SUMMARY: The U.S. Environmental Protection Agency (EPA) is announcing
the availability of the second external review draft of a document
titled, ``Second External Review Draft Integrated Science Assessment
for Particulate Matter'' (EPA/600/R-08/139B and EPA/600/R-08/139BA).
The document was prepared by the National Center for Environmental
Assessment (NCEA) within EPA's Office of Research and Development as
part of the review of the national ambient air quality standards
(NAAQS) for particulate matter.
    EPA is releasing this draft document to seek review by the Clean
Air Scientific Advisory Committee (CASAC) and the public (meeting date
and location to be specified in a separate Federal Register notice).
The draft document does not represent and should not be construed to
represent any final EPA policy, viewpoint, or determination. EPA will
consider any public comments submitted in response to this notice when
revising the document.

DATES: The public comment period begins on or about July 31, 2009.

SUMMARY: EPA is announcing a 45-day public comment period for the draft
document titled, ``Nanomaterial Case Studies: Nanoscale Titanium
Dioxide in Water Treatment and Topical Sunscreen'' (EPA/600/R-09/057).
The document was prepared by the National Center for Environmental
Assessment within EPA's Office of Research and Development. The case
studies focus on two different applications of nanoscale titanium
dioxide, water treatment and topical sunscreen. The document is
intended to serve as a foundation for creating a long-term research
strategy to provide the information needed for comprehensive
environmental assessments of selected nanomaterials. It does not
attempt to draw conclusions regarding potential environmental risks
of nanoscale titanium dioxide, but only to identify what is known and
what needs to be known to support future assessment efforts.
    EPA is releasing this draft document solely for the purpose of pre-
dissemination peer review under applicable information quality
guidelines. This document has not been formally disseminated by EPA. It
does not represent and should not be construed to represent any Agency
policy or determination. When finalizing the draft document, EPA
intends to consider any public comments that EPA receives in accordance
with this notice.

Revisions to Environmental Review for Renewal of Nuclear Power
Plant Operating Licenses

AGENCY: Nuclear Regulatory Commission.

SUMMARY: The Nuclear Regulatory Commission (NRC) is proposing to amend
its environmental protection regulations by updating the Commission's
1996 findings on the environmental impacts related to the renewal of a
nuclear power plant's operating license. The Commission stated that it
intends to review the assessment of impacts and update it on a 10-year
cycle, if necessary. The proposed rule redefines the number and scope
of the environmental impact issues which must be addressed by the
Commission in conjunction with the review of applications for license
renewal. As part of this 10-year update, the NRC revised the 1996
Generic Environmental Impact Statement (GEIS) for License Renewal of
Nuclear Plants. Concurrent with the amendments described in this
proposed rule, the NRC is publishing for comment the revised GEIS, a
revised Regulatory Guide 4.2, Supplement 1, Preparation of
Environmental Reports for Nuclear Power Plant License Renewal
Applications, and a revised Environmental Standard Review Plan,
Standard Review Plans for Environmental Reviews for Nuclear Power
Plants, Supplement 1: Operating License Renewal.

DATES: Comments on this proposed rule, its information collection
aspects and its draft regulatory analysis should be submitted by
October 14, 2009. Comments on the revised GEIS (NUREG-1437, Revision
1); Regulatory Guide (RG) 4.2, Supplement 1, Revision 1; and

Voluntary Labeling Program for Biobased Products

AGENCY: Departmental Administration, USDA.

ACTION: Notice of proposed rulemaking.

SUMMARY: The U.S. Department of Agriculture (USDA) is proposing to
establish a voluntary labeling program for biobased products under
section 9002 of the Farm Security and Rural Investment Act of 2002, as
amended by the Food, Conservation, and Energy Act of 2008. Under the
proposed labeling program, a biobased product, after being certified by
USDA, could be marketed using the ``USDA Certified Biobased Product''
label. The presence of the label will mean that the product meets USDA
standards for the amount of biobased content and that the manufacturer
or vendor has provided relevant information on the product for the USDA
BioPreferred Web site. The proposed rule applies to manufacturers and
vendors who wish to participate in the voluntary labeling program. The
proposed rule also applies to other entities (e.g., trade associations)
that wish to use the label to promote biobased products.

Recovery Act (RCRA) of 1976, as amended. EPA has issued regulations (40
CFR part 2, subpart B) that outline business confidentiality provisions
for the Agency and require all EPA Offices that receive information
designated by the submitter as CBI to abide by these provisions.

SUMMARY: Under the Federal Advisory Committee Act, Public Law 92-463,
EPA gives notice of a meeting of the NACEPT Subcommittee on Promoting
Environmental Stewardship.
    The purpose of the proposed Subcommittee on Promoting Environmental
Stewardship (SPES) of the National Advisory Council for Environmental
Policy and Technology (NACEPT) will be to advise the U.S. Environmental
Protection Agency (EPA) on how to promote environmental stewardship
practices that encompass all environmental aspects of an organization
in the regulated community and other sectors, as appropriate, in order
to enhance human health and environmental protection. A copy of the
meeting agenda will be posted at http://epa.gov/ncei/dialogue.htm. This
Web site also includes the draft charge of the SPES, which provides
further information about the purpose of the Subcommittee.

DATES: The NACEPT Subcommittee on Promoting Environmental Stewardship
will hold an open meeting on August 18, 2009 (9 a.m.-5 p.m.) and August
19, 2009 (9 a.m.-5 p.m.) Eastern.

Triclosan; Product Cancellation Order

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice.

SUMMARY: This notice announces EPA's order for the cancellations,
voluntarily requested by the registrant and accepted by the Agency, of
products containing the pesticide triclosan pursuant to section 6(f)(1)
of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as
amended. This cancellation order follows a April 22,2009 Federal
Register Notice of Receipt of Requests from the triclosan registrant to
voluntarily cancel all their triclosan technical grade product
registrations. These are not the last triclosan products registered for
use in the United States. In the April 22, 2009 notice, EPA indicated
that it would issue an order implementing the cancellations to
terminate uses, unless the Agency received substantive comments within
the 30-day comment period that would
merit its further review of these requests, or unless the registrant
withdrew their requests within this period. The Agency did not receive
any comments on the notice. Further, the registrant did not withdraw
their requests. Accordingly, EPA hereby issues in this notice a
cancellation order granting the requested cancellations. Any
distribution, sale, or use of the triclosan products subject to this
cancellation order is permitted only in accordance with the terms of
this order, including any existing stocks provisions.

DATES: The cancellations are effective July 30, 2009.

representation of individuals with multi-disciplinary expertise in the

SUMMARY: The United States is a Party to the United Nations Framework
Convention on Climate Change (UNFCCC). The Convention sets forth
requirements for UNFCCC Parties to provide a national communication
that lists the steps they are taking to implement the Convention. In
particular, Parties are to provide: An inventory of anthropogenic
emissions by sources and removal by sinks of all greenhouse gases not
controlled by the Montreal Protocol; a detailed description of the
policies and measures adopted to implement their commitments under the
Convention; and estimates of the effects those policies and measures
will have on emissions and sinks. Subsequent guidelines further
elaborate the information that Parties are to submit periodically. The
United States submitted the first U.S. Climate Action Report (USCAR) to
the UNFCCC Secretariat in 1994, the second in 1997, the third in 2002,
and the fourth in 2007. The U.S. Government is currently preparing its
fifth national communication, which is due to the UNFCCC secretariat on
January 1, 2010. The purpose of this announcement is to notify
interested members of the public of this process and to solicit
contributions and input on the issues covered in the national
communication for the purpose of preparing the report. The State
Department intends to make available for public review a draft national
communication in fall of 2009.

(30) days from the date of publication of this notice.

(SO2)

SUMMARY: On or about July 31, 2009, the Office of Air Quality Planning
and Standards (OAQPS) of EPA is making available a final report, Risk
and Exposure Assessment to Support the Review of the SO2
Primary National Ambient Air Quality Standard: Final Report. This
document presents the approaches taken to assess exposures to ambient
SO2 and to characterize associated health risks, and
presents the results of those assessments. This document also contains
a staff policy assessment regarding the adequacy of the current
SO2 NAAQS and potential alternative primary SO2
standards.

SUMMARY: Section 2301 of the Food, Conservation, and Energy Act of 2008
(the 2008 Act) amended the Food Security Act of 1985 to establish the
Conservation Stewardship Program. The purpose of the Conservation
Stewardship Program is to encourage producers to address resource
concerns in a comprehensive manner by undertaking additional
conservation activities, and improving, maintaining and managing
existing conservation activities. This interim final rule, with request
for comment, sets forth the policies, procedures, and requirements
necessary to implement the Conservation Stewardship Program as
authorized by the 2008 Act amendments.

DATES: Effective Date: This interim final rule is effective July 29,
2009.

Acquisition Regulation: Guidance on Technical Direction

AGENCY: Environmental Protection Agency (EPA).

SUMMARY: EPA is amending the EPA Acquisition Regulation (EPAAR) to
revise the prescription for and the content of a clause that addresses
issuing technical direction in contracts. This revision incorporates
and supersedes several class deviations to the EPAAR and updates
terminology and procedures related to issuing technical direction.

DATES: This final rule is effective August 12, 2009.

Identification of Priority Classes of Facilities for Development
of CERCLA Section 108(b) Financial Responsibility Requirements

ACTION: Priority notice of action.

SUMMARY: Section 108(b) of the Comprehensive Environmental Response,
Compensation, and Liability Act (CERCLA) of 1980, as amended,
establishes certain regulatory authorities concerning financial
responsibility requirements. Specifically, the statutory language
addresses the promulgation of regulations that require classes of
facilities to establish and maintain evidence of financial
responsibility consistent with the degree and duration of risk
associated with the production, transportation, treatment, storage, or
disposal of hazardous substances. CERCLA Section 108(b) also requires
EPA to publish a notice of the classes for which financial
responsibility requirements will be first developed. To fulfill this
requirement, EPA is by this notice identifying classes of facilities
within the hardrock mining industry for which the Agency will first
develop financial responsibility requirements under CERCLA Section
108(b). For purposes of this notice, hardrock mining facilities include
those which extract, beneficiate or process metals (e.g., copper, gold,
iron, lead, magnesium, molybdenum, silver, uranium, and zinc) and non-
metallic, non-fuel minerals (e.g., asbestos, gypsum, phosphate rock,
and sulfur).

SUMMARY: EPA is updating the Toxics Substances Control Act (TSCA)
Chemical Substance Inventory (TSCA Inventory) Master File to list 530
chemical substances as non-confidential on the TSCA Inventory that were
previously listed as confidential. This action is necessary because
these chemical substances no longer qualify for listing as confidential
on the TSCA Inventory.

DATES: This update is effective July 22, 2009.
    These chemical substances will be listed on public versions of the
TSCA Inventory on or after August 3, 2009.
