Boscalid; Pesticide Tolerances

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: This regulation establishes tolerances for residues of
boscalid in or on multiple commodities which are identified and
discussed later in this document. This regulation additionally revises
established tolerances in or on fruit, stone, group 12; hog, fat;
poultry, fat; and poultry, meat byproducts. Finally, this regulation
deletes the time-limited tolerance on tangerine as it expired on
December 31, 2008. BASF Corporation requested these tolerances under
the Federal Food, Drug, and Cosmetic Act (FFDCA).

DATES: This regulation is effective May 28, 2010. Objections and
requests for hearings must be received on or before July 27, 2010, and
must be filed in accordance with the instructions provided in 40 CFR

SUMMARY: This regulation establishes tolerances for combined residues
of prothioconazole and prothioconazole-desthio, calculated as parent in
or on grain, cereal, group 15 (except sweet corn, sorghum, and rice),
and grain, cereal, forage, fodder and straw, group 16 (except sweet
corn, sorghum, and rice) and sweet corn. Bayer CropScience requested
these tolerances under the Federal Food, Drug, and Cosmetic Act
(FFDCA).

DATES: This regulation is effective May 28, 2010. Objections and

SUMMARY: This document advises the public that a class deviation to the
Department of Energy (DOE) Financial Assistance Rules, particularly the
regulations that deal with programmatic changes, and DOE policies and
procedures on the use of warranted Contracting Officers to administer
financial assistance agreements, has been approved for the Energy
Efficiency and Conservation Block Grant (EECBG) program. This class
deviation gives authority to EECBG Program Managers to approve the
following processes for financial assistance agreements made using
Recovery Act funding to State, city, county, and Tribal recipients in
support of the formula EECBG program: Administer financial assistance
awards for approval of programmatic changes under the Changes section
of the Financial Assistance Rules; review of subsequent budget
submittals for consistency with the requirements of Office of
Management and Budget's (OMB) Cost Principles for State, Local and
Indian Tribal Governments (questions on allowability, allocability and
reasonableness of budgets and individual cost elements will be
forwarded to the Contracting Officer for adjudication), remove and/or
modify National Environmental Policy Act (NEPA) restrictions, including
guidance on NEPA requirements; and amend agreements for administrative
activities such as lifting conditions based on approval of Strategies.
The class deviation does not apply to non-formula awards.

Energy Efficiency and Sustainable Design Standards for New
Federal Buildings

SUMMARY: The U.S. Department of Energy (DOE) is publishing this notice
of proposed rulemaking (NOPR) to implement provisions of the Energy
Conservation and Production Act, as amended by the Energy Policy Act of
2005 and the Energy Independence and Security Act of 2007, that require
DOE to establish revised performance standards for the construction of
new Federal buildings and major renovations of Federal buildings. This
NOPR specifically addresses the use of sustainable design principles
for siting, design, and construction, and the use of water conservation
technologies to achieve energy efficiency. This proposed rulemaking
also provides criteria for identifying a certification system and level
for green buildings that encourages a comprehensive and
environmentally-sound approach to certification of green buildings.

DATES: Public comments on this proposed rule will be accepted until
July 27, 2010. The Department will hold a public meeting on Wednesday,
July 28, 2010, from 9 a.m. to 4 p.m., in Washington, DC. DOE must
receive requests to speak at the public meeting before 4 p.m.,
Wednesday, July 14, 2010. DOE must receive a signed original and an
electronic copy of statements to be given at the public meeting before
4 p.m., Wednesday, July 21, 2010.

Oil and Gas Exploration and Development

SUMMARY: On May 17, 2010, the Council on Environmental Quality (CEQ)
informed the Department of the Interior (DOI) that CEQ was conducting a
30 day review National Environmental Policy Act (NEPA) policies,
practices, and procedures for the Minerals Management Service (MMS)
decisions for Outer Continental Shelf (OCS) oil and gas exploration and
development.
    This review of MMS NEPA policies, practices and procedures is being
conducted as a result of the oil spill from the Deepwater Horizon well
and drilling rig in the Gulf of Mexico. The purpose of this review is
to ascertain how MMS applies NEPA in its management of Outer
Continental Shelf oil and gas exploration and development and make
recommendations for revisions. The scope of the review is intended to
be holistic, i.e. from leasing decisions to drilling and production.
    In line with CEQ's effort to engage the public in the NEPA process
and the President's Open Government Initiative, this notice is also a
solicitation for public comment on the review process undertaken by CEQ
as well as on current MMS NEPA policies, practices, and procedures
regarding Outer Continental Shelf oil and gas exploration and
development. Public participation in this review effort will benefit
this specific review process, the MMS NEPA implementation, CEQ's
overall effectiveness in overseeing NEPA, and the environmental and
social consequences of government activity.

availability of up to $25.7 million in discretionary Fiscal Year (FY)
2009 and 2010 funds under the Alternatives Analysis Program (49 U.S.C.
5339) authorized by the Safe, Accountable, Flexible, Efficient,
Transportation Equity Act: A Legacy For Users (SAFETEA-LU), Public Law
109-59, August 10, 2005. Discretionary program funds will be
distributed in accordance with the mission of this program and in
support of the Department of Transportation's Livability Initiative.

governing migratory bird rehabilitation in the United States. Before
creation of those regulations, rehabilitators were required to obtain a
special purpose permit to engage in rehabilitation activities. The
language in the final paragraph of the 2003 regulations dealt with the
transition of special purpose permit holders to operation under the new
rehabilitation permit regulations. This paragraph is no longer
relevant, so we remove it from the regulation.

SUMMARY: EPA will begin a general practice of reviewing confidentiality
claims for chemical identities in health and safety studies, and in
data from health and safety studies, submitted under the Toxic
Substances Control Act (TSCA) in accordance with Agency regulations at
40 CFR part 2, subpart B. Section 14(b) of TSCA does not extend
confidential treatment to health and safety studies, or data from
health and safety studies, which, if made public, would not disclose
processes used in the manufacturing or processing of a chemical
substance or mixture or, in the case of a mixture, the release of data
disclosing the portion of the mixture comprised by any of the chemical
substances in the mixture. Where a chemical identity does not
explicitly contain process information or reveal portions of a mixture,
EPA expects to find that the information would clearly not be entitled
to confidential treatment. This builds on similar efforts regarding
confidentiality of chemical identities listed on the public version of
the TSCA Chemical Substances Inventory (TSCA Inventory) and submitted
in notifications pursuant to TSCA section 8(e), discussed in the
Federal Register of January 21, 2010.

DATES: EPA expects to begin reviews of confidentiality claims -- both
newly submitted and existing claims -- in accordance with this guidance
on August 25, 2010. Though EPA is not required to solicit comment for
this action, comments received before this date will inform these
reviews.

Energy Conservation Program for Consumer Products: Test
Procedures for Refrigerators, Refrigerator-Freezers, and Freezers

AGENCY: Office of Energy Efficiency and Renewable Energy, Department of

SUMMARY: The U.S. Department of Energy (DOE) today is issuing a notice
of proposed rulemaking (NOPR) to amend the test procedures for
refrigerators, refrigerator-freezers, and freezers. The NOPR consists
of two parts. First, it proposes amending the current procedure by
adding test procedures to account for refrigerator-freezers equipped
with variable anti-sweat heater controls, amending the long-time
automatic defrost test procedure to capture all energy use associated
with the defrost cycle expended during testing, establishing test
procedures for refrigerator-freezers equipped with more than two
compartments, making minor adjustments to the language to eliminate any
potential ambiguity regarding how to conduct tests, and requiring
certain information in certification reports to clarify how some
products are tested to determine their energy ratings. Second, the
notice proposes amended test procedures for refrigerators,
refrigerator-freezers, and freezers that would be required for
measuring energy consumption once DOE promulgates new energy
conservation standards for these products. These new standards are
currently under development in a separate rulemaking activity. Pursuant
to the Energy Policy and Conservation Act of 1975, as amended, these
new standards would apply to newly manufactured products starting on
January 1, 2014. While the amended test procedures would be based
largely on the test methodology used in the existing test procedures,
they also include significant revisions with respect to the measurement
of compartment temperatures and compartment volumes that would provide
a more comprehensive accounting of energy usage by these products.
Finally, the new test procedure for 2014 would incorporate into the
energy use metric the energy use associated with icemaking for products
with automatic icemakers. This NOPR also discusses the proposed
treatment of combination wine storage-freezer products that were the
subject of a recent test procedure waiver, the testing of refrigeration
products with the anti-sweat heater switch turned off, the treatment of
auxiliary features used in refrigeration products, the treatment of
electric heaters in the current and proposed test procedures, and the
incorporation of icemaking energy use in the test procedure.

    Board meeting: June 29, 2010--Idaho Falls, Idaho; the U.S. Nuclear
Waste Technical Review Board will meet to discuss U.S. Department of
Energy plans for managing spent nuclear fuel and high-level radioactive
waste.
    Pursuant to its authority under section 5051 of Public Law 100-203,
Nuclear Waste Policy Amendments Act of 1987, the U.S. Nuclear Waste
Technical Review Board will meet in Idaho Falls, Idaho, on Tuesday,
June 29, 2010. to review U.S. Department of Energy (DOE) plans for
managing spent nuclear fuel (SNF) and high-level radioactive waste
(HLW). Among the topics that will be discussed are the amounts and
characteristics of waste stored at the Idaho National Laboratory,
agreements in place between the State of Idaho and the federal
government related to the packaging and movement of the waste, how the
recent decision to terminate the Yucca Mountain repository program will
affect waste management plans, and plans underway at DOE to transition
its responsibilities under the Nuclear Waste Policy Act (NWPA) from the
Office of Civilian Radioactive Waste Management to the Office of
Nuclear Energy. Also on the agenda are discussions of innovative
reactor technologies that could affect amounts or types of SNF or HLW
requiring disposal and presentations on studies of advanced fuel
cycles. The Nuclear Waste Policy Amendments Act of 1987 requires the
Board to conduct an independent review of the technical and scientific
validity of DOE activities related to nuclear waste management,
including transporting, packaging, and disposing of SNF and HLW.
    The Board meeting will be held at the Hilton Garden Inn, 700
Lindsay Boulevard; Idaho Falls, ID 83402; (tel.) 208-522-9500, (fax)
208-522-9501. A block of rooms has been reserved for meeting attendees.
When making a reservation, please ask for the ``NWTRB'' rate.

    The Board was established as an independent federal agency to
provide objective expert advice to Congress and the Secretary of Energy
on technical issues and to review the technical validity of DOE
activities related to implementing the NWPA. Board members are experts
in their fields and are appointed to the Board by the President from a
list of candidates submitted by the National Academy of Sciences. The
Board is required to report to Congress and the Secretary no fewer than
two times each year. All Board reports, correspondence, congressional

Renewable Energy Development Assistance Under the Rural Energy for
America Program

SUMMARY: The Rural Energy for America Program, formerly section 9006
under the 2002 Farm Bill, is composed of several types of grants and
guaranteed loan programs. These are: Guaranteed loans and grants for
the development/construction of renewable energy systems and for energy
efficiency improvement projects; grants for conducting energy audits;
grants for conducting renewable energy development assistance; and
grants for conducting renewable energy feasibility studies.
    The Agency is implementing the Rural Energy for America Program
(REAP) for Fiscal Year 2010 through the publication of three REAP
notices:
    Renewable energy system and energy efficiency improvement
grants and guaranteed loans;
    Energy audit and renewable energy development assistance
grants; and
    Renewable energy feasibility study grants.
    This REAP notice announces the availability of $2.4 million for
fiscal year (FY) 2010 to units of State, tribal, or local government;
instrumentalities of a State, tribal, or local government; land-grant
colleges and universities and other institutions of higher education,
including 1994 Land Grant Colleges
(Tribal Colleges), 1890 Land Grant Colleges, and Historically Black
Universities; rural electric cooperatives; and public power entities
for the provision of energy audits and renewable energy development
assistance to agricultural producers and rural small businesses. This
funding will be available in the form of grants. Funds that are not
awarded will convert to the REAP pool.
    Lastly, the Agency intends to publish a proposed rule that will
revise the current program, in large part to conform with the
requirements set out by the 2008 Farm Bill, at 7 CFR 4280, subpart B to
include renewable energy feasibility study grants, and that will add a
new subpart C to address energy audit and renewable energy development
assistance grants. Together, these two subparts will represent the
Rural Energy for America Program as authorized under section 9007 of
the Farm Security and Rural Investment Act of 2002 as amended by
section 9001 of the Food, Energy, and Conservation Act of 2008. The
Agency anticipates publishing final regulations to operate the Rural
Energy for America Program in fiscal year 2011.

electronically no later than 4:30 p.m., local time July 26, 2010.
Neither complete nor incomplete applications received after this date
and time will be considered for funding in FY 2010, regardless of the
postmark on the application.

SUMMARY: We are advising the public that an environmental assessment
and finding of no significant impact have been prepared by the Animal
and Plant Health Inspection Service relative to a request to allow the
interstate movement of garbage from Hawaii to a landfill in the State
of Washington. The environmental assessment documents our review and
analysis of the environmental impacts associated with, and alternatives
to, the movement of palletized or containerized baled municipal solid
waste to three existing ports on the Columbia River via barge and the
transfer and transportation of the waste via truck or rail to the
landfill. Based on its finding of no significant impact, the Animal and
Plant Health Inspection Service has determined that an environmental
impact statement need not be prepared.

SUPPLEMENTARY INFORMATION:

Background

    The importation and interstate movement of garbage is regulated by
the Animal and Plant Health Inspection Service (APHIS) under 7 CFR
330.400 and 9 CFR 94.5 (referred to below as the regulations) in order
to protect against the introduction into and dissemination within the
United States of plant and animal pests and diseases.
    On January 19, 2010, we published in the Federal Register (75 FR
2845-2846, Docket No. APHIS-2006-0172) a notice\1\ in which we
announced the availability, for public review and comment, of an
environmental assessment documenting our review and analysis of the
environmental impacts associated with, and alternatives to, the
movement of palletized or containerized baled municipal solid waste to
three existing ports on the Columbia River via barge and the transfer
and transportation of the waste via truck or rail to the landfill.

Coat Protein of Plum Pox Virus; Exemption from the Requirement of

SUMMARY: This regulation establishes an exemption from the requirement
of a tolerance for residues of the coat protein of plum pox virus in or
on stone fruit and almond when expressed in these food commodities by
the plant-incorporated protectant, coat protein gene of plum pox virus.
Interregional Research Project Number 4 of Rutgers University (on
behalf of the United States Department of Agriculture-Agricultural
Research Service-Appalachian Fruit Research Station) submitted a
petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA),
requesting an exemption from the requirement of a tolerance. This
regulation eliminates the need to establish a maximum permissible level
for residues of the coat protein of plum pox virus under the FFDCA.

Revocation of Significant New Use Rule on a Certain Chemical
Substance

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: Pursuant to 40 CFR 721.185, EPA is revoking a significant new
use rule (SNUR) promulgated under section 5(a)(2) of the Toxic
Substances Control Act (TSCA) for the chemical substance identified
generically as polyalkyl phosphate, which was covered by premanufacture
notice (PMN) P-95-1772. Based on the concern criteria in Sec. 
721.170(b), EPA issued a non-5(e) SNUR (i.e., a SNUR on a substance
that is not subject to a TSCA section 5(e) consent order) designating
certain activities as significant new uses. Subsequently, EPA received
and reviewed new information and test data for the chemical substance.
Based on the new information and test data, the Agency no longer finds
that the activities not described in PMN P-95-1772 constitute
significant new uses.

Clean Alternative Fuel Vehicle and Engine Conversions

AGENCY: Environmental Protection Agency (EPA).

ACTION: Proposed rule.

SUMMARY: EPA is proposing to simplify and streamline the process by
which manufacturers of clean alternative fuel conversion systems may
demonstrate compliance with vehicle and engine emissions requirements.
Specifically, EPA is proposing to revise the regulatory criteria for
gaining an exemption from the Clean Air Act prohibition against
tampering for the conversion of vehicles and engines to operate on a
clean alternative fuel. Under existing EPA regulations, an exemption
from the tampering prohibition may only be granted to vehicles and
engines covered by a certificate of conformity. The proposed revisions
would create additional compliance options beyond certification that
would protect manufacturers of clean alternative fuel conversion
systems against a tampering violation, depending on the age of the
vehicle or engine to be converted. The new options would alleviate some
economic and procedural impediments to clean alternative fuel
conversions while maintaining environmental safeguards to ensure that
acceptable emission levels from converted vehicles are sustained.

DATES: Comments must be received on or before July 23, 2010. Under the
Paperwork Reduction Act, comments on the information collection
provisions are best assured of having full effect if the Office of
Management and Budget (OMB) receives a copy of your comments on or
before June 25, 2010.
    Public Hearing: EPA has tentatively scheduled a public hearing
about this proposal for 9 a.m. June 23, 2010. EPA will hold the hearing

SUMMARY: EPA is announcing the availability of a draft transportation
conformity guidance document for public comment. Once finalized, this
guidance would help state and local agencies complete quantitative
PM2.5 and PM10 hot-spot analyses for project-
level transportation conformity determinations of certain highway and
transit projects. A hot-spot analysis includes an estimation of
project-level emissions, air quality modeling, and a comparison to the
relevant national ambient air quality standards (NAAQS) in
PM2.5 and PM10 nonattainment and maintenance areas. AGENCY: Environmental Protection Agency (EPA).

SUMMARY: This notice, pursuant to section 6(f)(2) of the Federal
Insecticide, Fungicide and Rodenticide Act (FIFRA), announces certain
Notices of Intent to Suspend issued by EPA pursuant to section
3(c)(2)(B) of FIFRA. Each Notice of Intent to Suspend was issued
following the Agency's issuance of a Data Call-In notice (DCI), which
required the registrants of the affected pesticide products containing
a certain pesticide active ingredient to take appropriate steps to
secure certain data, and following the registrant's failure to submit
these data or to take other appropriate steps to secure the required
data. The subject data were determined to be required to maintain in
effect the existing registrations of the affected product(s). Failure
to comply with the data requirements of a DCI is a basis for suspension
of the affected registrations under section 3(c)(2)(B) of FIFRA.

DATES: The Notice of Intent to Suspend included in this Federal
Register notice will become a final and effective suspension order
automatically by operation of law 30 days after the date of the
registrant's receipt of the mailed Notice of Intent to Suspend or 30
days after the date of publication of this notice in the Federal
Register (if the mailed Notice of Intent to Suspend is returned to the
Administrator as undeliverable, if delivery is refused, or if the
Administrator otherwise is unable to accomplish delivery to the
registrant after making reasonable efforts to do so), unless during
that time a timely and adequate request for a hearing is made by a
person adversely affected by the Notice of Intent to Suspend or the
registrant has satisfied the Administrator that the registrant has
complied fully with the requirements that served as a basis for the
Notice of Intent to Suspend. Unit IV. explains what must be done to
avoid suspension under this notice (i.e., how to request a hearing or
how to comply fully with the requirements that served as a basis for
the Notice of Intent to Suspend).

                By the authority vested in me as President by the
                Constitution and the laws of the United States of
                America, it is hereby ordered as follows:

                Section 1. Establishment. There is established the
                National Commission on the BP Deepwater Horizon Oil
                Spill and Offshore Drilling (the ``Commission'').

                Sec. 2. Membership. (a) The Commission shall be
                composed of not more than 7 members who shall be
                appointed by the President. The members shall be drawn
                from among distinguished individuals, and may include
                those with experience in or representing the
                scientific, engineering, and environmental communities,
                the oil and gas industry, or any other area determined
                by the President to be of value to the Commission in
                carrying out its duties.

                    (b) The President shall designate from among the
                Commission members two members to serve as Co-Chairs.

                Sec. 3. Mission. The Commission shall:

                    (a) examine the relevant facts and circumstances
                concerning the root causes of the Deepwater Horizon oil
                disaster;
                    (b) develop options for guarding against, and
                mitigating the impact of, oil spills associated with
                offshore drilling, taking into consideration the
                environmental, public health, and economic effects of

                America has the opportunity to lead the world in the
                development of a new generation of clean cars and
                trucks through innovative technologies and
                manufacturing that will spur economic growth and create
                high-quality domestic jobs, enhance our energy
                security, and improve our environment. We already have
                made significant strides toward reducing greenhouse gas
                pollution and enhancing fuel efficiency from motor
                vehicles with the joint rulemaking issued by the
                National Highway Traffic Safety Administration (NHTSA)
                and the Environmental Protection Agency (EPA) on April
                1, 2010, which regulates these attributes of passenger
                cars and light-duty trucks for model years 2012-2016.
                In this memorandum, I request that additional
                coordinated steps be taken to produce a new generation
                of clean vehicles.
