Protection of Stratospheric Ozone: The 2009 Critical Use
Exemption From the Phaseout of Methyl Bromide

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: This final rule authorizes uses of methyl bromide that qualify
for the 2009 critical use exemption and the amount of methyl bromide
that may be produced, imported, or supplied from existing pre-phaseout
inventory for those uses in 2009. EPA is taking action under the
authority of the Clean Air Act to reflect a consensus decision taken at
the Nineteenth Meeting of by the Parties to the Montreal Protocol on
Substances that Deplete the Ozone Layer.

DATES: This rule is effective on April 30, 2009.

SUMMARY: EPA published a notice on April 10, 2009 regarding plans to
make available approximately $40 million in Recovery Act funding to
supplement Revolving Loan Fund capitalization grants previously awarded
competitively under section 104(k)(3) of the Comprehensive
Environmental Response, Compensation and Liability Act (CERCLA). The
purpose of this notice is to notify eligible RLF grantees that
Supplemental Funding for Brownfields RLF grantees provided under the
April 10, 2009 notice will be subject to the Buy American provisions
for activities defined as infrastructure by the Agency.

77101, Israel, represented by SciReg, Inc., 12733 Director's Loop,
Woodbridge, VA 22192, USA. This EUP allows the use of 85.84 pounds (39.
02 kilograms) of the end-use product BAFI SDN (100%), containing the
active ingredient Bacillus firmus isolate I-1582 for treating seeds to
be planted on 7,478.25 acres of corn, cotton, and soybean to evaluate
the control of nematodes. The program is authorized only in the States
of Illinois, Indiana, Iowa, Michigan, Mississippi, Missouri, and North
Carolina for seed treatments and in Alabama, Arkansas, Colorado,
Georgia, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana,
Michigan, Minnesota, Mississippi, Missouri, Nebraska, North Carolina,
North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee,
Texas, and Wisconsin for planting treated seeds. Untreated seeds are to
be planted as controls on approximately 1,496 acres concurrently with
the planting of treated seeds in the specified states. The EUP is
effective from April 8, 2009 to April 8, 2011.

SUMMARY: Pursuant to section 10(a) of the Federal Advisory Committee
Act, as amended (5 U.S.C. Appendix 2), notice is hereby given of a
meeting of SACATM on June 25-26, 2009, at the Hilton Arlington Hotel,
950 North Stafford Street, Arlington, VA 22203. The meeting is open to
the public with attendance limited only by the space available. SACATM
advises the Interagency Coordinating Committee on the Validation of
Alternative Methods (ICCVAM), the NTP Interagency Center for the
Evaluation of Alternative Toxicological Methods (NICEATM), and the
Director of the NIEHS and NTP regarding statutorily mandated duties of
ICCVAM and activities of NICEATM.

DATES: The SACATM meeting will be held on June 25 and 26, 2009. The
meeting is scheduled from 8:30 a.m. to 5 p.m. on June 25 and 8:30 a.m.

Renewable Energy and Alternate Uses of Existing Facilities on the
Outer Continental Shelf

AGENCY: Minerals Management Service (MMS), Interior.

ACTION: Final rule; Notice of Availability of the Final Environmental
Assessment.

SUMMARY: The MMS is publishing final regulations to establish a program
to grant leases, easements, and rights-of-way (ROW) for renewable
energy project activities on the Outer Continental Shelf (OCS), as well
as certain previously unauthorized activities that involve the
alternate use of existing facilities located on the OCS; and to
establish the methods for sharing revenues generated by this program
with nearby coastal States. These regulations will also ensure the
orderly, safe, and environmentally responsible development of renewable
energy sources on the OCS.
    The MMS prepared a Final Environmental Assessment (EA) analyzing
this rule. The EA incorporates by reference the Programmatic
Environmental Impact Statement Programmatic Environmental Impact
Statement for Alternative Energy Development and Production and
Alternate Use of Facilities on the Outer Continental Shelf, Final
Environmental Impact Statement, October 2007. The EA was prepared to
assess any impacts of this rule. The Final EA is available on the MMS

DATES: Effective Date: This final rule is effective on June 29, 2009.

SUMMARY: The United States Department of Agriculture's (USDA) Rural
Utilities Service (RUS) announces the availability of $993,000 in grant
funds for the Household Water Well System (HWWS) Grant Program for
fiscal year (FY) 2009, to be competitively awarded. A notice of funding
availability and solicitation of applications was published in the
November 20, 2008 Federal Register, 73 FR 70315, prior to passage of a
final appropriations bill identifying a definite funding amount. For
information and other requirements on how to apply for HWWS Grant
Program funds, please refer to the November 20, 2008 issue of the

    The HWWS Grant Program is authorized under Section 306E of the
Consolidated Farm and Rural Development Act (CONACT), 7 U.S.C. 1926e.
The CONACT authorizes USDA Rural Development to make grants to
qualified private nonprofit organizations to establish lending programs
for household water wells. The non-profit organizations will use the
grants to make loans to individual homeowners to construct or upgrade a
household water well system for an existing home. The organizations
must contribute an amount equal to at least 10 percent of the grant
request to capitalize the loan fund. Applications may be submitted in
paper or electronic format. The HWWS Grant Program regulations are
contained in 7 CFR part 1776.

DATES: The deadline for completed applications for a HWWS grant is May
31, 2009. Applications in either paper or electronic format must be
postmarked or time-stamped electronically on or before the deadline.
Late applications will be ineligible for grant consideration.

New Source Performance Standards Review for Nonmetallic Mineral

SUMMARY: EPA is finalizing amendments to the Standards of Performance
for Nonmetallic Mineral Processing Plant(s) (NMPP). These final
amendments include revisions to the emission limits for NMPP affected
facilities which commence construction, modification, or reconstruction
on or after April 22, 2008. These final amendments for NMPP also
include: Additional testing and monitoring requirements for affected
facilities that commence construction, modification, or reconstruction
on or after April 22, 2008; exemption of affected facilities that
process wet material from this final rule; changes to simplify the
notification requirements for all affected facilities; and changes to
definitions and various clarifications. We are not taking any final
action in this document regarding the amendment to the Standards of
Performance for Calciners and Dryers in Mineral Industries discussed in
the proposed rule.

Proposed Endangerment and Cause or Contribute Findings for
Greenhouse Gases Under Section 202(a) of the Clean Air Act

AGENCY: Environmental Protection Agency (EPA).

ACTION: Proposed rule.

SUMMARY: Today the Administrator is proposing to find that greenhouse
gases in the atmosphere endanger the public health and welfare of
current and future generations. Concentrations of greenhouse gases are
at unprecedented levels compared to the recent and distant past. These
high atmospheric levels are the unambiguous result of human emissions,
and are very likely the cause of the observed increase in average
temperatures and other climatic changes. The effects of climate change
observed to date and projected to occur in the future--including but
not limited to the increased likelihood of more frequent and intense
heat waves, more wildfires, degraded air quality, more heavy downpours
and flooding, increased drought, greater sea level rise, more intense
storms, harm to water resources, harm to agriculture, and harm to
wildlife and ecosystems--are effects on public health and welfare
within the meaning of the Clean Air Act. In light of the likelihood
that greenhouse gases cause these effects, and the magnitude of the
effects that are occurring and are very likely to occur in the future,
the Administrator proposes to find that atmospheric concentrations of
greenhouse gases endanger public health and welfare within the meaning
of Section 202(a) of the Clean Air Act. She proposes to make this
finding specifically with respect to six greenhouse gases that together
constitute the root of the climate change problem: carbon dioxide,
methane, nitrous oxide, hydrofluorocarbons, perfluorocarbons, and
sulfur hexafluoride.
    The Administrator is also proposing to find that the combined
emissions of carbon dioxide, methane, nitrous oxide, and
hydrofluorocarbons from new motor vehicles and new motor vehicle
engines are contributing to this mix of greenhouse gases in the
atmosphere. Thus, she proposes to find that the emissions of these
substances from new motor vehicles and new motor vehicle engines are
contributing to air pollution which is endangering public health and
welfare under section 202(a) of the Clean Air Act.

SUMMARY: The Postal Accountability and Enhancement Act requires the
Postal Service to prescribe regulations for the safe transportation of
hazardous materials in the mail, and to prescribe regulations for the

up costs and damages for violations of these hazardous materials
regulations. Accordingly, the Postal Service is adopting new rules of
practice for its Office of the Judicial Officer.

SUMMARY: On or about March 19, 2009, the Office of Air Quality Planning and Standards (OAQPS) of EPA is making available for public review and comment a draft document titled ``Risk and Exposure Assessment to Support the Review of the SO2 Primary National Ambient Air
Quality Standards: Second Draft.'' The purpose of this draft document
is to convey the approach taken to assess exposures to ambient
SO2 and to characterize associated health risks, as well as
to present the results of those assessments.

Approval and Promulgation of Implementation Plans and Designation
of Areas for Air Quality Planning Purposes; Michigan; Redesignation of
the Detroit-Ann Arbor Area to Attainment for Ozone

AGENCY: Environmental Protection Agency (EPA).

ACTION: Proposed rule.

SUMMARY: EPA is proposing to make a determination under the Clean Air
Act (CAA) that the Detroit-Ann Arbor nonattainment area has attained
the 8-hour ozone National Ambient Air Quality Standard (NAAQS). The
Detroit-Ann Arbor area includes Lenawee, Livingston, Macomb, Monroe,
Oakland, St. Clair, Washtenaw, and Wayne Counties. This determination
is based on quality-assured ambient air quality monitoring data for the
2006-2008 ozone seasons that demonstrate that the 8-hour ozone NAAQS
has been attained in the area.
    EPA is proposing to approve a request from the State of Michigan to
redesignate the Detroit-Ann Arbor area to attainment of the 8-hour
ozone NAAQS. The Michigan Department of Environmental Quality (MDEQ)
submitted this request on March 6, 2009. In proposing to approve this
request EPA is also proposing to approve, as a revision to the Michigan
State Implementation Plan (SIP), the State's plan for maintaining the
8-hour ozone NAAQS through 2020 in the area. EPA is proposing to
approve the 2005 base year emissions inventory for the Detroit-Ann
Arbor area as meeting the requirements of section 182(a)(1) of the CAA.
EPA also finds adequate and is proposing to approve the State's 2020
Motor Vehicle Emission Budgets (MVEBs) for the Detroit-Ann Arbor area.
