SUMMARY: EPA is withdrawing its draft Pesticide Registration Notice (PR
Notice) entitled ``Label Statements Regarding Third-Party Endorsements
& Cause Marketing.'' The draft PR Notice, issued for public comment in
October 2007, contained a description of the Agency's proposed
framework for evaluating proposed statements and graphic material to
appear on pesticide labeling regarding third-party endorsements or a
relationship between the pesticide registrant and a charity (``cause
marketing claims'') and the kinds of information EPA would expect to
receive in applications to add such claims to pesticide labeling.
Public comments on the draft raised serious issues, leading the Agency
to conclude that considerably more information would likely be needed
to support such claims than was described by the draft PR Notice.
Rather than develop additional guidance, EPA believes it is better to
allocate its resources to other initiatives which should improve
pesticide labeling in ways that enhance users' understanding of and
ability to use products safely and effectively. Thus, the Agency will
continue to evaluate applications proposing to add labeling containing
third-party endorsements or cause marketing claims on a case-by-case
basis to ensure that the applicant has provided sufficient information
to allow EPA to determine whether products containing such claims meet
the standards for registration.

year reviews of the piping plover (Atlantic Coast, Great Lakes, and
Northern Great Plains populations) under the Endangered Species Act of
1973, as amended (Act). We request any new information on these
populations that may have a bearing on their classification as
endangered or threatened. Based on the results of these 5-year reviews,
we will make a finding on whether these populations are properly
classified under the Act.

DATES: To allow us adequate time to conduct these reviews, we must
receive your information no later than December 1, 2008. However, we
will continue to accept new information about any listed species at any
time.

request to renew and consolidate existing approved Information
Collection Requests (ICRs) and to update the burden in those estimates
to include the burden associated with EPA's upcoming Vessels General
Permit (VGP) to the Office of Management and Budget (OMB). Two of these
ICRs (NPDES and Sewage Sludge Monitoring Reports ICR, OMB 2040-0004 and
CSO Control Policy, OMB 2040-0170) are scheduled to expire on September
30, 2008. All of the burden will be consolidated under the NPDES and
Sewage Sludge Monitoring Reports ICR (OMB 2040-0004). Before submitting
the ICR to OMB for review and approval, EPA is soliciting comments on
specific aspects of the proposed information collection as described
below.

SUMMARY: The EPA is announcing extensions of the public comment periods
for the draft documents titled, ``Integrated Science Assessment for
Oxides of Nitrogen and Sulfur--Environmental Criteria; Second External
Review Draft'' (EPA 600/R-08/082), ``Annexes for the Integrated Science
Assessment for Oxides of Nitrogen and Sulfur--Environmental Criteria;
Second External Review Draft'' (EPA 600/R-08/083), and ``Risk and
Exposure Assessment for the Review of the Secondary National Ambient
Air Quality Standards for Oxides of Nitrogen and Oxides of Sulfur''
(EPA-452/P-08-005a).
    These documents were prepared as part of the Agency's review of the
secondary (welfare-based) national ambient air quality standards
(NAAQS) for nitrogen dioxide (NO2.) and sulfur dioxide
(SO2). EPA is releasing these draft documents solely for the
purpose of seeking comment from the public and the Clean Air Scientific
Advisory Committee (CASAC). The documents are being distributed solely
for the purpose of pre-dissemination review under applicable
information quality guidelines. They do not represent and should not be
construed to represent any Agency policy, viewpoint, or determination.
EPA will consider any public comments submitted in accordance with this
notice when revising the document.

DATES: The public comment period began on August 12, 2008 (73 FR
46908), for document EPA/600/R-08/082 and August 26, 2008 for document
EPA 600/R-08/083. This notice announces the extension of the deadline
for public comment from October 1, 2008, to October 10, 2008, for both
of these documents. Comments must be received on or before October 10,
2008.
    The public comment period began on August 29, 2008 (73 FR 50965),
for document EPA-452/P-08-005a. This notice announces the extension of
the deadline for public comment from October 15, 2008, to November 15,
2008. Comments must be received on or before November 15, 2008.

AGENCY: Environmental Protection Agency (EPA).

ACTION: Notice of availability.

SUMMARY: EPA Regions 1, 2, 3, 5, 6, 9, and 10 today are finalizing
EPA's NPDES general permit for stormwater discharges from industrial
activity, also referred to as the Multi-Sector General Permit (MSGP).
The MSGP consists of thirty four (34) separate Regional EPA permits
that may vary from each other based on State or Tribal water quality-
based requirements. This permit replaces the existing permits that
expired on October 30, 2005. As with the earlier permits, this permit
authorizes the discharge of stormwater associated with industrial
activities in accordance with the terms and conditions described
therein. Industrial dischargers have the choice to seek coverage under
an individual permit. An individual permit may be necessary if the
discharger cannot meet the terms and conditions or eligibility
requirements in the permit.

DATES: This permit is effective today, September 29, 2008. This
effective date is necessary to provide dischargers with the immediate
opportunity to comply with Clean Water Act requirements in light of the
expiration of the MSGP 2000 on October 30, 2005. In accordance with 40
CFR Part 23, this permit shall be considered issued for the purpose of
judicial review on October 13, 2008. Under section 509(b) of the Clean
Water Act, judicial review of this general permit can be had by filing
a petition for review in the United States Court of Appeals within 120
days after the permit is considered issued for purposes of judicial
review. Under section 509(b)(2) of the Clean Water Act, the
requirements in this permit may not be challenged later in civil or
criminal proceedings to enforce these requirements. In addition, this
permit may not be challenged in other agency proceedings. Deadlines for
submittal of notices of intent are provided in Part 1.4 of the MSGP.
This permit also provides additional dates for compliance with the
terms of these permits.
    EPA will host a Web cast presentation on Wednesday, November 5 from
12 noon to 2 p.m. (Eastern Standard Time) to explain the new permit
requirements. Registration information will be available on http://www.epa.gov/npdes/
training
two weeks before the Web cast.

Notice of Workshop and Call for Information on Integrated Science
Assessment for Ozone

SUMMARY: The U.S. Environmental Protection Agency (EPA) is announcing
that the Office of Research and Development's National Center for
Environmental Assessment (NCEA) is preparing an Integrated Science
Assessment (ISA) as part of the review of the National Ambient Air
Quality Standards (NAAQS) for ozone (O3). This is intended
to update the scientific assessment presented in the ``Air Quality
Criteria for Ozone and Related Photochemical Oxidants'' (EPA 600/P-05/
004aF-cF), published in February 2006. Interested parties are invited
to assist the EPA in developing and refining the scientific information
base for the review of the O3 NAAQS by submitting research
studies that have been published, accepted for publication, or
presented at a public scientific meeting.
    The EPA is also announcing that a workshop entitled, ``Workshop to
Discuss Policy-Relevant Science to Inform EPA's Integrated Plan for the
Ozone NAAQS,'' is being organized by NCEA and the EPA Office of Air and
Radiation's Office of Air Quality Planning and Standards (OAQPS). The
workshop will be held October 29-30, 2008, in Research Triangle Park,
North Carolina. The workshop will be open to attendance by interested
public observers on a first-come, first-served basis up to the limits
of available space.

DATES: The workshop will be held on October 29 and 30, 2008. The pre-
registration deadline is October 17, 2008. In response to the call for
information, all communications and information should be received by
EPA by November 3, 2008.

SUMMARY: To implement the Convention on International Trade in
Endangered Species of Wild Fauna and Flora (CITES or the Convention),
the Parties to the Convention meet periodically to review what species
in international trade should be regulated and other aspects of the
implementation of CITES. The fifteenth regular meeting of the
Conference of the Parties to CITES (CoP15) is tentatively scheduled to
be held in late January 2010 in Doha, Qatar. Therefore, with this
notice we are soliciting recommendations for amending Appendices I and
II of CITES at CoP15 as well as recommendations for resolutions,
decisions, and agenda items for discussion at CoP15. We invite you to
provide us with information and recommendations on animal and plant
species that should be considered as candidates for U.S. proposals to
amend CITES Appendices I and II. Such amendments may concern the
addition of species to Appendix I or II, the transfer of species from
one Appendix to another, or the removal of species from Appendix II. We
also invite you to provide us with information and recommendations on
possible resolutions, decisions, and agenda items for discussion at the
upcoming meeting. Finally, with this notice we also describe the U.S.
approach to preparations for CoP15.

Dry Cargo Residue Discharges in the Great Lakes

AGENCY: Coast Guard, DHS

ACTION: Interim rule; request for comments.

SUMMARY: The Coast Guard is amending its regulations to allow the
discharge of bulk dry cargo residue (DCR) in limited areas of the Great
Lakes by self-propelled vessels and by any barge that is part of an
integrated tug and barge unit. DCR is the residue of non-toxic and non-
hazardous bulk dry cargo like limestone, iron ore, and coal. These
regulations also add new recordkeeping and reporting requirements and
encourage carriers to adopt voluntary control measures for reducing
discharges. Discharges are now prohibited in certain protected and
sensitive areas where, previously, they were allowed. The Coast Guard
also requests public comments on the need for and feasibility of
additional conditions that might be imposed on discharges in the
future, such as mandatory use of control measures, or further
adjustments to the areas where discharges are allowed or prohibited.

DATES: This interim rule takes effect September 29, 2008. Initial
reports under amended 33 CFR 151.66(c)(4) are due January 15, 2009.

15, 2009.

amendments to the current standards of performance for petroleum
refineries has not changed and remains June 24, 2008.

Continued Operation of Los Alamos National Laboratory, Los Alamos, NM

SUMMARY: The National Nuclear Security Administration (NNSA) of the
U.S. Department of Energy (DOE) is issuing this Record of Decision
(ROD) for the continued operation of the Los Alamos National Laboratory
(LANL) in Los Alamos, New Mexico. This ROD is based on information and
analyses contained in the Final Site-Wide Environmental Impact
Statement for the Continued Operation of Los Alamos National
Laboratory, Los Alamos, New Mexico, DOE/EIS-0380 (Final SWEIS or 2008
SWEIS) issued on May 16, 2008; comments on the SWEIS; and other
factors, including costs, security considerations and the missions of
NNSA.
    In the 2008 SWEIS, NNSA assessed three alternatives for the
continued operation of LANL: (1) No Action, (2) Reduced Operations, and
(3) Expanded Operations. The No Action Alternative analyzed in this
SWEIS consists of NNSA and LANL continuing to implement earlier
decisions based on previous National Environmental Policy Act (NEPA)
reviews, including the 1999 LANL SWEIS (DOE/EIS-0238) and its ROD (64
FR 50797, Sept. 20, 1999). The 2008 SWEIS identified the Expanded
Operations Alternative as NNSA's Preferred Alternative. The SWEIS
includes a classified appendix that assesses the potential
environmental impacts of a representative set of credible terrorist scenarios.
    Because NNSA is continuing to evaluate significant technical and
national security issues that could affect the operation and missions
of LANL, NNSA is making only a few decisions at this time regarding the
continued operation of the laboratory. NNSA will not make any decisions
regarding nuclear weapons production and other actions analyzed in the
Complex Transformation Supplemental Programmatic Environmental Impact
Statement (DOE/EIS-0236-S4) (Complex Transformation SPEIS or SPEIS)
prior to the completion of the SPEIS. However, NNSA must make some
decisions now regarding LANL to support the safe and successful
execution of the laboratory's current missions. It is likely that NNSA
will issue other RODs regarding the continued operation of LANL based
on the 2008 SWEIS, the SPEIS and other NEPA analyses.
    NNSA has decided to continue to implement the No Action Alternative
with the addition of some elements of the Expanded Operations
Alternative. These elements include increases in operation of some
existing facilities and new facility projects needed for ongoing
programs and protection of workers and the environment. For the most
part, NNSA will continue the missions conducted at LANL at current
levels at this time. NNSA will also continue to implement actions
necessary to comply with the March 2005 Compliance Order on Consent
(Consent Order), which requires investigation and remediation of
environmental contamination at LANL. NNSA will not change pit
production at LANL at this time; the 1999 ROD set pit production at
LANL at 20 per year.

SUMMARY: EPA is announcing that Eastern Research Group, Inc. (ERG), an
EPA contractor for external scientific peer review, will convene an
independent panel of experts and organize and conduct an external peer
review workshop to review the external review draft document titled,
``Toxicological Review of Ethylene Glycol Mono Butyl Ether (EGBE): In
Support of Summary Information on the Integrated Risk Information
System (IRIS)'' (EPA/635/R-08/006A). EPA previously announced the 60-
day public comment period (ending June 24, 2008) for the draft document
in the Federal Register on April 25, 2008 (73 FR 22372-22373). EPA will
consider public comments and recommendations from the expert panel
workshop as EPA finalizes the draft document.
    The public comment period and the external peer review workshop are
separate processes that provide opportunities for all interested
parties to comment on the document. EPA intends to forward public
comments submitted in accordance with the Federal Register notice (73
FR 22372-22373) to ERG for consideration by the external peer review
panel prior to the workshop.
    EPA is releasing this draft document solely for the purpose of pre-
dissemination peer review under applicable information quality
guidelines. This document has not been formally disseminated by EPA. It
does not represent and should not be construed to represent any Agency
policy or determination.
    The public may attend this workshop as observers through a
registration process, and time will be set aside for observers to give
brief oral comments at the workshop regarding the draft document under
review. The draft document and EPA's peer review charge are available
via the Internet on NCEA's home page under the Recent Additions and the
Data and Publications menus at http://www.epa.gov/ncea. When finalizing

document corrects the final regulations.
