Diflubenzuron; Pesticide Tolerances for Emergency Exemptions

AGENCY: Environmental Protection Agency (EPA).

ACTION: Final rule.

SUMMARY: This regulation establishes time-limited tolerances for
combined residues of diflubenzuron and its metabolites p-
chlorophenylurea and p-chloroaniline in or on alfalfa, forage and
alfalfa, hay. This action is in response to EPA's granting of an
emergency exemption under section 18 of the Federal Insecticide,
Fungicide, and Rodenticide Act (FIFRA) authorizing use of the pesticide
on alfalfa and mixed grass/alfalfa fields. This regulation establishes
a maximum permissible level for residues of diflubenzuron and its
metabolites p-chlorophenylurea and p-chloroaniline, in these food
commodities. The time-limited tolerances expire and are revoked on
December 31, 2011.

DATES: This regulation is effective November 28, 2008. Objections and
requests for hearings must be received on or before January 27, 2009,
and must be filed in accordance with the instructions provided in 40
CFR part 178 (see also Unit I.C. of the SUPPLEMENTARY INFORMATION.

Effluent Limitations Guidelines and Standards for the
Construction and Development Point Source Category

AGENCY: Environmental Protection Agency (EPA).

ACTION: Proposed rule.

SUMMARY: The Environmental Protection Agency is proposing a regulation
that would strengthen the existing regulatory program for discharges
from construction sites by establishing technology-based Effluent
Limitations Guidelines and New Source Performance Standards for the
Construction and Development (C&D) point source category. This
proposal, if implemented, would significantly reduce the amount of
sediment and other pollutants discharged from construction sites. EPA
estimates that this proposed rule would cost $1.9 billion dollars per
year with annual monetized benefits of $332.9 million. This proposed
rule requests comment and information on the proposed regulation and an
alternate option with a different numeric limit based on different
technologies, as well as specific aspects of the proposal such as
technologies, costs, loading reductions, and economic achievability.

Protection of Stratospheric Ozone: The 2009 Critical Use
Exemption From the Phaseout of Methyl Bromide

AGENCY: Environmental Protection Agency (EPA).

ACTION: Proposed rule.

SUMMARY: EPA is proposing an exemption to the phaseout of methyl
bromide to meet the needs of 2009 critical uses. Specifically, EPA is
proposing uses that qualify for the 2009 critical use exemption and the
amount of methyl bromide that may be produced, imported, or supplied
from existing pre-phaseout inventory for those uses in 2009. EPA is
taking action under the authority of the Clean Air Act to reflect a
recent consensus decision taken by the Parties to the Montreal Protocol
on Substances that Deplete the Ozone Layer at the Nineteenth Meeting of
the Parties. EPA is seeking comment on the list of critical uses and on
EPA's determination of the amounts of methyl bromide needed to satisfy
those uses.

AGENCY: Bureau of Land Management, Interior.

ACTION: Notice of availability.

SUMMARY: The Bureau of Land Management (BLM) and the Department of
Energy (DOE) as co-lead agencies, and the U.S. Forest Service (FS) of
the Department of Agriculture (USDA), the Department of Defense (DOD),
and the U.S. Fish and Wildlife Service (USFWS) of the Department of the
Interior (DOI) as cooperating Federal Agencies (the Agencies) announce
the availability of the Final Programmatic Environmental Impact
Statement for the Designation of Energy Corridors on Federal Land in
the 11 Western States (Final PEIS) (DOE/EIS-0386) that also proposes to
amend 138 land use plans.
    The Coeur d'Alene Tribe, the California Energy Commission (CEC),
the California Public Utilities Commission (CPUC), the State of
Wyoming, and the Lincoln, Sweetwater, and Uinta counties and
conservation districts in Wyoming are also cooperating agencies. The
Department of Commerce (DOC) and the Federal Energy Regulatory
Commission (FERC) are consulting agencies.
    The Agencies prepared the Final PEIS pursuant to the National
Environmental Policy Act of 1969 (NEPA), as amended, 42 U.S.C. 4321 et
seq.; the Council on Environmental Quality NEPA regulations, 40 CFR
Parts 1500-1508; the DOE NEPA regulations, 10 CFR Part 1021; Compliance
with Floodplain and Wetland Environmental Review Requirements, 10 CFR
Part 1022; the BLM planning regulations, 43 CFR subpart 1610; and
applicable FS planning regulations.
    Section 368 of the Energy Policy Act of 2005 (EPAct 2005), Public
Law 109-58, directs the Secretaries of Agriculture, Commerce, Defense,
Energy, and the Interior, in consultation with FERC, states, tribal or
local units of governments, as appropriate; affected utility
industries; and other interested persons to designate, under their
respective authorities, corridors on Federal land in the 11 Western
States for oil, gas, and hydrogen pipelines as well as electricity
transmission and distribution facilities; perform any environmental
reviews that may be required to complete the designation of such
corridors; and incorporate the designated corridors into relevant
agency land use and resource management plans or equivalent plans.
    The 11 Western States are Arizona, California, Colorado, Idaho,
Montana, Nevada, New Mexico, Oregon, Utah, Washington, and Wyoming.

DATES: Copies of the Final PEIS were distributed beginning November 20,
2008 to Members of Congress, American Indian Tribal governments, state
and local governments, other Federal agencies, and organizations and
individuals who are known to have an interest in the Final PEIS.
    The DOI, USDA and DOD would issue separate Records of Decision
(ROD) to amend selected land use plans for the purpose of designating
EPAct 2005 Section 368 corridors no sooner than 30 days after the
Environmental Protection Agency publishes the Notice of Availability of
the Final PEIS. BLM's ROD must also await a 60-day Governors'
Consistency Review in accordance with 43 CFR 1610.3-2.

SUMMARY: On October 9, 2008, the Nuclear Regulatory Commission (NRC)
published for public comment a proposal to amend its generic
determination of no significant environmental impact for the temporary
storage of spent fuel after cessation of reactor operation codified at
10 CFR 51.23(a) (73 FR 59547) and a related update and proposed
revision of its 1990 Waste Confidence Decision (73 FR 59551). The
comment period for this proposed rule and for the proposed revisions of
its Waste Confidence Decision was to have expired on December 8, 2008.
A number of requests for extension of the comment period have been
received. The NRC has decided to extend the comment period for an
additional 60 days.

DATES: The comment period has been extended and now expires on February
6, 2009. Comments received after this date will be considered if it is
practical to do so, but the Commission is able to ensure consideration
only for comments received before this date.

ACTION: Final rule; Response to court order vacating regulatory
definition of navigable waters.

SUMMARY: The Environmental Protection Agency (EPA) is promulgating a
final rule to amend a Clean Water Act (CWA) section 311 regulation that
defines the term ``navigable waters.'' On July 17, 2002, EPA
promulgated a final rule which included revisions to the definition of
``navigable waters'' in the Spill Prevention, Countermeasure and
Control (SPCC) regulation. In this action, EPA is announcing the
vacatur of the July 17, 2002 revisions to the definition of ``navigable
waters'' in accordance with an order, issued by the United States
District Court for the District of Columbia (D.D.C.) in American
Petroleum Institute v. Johnson, 571 F.Supp.2d 165 (D.D.C. 2008),
invalidating those revisions. The court decision also restored the
regulatory definition of ``navigable waters'' promulgated by EPA in
1973; consequently, we are amending the definition of ``navigable
waters'' in part 112 to comply with that decision.

DATES: This rule is effective November 26, 2008.

Modification of Pesticide Tolerance Revocation for Diazinon

SUMMARY: This final rule amends the pesticide tolerance regulation for
diazinon by modifying the revocation of the tolerance for mushrooms.
Pesticide tolerances are established under the Federal Food, Drug, and
Cosmetic Act (FFDCA). This final rule resolves an objection filed by
the American Mushroom Institute in response to a final rule on diazinon
tolerances published on September 10, 2008, by granting the objection
and modifying the revocation of the diazinon tolerance on mushrooms to
expire on September 10, 2010.

SUMMARY: The Environmental Protection Agency (EPA) is proposing to
amend the dates by which facilities must prepare or amend Spill
Prevention, Control, and Countermeasure (SPCC) Plans, and implement
those Plans. The Agency is also proposing to establish dates for farms
to prepare or amend their Spill Prevention, Control, and Countermeasure
Plans (SPCC Plans), and implement those Plans. EPA had delayed
establishing compliance dates for farms pending revisions to the SPCC
rule that would specifically address this sector. Two different
extension dates are proposed for farms and production facilities that
meet the qualified facilities criteria. Elsewhere in this Federal
Register, the Agency is finalizing certain tailored and streamlined
requirements for facilities subject to the SPCC requirements.

SUMMARY: This Notice, pursuant to section 6(f)(2) of the Federal
Insecticide, Fungicide, and Rodenticide Act (FIFRA), 7 U.S.C. 136 et
seq., announces that EPA has issued a Notice of Intent to Suspend
pursuant to sections 3(c)(2)(B) and 4 of FIFRA. The Notice was issued
following issuance of a Section 4 Reregistration Data Requirements
Notice by the Agency and the failure of the registrant subject to the
Section 4 Reregistration Data Requirements Notice to take appropriate
steps to secure the data required to be submitted to the Agency. This
Notice includes the text of a Notice of Intent to Suspend, absent
specific chemical, product, or factual information. Table 1 of this
Notice further identifies the registrant to whom the Notice of Intent
to Suspend was issued, the date the Notice of Intent to Suspend was
issued, the active ingredient(s) involved, and the EPA registration
numbers and names of the registered product(s) which are affected by
the Notice of Intent to Suspend. Moreover, Table 2 of this Notice
identifies the basis upon which the Notice of Intent to Suspend was
issued. Finally, matters pertaining to the timing of requests for
hearing are specified in the Notice of Intent to Suspend and are
governed by the deadlines specified in section 3(c)(2)(B). As required
by section 6(f)(2), the Notice of Intent to Suspend was sent by
certified mail, return receipt requested, to the affected registrant at
its address of record. The Notice of Intent to Suspend described in
this Notice was received by the registrant and the products have been
suspended by operation of law. The Notice of Intent to Suspend has
become an effective suspension order.

Hazardous Materials: Enhancing Rail Transportation Safety and
Security for Hazardous Materials Shipments

AGENCY: Pipeline and Hazardous Materials Safety Administration (PHMSA),
Department of Transportation (DOT).

ACTION: Final rule.

SUMMARY: The Pipeline and Hazardous Materials Safety Administration, in
coordination with the Federal Railroad Administration (FRA) and the
Transportation Security Administration (TSA), is improving safety by
revising the current requirements in the Hazardous Materials
Regulations applicable to the safe and secure transportation of
hazardous materials by rail. We are requiring rail carriers to compile
annual data on certain shipments of explosive, toxic by inhalation, and
radioactive materials; use the data to analyze safety and security
risks along rail routes where those materials are transported; assess
alternative routing options; and make routing decisions based on those
assessments. We are also clarifying rail carriers' responsibility to
address in their security plans issues related to en route storage and
delays in transit. In addition, we are adopting a new requirement for
rail carriers to inspect placarded hazardous materials rail cars for
signs of tampering or the presence of suspicious items, including
improvised explosive devices. We adopted these requirements in an
interim final rule published April 16, 2008. This final rule fulfills
requirements in Section 1551 of the Implementing Recommendations of the
9/11 Commission Act of 2007. Also, in today's edition of the Federal
Register, both FRA and TSA are publishing final rules adopting
requirements and procedures that promote rail transportation security.

<bullet> Rules and major policymakings completed or canceled since the
last agenda.

Definitions:

    ``Semiannual regulatory agenda,'' ``E-Agenda,'' and ``online
regulatory agenda,'' all refer to the same comprehensive collection
of information that used to be published in the Federal Register,
but which is now available through an online database but not be
published in the Federal Register.

    ``Regulatory Plan'' refers to the document published in part 2
of the Federal Register that addresses the core of the Agency's
regulatory priorities that will be issued in the coming fiscal
year.

    ``Regulatory Flexibility Agenda'' refers to a document about

SUMMARY: The U.S. Environmental Protection Agency (EPA) is announcing a
45-day public review and request for additional information on
available peer-reviewed literature for 2,3,7,8-tetrachlorodibenzo-p-
dioxin (TCDD) dose-response for use in human health risk assessment. An
initial literature search was conducted by EPA through an Interagency
Agreement with the Department of Energy's Argonne National Laboratory.
Results of this preliminary search are available via the dioxin Web
site http://www.epa.gov/ncea/dioxin. The public is invited to review
the preliminary literature search results and submit any additional
information, specifically peer-reviewed TCDD dose-response studies, to
EPA that are not already identified in the literature search. Please
submit any information in accordance with the instructions provided
below. It is requested that the full publication be provided to EPA if
possible. Results of this literature search will be used by scientists
from EPA and other scientists from outside of EPA in the conduct of a
scientific expert workshop, open to the public, to be held in
Cincinnati, Ohio, on February 18-20, 2009. This workshop will be
announced in a future Federal Register notice.
    This notice provides: (1) A link to the electronic list of recent
literature search results for TCDD dose-response; and (2) instructions
to the public for submitting additional scientific information
pertinent to TCDD dose-response assessment to EPA that is not already
identified in the literature search.

SUMMARY: NICEATM announces availability of the ICCVAM Test Method
Evaluation Report: Validation Status of Five In Vitro Test Methods
Proposed for Assessing Potential Pyrogenicity of Pharmaceuticals and
Other Products (NIH Publication 08-6392). The test method evaluation
report (TMER) describes five in vitro pyrogen test methods that can be
used for detecting Gram-negative endotoxin in human parenteral
pharmaceuticals. The report includes ICCVAM's (a) Recommendations on
uses and limitations for each test method, (b) recommendations for
standardized protocols, (c) recommendations for future studies, and (d)
recommendations for the development of performance standards.
    ICCVAM concludes that none of these test methods can be considered
as a complete replacement for the rabbit pyrogen test (RPT) for all
testing situations for the detection of Gram-negative endotoxin.
However, ICCVAM recommends that they can be considered for use on a
case-by-case basis to detect Gram-negative endotoxin in human
parenteral drugs, subject to product-specific validation to demonstrate
equivalence to the RPT, in accordance with applicable U.S. Food and
Drug Administration regulations. When used in this manner, these
methods can reduce the number of animals needed for pyrogenicity
testing. The report also recommends that these
and other in vitro alternative test methods be considered prior to in
vivo pyrogenicity testing, where determined appropriate for a specific
testing situation.
    NICEATM also announces availability of the final ICCVAM Background
Review Document: Validation Status of Five In Vitro Test Methods
Proposed for Assessing Potential Pyrogenicity of Pharmaceuticals and
Other Products (NIH Publication 08-6391). The final background review
document (BRD) provides the data and analyses used to assess the
current validation status of these five in vitro test methods.
    The ICCVAM TMER and supporting BRDs have been forwarded to U.S.
Federal agencies for regulatory and other acceptance consideration,
where applicable. Responses received will be posted on the NICEATM-
ICCVAM Web site.

    The Commissioners have agreed to hold their seventeenth meeting
from 8:30 a.m. to 4 p.m. on Wednesday, December 10, 2008, at the office

will be open to the public.
