Requirements for Control Technology Determinations for Major
Sources in Accordance With Clean Air Act Sections, Sections 112(g) and

AGENCY: Environmental Protection Agency (EPA).

ACTION: Proposed rule.

SUMMARY: We are proposing to amend the rule governing case-by-case
emission limits for major sources of hazardous air pollutants under
section 112(j) of the Clean Air Act. Specifically, we are proposing
revisions to the section 112(j) rule to clarify and streamline the
process for establishing case-by-case emission limits in the case of
the complete vacatur of a section 112(d) rule applicable to a major
source category initially listed pursuant to section 112(c)(1). In
addition, we are also proposing revisions that would eliminate
provisions of the section 112(j) rule that have become obsolete or are
redundant.

DATES: Comments must be received on or before April 29, 2010, unless a
public hearing is requested by April 14, 2010. If a hearing is
requested on the proposed amendments, written comments must be received
by May 14, 2010. Under the Paperwork Reduction Act, comments on the
information collection provisions are best assured of having full

Tire Fuel Efficiency Consumer Information Program

AGENCY: National Highway Traffic Safety Administration (NHTSA),
Department of Transportation.

ACTION: Final rule.

SUMMARY: This document establishes the test procedures to be used by
tire manufacturers in a new consumer information program to generate
comparative performance information to inform consumers about the
effect of their choices among replacement passenger car tires on fuel
efficiency, safety, and durability. When this program is fully
established, this information will be provided to consumers at the
point of sale and online. This information will encourage the purchase
of better performing replacement tires.
    In order to provide this agency with time needed to conduct
additional consumer testing and resolve important issues raised by
public comments on the agency's proposal regarding the program, this
rule does not specify how the information will be explained and
provided to consumers. After a public meeting regarding the agency's
draft plan for additional testing, NHTSA will proceed with the testing
and then develop and publish a new proposal for these aspects of the
new program.

DATES: Today's final rule is effective June 1, 2010. The incorporation
by reference of certain publications listed in the rule is approved by
the Director of the Federal Register as of June 1, 2010.
    The various compliance dates for these regulations are set forth,
as applicable, in Sec.  575.106(e)(1)(iii).

1.0 Background

    Detroit Edison Company (the licensee) is the holder of Facility
Operating License No. NPF-43, which authorizes operation of Fermi 2.
The license provides, among other things, that the facility is subject
to all rules, regulations, and orders of the U.S. Nuclear Regulatory
Commission (NRC, the Commission) now or hereafter in effect.
    The facility consists of one boiling-water reactor located in
Monroe County, Michigan.

2.0 Request/Action

    Title 10 of the Code of Federal Regulations (10 CFR) Part 73,
``Physical protection of plants and materials,'' Section 73.55,
``Requirements for physical protection of licensed activities in
nuclear power reactors against radiological sabotage,'' published March
27, 2009, effective May 26, 2009, with a full implementation date of
March 31, 2010, requires licensees to protect, with high assurance,
against radiological sabotage by designing and implementing
comprehensive site security programs. The amendments to 10 CFR 73.55
published on March 27, 2009, establish and update generically
applicable security requirements similar to those previously imposed by
Commission orders issued after the terrorist attacks of September 11,
2001, and implemented by licensees. In addition, the amendments to 10
CFR 73.55 include additional requirements to further enhance site
security based upon insights gained from implementation of the post-
September 11, 2001, security orders. It is from five of these new
requirements that Fermi 2 now seeks an exemption from the March 31,
2010, implementation date. All other physical security requirements
established by this recent rulemaking have already been or will be
implemented by the licensee by March 31, 2010.
    By letter dated November 19, 2009, as supplemented by letter dated
December 23, 2009, the licensee requested an exemption in accordance
with 10 CFR 73.5, ``Specific exemptions.'' The licensee's November 19,
2009, and December 23, 2009, letters, have certain portions which
contain proprietary and safeguards information and, accordingly, are
not available to the public. The licensee has requested an exemption
from the March 31, 2010, compliance date stating that it must complete
a number of significant modifications to the current site security
configuration before all requirements can be met. Specifically, the
request is to extend the compliance date for five requirements that
would be in place by May 31, 2011, versus the March 31, 2010, deadline.
Being granted this exemption for the five requirements would allow the
licensee to complete the modifications designed to update aging
equipment and incorporate state-of-the-art technology to meet or exceed
the noted regulatory requirements. . .

4.0 Conclusion for Part 73 Schedule Exemption Request

    The NRC staff has reviewed the licensee's submittals and concludes
that the licensee has provided adequate justification for its request
for an extension of the compliance date to May 31, 2011, with regard to
five specified requirements of 10 CFR 73.55.

SUMMARY: PHMSA is amending the statutorily mandated registration and
fee assessment program for persons who transport, or offer for
transportation, certain categories and quantities of hazardous
materials. For those registrants not qualifying as a small business or
not-for-profit organization, PHMSA is increasing the annual fee from
$975 (plus a $25 administrative fee) to $2,575 (plus a $25
administrative fee) for registration year 2010-2011 and following
years. The increase is necessary to fund the national Hazardous
Materials Emergency Preparedness (HMEP) grants program at approximately
$28,300,000 in accordance with the Administration's Fiscal Year 2010
budget and proposed Fiscal Year 2011 budget.

National Primary Drinking Water Regulations; Announcement of the
Results of EPA's Review of Existing Drinking Water Standards and

SUMMARY: The Safe Drinking Water Act (SDWA) requires the United States
Environmental Protection Agency (EPA) to conduct a periodic review of
existing National Primary Drinking Water Regulations (NPDWRs) and
determine which, if any, need to be revised. The purpose of the review,
called the Six-Year Review, is to identify those NPDWRs for which
current health effects assessments, changes in technology, and/or other
factors provide a health or technical basis to support a regulatory
revision that will improve or strengthen public health protection. EPA
has completed its detailed review of 71 NPDWRs and at this time
believes that four NPDWRs are candidates for regulatory revision. These
four NPDWRs are acrylamide, epichlorohydrin, tetrachloroethylene, and
trichloroethylene. EPA requests public comment and/or relevant
information that will assist the Agency as we move forward with
regulatory action to revise these four NPDWRs. In addition to the 71
NPDWRs discussed in detail in today's action, this review also includes
14 other NPDWRs that need no detailed review because of recent or
ongoing revision actions.

Regulation of Fuels and Fuel Additives: Changes to Renewable Fuel
Standard Program

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: Under the Clean Air Act Section 211(o), as amended by the
Energy Independence and Security Act of 2007 (EISA), the Environmental
Protection Agency is required to promulgate regulations implementing
changes to the Renewable Fuel Standard program. The revised statutory
requirements specify the volumes of cellulosic biofuel, biomass-based
diesel, advanced biofuel, and total renewable fuel that must be used in
transportation fuel. This action finalizes the regulations that
implement the requirements of EISA, including the cellulosic, biomass-
based diesel, advanced biofuel, and renewable fuel standards that will
apply to all gasoline and diesel produced or imported in 2010. The
final regulations make a number of changes to the current Renewable
Fuel Standard program while retaining many elements of the compliance
and trading system already in place. This final rule also implements
the revised statutory definitions and criteria, most notably the new
greenhouse gas emission thresholds for renewable fuels and new limits
on renewable biomass feedstocks. This rulemaking marks the first time
that greenhouse gas emission performance is being applied in a
regulatory context for a nationwide program. As mandated by the
statute, our greenhouse gas emission assessments consider the full
lifecycle emission impacts of fuel production from both direct and
indirect emissions, including significant emissions from land use
changes. In carrying out our lifecycle analysis we have taken steps to
ensure that the lifecycle estimates are based on the latest and most
up-to-date science. The lifecycle greenhouse gas assessments reflected
in this rulemaking represent significant improvements in analysis based
on information and data received since the proposal. However, we also
recognize that lifecycle GHG assessment of biofuels is an evolving
discipline and will continue to revisit our lifecycle analyses in the
future as new information becomes available. EPA plans to ask the
National Academy of Sciences for assistance as we move forward. Based
on current analyses we have determined that ethanol from corn starch
will be able to comply with the required greenhouse gas (GHG) threshold
for renewable fuel. Similarly, biodiesel can be produced to comply with
the 50% threshold for biomass-based diesel, sugarcane with the 50%
threshold for advanced biofuel and multiple cellulosic-based fuels with
their 60% threshold. Additional fuel pathways have also been determined
to comply with their thresholds. The assessment for this rulemaking
also indicates the increased use of renewable fuels will have important
environmental, energy and economic impacts for our Nation.

DATES: This final rule is effective on July 1, 2010, and the percentage
standards apply to all gasoline and diesel produced or imported in
2010. The incorporation by reference of certain publications listed in
the rule is approved by the Director of the Federal Register as of July
1, 2010.

SUMMARY: The Office of Energy Efficiency and Renewable Energy (EERE) of
the U.S. Department of Energy hereby provides notice that on March 19,
2010, the Assistant Secretary for EERE granted nationwide limited
waivers of the Buy American requirements of the American Recovery and
Reinvestment Act of 2009 (Recovery Act; Pub. L. 111-5) under the
authority of section 1605(b)(1) [application of the restrictions of
section 1605 would be inconsistent with the public interest] for the
purchase of light-emitting diode LED lighting (lamps, fixtures, and any
supporting components) and heating, ventilation and air conditioning
(HVAC) units. These nationwide limited waivers apply to projects using
EERE Recovery Act funds for the construction, alteration, maintenance
and repair of a public building or public work. These limited waivers
only apply in circumstances where the recipient of EERE Recovery Act
funds (``grantee'') has taken substantial steps to commit funds for the
purchase of LED lights or HVAC units between February 17, 2009 and
March 31, 2010. Substantial steps to commit funds would include, but
are not limited to: (1) issuing a Request for Proposals (RFP) on or
before March 31, 2010 (applicable only where the grantee accepts a
proposal received under that RFP); (2) in the case of a sole source
selection: placing an order for the goods on or before March 31, 2010;
(3) commencing a bidding process on or before March 31, 2010; (4) in
circumstances where the grantee solicited quotes without an RFP: the
grantee purchases the goods based on a quote dated on or before March
31, 2010 and the order for the goods is placed on or before March 31,
2010; and (5) grantee has executed a contract or purchase agreement
with a supplier to acquire affected goods between February 17, 2009 and
March 31, 2010.
    On March 31, 2010, these limited waivers of Buy American provisions
will expire, with the exception of LED traffic lights, arrows, and
crosswalk signals, which are covered by a nationwide categorical waiver
based on domestic nonavailability issued on February 11, 2010. After
March 31, 2010, EERE grantees are required to procure LED lighting and
HVAC units from domestic manufacturers in accordance with the Recovery
Act Buy American provisions.

Notice of Lodging of Second Modification to Consent Decree Under
Clean Air Act

    Under 28 CFR 50.7, notice is hereby given that on March 19, 2010, a
Second Modification (``Second Modification'') to the November 2005
First Revised Consent Decree (``First Revised Consent Decree'') in the
case of United States, et al. v. Marathon Ashland Petroleum LLC, Civil
Action No. 01-40119 (PVG), was lodged with the United States District
Court for the Eastern District of Michigan.
    Under the Second Modification, MPC must continue to comply with the
First Revised Consent Decree, but, in addition, MPC will pay a civil
penalty of $408,000 and perform two Supplemental Environmental Projects
valued at approximately $963,000 at its Canton and Catlettsburg
Refineries in settlement of claims that MPC violated the Benzene Waste
Operations NESHAP (``BWON''), 40 CFR part 61, subpart FF, and the BWON
provisions of the November 2005 First Revised Consent Decree at those
two refineries. In addition, MPC will pay a stipulated penalty of
$3,933 to resolve claims involving flaring incidents at the Canton,
Catlettsburg, Detroit, and Robinson Refineries. Finally, the Second
Modification amends two Appendices to the First Revised Consent Decree
to reflect a 2008 regulatory change that EPA made to the New
Source Performance Standards for Petroleum Refineries.
    The Department of Justice will receive for a period of thirty (30)
days from the date of this publication comments relating to the Second

SUMMARY: The Rural Utilities Service (RUS) announces the availability
of $993,000 in grant funds to be competitively awarded for the
Household Water Well System (HWWS) Grant Program for fiscal year 2010.
RUS will make grants to qualified private non-profit organizations to
establish lending programs for homeowners to borrow up to $11,000 to
construct or repair household water wells for an existing home. The
HWWS Grant Program regulations are contained in 7 CFR 1776.

DATES: The deadline for completed applications for a HWWS grant is May
31, 2010. Applications in either paper or electronic format must be
postmarked or time-stamped electronically on or before the deadline.
Late applications will be ineligible for grant consideration.

AGENCY: Environmental Protection Agency (EPA).

ACTION: Direct final rule.

SUMMARY: EPA is taking direct final action to convert a conditional
approval of specified provisions of the Michigan State Implementation
plan (SIP) to a full approval. The revisions consist of requirements of
the prevention of significant deterioration (PSD) construction permit
program under the Federal Clean Air Act (CAA). This program affects
major stationary sources in Michigan that are subject to or potentially
subject to the PSD construction permit program. EPA is converting its
prior conditional approval to full approval because the Michigan
Department of Environmental Quality (MDEQ) submitted corrections to the
rules that satisfy the conditions listed in EPA's conditional approval.
As part of this direct final rule, EPA is rescinding Michigan's
delegation of authority for implementing the Federal PSD regulations.
This action is being taken under section 110 of the CAA.

DATES: This direct final rule will be effective May 24, 2010, unless
EPA receives adverse comments by April 26, 2010. If adverse comments
are received, EPA will publish a timely withdrawal of the direct final
rule in the Federal Register informing the public that the rule will
not take effect.

SUMMARY: EPA proposes to convert a conditional approval of revisions to
the Michigan State Implementation Plan (SIP) to a full approval under
the Federal Clean Air Act (CAA). The revisions consist of requirements
of the prevention of significant deterioration (PSD) construction
permit program in Michigan. As required by the conditional approval,
Michigan has submitted a SIP revision pertaining to the ``potential to
emit'' and ``emission unit'' definitions and EPA has found the
revisions acceptable.

DATES: Comments must be received on or before April 26, 2010.

SUMMARY: The U.S. Department of Energy (DOE) will hold a public meeting
to discuss and receive comments on the product classes that DOE plans
to analyze for purposes of establishing energy conservation standards
for residential central air conditioners and heat pumps; the analytical
framework, models, and tools that DOE is using to evaluate amended
standards for these products; the results of preliminary analyses
performed by DOE for these products; and potential energy conservation
standard levels derived from these analyses that DOE could consider for
these products. DOE also encourages written comments on these subjects.
DOE has prepared a preliminary technical support document (TSD), which

Commercialization of University Research Request for Information

ACTION: Notice.

SUMMARY: In September 2009, President Obama released his national
innovation strategy, which is designed to promote sustainable growth
and the creation of quality jobs. Two key parts of this strategy are to
increase support for both the fundamental research at our nation's
universities and the effective commercialization of promising
technologies.
    The Federal government supports university-based research for a
variety of reasons. Expanding the frontiers of human knowledge is a
worthy objective in its own right. Basic research that is not motivated
by any particular application can have a transformative impact. As
President Obama noted in his National Academy speech, ``It was basic
research in the photoelectric field that would one day lead to solar
panels. It was basic research in physics that would eventually produce
the CAT scan. The calculations of today's GPS satellites are based on
the equations that Einstein put to paper more than a century ago.''
    Yet it is often transferring viable research discoveries to the
marketplace that can pose the greatest challenge to innovators and
entrepreneurs. As a result, the Administration is interested in working
with all stakeholders (including universities, companies, Federal
research labs, entrepreneurs, investors, and non-profits) to identify
ways in which we can increase the economic impact of Federal investment
in university R&D and the innovations being fostered in Federal and
private proof of concept centers (POCCs). This RFI is designed to
collect input from the public on ideas for promoting the
commercialization of Federally funded research. The first section of
the RFI seeks public comments on how best to encourage
commercialization of university research. The second section of the RFI
seeks public comments on whether POCCs can be a means of stimulating
the commercialization of early-stage technologies by bridging the
``valley of death.''
    Background: Federally-funded research has contributed to economic
growth, job creation and improvements in our quality of life. In the
information and communications sector, for example, university-based
research has played a key role in the development of technologies such
as the Internet, electronic design automation, mass storage, speech
recognition, parallel computing, computer graphics, and workstations.
In the life sciences, university research has led to new tools to
diagnose, prevent and treat diseases.
    With respect to POCCs, innovative technologies developed at POCCs
arise primarily from not-for profit research institutions such as
hospitals and foundations as well as from Federal laboratories and the
private sector. The Federal Government funds much of this early-stage
research and also provides funding and incentives to entrepreneurial
businesses to bring new technologies to the marketplace. For example,
the NSF Engineering Research Centers Program provides core funds to
move fundamental research through proof-of-concept testing and
additional incentive funds to speed the translation of research further
into the realm of project development in partnership with start-ups and
other small businesses. State and local governments also provide
resources to promote new business development. Despite these resources,
too many technologies fail to cross the ``valley of death'' of product
development between the research laboratory and commercialization by
the private sector.
    The Administration has already taken a number of steps to promote
and encourage the commercialization of federally funded research:
    The President's FY11 budget proposes to double the
National Science Foundation's Partnership for Innovation program. This
will allow the NSF to provide grants that will increase the engagement
of faculty and students across all disciplines in the innovation and
entrepreneurship process; increase the impact of the most promising
university innovations through commercialization, industry alliances,
and start-up formation, and develop a regional community that supports
the ``innovation ecosystem'' around universities.
    On February 24, 2010, led by Commerce Secretary Gary
Locke, the Administration organized a forum to explore issues related
to commercialization of university research.
    Dr. Francis Collins, Director of the National Institutes
of Health, has indicated that translational medicine is one of his top
five priorities. For example, NIH is making it easier for academic
researchers to move from fundamental research to the creation of assays
that can be used to screen hundreds of thousands of candidates for drug
development.
    Seven agencies are providing almost $130 million to
support an Energy Regional Innovation Cluster in energy efficient
building systems design. In addition to funding research, this will
provide support for business development, public infrastructure,
education, and workforce development.
    The National Economic Council and the Office of Science and
Technology Policy will use the input from this RFI to shape the
Administration's future policy on the commercialization of federally
funded research.
    RFI Guidelines: Responses to this RFI should be submitted by 11:59
p.m. Eastern Time on April 26, 2010. Responses to this RFI must be
delivered electronically as an attachment to an e-mail sent to NEC_
General@who.eop.gov
with the subject line ``Commercialization of
University Research.'' Responses to this notice are not offers and
cannot be accepted by the Government to form a binding contract or
issue a grant. Information obtained as a result of this RFI may be used
by the government for program planning on a non-attribution basis. Do

confidential.
