Pesticide Program Dialogue Committee; Notice of Public Meetings

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: Pursuant to the Federal Advisory Committee Act, EPA gives
notice of a public meeting of the Pesticide Program Dialogue Committee
(PPDC) on April 22-23, 2009. A draft agenda is under development that
will include reports from and discussions about current issues from the
following PPDC work groups: Work Group on 21st Century Toxicology/New
Integrated Testing Strategies; Work Group on Web-Distributed Labeling;
and Work Group on Comparative Safety Statements for Pesticide Product
Labeling. The agenda will also include a discussion about current water
quality issues (including an update on spray drift); a discussion about
an overall strategy regarding incident data, including pyrethroid
incidents and pet incidents; and updates on the Endocrine Disruptors
Screening Program, Pollinator Protection, and the Endangered Species
Act consultation process. Several PPDC work group meetings have also
been scheduled in March and April 2009, and are open to the public.

SUMMARY: Congress has appropriated limited funds to the U.S. Army Corps
of Engineers (Corps) for implementation of the Estuary Habitat
Restoration Program as authorized in Section 104 of the Estuary
Restoration Act of 2000, Title I of the Estuaries and Clean Waters Act
of 2000 (Pub. L. 106-457) (accessible at http://www.usace.army.mil/
CECW/ERA/pages/Default.aspx
). On behalf of the Estuary Habitat
Restoration Council (Council), the Corps is soliciting proposals for
estuary habitat restoration projects. This document describes project
criteria and evaluation criteria the Council will use to determine
which projects to recommend. Recommended projects must provide
ecosystem benefits, have scientific merit, be technically feasible, and
be cost-effective. Proposals selected for Estuary Habitat Restoration
Program funding may be implemented in accordance with a cost-share
agreement with the Corps, a cooperative agreement with the Corps, or a
cooperative agreement with one of the other agencies represented on the
Council, subject to availability of funds.

Federal Procurement of Energy Efficient Products

SUMMARY: The U.S. Department of Energy (DOE) today publishes a final
rule to promote Federal procurement of energy-efficient products. The
final rule establishes guidelines for Federal agencies regarding the
implementation of amendments to the National Energy Conservation Policy
Act (NECPA) that require Federal agencies to procure ENERGY STAR
qualified and Federal Energy Management Program (FEMP) designated
products in procurements involving energy consuming products and
systems. Today's final rule includes changes in response to comments
received on the notice of proposed rulemaking published June 19, 2007.
Most notably, today's final rule does not establish a reporting
requirement, as initially proposed, for federal agencies under
procurement requirement of NECPA.

Implementation of a Dose Standard After 10,000 Years

AGENCY: Nuclear Regulatory Commission.

SUMMARY: The U.S. Nuclear Regulatory Commission (NRC) is amending its
regulations governing the disposal of high-level radioactive wastes in
a proposed geologic repository at Yucca Mountain, Nevada. The final
rule implements the U.S. Environmental Protection Agency's (EPA's)
revised standards for doses that could occur after 10,000 years, but
within the period of geologic stability. The final rule also specifies
a range of values for the deep percolation rate to be used to represent
climate change after 10,000 years, as called for by EPA, and specifies
that calculations of radiation doses for workers use the same weighting
factors that EPA is using for calculating individual doses to members
of the public.

DATES: Effective Date: This final rule is effective on April 13, 2009.

Hazardous Waste Management System; Identification and Listing of
Hazardous Waste; Final Exclusion

AGENCY: Environmental Protection Agency.

SUMMARY: Environmental Protection Agency (EPA) is granting a petition
submitted by Bayer Material Science in Baytown, Texas to exclude (or
delist) the toluene diisocyanate (TDI) residues generated from its
facility located in Baytown, Texas from the lists of hazardous wastes.
This final rule responds to the petition submitted by Bayer Material
Science to delist K027 TDI residues generated from the facility's
distillation units.
    After careful analysis and use of the Delisting Risk Assessment
Software (DRAS), EPA has concluded the petitioned waste is not
hazardous waste. This exclusion applies to 9,780 cubic yards per year
of the K027 residues. Accordingly, this final rule excludes the
petitioned waste from the requirements of hazardous waste regulations
under the Resource Conservation and Recovery Act (RCRA) when it is
disposed in a Subtitle D Landfill.

SUMMARY: The U.S. Environmental Protection Agency (EPA) is announcing
the availability of a document titled, ``First External Review Draft
Integrated Science Assessment for Carbon Monoxide'' (EPA/600/R-09/019).
This draft document was prepared by the National Center for
Environmental Assessment (NCEA) within EPA's Office of Research and
Development as part of the review of the national ambient air quality
standards (NAAQS) for carbon monoxide.
    EPA is releasing this draft document to seek review by the Clean
Air Scientific Advisory Committee (CASAC) and the public. The draft
document does not represent and should not be construed to represent
any final EPA policy, viewpoint, or determination. EPA will consider
any timely public comments submitted in response to this notice when
revising the document.

SUMMARY: The U.S. Environmental Protection Agency (EPA or Agency),
National Center for Environmental Innovation (NCEI) is giving notice of
the availability of its solicitation for proposals from institutions
that are interested in organizing two symposia over four years to
promote sharing and transfer of innovative environmental protection
approaches among States, EPA, and other primarily governmental
representatives. The solicitation is available at the Agency's State

SUMMARY: Section 136 of the Energy Independence and Security Act of
2007, as amended, provides for grants and loans to eligible automobile
manufacturers and component suppliers for projects that reequip,
expand, and establish manufacturing facilities in the United States to
produce light-duty vehicles and components for such vehicles, which
provide meaningful improvements in fuel economy performance beyond
certain specified levels. Section 136 also provides that grants and
loans may cover engineering integration costs associated with such
projects. The program established by section 136 is referred to as the
Advanced Technology Vehicles Manufacturing Incentive Program.
    This notice announces that DOE has determined to change the
previously announced process for submission of applications for a loan
under section 136. Henceforth, DOE will consider and evaluate
substantially complete applications as and when they are submitted and
may make decisions on such applications and close loans with respect to
such applications at any time.

Wildlife Habitat Incentive Program Correction

SUMMARY: The Natural Resources Conservation Service published in the
Federal Register of January 16, 2009, an interim final rule with
request for comment amending the program regulations for the Wildlife
Habitat Incentive Program (WHIP) to incorporate programmatic changes
authorized by the Food, Conservation, and Energy Act of 2008 (2008
Act). The language in the interim final rule regarding the application
of the payment limitation to joint operations was incorrect and is
inconsistent with payment attributions specified in the regulation
which governs payment limitations and eligibility determinations for
CCC-funded programs. This document corrects that language. NRCS is also
using the opportunity presented by this rulemaking to extend the
comment period by an additional 30 days and ask for public input on key
programmatic implementation questions.

DATES: This correction is effective on March 12, 2009. The comment
period for the WHIP Interim Final Rule published on January 16, 2009,
is hereby extended and comments must be received on or before April 17,
2009. Additionally, NRCS has extended the public comment period for the
Environmental Analysis (EA) and Finding of No Significant Impact
(FONSI) until April 17, 2009. A copy of the EA and FONSI may be
obtained, and comments submitted, as provided for in the January 16,
2009, WHIP interim final rule.

SUMMARY: This regulation establishes a temporary exemption from the
requirement of a tolerance for residues of the Bacillus mycoides
isolate J in or on pecans, potatoes, sugar beets, tomatoes, and peppers
when used in accordance with good agricultural practices. Montana
Microbial Products, submitted a petition to EPA under the Federal Food,
Drug, and Cosmetic Act (FFDCA), requesting to amend the existing
temporary tolerance exemption. This regulation eliminates the need to
establish a maximum permissible level for residues of Bacillus mycoides
isolate J in or on pecans, potatoes, sugar beets, tomatoes, and peppers
on a time-limited basis. The temporary tolerance exemption expires on
March 31, 2011.

SUMMARY: EPA previously announced the final NPDES general permit for
discharges incidental to the normal operation of vessels, also referred
to as the Vessel General Permit (VGP), in the Federal Register on
December 29, 2008 (73 FR 79493). The permit was signed on December 18,
2008 and became effective on December 19, 2008. EPA subsequently
noticed final issuance of the VGP for the states of Hawaii and Alaska,
after receipt of a certification pursuant to section 401 of the Clean
Water Act (CWA) from Hawaii and a final response on the national
consistency determination required by section 307(c)(1) of the Coastal
Zone Management Act (CZMA) from Alaska, which was signed on February 2,
2009, with an effective date of February 6, 2009. Today's notice of
availability provides notice of EPA's deletion of specific State
section 401 certification conditions from Part 6 of the VGP for the
States of New Jersey, Illinois, and California.

                Memorandum for the Heads of Executive Departments and
                Agencies

                Science and the scientific process must inform and
                guide decisions of my Administration on a wide range of
                issues, including improvement of public health,
                protection of the environment, increased efficiency in
                the use of energy and other resources, mitigation of
                the threat of climate change, and protection of
                national security.

                The public must be able to trust the science and
                scientific process informing public policy decisions.
                Political officials should not suppress or alter
                scientific or technological findings and conclusions.
                If scientific and technological information is
                developed and used by the Federal Government, it should
                ordinarily be made available to the public. To the
                extent permitted by law, there should be transparency
                in the preparation, identification, and use of
                scientific and technological information in
                policymaking. The selection of scientists and
                technology professionals for positions in the executive
                branch should be based on their scientific and
                technological knowledge, credentials, experience, and
                integrity.

                By this memorandum, I assign to the Director of the
                Office of Science and Technology Policy (Director) the
                responsibility for ensuring the highest level of
                integrity in all aspects of the executive branch's
                involvement with scientific and technological
                processes. The Director shall confer, as appropriate,
                with the heads of executive departments and agencies,
                including the Office of Management and Budget and
                offices and agencies within the Executive Office of the
                President (collectively, the ``agencies''), and
                recommend a plan to achieve that goal throughout the
                executive branch.

Protection of Stratospheric Ozone: Recordkeeping and Reporting
Requirements for the Import of Halon-1301 Aircraft Fire Extinguishing

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: The Environmental Protection Agency is taking final action to
grant a specific exemption from requirements to petition the Agency in
order to import used ozone-depleting substances. The exemption would
apply to entities that import spherical pressure vessels containing
halon 1301 for aircraft fire extinguishing (``aircraft halon bottles'')
for purposes of hydrostatic testing. This final rule reduces the
administrative burden on entities that are importing aircraft halon
bottles for the purpose of maintaining these bottles to meet commercial
safety specifications and standards set forth in airworthiness
directives of the Federal Aviation Administration. This action does not
exempt entities that import bulk quantities of halon-1301 in containers
that are being imported for other purposes.

DATES: This final rule is effective on April 9, 2009.

SUMMARY: The Draft Inventory of U.S. Greenhouse Gas Emissions and
Sinks: 1990-2007 is available for public review. Annual U.S. emissions
for the period of time from 1990 through 2007 are summarized and
presented by source category and sector. The inventory contains
estimates of carbon dioxide (CO2), methane (CH4),
nitrous oxide (N2O), hydrofluorocarbons (HFC),
perfluorocarbons (PFC), and sulfur hexafluoride (SF6)
emissions. The inventory also includes estimates of carbon fluxes in
U.S. agricultural and forest lands. The technical approach used in this
report to estimate emissions and sinks for greenhouse gases is
consistent with the methodologies recommended by the Intergovernmental
Panel on Climate Change (IPCC), and reported in a format consistent
with the United Nations Framework Convention on Climate Change (UNFCCC)
reporting guidelines. The Inventory of U.S. Greenhouse Gas Emissions
and Sinks: 1990-2007 is the latest in a series of annual U.S.
submissions to the Secretariat of the UNFCCC.

SUMMARY: Section 2707 of the Food, Conservation, and Energy Act of 2008
(2008 Act) establishes the Cooperative Conservation Partnership
Initiative (CCPI) by amending Section 1243 of the Food Security Act of
1985 [16 U.S.C. 3843]. The Secretary of Agriculture has delegated the
authority for CCPI to the Chief of the Natural Resources Conservation
Service (NRCS), who is a Vice President of the Commodity Credit
Corporation (CCC). NRCS is an agency of the United States Department of
Agriculture (USDA). Congress established CCPI to assist potential
partners with focusing conservation assistance in defined project areas
to achieve high-priority natural resource objectives. In fiscal year
(FY) 2009, NRCS will make Environmental Quality Incentives Program
(EQIP) and Wildlife Habitat Incentive Program (WHIP) funds available to
owners and operators of agricultural and nonindustrial private forest
lands who will participate in CCPI projects.
    The purpose of this notice is to inform potential partners and
producers that include nonindustrial private forest landowners of the
availability of CCPI funds and other assistance and to solicit
proposals from potential partners who seek to enter into partnership
agreements with NRCS to enhance conservation outcomes on agricultural
and nonindustrial private forest land.
    Additionally, NRCS requests public comment on how CCPI can
contribute to the Nation's efforts on energy, climate change, and
carbon sequestration within the framework of the Initiative.

DATES: Proposals must be received in the NRCS State office or National
office (where the project areas are multi-State or national) within 45
days of the date of this notice. Comments must be received within 30
days of the date of this notice.
