Federal Advisory Committee Management, and
other directives and instruction issued in the implementation of those

SUMMARY: The EPA is hereby granting a nationwide waiver of the Buy
American requirements of ARRA Section 1605 under the authority of
Section 1605(b)(1) (public interest waiver) for de minimis incidental
components of eligible water infrastructure projects funded by ARRA
This action revises the terms under which incidental components qualify
for coverage under the public interest de minimis waiver signed and
effective on May 22, 2009, and permits the use of non-domestic iron,
steel, and manufactured goods when they occur in de minimis incidental
components of such projects funded by ARRA that may otherwise be
prohibited under section 1605(a).

Avermectin B1 and its delta-8,9-isomer; Pesticide
Tolerances

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: This regulation establishes tolerances for combined residues
of avermectin B1 and its delta-8,9-isomer in or on stone
fruit crop group 12, tree nut crop group 14, pistachio, tuberous and
corm vegetable crop subgroup 01C, goat fat, hog fat, horse fat, sheep
fat, cattle fat, and cattle meat byproducts. Existing tolerances for
cattle, fat and cattle, meat byproducts are revised. Existing
individual crop tolerances on almond, plum, potato, and walnut are
deleted and replaced by the establishment of new crop group tolerances.
Existing tolerances on almond, hulls and plum, prune, dried are
retained. This regulation also makes a technical correction to
correctly express the existing tolerances for mint (replace term
``mint'' with the more specific terms ``peppermint, tops'' and
``spearmint, tops''). Syngenta Crop Protection, Inc. and Y-TEX
Corporation requested these tolerances under the Federal Food, Drug,
and Cosmetic Act (FFDCA).

SUMMARY: On May 20, 2009 EPA published a Final Rule that established an
18-month, time-limited exemption from the requirement of a tolerance
for residues of the Bacillus thuringiensis Cry1A.105 protein in or on
the food and feed commodities cotton seed, cotton seed oil, cotton seed
meal, cotton hay, cotton hulls, cotton forage and cotton gin byproducts
when used as a plant-incorporated protectant. Subsequent to the
publication of the May 20, 2009 Final Rule, the Agency identified an
error in the Analytical Methods section of that Rule's preamble.
Through this action, EPA is republishing the tolerance exemption with a
new effective date and opportunity to request a hearing, and a
corrected Analytical Methods section. The conditions of the
time-limited tolerance exemption as established on May 20, 2009 are
unchanged: the time-limited tolerance exemption expires and is revoked
on November 22, 2010.

Loan Guarantees for Projects That Employ Innovative Technologies

AGENCY: Office of the Chief Financial Officer, Department of Energy.

ACTION: Proposed rule.

SUMMARY: On October 23, 2007, the Department of Energy (DOE or the
Department) published a final rule establishing regulations for the
loan guarantee program authorized by Section 1703 of Title XVII of the
Energy Policy Act of 2005 (Title XVII or the Act). Section 1703 of
Title XVII authorizes the Secretary of Energy (Secretary) to make loan
guarantees for projects that ``avoid, reduce, or sequester air
pollutants or anthropogenic emissions of greenhouse gases; and employ
new or significantly improved technologies as compared to commercial
technologies in service in the United States at the time the guarantee
is issued.'' Section 1703 of Title XVII also identifies ten categories
of technologies and projects that are potentially eligible for loan
guarantees. The two principal goals of section 1703 of Title XVII are
to encourage commercial use in the United States of new or
significantly improved energy-related technologies and to achieve
substantial environmental benefits. DOE believes that commercial use of
these technologies will help sustain and promote economic growth,
produce a more stable and secure energy supply and economy for the
United States, and improve the environment.
    Through experience gained implementing the loan guarantee program
authorized by section 1703 of Title XVII, and information received from
industry indicating the wide variety of ownership structures which
participants would like to employ in implementing projects seeking loan
guarantees, DOE believes it is appropriate to consider certain changes
to the existing regulations to provide flexibility in the determination
of an appropriate collateral package to secure guaranteed loan
obligations, facilitate collateral sharing and related intercreditor
arrangements with other project lenders, and to provide a more workable
interpretation of certain statutory provisions regarding DOE's
treatment of collateral.

SUMMARY: We, the U.S. Fish and Wildlife Service (Service), will host a
Wind Turbine Guidelines Advisory Committee (Committee) meeting
September 1-3, 2009. The meeting is open to the public. The meeting
agenda will include reports from the Legal and Synthesis Subcommittees,
and discussion of the current draft Recommendations to the Secretary.

DATES: The meeting is scheduled for September 1-3, 2009. The sessions
will be 8 a.m. to 5:30 p.m. September 1-2, and 8 a.m. to 3:30 p.m.

Request for Information on Low-Level Radioactive Waste Disposal
and Notice of Public Meeting

AGENCY: Nuclear Regulatory Commission.

ACTION: Notice of public meeting and request for information.

SUMMARY: The U.S. Nuclear Regulatory Commission (NRC) staff is
conducting a public meeting to gather information to assess the effect
of a lack of access to low-level waste (LLW) disposal facilities on
those who use radioactive sources or materials in conducting research
such as universities and hospitals. The purpose of this information
gathering is to identify important research that has been impacted and/
or stopped because of a lack of disposal options for radioactive
sources or materials. This information will be provided to the
Commission to inform future Commission decisionmaking. The NRC is
planning to host a public meeting on this topic at its Rockville, MD
Headquarters on the morning of October 7, 2009.

DATES: The public is invited to provide information related to the
above topic until October 20, 2009. Comments submitted by mail should
be postmarked by that date to ensure consideration. Comments received
after that date will be considered to the extent practical. The NRC is
planning to host a public meeting at its Rockville, MD Headquarters to
solicit public input on the questions identified below on October 7,
2009. Because of anticipated interest, the meeting will be Web cast.

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice of data availability (NODA).

SUMMARY: EPA is administering--under the Clean Air Interstate Rule
(CAIR) Federal Implementation Plans (FIPs)--the CAIR NOX
Annual Trading Program Compliance Supplement Pool (CAIR CSP) for the
States of Delaware, Louisiana, Maryland, Pennsylvania, and Wisconsin.
The CAIR FIPs require the Administrator to determine by order the CAIR
CSP allowance allocations for units in these States that requested and
qualify for these allocations and to provide the public with the
opportunity to object to the allocation determinations. In this Notice
of Data Availability (NODA), EPA is making available, to the public,
data and other information relating to the CAIR CSP allowance
allocations and denial of allocations to individual units whose owners
and operators requested such an allocation from EPA. The allocations
and denial of allocations are based on each unit's emissions data
reported to EPA in quarterly emissions reports submitted by the unit's
owners and operators under the CAIR trading program and other programs
and on EPA's interpretations of the regulation governing the allocation
of CAIR CSP allowances. The NODA presents the
emissions data and other information, including the CAIR CSP allowance
allocation calculations for each individual unit and the resulting
allocation for each unit.
