SUMMARY: Section 5 of the Toxic Substances Control Act (TSCA) requires
any person who intends to manufacture (defined by statute to include
import) a new chemical (i.e., a chemical not on the TSCA Inventory) to
notify EPA and comply with the statutory provisions pertaining to the
manufacture of new chemicals. Under sections 5(d)(2) and 5(d)(3) of
TSCA, EPA is required to publish a notice of receipt of a
premanufacture notice (PMN) or an application for a test marketing
exemption (TME), and to publish periodic status reports on the
chemicals under review and the receipt of notices of commencement to
manufacture those chemicals. This status report, which covers the
period from June 21, 2010 to June 30, 2010, consists of the PMNs and
TME, both pending or expired, and the notices of commencement to
manufacture a new chemical that the Agency has received under TSCA
section 5 during this time period.

SUMMARY: The Environmental Protection Agency's (EPA) Office of Water
intends to transfer information collected from the construction and
development industry and claimed as confidential business information
(CBI) to The Cadmus Group (Cadmus) and its subcontractor. In addition,
EPA plans to transfer CBI collected from the steam electric industry to
a new subcontractor of a contractor, Eastern Research Group (ERG). EPA
previously announced a CBI transfer to ERG (70 FR 9070, February 24,
2005). The information being transferred will be collected under the
authority of section 308 of the CWA. Transfer of the information will
allow the contractors and subcontractors to access information
necessary to support EPA in the planning, development, and review of
effluent limitations guidelines and standards under the Clean Water Act
(CWA). Interested persons may submit comments on this intended transfer
of information to the address noted below.

Draft Toxicological Review of Hexavalent Chromium: In Support of
Summary Information on the Integrated Risk Information System (IRIS)

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice of Public Comment Period and Listening Session.

SUMMARY: EPA is announcing a 60-day public comment period and a public
listening session for the external review draft human health assessment
titled, ``Toxicological Review of Hexavalent Chromium: In Support of
Summary Information on the Integrated Risk Information System (IRIS)''
EPA/635/R-10/004C. The draft assessment was prepared by the National
Center for Environmental Assessment (NCEA) within the EPA Office of
Research and Development (ORD). EPA is releasing this draft assessment
solely for the purpose of pre-dissemination peer review under
applicable information quality guidelines. This draft assessment has
not been formally disseminated by EPA. It does not represent and should
not be construed to represent any Agency policy or determination. After
public review and comment, an EPA contractor will convene an expert
panel for independent external peer review of this draft assessment.
The public comment period and external peer review meeting are separate
processes that provide opportunities for all interested parties to
comment on the assessment. The external peer review meeting will be
scheduled at a later date and announced in the Federal Register. Public
comments submitted during the public comment period will be provided to
the external peer reviewers before the panel meeting and considered by
EPA in the disposition of public comments. Public comments received
after the public comment period closes will not be submitted to the
external peer reviewers and will only be considered by EPA if time
permits.
    The listening session will be held on November 18, 2010, during the
public comment period for this draft assessment. The purpose of the
listening session is to allow all interested parties to present
scientific and technical comments on draft IRIS health assessments to
EPA and other interested parties attending the listening session. EPA
welcomes the comments that will be provided to the Agency by the
listening session participants. The comments will be considered by the
Agency as it revises the draft assessment after the independent
external peer review. If listening session participants want EPA to
share their comments with the external peer reviewers, they should also
submit written comments during the public comment period using the
detailed and established procedures described in the SUPPLEMENTARY
INFORMATION section of this notice.

DATES: The public comment period begins September 30, 2010, and ends
November 29, 2010. Comments should be in writing and must be received
by EPA by November 29, 2010.
    The listening session on the draft assessment for hexavalent
chromium will be held on November 18, 2010, beginning at 9 a.m. and
ending at 4 p.m., Eastern Standard Time. To attend the listening
session, interested parties should register no later than November 11,
2010. To present at the listening session, indicate in your
registration that you want to make oral comments at the session and
provide the length of your presentation. The following are instructions

AGENCY: Pipeline and Hazardous Materials Safety Administration (PHMSA),

SUMMARY: On February 2, 2010, the Pipeline and Hazardous Materials
Safety Administration published a final rule amending the Hazardous
Materials Regulations to: Revise several packaging related definitions;
add provisions to allow more flexibility when preparing and
transmitting closure instructions, including conditions under which
closure instructions may be transmitted electronically; add a
requirement for shippers to retain packaging closure instructions;
incorporate new language that allows for a practicable means of
stenciling the United Nations (UN) symbol on packagings; and clarify a
requirement to document the methodology used when determining whether a
change in packaging configuration requires retesting as a new design or
may be considered a variation of a previously tested design. The
February 2 final rule also incorporated requirements for the
construction, maintenance, and use of Large Packagings. This final rule
responds to one petition for reconsideration and four appeals submitted
in response to the February 2 final rule and also corrects several
errors that occurred in that rulemaking.

DATES: Effective Date: October 1, 2010.
    Voluntary Compliance Date: Compliance with the requirements adopted
herein is authorized as of September 30, 2010. However, persons
voluntarily complying with these regulations should be aware that
appeals may be received and as a result of PHMSA's evaluation of these
appeals, the amendments adopted in this final rule correction may be
revised accordingly.

SUMMARY: EPA is revoking certain tolerances for the fungicides dicloran
and thiophanate-methyl; the herbicides EPTC, hexazinone, picloram, and
propazine; the defoliant and herbicide cacodylic acid; the plant growth
regulator and herbicide diquat, the insecticides disulfoton,
methamidophos, methomyl, phosmet, piperonyl butoxide, pyrethrins, and
thiodicarb; the fumigant antimicrobial and insecticide methyl bromide,
and the nematicides/insecticides ethoprop and fenamiphos, and the
tolerance exemptions for the insecticide/miticide pyrethrum and
insecticide synergist N-octyl bicycloheptene dicarboximide. However,
EPA will not revoke specific malathion tolerances at this time. In
addition, EPA is removing certain expired tolerances for disulfoton,
fenamiphos, and thiophanate-methyl. Also, EPA is modifying certain
tolerances for the fungicide thiophanate-methyl, herbicides dicamba,
EPTC, hexazinone and picloram, and insecticide synergist N-octyl
bicycloheptene dicarboximide. In addition, EPA is establishing new
tolerances for the fungicide thiophanate-methyl and the herbicides
EPTC, hexazinone, and picloram. Also, EPA is reinstating specific
tolerances for methamidophos residues as a result of the application of
the insecticide acephate. The regulatory actions finalized in this
document are in follow-up to the Agency's reregistration program under
the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), and
tolerance reassessment program under the Federal Food, Drug, and
Cosmetic Act (FFDCA), section 408(q).

DATES: This regulation is effective September 29, 2010. Objections and

SUMMARY: There will be a 1-day consultation meeting of the Federal
Insecticide, Fungicide, and Rodenticide Act Scientific Advisory Panel
(FIFRA SAP) to consider and review scientific issues associated with
pesticide exposure models and climate change. The purpose of the
meeting is for the Agency to seek advice on models for predicting human
and ecological exposures to pesticides that might be appropriate to
account for the effects of climate change.

SUMMARY: EPA announces the withdrawal of the pesticide science policy
document ``Use of the Pesticide Data Program (PDP) in Acute Risk
Assessment.'' In estimating dietary exposure to pesticides, the Agency
uses a variety of data and different models. This science policy
document was developed to explain a particular statistical methodology,
known as decomposition, for using information from the U.S. Department
of Agriculture's (USDA) Pesticide Data Program (PDP) in risk
assessments of acute exposure to pesticide residues in food. EPA is
withdrawing this policy because EPA has been using a less resource-
intensive and generally comparable method of analyzing data on
pesticide residues. This action is in response to the recommendations
made by EPA's Office of Inspector General during its review of EPA's
implementation of the Food Quality and Protection Act (FQPA). In its
report ``Opportunities to Improve Data Quality and Children's Health
through the FQPA'' issued January 10, 2006, the Office of Inspector
General recommended that EPA should update the status of its Science
Policy issue papers. This Federal Register notice updates the public on
the status of one of those papers. EPA is withdrawing this policy
because EPA has been using a less resource-intensive and generally
comparable method of analyzing data on pesticide residues.

examining issues related to the global free flow of information on the
Internet. Specifically, the Department seeks public comment from all

Internet. The Task Force seeks to understand why these restrictions
have been instituted; what, if any, impact they have had on innovation,
economic development, global trade and investment; and how best to
address negative impacts. After analyzing the comments responding to
this Notice, the Department intends to publish a report which will
contribute to the Administration's domestic policy and international
engagement on these issues.

Hazardous Materials Regulations to update and clarify certain

of bins as a method of consolidating packages for ease of handling when
transported by motor vehicle and to clarify that the definition of
``person,'' as that term is used in the regulations, also includes

also proposes to provide an exception from regulation for permeation
devices containing small amounts of hazardous materials.

Supplemental Determination for Renewable Fuels Produced Under the
Final RFS2 Program From Canola Oil

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: On March 26, 2010, the Environmental Protection Agency
published final changes to the Renewable Fuel Standard (RFS) program as
required by the Energy Independence and Security Act (EISA) of 2007. In
the preamble to the final rule, EPA indicated that it had not completed
the lifecycle greenhouse gas (GHG) emissions impact analysis for
several specific biofuel production pathways but that this work would
be completed through a supplemental final rulemaking process. This
supplemental final rule describes a final GHG analysis for canola oil
biodiesel. It also finalizes our regulatory determination that canola
oil biodiesel meets the biomass-based diesel and advanced biofuel GHG
reduction thresholds of 50% as compared to the baseline petroleum fuel
it will replace, petroleum diesel. This final rules will allow
producers or importers of canola oil biodiesel fuel to generate
biomass-based diesel Renewable Identification Numbers (RINs), providing
that the fuel meets other definitional criteria for renewable fuel
(e.g., produced from renewable biomass as defined in the RFS2
regulations, and used to reduce or replace petroleum-based
transportation fuel, heating oil or jet fuel). In addition, this rule
includes a new regulatory provision establishing a temporary and
limited means for producers or importers of canola oil biodiesel to
generate RINs for qualifying biofuel produced or imported between July
1, 2010, and the effective date of this rule.

DATES: This final rule is effective on September 28, 2010.

Public Hearing Locations for the Proposed Fuel Economy Labels

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: EPA and NHTSA are announcing the location addresses for the
public hearings to be held for ``Revisions and Additions to Motor
Vehicle Fuel Economy Label,'' published in the Federal Register on
September 23, 2010. The goal of a revised label will be to provide
consumers with simple, straightforward comparisons across all vehicles
types, including electric vehicles (EV), plug-in hybrid electric
vehicles (PHEV), and conventional gasoline and diesel vehicles. NHTSA
and EPA are proposing these changes in compliance with the Energy
Independence and Security Act (EISA) of 2007, which imposes several new
labeling requirements. Also, the agencies believe that the current
labels can be improved to help consumers make more informed vehicle
purchase decisions and to address the entrance of advanced technology
vehicles into the U.S. market. The new labels are proposed to be
displayed on new vehicles beginning with the 2012 model year.

DATES: NHTSA and EPA will jointly hold two public hearings on the
following dates: Thursday, October 14, 2010, in Chicago, Illinois, and
Thursday, October 21, 2010, in Los Angeles, California. The hearing
sessions will be from 12 p.m. to 4 p.m. and 6 p.m. to 10 p.m. local
time and continue until everyone has had a chance to speak. Note that
the times have changed from those indicated in the proposed rule.

Draft Toxicological Review of Urea: In Support of Summary

SUMMARY: EPA is announcing a 60-day public comment period and a public
listening session for the external review draft human health assessment
titled, ``Toxicological Review of Urea: In Support of Summary
Information on the Integrated Risk Information System (IRIS)'' [EPA/
635/R-10/005]. The draft assessment was prepared by the National Center
for Environmental Assessment (NCEA) within the EPA Office of Research
and Development (ORD). EPA is releasing this draft assessment solely
for the purpose of pre-dissemination peer review under applicable
information quality guidelines. This draft assessment has not been
formally disseminated by EPA. It does not represent and should not be
construed to represent any Agency policy or determination. After public
review and comment, an EPA contractor will convene an expert panel for
independent external peer review of this draft assessment. The public
comment period and external peer review meeting are separate processes
that provide opportunities for all interested parties to comment on the
assessment. The external peer review meeting will be scheduled at a
later date and announced in the Federal Register. Public comments
submitted during the public comment period will be provided to the
external peer reviewers before the panel meeting and considered by EPA
in the disposition of public comments. Public comments received after
the public comment period closes will not be submitted to the external
peer reviewers and will only be considered by EPA if time permits.
    The listening session will be held on November 16, 2010, during the
public comment period for this draft assessment. The purpose of the
listening session is to allow all interested parties to present
scientific and technical comments on draft IRIS health assessments to
EPA and other interested parties attending the listening session. EPA
welcomes the comments that will be provided to the Agency by the
listening session participants. The comments will be considered by the
Agency as it revises the draft assessment after the independent
external peer review. If listening session participants would like EPA
to share their comments with the external peer reviewers, they should
also submit written comments during the public comment period using the
detailed and established procedures described in the SUPPLEMENTARY

Energy Efficiency Program for Certain Commercial and Industrial
Equipment: Public Meeting and Availability of the Framework Document
for Commercial and Industrial Electric Motors

SUMMARY: The U.S. Department of Energy (DOE) is initiating the
rulemaking to amend the energy conservation standards for certain
commercial and industrial electric motors under section 342(b) of the
Energy Policy and Conservation Act (EPCA). DOE will hold an informal
public meeting to discuss and receive comments on its planned
analytical approach and the issues it will address during this
rulemaking. DOE welcomes written comments from the public on any
subject within the scope of this rulemaking. To inform interested
parties and to facilitate this process, DOE has prepared a framework
document that details the analytical approach that DOE will use and
identifies several issues on which DOE is particularly interested in
receiving comment. A copy of the framework document is available at:

SUMMARY: The Hydrogen and Fuel Cell Technical Advisory Committee (HTAC)
was established under section 807 of the Energy Policy Act of 2005
(EPACT), Public Law 109-58; 119 Stat. 849. The Federal Advisory
Committee Act, Public Law 92-463, 86 Stat. 770, requires that public
notice of this meeting be announced in the Federal Register.
