SUMMARY: On June 12, 2009, the Natural Resources Conservation Service
(NRCS) published in the Federal Register a notice for the purpose of:
(1) Notifying the public about the results of NRCS compliance with
section 1242(h) of the Food Security Act of 1985, as amended; and (2)
to solicit public comment about how to improve agency conservation
practice standards. The public comment period closed on August 11,
2009. NRCS is hereby reopening the public comment period and amending
the closing date September 14, 2009 to ensure the agency has received
comments from a broad segment of the agriculture sector.

Spinetoram; Pesticide Tolerances

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: This regulation amends the tolerances for the combined
residues of spinetoram in or on almond, hulls; nut, tree, group 14; and
pistachio and establishes tolerances for date; pomegranate; pineapple;
pineapple, processed residue; spice, subgroup 19B, except black pepper;
and hop, dried cones. The Interregional Research Project Number 4 (IR-
4) requested these tolerances under the Federal Food, Drug, and
Cosmetic Act (FFDCA).

DATES: This regulation is effective August 13, 2009. Objections and
requests for hearings must be received on or before October 13, 2009,
and must be filed in accordance with the instructions provided in 40
CFR part 178 (see also Unit I.C. of the SUPPLEMENTARY INFORMATION).

Proposed Suspension and Modification of Nationwide Permit 21

ACTION: Notice; extension of comment period.

SUMMARY: In the July 15, 2009, issue of the Federal Register (74 FR
34311) the U.S. Army Corps of Engineers published a proposal to take
two actions concerning Nationwide Permit 21, which authorizes
discharges of dredged or fill material into waters of the United States
for surface coal mining activities. The two proposed actions are to
suspend NWP 21 to prohibit its use to authorize surface coal mining
activities in the Appalachian region of Kentucky, Ohio, Pennsylvania,
Tennessee, Virginia, and West Virginia, and then to modify NWP 21 to
make that prohibition permanent until NWP 21 expires on March 18, 2012.
The July 15, 2009, notice stated that public comments and any requests
for a public hearing must be received by August 14, 2009. We have received several requests to extend the comment period. We are extending the comment period to September 14, 2009.

Sale and Disposal of National Forest System Timber; Downpayment
and Periodic Payments

AGENCY: Forest Service, USDA.

ACTION: Final rule.

SUMMARY: This final rule revises the Forest Service's downpayment and
periodic payment regulations to reflect changes in contracting
procedures and authorities since these regulations were adopted in
1991. The changes remove obsolete references and procedures; make
downpayments and periodic payments optional for stewardship contracts;
allow downpayment and periodic payment amounts to be recalculated when
contracts receive rate redeterminations; revise procedures for
releasing downpayments; and allow downpayments to be temporarily
reduced for certain delays, interruptions, or extensions. This final
rule protects the Government's financial security, reduces speculative
bidding, and encourages purchasers to harvest timber in a timely
manner. In addition, the rule provides financial relief to timber
purchasers when forest product prices drastically decline or purchasers
receive additional contract time and are not expected to operate.

Carbon Black; Exemption from the Requirement of a Tolerance

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: This regulation establishes an exemption from the requirement
of a tolerance for residues of carbon black (CAS Reg. No. 1333-86-4)
under 40 CFR 180.920 when used as an inert ingredient (colorant) in
pesticide formulations applied to seeds used to grow agricultural and
horticultural crops. Becker Underwood, Inc. submitted a petition to EPA
under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting an
exemption from the requirement of a tolerance. This regulation
eliminates the need to establish a maximum permissible level for
residues of carbon black.

Sodium Lauryl Sulfate; Exemption From the Requirement of a
Tolerance

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: This regulation establishes an exemption from the requirement
of a tolerance for residues of sodium lauryl sulfate (CAS Reg. No. 151-
21-3) when used as a component of food contact sanitizing solutions
applied to all food contact surfaces in public eating places, dairy-
processing equipment, and food-processing equipment and utensils at a
maximum level in the end-use concentration of 350 parts per million
(ppm). ETI H2O submitted a petition to EPA under the Federal Food,
Drug, and Cosmetic Act (FFDCA), requesting an exemption from the
requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of sodium lauryl sulfate.

1-Naphthaleneacetic Acid Ethyl Ester; Pesticide Tolerance for
Emergency Exemptions

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: This regulation establishes a time-limited tolerance for
residues of 1-naphthaleneacetic acid ethyl ester in or on avocados.
This action is in response to EPA's granting of an emergency exemption
under section 18 of the Federal Insecticide, Fungicide, and Rodenticide
Act (FIFRA) authorizing use of the pesticide on avocado trees. This
regulation establishes a maximum permissible level for residues of 1-
naphthaleneacetic acid ethyl ester in this food commodity. The time-
limited tolerance expires and is revoked on December 31, 2012.

SUMMARY: This notice provides the names, addresses, professional
affiliations, and selected biographical data of persons nominated to
serve on the Scientific Advisory Panel (SAP) established under section
25(d) of the Federal Insecticide, Fungicide, and Rodenticide Act
(FIFRA). The FIFRA SAP was created on November 28, 1975, and made a
statutory panel by amendment to FIFRA, dated October 25, 1988. The
Agency is, at this time, selecting two new members to serve on the
FIFRA SAP as a result of a membership term that will expire this year
and the sudden and unexpected loss of a FIFRA SAP member. Public
comment on the nominations is invited, as these comments will be used
to assist the Agency in selecting the new chartered FIFRA SAP members.

Bromonitrostyrene; Product Cancellation Order

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: This notice announces EPA's order for the cancellation of
products containing the pesticide bromonitrostyrene, pursuant to
section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide
Act (FIFRA), as amended. This cancellation order follows an August 27,
2008 Federal Register Notice of Receipt of Requests from the
bromonitrostyrene registrants to voluntarily cancel all their
bromonitrostyrene product registrations. These are the last
bromonitrostyrene products registered for sale or distribution in the
United States. In the August 27, 2008 Notice, EPA indicated that it
would issue an order accepting the requests for voluntary cancellation
and implementing the cancellations, unless the Agency received
substantive comments within the 30-day comment period that would merit
its further review of these requests, or unless the registrants
withdrew their requests within this period. The Agency did not receive
any comments on the notice. Further, the registrants did not withdraw
their requests. Accordingly, EPA hereby issues in this notice a
cancellation order accepting the requested cancellations and cancelling
the affected registrations. Any distribution, sale, or use of the
bromonitrostyrene products subject to this cancellation order is
permitted only in accordance with the terms of this order, including
any existing stocks provisions.

DATES: The cancellations are effective August 12, 2009.

Notice of Meeting

    Board meeting: September 23, 2009-National Harbor, MD; the U.S.
Nuclear Waste Technical Review Board will meet to discuss the
implications of fuel-cycle technologies for nuclear waste management
and disposal.
    Pursuant to its authority under section 5051 of Public Law 100-203,
Nuclear Waste Policy Amendments Act of 1987, the U.S. Nuclear Waste
Technical Review Board will meet at National Harbor, Maryland, on
Wednesday, September 23, 2009, to discuss the implications of
alternative technological strategies for the management and disposal of
spent nuclear fuel and high-level radioactive waste. The Board will
receive an update on the Fuel Cycle Study being conducted at the
Massachusetts Institute of Technology, and a panel of industry
representatives will discuss their proposals to the U.S. Department of
Energy (DOE) for recycling, reprocessing, and burning spent nuclear
fuel in fast reactors. The Board also has invited a representative of
the Nuclear Energy Agency to present an overview of efforts in other
countries to manage and dispose of nuclear waste.
    Information presented at the meeting will be used by the Board as
part of its ongoing effort to inform Congress, the Secretary of Energy,
and a blue-ribbon commission of technical issues and questions that
should be addressed related to waste-management alternatives. The
Nuclear Waste Policy Amendments Act of 1987 requires the Board to
conduct an independent review of the technical and scientific validity
of DOE activities related to nuclear waste management, including
transporting, packaging, and disposing of spent nuclear fuel and high-
level radioactive waste.
    The Board meeting will be held at the Gaylord Hotel; 201 Waterfront

    A detailed meeting agenda will be available on the Board's Web
site, http: //www.nwtrb.gov, approximately one week before the meeting.

    The meeting will begin at 8 a.m. on Wednesday morning. Time has
been set aside at the end of the day for public comments. Those wanting
to speak are encouraged to sign the ``Public Comment Register'' at the
check-in table. A time limit may have to be set on individual remarks,
but written comments of any length may be submitted for the record.

SUMMARY: EPA is taking final action to revise a portion of its Phase 2
implementation rule for the 8-hour ozone National Ambient Air Quality
Standard (NAAQS or standard) for which the Agency had sought a
voluntary remand from the U.S. Circuit Court of Appeals for the
District of Columbia Circuit. The Court granted EPA's request by
remanding and vacating that portion of the rule. Specifically, this
rule addresses an interpretation that allowed certain credits toward
reasonable further progress (RFP) for the 8-hour standard from
emissions reductions outside the nonattainment area.

DATES: This rule is effective on October 13, 2009.

Sciences Advisory Committee

    Pursuant to Section 14(a)(2)(A) of the Federal Advisory Committee
Act, 5 U.S.C. App., and in accordance with Title 41 of the Code of
Federal Regulations, Section 102-3.65, and following consultation with
the Committee Management Secretariat, General Services Administration,
notice is hereby given that the Fusion Energy Sciences Advisory
Committee has been renewed for a two-year period.
    The Committee will provide advice to the Office of Science (DOE),
on long-range plans, priorities, and strategies for advancing plasma
science, fusion science and fusion technology--the knowledge base
needed for an economically and environmentally attractive fusion energy
source. The Secretary of Energy has determined that the renewal of the
Fusion Energy Sciences Advisory Committee is essential to the conduct
of the Department's business and in the public interest in connection
with the performance of duties imposed upon the Department of Energy by
law. The Committee will continue to operate in accordance with the
provisions of the Federal Advisory Committee Act, the Department of
Energy Organization Act (Pub. L. 95-91), the General Services
Administration Final Rule on Federal Advisory Committee Management, and
other directives and instruction issued in the implementation of those
Acts.
