SUMMARY: On January 30, 2009, the Natural Resources Defense Council
(``NRDC'') submitted a petition for reconsideration (the ``NRDC
Petition'') of the rule addressing ``aggregation'' under the Prevention
of Significant Deterioration and the Nonattainment New Source Review
programs (collectively, ``NSR'') published in the Federal Register on
January 15, 2009. This rule (the ``NSR Aggregation Amendments'')
described when a source must combine (``aggregate'') nominally-separate
physical changes and changes in the method of operation for the purpose
of determining whether they are a single change under NSR and result in
a significant emissions increase.
    In response to the NRDC Petition, having found that the petitioner
has raised objections to the rule that arose after the comment period
and that are of central relevance to the rule, the EPA is convening a
proceeding for reconsideration as provided for under the Clean Air Act
section 307(d)(7)(B). In the near future, EPA will publish a notice in
the Federal Register establishing a comment period and a hearing date
for this proceeding.

DATES: On February 13, 2009, the EPA hereby convenes a proceeding for
reconsideration of the NSR Aggregation Amendments published at 74 FR
2376 (January 15, 2009).

SUMMARY: In a separate document in the ``Rules'' section of this
Federal Register, the Environmental Protection Agency (EPA) announced
the convening of a proceeding for reconsideration of the final rule
that amends the Prevention of Significant Deterioration (PSD) and
Nonattainment New Source Review (NSR) regulations addressing
aggregation published in the Federal Register on January 15, 2009. By
this action, the EPA is administratively staying and delaying the
effective date of this rule for 90 days. Thus, the January 15, 2009
rule will become effective on May 18, 2009.

DATES: The effective date of FR Doc. E9-815, published in the Federal
Register on January 15, 2009 (74 FR 2376) is delayed to May 18, 2009.

agenda will include a briefing and discussion of the Information,
Planning, and Consultation System (IPaC) to inform the Committee in its
development of recommendations to the Secretary of the Interior.

Promote the Conservation of Migratory Birds

SUMMARY: This notice is to inform the public of a Memorandum of
Understanding (MOU) between the Forest Service, U.S. Department of
Agriculture, and the U.S. Fish and Wildlife Service, signed December 8,
2008, to promote the conservation of migratory birds. Pursuant to
Executive Order (E.O.) 13186 (January 17, 2001), ``Responsibilities of
Federal Agencies to Protect Migratory Birds,'' this MOU outlines a
collaborative approach to promote the conservation of migratory bird
populations. It does not authorize the ``take'' of migratory birds.
Take, as defined in 50 CFR 10.12 regarding all wildlife and plants,
means to pursue, hunt, shoot, wound, kill, trap, capture, or collect,
or attempt to pursue, hunt, shoot, wound, kill, trap, capture, or
collect. This MOU identifies specific activities where cooperation
between the Parties will contribute substantially to the conservation
of migratory birds and their habitats.

DATES: This notice is effective February 13, 2009. The MOU went into
effect December 8, 2008, and shall remain in effect for a period of five
years.

SUMMARY: This document seeks public comment on a proposal to delay for
104 days the effective date of the interim rule, for Rural Development
Guaranteed Loans, which was published on December 17, 2008. The interim
rule establishes a unified guaranteed loan platform for the enhanced
delivery of four existing Rural Development guaranteed loan programs--
Community Facility; Water and Waste Disposal; Business and Industry;
and Rural Energy for America Program, formerly known as Renewable
Energy Systems and Energy Efficiency Improvement Projects. The
Department seeks comments on whether or not it should delay the
effective date of the interim rule until June 1, 2009, in order to
provide the Agency sufficient time to implement certain administrative
aspects associated with the interim rule. For that reason, the
Department is seeking comments on the merits of extending the effective
date of the interim rule to June 1, 2009. In order to allow sufficient
time for public comment on the Agency's proposal to further extend the
effective date until June 1, 2009, this document extends the current
effective date from February 17, 2009, to March 9, 2009, pursuant to
the ``good cause'' clause under the Administrative Procedures Act (5
U.S.C. 553(b)(3)(B)).

DATES: The effective date of the interim rule, which was published on
December 17, 2008 [73 FR 76698], delayed until February 17, 2009 [74 FR
2823], is further delayed until March 9, 2009.
    Comments on extending the effective date to June 1, 2009, must be
received on or before February 20, 2009.

SUMMARY: The EPA is announcing a public hearing to be held for the
proposed rule ``Proposed Rule to Implement the 1997 8-Hour Ozone
National Ambient Air Quality Standard: Revision on Subpart 1 Area
Reclassification and Anti-Backsliding Provisions Under Former 1-Hour
Ozone Standard; Proposed Deletion of Obsolete 1-Hour Ozone Standard
Provision'' which published in the Federal Register on January 16,
2009. The hearing will be held in Washington, DC, on Monday, March 2,
2009.
    EPA is also announcing an extension of the public comment period on
our proposed rule. EPA is extending the comment period that originally
ends on February 17, 2009. The extended comment period will close on
April 1, 2009.
    In this notice of proposed rulemaking, EPA proposed to revise the
rule for implementing the 1997 8-hour ozone national ambient air
quality standard (NAAQS) for several of the limited portions of the
rule vacated by the U.S. Circuit Court of Appeals for the District of
Columbia. The proposal addresses the classification system for the
subset of initial 8-hour ozone nonattainment areas that the
implementation rule originally covered under Clean Air Act (CAA) title
I, part D, subpart 1. The proposal also addresses how 1-hour ozone
contingency measures that apply for failure to attain or make
reasonable progress toward attainment of the 1-hour standard should
apply under the anti-backsliding provisions of the implementation rule.
In addition, the proposal removes language relating to the vacated
provisions of the rule that provided exemptions from the requirements
of nonattainment new source review (NSR) and CAA section 185 penalty
fees under the 1-hour standard. The public hearing will provide
interested parties the opportunity to present data, views, or arguments
concerning these proposed changes.

DATES: Public Hearing. The public hearing will be held on March 2,
2009.
    Comments. Comments must be received on or before April 1, 2009.

SUMMARY: The Clean Air Act preempts States from adopting emission
standards for new motor vehicles and motor vehicle engines but requires
EPA to waive this preemption for California unless EPA makes certain
findings. Acting at the direction of the California legislature, the
California Air Resources Board (CARB) adopted greenhouse gas emission
regulations for passenger cars, light-duty trucks and medium-duty
passenger vehicles beginning with the 2009 model year. By letter dated
December 21, 2005, CARB submitted a request that EPA grant a waiver for
these regulations. EPA denied this request on March 6, 2008. EPA
believes that there are significant issues regarding the
Agency's denial of the waiver. The denial was a substantial departure
from EPA's longstanding interpretation of the Clean Air Act's waiver
provisions and the history of granting waivers to California for its
new motor vehicle emission program. Many different parties--including
California, States that have adopted or are interested in adopting
California's standards, members of Congress, scientists, and other
stakeholders--have expressed similar concerns about the denial of the
waiver. EPA believes there is merit to reconsidering its decision
denying California's waiver. Therefore, this Federal Register notice
initiates such reconsideration, and announces a public hearing
concerning California's request and a re-opening of the written comment
period.

DATES: A public hearing concerning this reconsideration will be held on
March 5, 2009, beginning at 9:30 a.m. Any party planning to present
oral testimony should notify EPA by March 2, 2009, expressing its
interest. Any party may submit written comments by April 6, 2009.

public comment on the recommendations it has received from the
Metropolitan and Micropolitan Statistical Area Standards Review
Committee for changes to OMB's metropolitan and micropolitan
statistical area standards. The committee's report and recommendations,
which are published in their entirety in the Appendix, follow from
study of the 2000 standards, published by OMB in the December 27, 2000
Federal Register (65 FR 82227-82238). The committee's work is a key
element in OMB's review that will culminate in publication of the 2010
statistical area standards for the next decade. (Decisions on changes
to the metropolitan and micropolitan statistical area standards will
not affect the collection, tabulation, and publication of data from the
2010 Census and other current Federal data collections for geographic
areas such as states, counties, county subdivisions, and
municipalities.)
    Request for Comments: OMB is seeking comments only on the specific
recommendations of the committee for revising the 2000 standards. In
addition, OMB would welcome comments on the wording of the recommended
2010 standards to help ensure their clarity and understandability.

SUMMARY: The Tribal Pesticide Program Council (TPPC) will hold a 2-day
meeting beginning on Thursday, March 12, 2009 and ending on Friday,
March 13, 2009. This notice announces the location and times for the
meeting and sets forth the tentative agenda topics.

DATES: The meeting will be held on March 12, 2009, from 9 a.m. to 5
p.m. and March 13, 2009 from 9 a.m. to 5 p.m. To request accommodation

Notice of Receipt of Application for a Presidential Permit To
Operate and Maintain Pipeline Facilities on the Border of the United
States

    Notice is hereby given that the Department of State has received an
application from Dome Petroleum Corp., a North Dakota corporation
(``Dome Petroleum''), with its principal address at 4101 Winfield Road,
Warrenville, Illinois 60555, and Kinder Morgan Cochin, LLC, (``Kinder
Morgan''), a Delaware limited liability company with its principal
office at 500 Dallas Street Suite 1000, Houston, TX 77002, for
Presidential permits, pursuant to Executive Order 13337 of April 30,
2004, to operate and maintain two cross-border pipelines they recently
acquired from Dome Pipeline Corporation (``Dome Pipeline'') to
transport petroleum, petroleum products, and other liquid hydrocarbons
between the United States and Canada, crossing the international
boundary line underneath the Detroit River between Detroit, Michigan
and Windsor, Canada.
    A Permit for these pipelines was originally issued to American
Brine, Inc. on October 23, 1957. The permit granted American Brine the
authority to construct, connect, operate, and maintain two pipelines
(collectively, the ``Pipelines'') to carry liquid brine between the
United States and Canada, crossing underneath the Detroit River between
Detroit, Michigan and Windsor, Canada. This permit was superseded by a
new permit issued to American Brine on March 13, 1969. Following the
sale of these pipelines to Dome Pipeline in 1972, this superseding
permit was amended to reflect Dome Pipeline as the new owner, and to
permit the pipelines to transport petroleum, petroleum products and
other liquid hydrocarbons.
    On March 15, 2007 Dome Petroleum sold Dome Pipeline, its former
subsidiary, to Kinder Morgan Energy Partners LP, a master limited
partnership with its principal office in Houston, Texas. Following the
sale, Dome Pipeline was merged into Kinder Morgan Cochin (``Kinder
Morgan''), a Delaware limited liability company and subsidiary of
Kinder Morgan Energy Partners with its principal office in Houston,
Texas.
    Under the terms of the all-stock sale, ownership of the Pipelines
was to be transferred to Dome Petroleum and Kinder Morgan. Dome
Petroleum shall be the sole owner of the pipeline common referred to as
the Eastern Delivery System South Pipeline System
(``EDS Pipeline''), located to the east-southeast of the other
pipeline. Kinder Morgan shall be the sole owner of the pipeline
commonly referred to as the Cochin Pipeline, located to the west-
northwest of the EDS Pipeline. Each party shall be solely responsible
for the maintenance of their pipeline and any liability associated with
that pipeline. All easements, licenses, leases and permits associated
with the Pipelines, except for any Presidential permits issued by the
Department, and all real property formerly owned in fee by Dome
Pipeline, shall be owned jointly by Dome Petroleum and Kinder Morgan as
tenants in common. If approved by the Department, separate individual
Presidential permits will be issued to Dome Petroleum and Kinder Morgan
for their respective pipelines.
    According to the application, Dome Petroleum and Kinder Morgan
have, in written correspondence to the Department of State, committed
to abide by the relevant terms and conditions of the permit previously
issued by the Department to Dome Pipeline. Further, Dome Petroleum and
Kinder Morgan have indicated in that correspondence that there have
been no substantial changes in the operations of the EDS and Cochin
pipelines from those originally authorized by the Department and
further stated that the future operation of the pipelines will remain
essentially unchanged from that previously permitted. Therefore, in
accordance with 22 CFR 161.7(b)(3) and the Department's Procedures for
Issuance of a Presidential Permit Where There Has Been a Transfer of
the Underlying Facility, Bridge or Border Crossing for Land
Transportation (70 FR 30990, May 31, 2005), the Department of State
does not intend to conduct an environmental review of the application
unless information is brought to its attention that the transfer
potentially would have a significant impact on the quality of the human
environment.
    As required by E.O. 13337, the Department of State is circulating
this application to concerned federal agencies for comment.

relative to this proposal on or before March 12, 2009 to J. Brian

SUMMARY: International Transmission Company, d/b/a ITCTransmission
(ITC) has applied for an amendment of a Presidential permit to
construct, operate, maintain and connect electric transmission
facilities across the U.S. international border.

SUPPLEMENTARY INFORMATION: The construction, operation, maintenance,
and connection of facilities at the international border of the United
States for the transmission of electric energy between the United
States and a foreign country is prohibited in the absence of a
Presidential permit issued pursuant to Executive Order (EO) 10485, as
amended by EO 12038.
    On September 26, 2000, DOE issued a Presidential permit to
International Transmission Company (ITC) in Order No. PP-230,
authorizing it to construct, operate, maintain, and connect electric
transmission facilities at the international border of the United
States and Canada. Those facilities are currently authorized by
Presidential Permit No. PP-230-3 and include:
    (1) One 230,000-volt (230-kV) transmission line, including one 675-
MVA phase-shifting transformer connecting the Bunce Creek Station,
located in Marysville, Michigan, with Hydro One's Scott Transformer
Station, located in Sarnia, Ontario (identified as the B3N facility);
    (2) One 230-kV transmission line connecting the Waterman Station,
located in Detroit, Michigan, with Hydro One's J. Clark Keith
Generating Station, located in Windsor, Ontario (identified as the J5D
facility);
    (3) One 345-kV transmission line connecting the St. Clair
Generating Station, located in East China Township, Michigan, with
Hydro One's Lambton Generating Station, located in Moore Township,
Ontario (identified as the L4D facility); and
    (4) One 230-kV transmission line connecting the St. Clair
Generating Station with Hydro One's Lambton Generating Station
(identified as the L51D facility).
    In March 2003, the phase shifting transformer installed on the B3N
facilities failed. On January 5, 2009, ITC applied to DOE to amend
Presidential Permit PP-230-3 by authorizing it to replace the failed
675-MVA transformer with two 700-MVA phase shifting transformers
connected in series.
    Procedural Matters: Any person desiring to become a party to this
proceeding or to be heard by filing comments or protests to this
application should file a petition to intervene, comment or protest at
the address provided above in accordance with Sec. Sec.  385.211 or
385.214 of the Federal Energy Regulatory Commission's (FERC) Rules of
Practice and Procedures (18 CFR 385.211, 385.214). Fifteen copies of
each petition and protest should be filed with DOE on or before the
date listed above.
    Additional copies of such petitions to intervene or protest also
should be filed directly with Mr. James Frankowski, ITC Holdings Corp,

    Before a Presidential permit may be granted or amended, DOE must
determine that the proposed action will
not adversely impact on the reliability of the U.S. electric power
supply system. In addition, DOE must consider the environmental impacts
of the proposed action (i.e., granting the Presidential permit, with
any conditions and limitations, or denying the permit) pursuant to the
National Environmental Policy Act of 1969. DOE also must obtain the
concurrences of the Secretary of State and the Secretary of Defense
before taking final action on a Presidential permit application.
