RIN 0579-AC53

Agricultural Bioterrorism Protection Act of 2002; Biennial Review
and Republication of the Select Agent and Toxin List; Delay of
Compliance Date for Newly Registered Entities

AGENCY: Animal and Plant Health Inspection Service, USDA.

ACTION: Final rule; delay of compliance date.

-----------------------------------------------------------------------

SUMMARY: In a final rule published in the Federal Register on October
16, 2008 (73 FR 61325-61332, Docket No. APHIS-2007-0033), and effective
November 17, 2008, we amended and republished the list of select agents
and toxins that have the potential to pose a severe threat to animal or
plant health, or to animal or plant products, thus implementing the
findings of the second biennial review of that list. Among other
changes, we changed the entry for ``Newcastle disease virus
(velogenic)'' to read ``virulent Newcastle disease virus,'' thus
including some non-velogenic strains of Newcastle disease virus as
select agents. The final rule set the compliance date for entities that
were newly required to register as entities possessing select agents or
toxins as April 14, 2009. Since the publication of the final rule, we
have been notified of entities that use virulent Newcastle disease
virus and that have not previously been registered. This notice informs
the public that we are extending the compliance date for new
registrants to July 13, 2009, to give us additional time to determine
how best to regulate those entities.

DATES: The compliance date for entities that are newly required to
register is extended to July 13, 2009.

-----------------------------------------------------------------------

SUMMARY: The Energy Policy and Conservation Act (EPCA) prescribes
energy conservation standards for various consumer products and
commercial and industrial equipment, including general service
fluorescent lamps (GSFL) and incandescent reflector lamps (IRL), and
the statute also requires the Department of Energy (DOE) to

GSFL and IRL would be technologically feasible and economically
justified, and would save a significant amount of energy. In addition,
EPCA directs DOE to consider adoption of standards for additional GSFL
not already covered by EPCA-prescribed standards. In this notice, DOE
proposes amended energy conservation standards for certain GSFL and IRL
and new energy conservation standards for certain additional GSFL not
currently covered by standards.

DEPARTMENT OF THE INTERIOR

National Park Service

Notice of Availability for the Record of Decision on the Final
General Management Plan/Wilderness Study/Environmental Impact
Statement, Sleeping Bear Dunes National Lakeshore, MI

AGENCY: National Park Service, Department of the Interior.

ACTION: Notice of Availability for the Record of Decision on the Final
General Management Plan/Wilderness Study/Environmental Impact
Statement, Sleeping Bear Dunes National Lakeshore, Michigan.

-----------------------------------------------------------------------

SUMMARY: Pursuant to Section 102(2)(C) of the National Environmental
Policy Act of 1969 (42 U.S.C. 4332(C)), the National Park Service (NPS)
announces the availability of the Record of Decision (ROD) for the
Final General Management Plan (GMP)/Wilderness Study (WS)/Environmental
Impact Statement (EIS), Sleeping Bear Dunes
National Lakeshore (Lakeshore), Michigan. On January 6, 2009, the
Midwest Regional Director approved the ROD for the project. As soon as
practicable, the NPS will begin to implement the preferred alternative
contained in the final EIS.
The preferred alternative will provide for the preservation of
natural resources, while offering opportunities for visitor enjoyment
of natural, cultural, and recreational resources in a scenic outdoor
setting. This alternative includes approximately 32,100 acres (45
percent of the Lakeshore) proposed for wilderness. No developed county
roads are included in proposed wilderness areas. Visitor services and
facilities remain much as they are now, with improvements at key
locations on the mainland and on South Manitou Island. Acquisition of
lands within the Benzie Corridor will continue.
The ROD includes a statement of the decision made, synopses of
other alternatives considered, the basis for the decision, a
description of the environmentally preferable alternative, a finding on
impairment of park resources and values, a listing of measures to
minimize environmental harm, and an overview of public involvement in
the decision-making process.

Bacillus subtilis MBI 600; Exemption from the Requirement of a
Tolerance

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

-----------------------------------------------------------------------

SUMMARY: This regulation establishes an exemption from the requirement
of a tolerance for residues of the biofungicide, Bacillus subtilis MBI
600, in or on all food commodities, including residues resulting from
post-harvest uses, when applied/used in accordance with good
agricultural practices. Becker Underwood, Inc. submitted a petition to

all food commodities.

DATES: This regulation is effective April 8, 2009. Objections and
requests for hearings must be received on or before June 8, 2009, and
must be filed in accordance with the instructions provided in 40 CFR
part 178 (see also Unit I.C. of the SUPPLEMENTARY INFORMATION).

DEPARTMENT OF ENERGY

[Docket Number: EERE-2006-STD-0127]
RIN 1904-AB49

Energy Conservation Program: Energy Conservation Standards for
Certain Consumer Products (Dishwashers, Dehumidifiers, Microwave Ovens,
and Electric and Gas Kitchen Ranges and Ovens) and for Certain
Commercial and Industrial Equipment (Commercial Clothes Washers)

AGENCY: Office of Energy Efficiency and Renewable Energy, Department of
Energy.

ACTION: Final rule.

-----------------------------------------------------------------------

SUMMARY: The Department of Energy (DOE) is announcing that it is
amending energy conservation standards pertaining to the cooking
efficiency of residential gas kitchen ranges and ovens, because it has
determined that such standards would be technologically feasible and
economically justified and would result in significant conservation of
energy, the three primary statutory criteria for adoption of standards
under the Energy Policy and Conservation Act (EPCA). DOE is not
adopting energy conservation standards pertaining to the cooking
efficiency of residential electric kitchen ranges and ovens and
microwave ovens, because it has determined that such standards would
not be technologically feasible and economically justified. At this
point, DOE has decided to defer its decision regarding adoption of
amended energy conservation standards for the energy efficiency of
commercial clothes washers and standby mode and off mode power
consumption by microwave ovens, pending further rulemaking. Finally,
DOE is not adopting amended standards for dishwashers and dehumidifiers
in this rulemaking, because recent amendments to EPCA have already set
standards for those products.

DATES: The effective date of this rule is June 8, 2009. Compliance with
the standards set by today's final rule is required on April 9, 2012.

ADDRESSES: For access to the docket to read background documents, the
technical support document, transcripts of the public meetings in this

ANNOUNCEMENT 5

Subject: HAZ/Nuclear, ENERGY/Nuclear - ND. NRC. Indiana Michigan Power Company; Donald C. Cook Nuclear Plant, Units 1 and 2; Exemption

[Federal Register: April 7, 2009 (Volume 74, Number 65)]
[Notices]
[Page 15778-15779]

NUCLEAR REGULATORY COMMISSION

[Docket Nos. 50-315 and 50-316; NRC-2009-0153]

Indiana Michigan Power Company; Donald C. Cook Nuclear Plant,
Units 1 and 2; Exemption

1.0 Background

The Indiana Michigan Power Company (the licensee) is the holder of
Facility Operating License Nos. DPR-58 and DPR-74, which authorizes
operation of the Donald C. Cook Nuclear Plant, Units 1 and 2. The
licenses provide, among other things, that the facility is subject to
all rules, regulations, and orders of the U.S. Nuclear Regulatory
Commission (NRC, the Commission) now or hereafter in effect.
The facility consists of two pressurized-water reactors located in
Berrien County in Michigan.

2.0 Request/Action

Title 10 of the Code of Federal Regulations, Part 50, Section
36a(a)(2) (10 CFR 50.36a(a)(2)) requires each licensee to submit a
report to the Commission annually that specifies the quantity of each
of the principal radionuclides released to unrestricted areas in liquid
and in gaseous effluents during the previous 12 months, including any
other information as may be required by the Commission to estimate
maximum potential annual radiation doses to the public resulting from
effluent releases. The report must be submitted as specified in Section
50.4, and the time between report submittals must be no longer than 12
months.
The licensee has proposed an amendment to Technical Specification
5.6.3 to change the submittal date for the report from ``within 90 days
of January 1 of each year'' to ``prior to May 1 of each year.''
Therefore, the licensee has requested a one-time exemption from the 12-
month reporting criteria specified in 10 CFR 50.36a(a)(2) for its
submittal of the 2008 Radioactive Effluent Release Report.
In summary, the exemption does not affect the information required
to be submitted or the time period the report covers, only the date the
report is submitted.
