Pasteuria usgae; Exemption from the Requirement of a Tolerance

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: This regulation establishes an exemption from the requirement
of a tolerance for residues of the microbial pesticide, Pasteuria
usgae, in or on all food commodities when applied preharvest and used
as a nematicide in accordance with good agricultural practices.
MacIntosh and Associates Incorporated (on behalf of Pasteuria
Bioscience Incorporated) submitted a petition to EPA under the Federal
Food, Drug, and Cosmetic Act (FFDCA), requesting an exemption from the
requirement of a tolerance. This regulation eliminates the need to
establish a maximum permissible level for residues of Pasteuria usgae.

DATES: This regulation is effective June 30, 2010. Objections and
requests for hearings must be received on or before August 30, 2010,
and must be filed in accordance with the instructions provided in 40
CFR part 178 (see also Unit I.C. of the SUPPLEMENTARY INFORMATION).

SUMMARY: On October 28, 2009, we promulgated general control
requirements to control emissions of hazardous air pollutants from heat
exchange systems at petroleum refineries. These requirements were
published as amendments to the national emission standards for
petroleum refineries. In this notice, we are correcting typographical
errors and inadvertent errors in section references.

Regulation of Fuels and Fuel Additives: Modifications to

ACTION: Partial withdrawal of direct final rule.

SUMMARY: EPA published a direct final rule to amend the Renewable Fuel
Standard program requirements on May 10, 2010. Because EPA received
adverse comment, we are withdrawing several provisions of the direct
final rule.

``actual peak capacity,'' ``baseline volume,'' and ``permitted

Temporary Suspension of Certain Oil Spill Response Time
Requirements To Support Deepwater Horizon Oil Spill of National
Significance (SONS) Response

ACTION: Emergency temporary interim rule.

SUMMARY: This joint Coast Guard and Environmental Protection Agency
(EPA) temporary interim rule will suspend oil spill response time
requirements, and certain identification and location requirements, for
facilities and vessels whose response resources are relocated in support of the Deepwater Horizon SONS response. By providing oil spill removal organizations
(OSROs), and facilities and vessels with their own response resources,
with the temporary opportunity to relocate response resources from
current locations to the Gulf of Mexico, this rule directly assists in
the urgently needed immediate relocation of nationwide oil spill
response resources to the Gulf of Mexico to aid in the response to the
Deepwater Horizon SONS. The rule also provides notice that the Federal
On-Scene Coordinator for the Deepwater Horizon SONS has requested the
Armed Forces to relocate Armed Forces oil spill response resources, in
particular those of the Navy, from their current locations to the Gulf
of Mexico to aid in the response to the Deepwater Horizon SONS.

DATES: Effective Date: This rule is effective from June 30, 2010
through December 31, 2010.

1-naphthaleneacetic acid in or on avocados which was inadvertently
deleted by the September 11, 2009 final rule.

ACTION: Notice of extension of deadline to submit pre-applications.

SUMMARY: On June 1, 2010, DOT published a notice (75 FR 30461)
announcing the availability of funding and requesting proposals for
DOT's National Infrastructure Investments grant program under the FY
2010 Appropriations Act. The DOT is referring to the grants for
National Infrastructure Investments as ``TIGER II Discretionary
Grants.'' Through this notice, DOT is extending the deadline to submit
pre-applications for TIGER II Discretionary Grants from July 16, 2010,
at 5 p.m. EDT to July 26, 2010, at 5 p.m. EDT. The deadline for
submitting final applications is not being extended, and remains August
23, 2010, at 5 p.m. EDT.

DATES: Pre-applications must be submitted by July 26, 2010, at 5 p.m.
EDT (the ``Pre-Application Deadline''). Final applications must be
submitted through Grants.gov by August 23, 2010, at 5 p.m. EDT (the
``Application Deadline''). The DOT pre-application system opened on
June 23, 2010 to allow prospective applicants to submit pre-
applications. Subsequently, the Grants.gov ``Apply'' function will open
on July 30, 2010, allowing applicants to submit applications. While
applicants are encouraged to submit pre-applications in advance of the
Pre-Application Deadline, pre-applications will not be reviewed until
after the Pre-Application Deadline. Similarly, while applicants are
encouraged to submit applications in advance of the Application
Deadline, applications will not be evaluated, and awards will not be
made, until after the Application Deadline. Pursuant to the FY 2010
Appropriations Act, the DOT will evaluate all applications and announce
the projects that have been selected to receive TIGER II Discretionary
Grants no sooner than September 15, 2010.

SUMMARY: EPA is administering--under the Clean Air Interstate Rule
(CAIR) Federal Implementation Plans (FIPs)--the CAIR NOX Annual Trading Program (CAIRNOX) new unit set-aside allowance pools for Delaware and the District of Columbia. The CAIRNOX FIPs require the Administrator to determine each year by order the allowance allocations from the new unit set-aside for units in these jurisdictions whose owners and operators requested these allocations and to provide the public with the opportunity to object to the allocation determinations. In this NODA EPA is making available to the public the emissions data and other information upon which the allocations, or denial of allocations, are based and the CAIRNOX new unit set-aside allowance allocation (if any) for each individual unit.DATES: Objections must be received by July 29, 2010. AGENCY: Office of Energy Efficiency and Renewable Energy, Department of

SUMMARY: On December 9, 2008, the U.S. Department of Energy (DOE)
published a notice of proposed rulemaking (NOPR) in which it proposed
amendments to its test procedures for residential clothes dryers and
room air conditioners to provide for measurement of standby mode and
off mode power use by these products in order to implement recent
amendments under the Energy Independence and Security Act of 2007 (EISA
2007) to the Energy Policy and Conservation Act (EPCA). In response to
comments on the NOPR, DOE conducted additional investigations to
address certain issues raised in these comments. In today's
supplemental notice of proposed rulemaking (SNOPR), DOE is continuing
to propose amendments to incorporate into its test procedures relevant
provisions from the International Electrotechnical Commission (IEC)
Standard 62301, ``Household electrical appliances--Measurement of
standby power,'' First Edition 2005-06, including language to clarify
application of these provisions for measuring standby mode and off mode
power consumption in clothes dryers and room air conditioners. In
addition, DOE is proposing to adopt definitions of modes based on the
relevant provisions from IEC Standard 62301 Second Edition Committee
Draft for Vote. DOE is also proposing to amend its test procedures for
clothes dryers and room air conditioners to address active mode energy
use. Specifically, today's proposal addresses testing methods for
clothes dryer automatic cycle termination, vent-less clothes dryers,
test cloth preconditioning for clothes dryer energy tests, test
conditions for gas clothes dryers, and current clothes dryer usage
patterns and capabilities as well as the references in the current room
air conditioner and clothes dryer test procedure. DOE will hold a
public meeting to discuss and receive comments on the issues presented
in this notice.

DATES: DOE will hold a public meeting on Wednesday, July 14, 2010 from
9 a.m. to 4 p.m., in Washington, DC. DOE must receive requests to speak
at the public meeting before 4 p.m., Wednesday, July 7, 2010. DOE must

SUMMARY: NICEATM announces availability of Interagency Coordinating
Committee on the Validation of Alternative Methods (ICCVAM) Test Method
Evaluation Reports (TMERs) recommending two nonradioactive versions of
the Local Lymph Node Assay (LLNA) for assessing allergic contact
dermatitis (ACD) hazard potential of chemicals and products and
expanded uses of the LLNA for pesticide formulations and other
products. Related ICCVAM Test Method Recommendations in each report
have also been transmitted to Federal agencies for their review and
response to ICCVAM in accordance with the provisions of the ICCVAM
Authorization Act of 2000. The LLNA: 5-Bromo-2'-deoxyuridine-Enzyme-
Linked Immunosorbent Assay (BrdU-ELISA) and LLNA: Daicel Adenosine
Triphosphate (DA) do not use radioactive reagents and therefore provide
advantages in terms of reduced hazardous waste disposal and broader
availability for use by laboratories that cannot use radioactive
reagents. ICCVAM concludes that the accuracy and reliability of the
LLNA: BrdU-ELISA and LLNA: DA support use of these test methods to
identify substances as potential skin sensitizers or nonsensitizers.
Based on an updated evaluation, ICCVAM is also recommending expanded
use of the LLNA to evaluate the ACD hazard potential of pesticide
formulations and other products.

SUMMARY: NOAA's Next Generation Strategic Plan (Plan) sets the course
for the agency's mission, a vision of the future, the societal outcomes
that NOAA aims to help realize, and, consequently, the actions that the
agency must take. The draft Plan lays the foundation for NOAA to play a
leading Federal role in responding to the Nation's most urgent
challenges, ranging from climate change, severe weather, and natural or
human-induced disasters to declining biodiversity and threatened or
degraded ocean and coastal resources. NOAA's draft strategy emerged
from extensive consultations across the Nation with staff and
stakeholders--the extended community of partners and collaborators in
the public, private, and academic sectors who have a stake in NOAA's
mission. During more than 20 regional stakeholder forums, a national
forum in Washington, DC, and through web-based engagement and idea
generation, NOAA gathered input that helped assess the greatest
challenges facing our Nation and the highest priority goals for NOAA.
NOAA invites comments on the Plan on its: mission statement; vision of
the future; long-term strategic goals and five-year objectives;
enterprise components and five-year objectives; and strategic
partnerships.

SUMMARY: EPA is administering--under the Clean Air Interstate Rule
(CAIR) Federal Implementation Plans (FIPs)--the CAIR NOX
Ozone Season Trading Program (CAIROS) new unit set-aside allowance
pools for Delaware and the District of Columbia. The CAIROS FIPs
require the Administrator to determine each year by order the allowance
allocations from the new unit set-aside for units in these
jurisdictions whose owners and operators requested these allocations
and to provide the public with the opportunity to object to the
allocation determinations. On April 27, 2010, EPA issued a NODA setting
forth such determinations in the Federal Register and provided an
opportunity for submission of objections. Through the NODA issued
today, EPA is making available to the public the Agency's
determinations, after considering all objections, of CAIROS allowance
allocations and denials of such allocations under the FIPs, as well as
the data upon which the allocations and denials of allocations were
based.

DATES: Under Sec.  97.353(e), EPA must record, by September 1, 2010,
the CAIROS new unit set-aside allowance allocations, consistent with
this NODA, in the compliance accounts of units whose owners and
operators successfully applied for a CAIROS new unit set-aside
allowance allocation under the CAIR FIPs.

SUMMARY: In accordance with section 113(g) of the Clean Air Act, as
amended (``Act''), 42 U.S.C. 7413(g), notice is hereby given of a proposed
settlement agreement to address lawsuits filed by Navistar, Inc.
(Navistar) in the United States Court of Appeals for the District of
Columbia Circuit: Navistar v. EPA, Nos. 09-1113, 09-1114 and 09-1317
(DC Cir.). Navistar filed petitions for review of the following: (1) An
EPA rule published January 18, 2001 promulgating standards for new
heavy duty motor vehicles and engines; (2) a letter, dated February 18,
2009, sent by the Director of the Compliance and Innovative Strategies
Division, Office of Transportation and Air Quality, providing guidance
to manufacturers of heavy-duty diesel engines; and (3) an agency
notice, published November 9, 2009, approving new scheduled maintenance
for new motor vehicles and engines using selective catalytic
technologies. Under the terms of the proposed settlement agreement,
Navistar agrees to dismiss these petitions with prejudice, to withdraw
related Freedom if Information Act requests, and to be precluded from
challenging certain other related actions. EPA agrees to engage in a
public process within a specific time frame to reexamine its policies,
for future model year 2011 and later heavy duty diesel engines, for
operation of SCR-equipped engines without DEF, with improper DEF, or
when tampering (or some other defect in the SCR system) is detected.
The public process shall take the form of a workshop, hearing, or other
public process.

meeting listed under DATES was Monday, July 13, 2010 and is incorrect.
The correct date is Monday, July 12, 2010.
    Also, in that notice under Public Participation it was indicated
that the meeting will be available via live audio Webcast. The meeting
is now planned to be live video Webcast. Additional information will be

Anthropology Department, Kalamazoo, MI

AGENCY: National Park Service, Interior.

ACTION: Notice.

    Notice is here given in accordance with the Native American Graves
Protection and Repatriation Act (NAGPRA), 25 U.S.C. 3003, of the
completion of an inventory of human remains and associated funerary
objects in the possession of Western Michigan University, Anthropology
Department, Kalamazoo, MI. The human remains and associated funerary
objects were removed from Kent County, MI.
    This notice is published as part of the National Park Service's
administrative responsibilities under NAGPRA, 25 U.S.C. 3003(d)(3). The
determinations in this notice are the sole responsibility of the
museum, institution, or Federal agency that has control of the Native
American human remains and associated funerary objects. The National
Park Service is not responsible for the determinations in this notice.

    A detailed assessment of the human remains was made by Western
Michigan University professional staff in consultation with
representatives of the Little River Band of Ottawa Indians, Michigan,
and the Little Traverse Bay Bands of Odawa Indians, Michigan.
    In 1984, human remains representing a minimum of two individuals
were removed from the Front and Leonard Street intersection, Kent
County, MI, during the excavation of a building foundation. George
Davis, then president of the Wright L. Coffinberry Chapter of the
Michigan Archaeological Society, recovered as much of the material as
possible after they had tumbled from the shovel of the tractor during
the construction. It is not clear how or why they were transferred to
Western Michigan University. No known individuals were identified. The
five associated funerary objects are three turtle shell fragments, a
badly rusted nail, and a kaolin pipe stem fragment.
    The human remains were determined to be of Native American ancestry
based on skeletal and dental morphology. The determination of an early
19th century date is based on typology of the kaolin pipe and the close
proximity of these remains to a known 19th century Ottawa settlement,
Noondays Village (20KT114). Consequently, the preponderance of
osteological, historical, and consultation evidence connects the
remains found at Front Avenue and Leonard Street to the Little River
Band of Ottawa Indians, Michigan.
    In 1990, human remains representing a minimum of six individuals
were removed from Riverside Drive, Lowell, Kent County, MI. The remains
were uncovered during installation of a fire hydrant and water main.
Upon discovery, Dr. Robert Sundick was called to the site to conduct an
excavation of the remains. After completion, the remains were sent with
Sundick to Western Michigan University for curation and analysis. The
68 associated funerary objects are 1 leather garment fragment decorated
with small round cuprous brooches, 1 decorative cuprous item (possible
ear wheel fragment), 3 cuprous Saturn-shaped bells, 8 wrought iron
nails with remnants of wood which may be remains of a coffin, 53 glass
beads (representing 27 black glass tubular beads and 26 purple glass
seed beads), 1 small bag of very fragmented faunal remains, and 1
pottery sherd.
    The human remains were determined to be of Native American ancestry
based on skeletal and dental morphology. They were dated to the early
19th century based on analysis of the garment fragment, the presence of
glass trade beads, and typology of the other associated funerary
objects.
    The Little River Band of Ottawa Indians, Michigan, are well-
documented as occupying the Grand River Valley since at least the 17th
century. All of the human remains and associated funerary objects
described above from the Kent County sites are, by a preponderance of
the evidence, culturally affiliated with the Little River Band of
Ottawa Indians, Michigan, whose ancestors include the Grand River
Ottawa Bands.
    Officials of Western Michigan University have determined that,
pursuant to 25 U.S.C. 3001(9), the human remains described above
represent the physical remains of eight individuals of Native American
ancestry. Officials of Western Michigan University also have determined
that, pursuant to 25 U.S.C. 3001(3)(A), the 73 objects described above
are reasonably believed to have been placed with or near individual
human remains at the time of death or later as part of the death rite
or ceremony. Lastly, officials of Western Michigan University have
determined that, pursuant to 25 U.S.C. 3001(2), there is a relationship
of shared group identity that can be reasonably traced between the
Native American human remains and associated funerary objects and the
Little River Bands of Ottawa Indians, Michigan.
    Representatives of any other Indian tribe that believes itself to
be culturally affiliated with the human remains and associated funerary
objects should contact LouAnn Wurst, Department of Anthropology,
Western Michigan University, 1005 Moore Hall, Kalamazoo, MI 49008,
telephone (269) 387-2753, before July 28, 2010. Repatriation of the
human remains and associated funerary objects to the Little River Band
of Ottawa Indians, Michigan, may proceed after that date if no
additional claimants come forward.
    Western Michigan University is responsible for notifying the Little
River Band of Ottawa Indians, Michigan, and the Little Traverse Bay
Bands of Odawa Indians, Michigan, that this notice has been published.

Pipeline Safety: Updating Facility Response Plans in Light of the
Deepwater Horizon Oil Spill

SUMMARY: PHMSA is issuing an Advisory Bulletin to operators of
hazardous liquid pipeline facilities required to prepare and submit an
oil spill response plan under 49 CFR part 194. In light of the
Deepwater Horizon oil spill in the Gulf of Mexico, which has resulted
in the relocation of oil spill response resources to address the oil
spill, PHMSA is reminding operators of their responsibilities to review
and update their oil spill response plans and to comply with other
emergency response requirements to ensure the necessary response to a
worst case discharge from their pipeline facility.

Phthalates and Phthalate Substitutes and Correction of E-mail Address

SUMMARY: The Consumer Product Safety Commission (``CPSC'' or
``Commission'') is announcing time changes to the second meeting of the
Chronic Hazard Advisory Panel (CHAP) on phthalates and phthalate
substitutes. The Commission appointed this CHAP to study the effects on
children's health of all phthalates and phthalate alternatives as used
in children's toys and child care articles, pursuant to section 108 of
the Consumer Product Safety Improvement Act of 2008 (CPSIA) (Pub. L.
110-314). The Commission also is correcting the e-mail address for
requests and procedures for oral presentations of comments.

DATES: The meeting will begin at 8:30 a.m. on July 26, 2010. The
opportunity for the public to present oral comments will remain on July
26, 2010, from 10 a.m. to 5 p.m. The remainder of the meeting will be
from 8:30 a.m. to 5 p.m. on July 27, 2010 and from 8:30 a.m. to 2 p.m.
on July 28, 2010.
