Introduction to the Unified Agenda of Federal Regulatory and
Deregulatory Actions

AGENCY: Regulatory Information Service Center.

ACTION: Introduction to the Unified Agenda of Federal Regulatory and
Deregulatory Actions.

SUMMARY: The Regulatory Flexibility Act requires that agencies publish
semiannual regulatory agendas in the Federal Register describing
regulatory actions they are developing that may have a significant
economic impact on a substantial number of small entities (5 U.S.C.
602). Executive Order 12866 ``Regulatory Planning and Review,'' signed
September 30, 1993 (58 FR 51735) and Office of Management and Budget
memoranda implementing section 4 of that Order establish minimum
standards for agencies' agendas, including specific types of
information for each entry.

     The Unified Agenda of Federal Regulatory and Deregulatory Actions
(Unified Agenda) helps agencies fulfill these requirements. All Federal
regulatory agencies have chosen to publish their regulatory agendas as
part of the Unified Agenda.

     Editions of the Unified Agenda prior to fall 2007 were printed in
their entirety in the Federal Register. Beginning with the fall 2007
edition, the Internet is the basic means for conveying Regulatory
Agenda information to the maximum extent legally permissible. The
complete Unified Agenda for spring 2009, which contains the regulatory
agendas for 56 Federal agencies, is available to the public at http://
reginfo.gov.

     The spring 2009 Unified Agenda publication appearing in the
Federal Register consists of agency regulatory flexibility agendas, in
accordance with the publication requirements of the Regulatory
Flexibility Act. Agency regulatory flexibility agendas contain only
those Agenda entries for rules which are likely to have a significant
economic impact on a substantial number of small entities and entries
that have been selected for periodic review under section 610 of the
Regulatory Flexibility Act.

Metconazole; Pesticide Tolerances

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: This regulation establishes tolerances for the residues of
metconazole, including its metabolites and degradates, in or on corn,
field, forage; corn, field, grain; corn, field, stover; corn, pop,
grain; corn, pop, stover; corn, sweet, forage; corn, sweet, kernel plus
cob with husks removed; corn, sweet, stover; cotton, undelinted seed;
and cotton, gin byproducts. BASF Corporation requested these tolerances
under the Federal Food, Drug, and Cosmetic Act (FFDCA). This regulation
also establishes tolerances for residues of metconazole, including its
metabolites and degradates, in or on canola seed, and eggs. Valent
U.S.A. Corporation requested the tolerance for canola seed under the
FFDCA. EPA required an additional tolerance for eggs based on findings
in the studies submitted by the registrant.
In addition, this action establishes time-limited tolerances for
the residues of metconazole, including its metabolites and degradates,
in or on sugarcane, cane at 1.6 ppm and sugarcane, molasses at 3.2 ppm,
in response to the approval of crisis exemptions declared by the states
of Florida and Louisiana under section 18 of the Federal Insecticide,
Fungicide, and Rodenticide Act (FIFRA) authorizing the quarantine use
of the fungicide on sugarcane to control the fungal pathogen, Puccinia
kuehnii. This regulation establishes a maximum permissible level of
residues in this food commodity. The time-limited tolerances expire and
are revoked on December 31, 2011.

DATES: This regulation is effective May 7, 2009. Objections and
requests for hearings must be received on or before July 6, 2009, and
must be filed in accordance with the instructions provided in 40 CFR
part 178 (see also Unit I.C. of the SUPPLEMENTARY INFORMATION).

SUMMARY: EPA is announcing a public comment period for the external
review draft document titled, ``Toxicological Review of 1,4-Dioxane: In
Support of Summary Information on the Integrated Risk Information
System (IRIS).'' The public comment period and the external peer-review
workshop, which will be scheduled at a later date and announced in the
Federal Register, are separate processes that provide opportunities for
all interested parties to comment on the document. EPA intends to
forward the public comments that are submitted in accordance with this
notice to the external peer-review panel prior to the meeting for their
consideration. When finalizing the draft document, EPA intends to
consider any public comments that EPA receives in accordance with this
notice.
    EPA is releasing this draft document solely for the purpose of pre-
dissemination peer review under applicable information quality
guidelines. This document has not been formally disseminated by EPA. It
does not represent and should not be construed to represent any Agency
policy or determination.

for public discussion on potential changes to EPA's existing small
drinking water system variance determination methodology as well as to
discuss alternative compliance strategies (e.g., capacity development
and utilization of provisions of the Drinking Water State Revolving
Fund such as disadvantaged community loan subsidies) that could be
considered.

SUMMARY: This regulation establishes an exemption from the requirement
of a tolerance for residues of Morpholine 4-C6-12 Acyl
derivatives (CAS Reg. No. 887947-29-7), herein referred to in this
document as morpholine amide when used as the inert ingredient in
pesticide formulations applied in or on growing crops. Huntsman
Corporation submitted a petition to EPA under the Federal Food, Drug,
and Cosmetic Act (FFDCA), requesting an exemption from the requirement
of a tolerance. This regulation eliminates the need to establish a
maximum permissible level for residues of morpholine amide.

SUMMARY: This regulation establishes a time-limited tolerance for
residues of novaluron in or on strawberry. This action is in response
to EPA's granting of an emergency exemption under section 18 of the
Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) authorizing
use of the pesticide on strawberries. This regulation establishes a
maximum permissible level for residues of novaluron in this food
commodity. The time-limited tolerance expires and is revoked on
December 31, 2011.

National Emission Standards for Hazardous Air Pollutants From the

SUMMARY: EPA is proposing amendments to the current National Emission
Standards for Hazardous Air Pollutants (NESHAP) from the Portland
Cement Manufacturing Industry. These proposed amendments would add or
revise, as applicable, emission limits for mercury, total hydrocarbons
(THC), and particulate matter (PM) from kilns and in-line kiln/raw
mills located at a major or an area source, and hydrochloric acid (HCl)
from kilns and in-line kiln/raw mills located at major sources. These
proposed amendments also would remove the following four provisions in
the current regulation: the operating limit for the average hourly
recycle rate for cement kiln dust; the requirement that cement kilns
only use certain type of utility boiler fly ash; the opacity limits for
kilns and clinker coolers; and the 50 parts per million volume dry
(ppmvd) THC emission limit for new greenfield sources. EPA is also
proposing standards which would apply during startup, shutdown, and
operating modes for all of the current section 112 standards applicable
to cement kilns.
    Finally, EPA is proposing performance specifications for use of
mercury continuous emission monitors (CEMS), which specifications would
be generally applicable and so could apply to sources from categories
other than, and in addition to, portland cement, and updating
recordkeeping and testing requirements.

EPA will hold a public hearing on May 26, 2009. Under the Paperwork

registrants and other stakeholders.

Fiscal Year (FY) 2009; Brownfields Economic Development Initiative
(BEDI)

SUMMARY: HUD announces the availability on its Web site of the
application information, submission deadlines, funding criteria, and
other requirements for the FY2009 Brownfields Economic Development
Initiative (BEDI) NOFA. The BEDI NOFA makes approximately $20 million
in assistance available, combining assistance appropriated by the
Department of Housing and Urban Development Appropriations Act, 2009
(Pub. L. 111-8, approved March 11, 2009) and the Department of Housing
and Urban Development Appropriations Act, 2008 (Pub. L. 110-116,
approved December 26, 2007). All BEDI grants must be used in
conjunction with a new Section 108-guaranteed loan commitment.
Applicants for BEDI assistance must address the requirements
established by HUD's Fiscal Year 2009 Notice of Funding Availability
(NOFA) Policy Requirements and General Section to the NOFA published on
December 29, 2008 (73 FR 79548), as amended on April 16, 2009 (74 FR
17685). Applicants should take particular note that they should follow
the application submission instructions contained in this NOFA and not
use those in the General Section. The notice providing information
regarding the application process, funding criteria and eligibility
requirements is available on the HUD Web site at http://www.HUD.gov/
BEDI.

Interim Staff Guidance on Assessing the Consequences of an
Accidental Release of Radioactive Materials From Liquid Waste Tanks

AGENCY: Nuclear Regulatory Commission (NRC).

ACTION: Solicitation of public comment.

SUMMARY: The NRC is soliciting public comment on its Proposed Interim
Staff Guidance (ISG) DC/COL-ISG-013 (Agencywide Documents Access and
Management System (ADAMS) Accession No. ML090830488). The purpose of
this ISG is to modify and provide Combined License (COL) and Design
Certification (DC) applicants additional clarity and guidance for the
application of Standard Review Plan (SRP) Sections 11.2 and 2.4.13 on
the characterization of hydro geological properties of a site
associated with the effects of accidental releases of radioactive
liquid on existing or likely future uses of ground and surface water
resources in meeting the requirements of Title 10 of the Code of
Federal Regulations, Part 100 (10 CFR 100.10 or 100.20) and Appendix B
to 10 CFR Part 20 on effluent concentration limits. This ISG would
revise the staff guidance previously issued in March 2007 in the SRP
NUREG-0080, ``Standard Review Plan for the Review of Safety Analysis
Reports for Nuclear Power Plants,'' Sections 11.2 and 2.4.13. These two
SRP sections are not internally consistent in identifying acceptable
criteria for assessing the consequences of accidental releases of
radioactive materials, or in providing guidance to the staff and
applicants to establish conditions for such releases and define
acceptable assumptions to describe exposure scenarios and pathways to
members of the public. The NRC staff issues DC/COL-ISGs to facilitate
timely implementation of current staff guidance and to facilitate
activities associated with review of applications for DCs and COLs by
the Office of New Reactors. The NRC staff will also incorporate the
approved DC/COL-ISG-013 into the next revision of the SRP and related
guidance documents.

DATES: Comments must be filed no later than 60 days from the date of
publication of this notice in the Federal Register. Comments received
after this date will be considered, if it is practical to do so, but
the Commission is able to ensure consideration only for comments
received on or before this date.

SUMMARY: The Department of Energy (DOE) published on May 16, 2008, a
proposed rule concerning its financial assistance regulation. That
proposed rule included a recodification of 10 CFR part 600. However,
DOE inadvertently omitted one phrase from the existing part 600. This
action will afford interested members of the public the opportunity to
comment on the continued inclusion of this phrase in DOE's financial
assistance regulations.
